The design and materials of construction shall comply with the requirements of Section 426.3 for character, quality, and minimum dimensions. SECTION 428.0 SWIMMING POOLS 428.1 General: Pools used for swimming or bathing shall be in conform- ity with the requirements of this section, provided, however, these regulations shall not be applicable to any such pool less than twenty-four (24) inches deep or having a surface area less than two-hundred and fifty (250) square feet, except when such pools are permanently equipped with a water recirculating system or involve structural materials. For purposes of this code, pools are classified as private swimming pools or public and semi-public swimming pools, as defined in Section 428.2. Materials and constructions used in swimming pools shall comply with the applicable requirements of this code. Pools used for swimming or bathing and their equipment or accessories which are constructed, installed and maintained in accordance with the applicable standards listed in Appendix B shall be deemed to conform to the requirements of this code, provided the requirements of Section 428.8 are included in the installation and the requirements of the Commonwealth of Massachusetts Environmental Code 310 CMR 16.00 are met. 428.2 Classification of pools: Any constructed pool which is used, or intended to be used, as a swimming pool in connection with a single - family residence and available only to the family of the householder and his private guests shall be classified as a private swimming pool. Any swimming pool other than a private swimming pool shall be classified in the public or semi-public swimming pool categories. 428.3 Plans and permits 428.3.1 Permits: A swimming pool or appurtenances thereto shall not be constructed, installed, enlarged or altered until a permit has been ob- tained from the building official. The approval of all city, county and state authorities having jurisdiction over swimming pools shall be obtained before applying to the building official for a permit. Certified copies of these approvals shall be filed as part, of the supporting data for the application for the permit. 428.3.2 Plans: Plans shall accurately show dimensions and construction of pool and appurtenances and properly established distances to lot lines, buildings, walks and fences; details of water supply system, drainage and water disposal systems, and all appurtenances pertaining to the swimming pool. An attempt to obtain a permit to install a priMAtp swimming pool in his rear yard revealed that such pool would be considered a semi-public pool because the property dwelling is not a single familydwelling pursuant ro sarrion 428.2. The appellant intends to use the pool for his private usp. A five foot (5' ) enclosure will be provided. Relief is desired to allow this inground pool to be constructed on, the lot wit h„ has a three (3) family dwelling for the exclusive use of the owner and be classi- fied as a private pool. r — / Tey Page 2 of 3 Docket Number: 799 As a result of this appeal and testimony, the Board determined that: 1. A constructed swimming pool intended to be used in connection with other than a single residence shall be classified in the public or semi—public swimming pool categories. Section 428.2 2. Although the proposed pool will be constructed in the rear yard of a three (3) family dwelling, the owner/occupant of this property intends to install this pool for use limited to his family and his private guests, as allowed for pools classified as a private swimming pool. 3. Access to this fenced in pool will be through a five foot (5' ) high top latching gate intended to be kept locked when pool is not in use. 4. A five foot (5') high wooden fence with vertical members spaced not more than three inches (3") apart on the exterior and horizontal fence rail kept on the pool side of the fence will add an extra measure of security against unauthorized use. In conclusion, based on above determinations, the Board unanimously voted as follows: 1.
