Salem, Massachusetts 01970 RE: DEP Files 64-282, 64-283, 64-284 (Grenier, Marlborough Road) Dear Sir; The Commission has asked for further information concerning the presence or absence of nverfront area affecting the three above-referenced notices of intent. I attach a variety of documents which may assist you in your considerations, and offer the following arguments on behalf of my client, Mr. Grenier. 310 CMR 10.58: (2) provides definitions of the regulatory entity"river'. The first paragraph of this section describes a river as beginning"at the point an intermittent stream becomes perennial, or at a spring or pond which discharges throughout the year." The section includes the presumption that a river or stream shown as perennial on the current USGS map is perennial unless rebutted by evidence from a competent source asserting to the contrary. (Competent sources include Department staff, conservation commissioners, and conservation commission staff.) The regulations further provide that the issuing authority may consider evidence from other sources. In accordance with paragraph ii. of section(2) cited above, Hancock Environmental Consultants has provided the Commission with field observations that the stream was not flowing through out the month of August, 1998. We have also presented documentation of average to above average surface and groundwater flows during the previous five months(March through July, 1998) as well as the month(August 1998) during which a dry streambed was observed and photogrliphed. Although paragraph(2) i. assumes that the stream in question is not shown as perennial on the USGS map, we have also calculated the watershed area of Strongwater Brook to be 0.39± square miles. The regulatory standard of proof to assert that a stream is a river requires 3 square miles of I watershed. The reach of Strongwater Brook at issue has approximately 13% of the required area. The Commission has asked if Strongwater Brook appears on the Flood Insurance Rate Maps. It does, but is shown as a linear feature without appurtenant floodplain. (It is also labeled as Strong Body Brook, but is clearly the stream in question.) Division of Hancock Survey Associates,Inc. Other standards of proof cited in the regulations include the absence of channel or bank and soils information showing depressed groundwater elevations significantly below the surface. We have stipulated that the reach of Strongwater Brook in question does exhibit a well defined two to six foot wide channel and a bank ranging from six to twelve inches in height, but assert that these structural characteristics are shared by intermittent streams as defined by the regulations. A test pit dug on September 5, 1998 at the center of the (then dry) channel just above the farm crossing on lot 3 indicated no free water to a depth of 26 inches. The observation pit remained open for 20 minutes, and soils throughout consisted of fine silty sand exhibiting pronounced gleying. The observed conditions are typical of an intermittent streambed. Rachel Freed, of DEP, suggested 1 also check the Inventory of Rivers and Streams prepared by the Massachusetts Stream Classification Program in July 1982. This document was under consideration as a regulatory reference during the early stages of the draft Rivers Bill, but is not cited in the regulations as finally promulgated. Strongwater Brook is classified as interrupted (urban). The glossary included in the inventory defines"interrupted" as "flow [which is] disrupted, or appears to stop and then reappears within a specific land-use type..." The Inventory specifies an urban land use, but the reach at issue lies within a wetland characteristic of groundwater breakout, which provides a twenty to fifty foot wide vegetated buffer to the watercourse. The nearest existing development consists of several existing dwellings along Marlborough Road, typically 100 to 300 feet from Strongwater Brook. This letter and the documentation already submitted can be summed up in the following manner: Strongwater Brook appears as a perennial stream on the Salem Quadrangle USGS map dated 1985, but exhibits characteristics of an intermittent stream, most particularly the absence of surface flow during the month of August 1998. The remainder of the evidence is offered in corroboration of the observation and in rebuttal of the presumption. I will attend the meeting scheduled for October 1, 1998, and will gladly answer any questions the Commission may have. Please find attached photographic documentation of a dry streambed observed August 11, 1998. 1 have visited the site twice since that date, and the streambed remains dry as of this morning. Insofar as the issue has been much debated by the Commission, I have also calculated the watershed of the reach of Strongwater Brook affecting this parcel, and have determined that its area equals 247± acres, approximately 0.39 square miles. This watershed is approximately 13% of the standard of proof required to support a claim that an intermittent stream is a river (ref 310 CMR 10.58: (2) (a) 1.). I wish to stress that the documented observation of August 1997 occurred at a time of drought as defined in the above-cited section, but that this is by no means the case this year. It appears from the testimony of Judge Fumari, the previous owner of the property, that the brook dries up every summer. Thank you for your attention to this matter. All work shall conform to the above-referenced Notice of Intent, site plan and supporting documents and those final specifications which shall be filed with the Commission prior to construction. Any change made or intended to be made to the approved plans shall require the applicant to inquire of the Commission in writing whether the change is substantial enough to require the filing of a new Notice of Intent. 2. Members and agents of the Commission shall have the right to enter and inspect the premises at all reasonable times to evaluate compliance with the conditions in this Order. The Commission may require the applicant to submit additional data or information necessary for the Commission to conduct that evaluation. 3. Upon completion of the project,the applicant shall submit, with the request for a Certification of Compliance, an affidavit, prepared by a professional engineer or land surveyor registered in the Commonwealth of Massachusetts, stating that the site has been developed in accordance with the requirements of this Order of Conditions, the referenced site plan and supporting documents. 4. This Order shall apply to every successor in control or successor in interest of the property described in the Notice of Intent and accompanying plans or part thereof. In the event this land or any part thereof changes ownership before or during construction, the current owner shall notify the new owner, by registered mail, of this Order prior to the transfer of ownership and shall forward proof of this notification to the Commission. 5. Prior to commencement of construction activity, a haybale barrier shall be placed downgradient of construction to prevent siltation of the adjacent wetland. Haybales shall be anchored with stakes and entrenched 4 to 6 inches in depth. Trench material shall be deposited on the upgradient side of the haybale barrier. Haybales shall be inspected daily; those showing signs of deterioration shall be replaced immediately. The haybale barrier shall remain in proper functioning condition until all disturbed areas have been stabilized. 6. Additional erosion and sedimentation control measures deemed necessary by the Commission shall be instituted by the applicant. Any siltation caused onto any wetland or waterway area shall be promptly reported to the Commission. Such areas shall be restored to the satisfaction of the Commission. 7. During construction, no debris, fill, or excavated material shall be stockpiled within 100 feet of designated wetlands. Any other stockpile location will be protected sufficient to prevent sediment from surface runoff entering wetlands. 8. Equipment servicing and overnight equipment storage must be conducted outside the outer riparian zone. Equipment must be maintained to prevent leakage or discharge of pollutants. 9. *No spill or discharge of petroleum products or other pollutants will occur within 100 feet of any wetland resource area. 10. *Use or storage of rock salt (sodium chloride) or other toxic de-icing chemicals is .f prohibited within 100 feet of the resource area. Any arrangement for snow removal shall stipulate the ban. 11. Notice shall be given this Commission no more than 2 weeks nor less than 2 days prior to the commencement of construction activities. The City of Salem Conservation Commission is aggrieved by the action of the Department in its issuance of a Superceding Order of Conditions and hereby requests an adjudicatory hearing. Strongwater Brook is a perennially flowing river and development is not permitted within the inner riparian zone. Site inspections were undertaken at a time during drought periods. I have attached an informational package from the USGS for your review. Please be aware that the Salem Conservation Commission has conducted several site visits and strongly believes that the interests of the Rivers Protection Act apply to all seven lots of this subdivision and the full length of Strongwater Brook within the subdivision. Flows in most tributaries dwindled to a trickle or dried up altogether. On the mainstem Ipswich, the effects of low flows are most obvious in reaches that have a slight slope or gradient_ The low flows in these reaches leaves large stretches of streambed exposed, and streamside habitat features such as undercut banks, root masses, aquatic vegetation, and overhanging vegetation are left high and dry, and are not available to support support aquatic life. In low-gradient reaches that are pooled behind riffles, woody debris, or dams, water velocities slow, temperatures increase, and algal blooms are common_ Many fish become concentrated in isolated pools. Water levels will remain low until substantial rainfalls replenish the watershed. As the dry weather persists, and available habitat in the river stays low, and the remaining aquatic life is increasingly stressed due to high water temperatures, lower levels of dissolved oxygen, dwindling food supplies, and predation.
