Based on a site visit of the work done so far it is evident that a more formal solution to conveying storm water run-off is needed to adequately address the development of these two sites. It is my understanding that the abutting property, also owned by the Jermyn Realty Trust, has a stream that leads to a drainage pipe under Marlborough Road. Given the topography of the land and the drainage issues associated with the development of the two homes noted, it would be best resolved if a drainage catch basin is installed at the lower portion of Outlook Avenue and then piped across the lot of 5 Outlook Ave and discharged to a rip-rapped swale going in the direction of the existing stream. Easements for the drainage system would need to be established for each portion of the system on private property for future maintenance by the City. Satisfactory resolution of this issue will allow the utility and site development work to proceed. Please have your Engineer revise the plans, incorporating the drainage system and easements discussed above and resubmit for final City approval. As you are aware,the drainage issues relative to the area in question were not created by my development of the two lots outlined above(#5 Outlook Ave&#7 Outlook Ave). Scenic Terrace is a well documented problem area that has been addressed by the city on numerous occasions by multiple residents well before this project was started.My development of this area,based on topography of the land will not introduce additional storm water runoff to the scenic terrace area. My project opens up the opportunity for resolution of the long standing issue that has plagued this area. I do not agree with you recommendation of developing a rip rap swale which would introduce storm water run-off into property located within a designated wetlands buffer zone.I do not believe your recommendation is an appropriate solution for the issue at hand. I believe a more appropriate solution would be to develop a drainage plan which would establish a drainage catch basin at the lower portion of Outlook which is well outside the designated wetland buffer zone.Then pipe the drain straight down Outlook Ave West directly into an established drainage catch basin located at the intersection of Outlook Ave and Marlborough Rd. This project has mutual benefit for all of Scenic Terrace/The City of Salem.As such,Bob Lubas and I are prepared to incur the costs of engineering development costs, excavation and installation of drainage system to specification, including removal of any ledge necessary providing the following: City of Salem will provide: • All necessary drainage pipe • Drainage catch basin system • Patching any existing hot topped area on Outlook Ave West which is disturbed by this project Joe,I believe this proposal is a fair and equitable solution for all parties.I look forward to your approval so that we may move this project forward to completion as soon as possible.. Improvements to Outlook Avenue are on-going by others. The southern portion of the property, where the proposed residence is to be constructed, slopes to the west; and the northern portion of the property slopes to the north. Construction of the proposed residence requires retaining walls on the north and west sides of the property. An intermittent stream exists at the base of the slope on the adjacent property to the north. The southern bank of the stream is approximately 60 feet north of the property line, and approximately 80 feet from the limit of the proposed work. As depicted on the Site Plan (Figure C-1), the proposed house, utility work, and most of the site grading will be located beyond the buffer zone. Only the northern stone retaining wall and a portion of the site grading will be within the Buffer Zone to the resource area. The purpose of this RDA is to seek a negative determination for performing site grading, including the construction of retaining walls within the buffer zone to the resource area. Such work is to be performed at a distance greater than 80 feet from the resource area. Erosion controls consisting of a haybale barrier will be positioned downslope of the proposed work, as depicted on the Site Plan.
