Pursuant to the authority of M.G.L. c. 131, §40, the Conservation Commission considered your
Request for Determination of Applicability, with its supporting documentation, and made the following
Determination.
Project Description (if applicable):
Thero osed work includes the installation of four
P P new poles (131351, 1352, 1353, 1354) and one
associated anchor at pole 1354 along the northern shoulder of Planters Street, at the road's eastern end.
In-kind replacement of one pole (P3935-04) and the removal of one pole/anchor within the parking lot at
the end of Planters Street are proposed but are exempt under the public utility maintenance exemption
within the MA Wetlands Protection Act.

Protection Act and regulations:
Positive Determination
Note: No work within the jurisdiction of the Wetlands Protection Act may proceed until a final Order of
Conditions (issued following submittal of a Notice of Intent or Abbreviated Notice of Intent) or Order of
Resource Area Delineation (issued following submittal of Simplified Review ANRAD) has been received
from the issuing authority(i.e., Conservation Commission or the Department of Environmental Protection).
❑ 1. The area described on the referenced plan(s)is an area subject to protection under the Act.
Removing, filling, dredging, or altering of the area requires the filing of a Notice of Intent.
❑ 2a. The boundary delineations of the following resource areas described on the referenced plan(s)are
confirmed as accurate. Therefore,the resource area boundaries confirmed in this Determination are
binding as to all decisions rendered pursuant to the Wetlands Protection Act and its regulations regarding

adjacent lots formerly or presently owned by the same owner.
❑ Alternatives limited to the original parcel on which the project is located, the subdivided
parcels, any adjacent parcels, and any other land which can reasonably be obtained within
the municipality.
❑ Alternatives extend to any sites which can reasonably be obtained within the appropriate
region of the state.
Negative Determination
Note: No further action under the Wetlands Protection Act is required by the applicant. However, if the
Department is requested to issue a Superseding Determination of Applicability, work may not proceed
on this project unless the Department fails to act on such request within 35 days of the date the
request is post-marked for certified mail or hand delivered to the Department.Work may then proceed
at the owner's risk only upon notice to the Department and to the Conservation Commission.
Requirements for requests for Superseding Determinations are listed at the end of this document.
❑ 1. The area described in the Request is not an area subject to protection under the Act or the
Buffer Zone.
2.The work described in the Request is within an area subject to protection under the Act, but will
not remove, fill, dredge, or alter that area. Therefore, said work does not require the filing of a
Notice of Intent.
❑ 3. The work described in the Request is within the Buffer Zone, as defined in the regulations, but
will not alter an Area subject to protection under the Act. Therefore, said work does not require
the filing of a Notice of Intent, subject to the following conditions (if any).

D. Appeals
The applicant, owner, any person aggrieved by this Determination,any owner of land abutting the land
upon which the proposed work is to be done, or any ten residents of the city or town in which such land is
located, are hereby notified of their right to request the appropriate Department of Environmental
Protection Regional Office (see Attachment)to issue a Superseding Determination of Applicability. The
request must be made by certified mail or hand delivery to the Department, with the appropriate filing fee
and Fee Transmittal Form (see Request for Departmental Action Fee Transmittal Form) as provided in
310 CMR 10.03(7)within ten business days from the date of issuance of this Determination.A copy of the
request shall at the same time be sent by certified mail or hand delivery to the Conservation Commission
and to the applicant if he/she is not the appellant. The request shall state clearly and concisely the
objections to the Determination which is being appealed. To the extent that the Determination is based on
a municipal ordinance or bylaw and not on the Massachusetts Wetlands Protection Act or regulations, the
Department of Environmental Protection has no appellate jurisdiction.

Wetlands Ordinance. Grid seeks approval for the installation of four utility poles along the northern shoulder
of Planters Street at the road's eastern end (Figure 1). The proposed activity would occur within the 100-
foot buffer zone of vegetated wetlands, salt marsh and within Land Subject to Coastal Storm Flowage.
Grid proposes the installation of four new poles to support an upgrade project taking place at the Rail Yard
' Substation on Fort Avenue in Salem. The additional poles will increase the reliability of this substation and
service in the Salem and Beverly area. They will span a total linear distance of approximately 70 feet. One
of these poles would also have an associated anchor installed parallel to the street. Furthermore, Grid will
' conduct an in-kind replacement of a wooden pole located at the edge of wetlands just northeast of Planters
Street, and remove a pole located at the end of Planters Street. This replacement and removal constitutes
an exempt maintenance activity according to the Wetlands Protection Act and the Salem Wetlands
Ordinance.

' Introduction ENSR
On behalf of National Grid (Grid), this Request for Determination of Applicability (RDA) is filed pursuant to the
Massachusetts Wetlands Protection Act(MGL Ch. 131 s. 40)and the City of Salem Wetlands Ordinance for
the installation of four new wooden electrical poles. The four new poles would be installed at the eastern end
of Planters Street, along the road edge bordering on the utility easement(Figure 1). Installation will take place
within buffer zone to vegetated wetlands and salt marsh and within Land Subject to Coastal Storm Flowage
(LSCSF).
Description of Resource Areas
' ENSR wetland scientists reviewed the project area to document the presence of state and local wetland
resource areas on July 25, 2007. Three wetland resource areas were delineated using methodology
prescribed by the 1987 Army Corps of Engineers Manual and the 1995 MADEP Delineating Bordering
Vegetated Wetlands policy guidebook. Areas exhibiting a dominance of wetland vegetation in conjunction with
hydric soils or other positive indicators of a wetland hydrological regime were marked in the field using
alphanumeric numbered surveyors tape.
' The first wetland, located just east of the end of Planters Street and the parking lot, was designated as salt
marsh. A series of SM-1 to SM-20 was used to demarcate the area. Species found in the wetland were
characteristic of New England salt marsh and included seaside goldenrod (Solidago sempervirens), spike
' grass(Distichlys spicata), black rush (Juncus gerardil), sea lavender(Limonium nashil), several cordgrasses
(Spartina patens, Spartina alterniflora, Spartina pectinata), and some seaside rose(Rosa rugosa). There was
evidence of regular tidal flushing, including a small stream leading to Collins Cove.
A second wetland resource area, to the immediate north of Planters Street, was identified as a palustrine
emergent(PEM)wetland. It was marked with flags A-1 through A-14. This vegetated wetland was
characterized by the presence of hydric soils and wetland hydrology. The dominant vegetation was Spartina
pectinata, an obligate wetland species. There was also broad-leaf cattail (Typha latifolia), Bidens spp., reed
canary grass(Phalaris arundinacea), blue vervain (Verbena hastata), soft rush (Juncus effusus), purple
Ioosestrife(Lythra salicaria), and common reed (Phragmites australis), along with black willow(Salix nigra),
' gray birch (Betula populifolia), and green ash (Fraxinus pennsylvanica) along the edges.
A third wetland area, located to the northeast of Planters Street and adjacent to the salt marsh, was
' demarcated as series B-1 to B-10. This PEM was dominated by Phragmites australis, with some Spartina
pectinata and Betula populifolia. No standing water was observed in this area. Although soils were hydric,
they were not saturated at the time of inspection.
' The proposed installation of new poles would occur in uplands along the shoulder of Planters Street, in the
100-foot wetland buffer zone along the shoulder of Planters Street and in LSCSF. No new poles will be
installed within vegetated wetlands or salt marsh.
' The Federal Emergency Management Agency (FEMA) Flood Insurance Rate Maps (FIRM)for the City of
Salem (Community Panel No. 250102-0001 B, 1985) identifies the 100-year floodplain associated with Beverly
Harbor at the Planters Street site (Figure 2). The site is within two zones. B and A4. According to FEMA,
zone A4 is classified as the 100-year flood zone(elevation 12 ft NGVD 29). Zone B is the 500-year flood
zone.
According to the 2006 Edition (MassGIS version)of the Massachusetts Natural Heritage Atlas, prepared by
the Massachusetts Natural Heritage and Endangered Species Program, the site is not located within an area
of Estimated Habitats of Rare Wildlife or an area of Priority Habitats of Rare Species (Figure 3). There are no

certified vernal pools located on or near the site. ENSR did not observe any evidence of rare or endangered
species during the site investigations.
' Description of Proposed Activities and Resource Area Protection
In support of an upgrade project within Salem's Rail Yard Substation on Fort Avenue, Grid proposes to install
four new poles and one anchor along the northern shoulder of Planters Street at the road's eastern end.
There is currently a distance of approximately 85 feet between the existing pole towards the end of Planters
Street and the off-road pole (P3935-04)to the northeast of the end of the road (Figure 4). The four new poles
will span a total linear distance of approximately 70 feet.
' National Grid is also proposing that the older, off-road pole(P3935-84) be replaced in-kind to increase stability.
This pole replacement will be conducted from the existing gravel access path and haybales will be installed in
a U-formation around the base of the pole. In addition, Grid is proposing the removal of a pole and anchor that
are located in the northeast corner of the parking lot at the end of Planter's Street. The pole will be cut at base
and removed. Disturbed soil around the removed anchor and pole will be stabilized and seeded. This pole
removal is also a maintenance activity, as the pole would no longer be necessary following the proposed
installation of four new poles. These activities constitute exempt activities under the public utility maintenance
' exemption within the MA Wetlands Protection Act and the Salem Wetlands Ordinance. These exempt
maintenance activities are included in this RDA as written notification.
Installation of poles and anchors will occur in the month of October 2007 over a period of two weeks. Poles
' will be installed within three feet of the edge of the road pavement and in-line with existing pole 1350. The
new 40-foot poles(numbers P1351, P1352, P1353, and P1354)will be installed seven feet below grade(33
feet above ground). Soil excavated during pole installation will be temporarily stored adjacent to the pole and
' used for backfill around the new poles. Any excess soil will be removed from the site and disposed of
properly. The temporary impact of pole installation, replacement, and removal is estimated at approximately 4
sq. ft per pole(total temporary impacts of less than 20 sq. ft). Total permanent impacts per pole will be less
than 1 sq. ft(cumulative permanent impacts of less than 5 sq. ft).
The new poles and the overhead conductor wires will be installed by truck-mounted equipment located along
Planters Street. Installation of conductor wire will not result in wetland or buffer-zone impacts, as no ground
' disturbance is involved.
Hay bales will be installed in a LI-formation around the base of the pole sites to prevent downgradient soil
' migration in the event of sudden rainfall. The bales will be installed prior to installation, and will remain in situ
until the ground has been stabilized. To restore the surface soils to pre-construction grade, a native grass
seed mix will be broadcast over the disturbed soil.
New pole installations will occur in an upland area that is within the 100-foot buffer zone of vegetated wetlands
and LSCSF. There will be no new poles installed, and no net fill placed, in vegetated wetlands or salt
marsh.
