Appeals The applicant, owner, any person aggrieved by this Determination, any owner of land abutting the land upon which the proposed work is to be done, or any ten residents of the city or town in which such land is located, are hereby notified of their right to request the appropriate Department of Environmental Protection Regional Office (see Appendix A)to issue a Superseding Determination of Applicability. We were authorized to prepare this filing at the request of Mr. William O'Connell, representative for the Saint Mary's Cemetery, ' owner of the property known as Assessor's Map 117-0178-0, located at 226 North Street, in Salem,Massachusetts (the "Site"). 1 ' Wetland Restoration,Wildlife Habitat Assessment, Permit Preparation,and Ecological Services ' M:ICIRREN7'PROJECT F7LE"CIIDIOCESE OFBOSTOMSALEMSaintMary's Cemetery-SalemIRDA Texl.doc 1 ' Overview ' Restoration of Debris Area In brief,the project includes the removal of two areas of debris, as well as,the ' installation of a fence to ensure no future dumping within these areas (See Plan by BSC, Inc.-Figure 2). Portions of the debris piles are located within the Bordering Vegetated Wetland(BVW),as well as, the 100-foot Buffer Zone. We propose to remove the debris ' within these areas by hand and with small machinery. Debris will be stockpiled on site outside the buffer zone for proper disposal to a licensed facility. The restoration area will be graded to blend with the surrounding topography. We do not anticipate the need to ' bring in any fill or loam. All disturbed areas will be seeded with a native wildflower mix to establish a dense vegetated buffer to the downgradient wetland area. We propose to install staked haybales along the limit of work as shown on the Plan. All work required ' within the bordering vegetated wetland will be conducted by hand. No equipment will be allowed to enter the wetland area. A wetland scientist will be present during the restoration efforts and will provide guidance during the project. Existing Granite ' The cemetery underwent renovations over approximately 50 years ago, removing all granite steps and posts. These large pieces of granite were deposited along the border of the cemetery between the cemetery plots and the salt marsh. (See Photos,Appendix xxx). We propose to leave the granite blocks in place within the bordering vegetated wetland and the adjacent buffer zone. Since the blocks have been in place for along period of time,they provide wildlife habitat as breeding areas for birds and small ' mammals,as well as,basking areas for reptiles. These blocks have been in this area for many years based on the large number of mature trees growing between the granite blocks. To remove this material would result in extensive damage to the resource area from the loss of canopy and shrub community. We feel that this intrusion is unnecessary as the granite functions to provide wildlife habitat value to this area. The boundary of the Bordering Vegetated Wetland was delineated on November 20, ' 2002, by DeRosa Environmental Consulting, Inc. and demarcated with pink surveyor's flagging consecutively numbered Al to A21. The boundary of the Bordering Vegetated Wetland was delineated based on vegetation alone. There is a distinct break in slope ' between the upland and wetland areas. Soil plots were examined to verify the boundary determination. ' The plant community in this area consisted principally of sumac (Rhus sp.), red maple (Acer rubrum), swamp white oak(Quercus bicolor), red oak(Quercus rubra), and willow(Salix sp.) in the canopy. The shrub community consisted principally of glossy ' buckthorn(Rhamnus frangula), and highbush blueberry(Vaccinium corymbosum). The herbaceous community consisted principally of knotweed(Polygonum sp.), purple loosestrife(Lythra salicaria),common reed(Phragmites sp.), and greenbrier(Smilax ' rotundifolia). These plants constitute a wetland plant community under the Act. The MADEP data sheets are attached for your review. ' Rare & Endangered Species Habitat There is no portion of the project located within the boundaries of Rare& Endangered Species Habitat (Figure 3) as determined by the Massachusetts Department of Fisheries & Wildlife (2000(2001 Edition). Since the removal of the debris is an improvement to the existing conditions, we feet that the work within the BVW will benefit the long-term value of the site. Accordingly, we do not expect that the proposed ' project will destroy or otherwise impair any portion of the downgradient Bordering Vegetated Wetland. The removal of the debris constitutes an improvement to existing site conditions. We believe that the removal of the debris will have a positive impact on ' the BVW and surrounding Buffer Zone, therefore meeting the Performance Standard of no adverse impact. Land Subject to Coastal Storm Flowage The Flood Zone A2 is located at Elevation 10 according to FEMA Flood Insurance Rate ' Map revised August 1985. The proposed project is located outside Elevation 10. City of Salem Wetlands Ordinance ' The City of Salem Wetlands Ordinance follows the Performance Standards set forth in the Wetlands Protection Act. The debris has been deposited by outside parties dumping on the site. The debris includes shopping carts,televisions,buckets, yard waste,and other materials. We propose to remove all debris within and adjacent to I ' the BVW. Small pieces of debris will be removed by hand, with larger items removed with machinery. All disturbed areas will he graded and seeded with a native wildflower seed mix upon removal of all debris. A fence is proposed to ensure no future dumping ' Within this area of the cemetery(See Site Plan). ' Granite Blocks Discarded granite blocks are located with the adjacent salt marsh and buffer zone to bordering vegetated wetland. This activity occurred many years before the inception of ' the Wetlands Protection Act(ca. 1950s)when the cemetery underwent renovation removing granite stairs and fencing within the cemetery. These large pieces of granite were deposited outside the cemetery plot boundaries within the bordering vegetated ' wetland, salt marsh, and associated buffer zones. Upon inspection of the area, many mature trees were observed growing between the granite blocks,providing evidence that the blocks have been in place for many years. The removal of this material would have ' an adverse impact on the resource area, as it would require the use of heavy machinery and loss of the existing canopy and understory plantings. The large pieces of granite and the mature tress within the area serve as wildlife habitat value within the buffer zone and ' bordering vegetated wetland. We have discussed the presence of these granite blocks with Don Cefalo, Conservation Agent, and suggest that leaving them in place would better serve the existing wetland resource area because of the added wildlife habitat value 1 and the additional environmental cost of removing them. 1 1 ' Wetland Restoration, Wildlife Habitat Assessment, Permit Preparation, and Ecological Services Af.ICURRENr PROJECT'RLEScI RCHIJ[OC{.SE OF BOSTO,"ALEA4-Saint A-farv's Cemeiery-Sarni iRU.a 7:ai_doc 1 ' EROSION & SEDIMENTATION CONTROL PLAN ' Configuration of Siltation Barriers Prior to any earthwork at the site, a silt barrier consisting of staked hay bales will be installed downgradient of the proposed area of activity to prevent any erosion/sedimentation to the downgradient wetland resource area(Refer to Buffer Zone ' Restoration Plan, Figure 2). These silt barriers will remain in place during the entire construction process and until all exposed soils are completely re-vegetated. ' Limits of Work The hay bale line will serve as the limit of work for this project. No heavy equipment will ' be allowed to enter any wetland resource area at any time. Heavy equipment will be stored outside the buffer zone overnight or when not in use. All on-site wetland boundaries shall be marked with stakes and flagging to prevent machinery from ' unknowingly entering resource areas. Contingency Hay Bales & Inspections ' Contingency hay bales(10)will be stored at the site on and beneath 6-millimeter polyurethane sheeting, to be available for repair of the silt barrier on an as-needed basis. ' Inspections of the silt barrier will be made weekly by the construction foreman and after every rainfall, to assure proper function. Damaged or impaired barriers will be replaced immediately. Seeding of Exposed Soils I ' After final grading all exposed soils will be seeded with a wildflower seed mix(Table 1) and either hydroseeded or hand seeded and hay mulched to prevent erosion.
