I would like to personally assure you that this in fact is not true, and that all trucks delivering material to this site are also fully covered with tarps in place. I believe what you have observed during your site visit is in fact a combination of the following; trucks leaving the site carrying small amounts of soft earth within the tire treads, and the winter's toll of city street sanding. While it is not the intent of this site work to cause disruption within the neighborhood, it is difficult during a mild winter to control the moisture-content of the fill being supplied. I have every intention of keeping my oath as a good neighbor, and will, as conditions warrant provide periodic machine sweeping of the soil within the street. Please note that the contractor has been informed about this matter, and that the integrity of this neighborhood is Parmount. We have no record of any permits issued for this site. Furthermore it appears that this fill material is encroaching upon a wetland. It is our opinion that the site as it exists is both illegal and unsafe. I HAVE ISSUED A VERBAL CEASE AND DESIST ORDER ( to Mrs Jermyn today at 9:40 AM. )for the filling of this land until such time that I receive and approve a set of engineering plans for the design of the proposed slope. In addition, I believe that a precipice of this magnitude and slope should have a fence/guardrail at its edge to ensure public safety. At this time the site is very unsafe. I would like the Conservation Commission to investigate the site with regard to wetlands encroachment and would appreciate a letter indicating your findings and orders of condition .
