B. Order of Delineation (cont.)
This Order of Resource Area Delineation determines the boundaries of those resource areas noted above
and is binding as to all decisions rendered pursuant to the Massachusetts Wetlands Protection Act
(M.G.L. c.131, §40)and its regulations (310 CMR 10.00)regarding such boundaries.This Order does
not, however, determine the boundaries of any resource area or Buffer Zone to any resource area not
specifically noted above, regardless of whether such boundaries are contained on the plans attached to
this Order or to the Abbreviated Notice of Resource Area Delineation.
This Order must be signed by a majority of the Conservation Commission. The Order must be sent by
certified mail (return receipt requested)or hand delivered to the applicant. A copy also must be mailed or
hand delivered at the s me time to the appropriate DEP Regional Office(see Appendix A)

C. Appeals
The applicant, the owner, any person aggrieved by this Order, any owner of land abutting the land subject
to this Order, or any ten residents of the city or town in which such land is located, are hereby notified of
their right to request the appropriate DEP Regional Office (see Appendix A)to issue a Superseding Order
of Resource Area Delineation. The request must be made by certified mail or hand delivery to the
Department, with the appropriate filing fee and a completed Appendix E: Request for Departmental Action
Fee Transmittal Form, as provided in 310 CMR 10.03(7)within ten business days from the date of
issuance of this Order. A copy of the request shall at the same time be sent by certified mail or hand
delivery to the Conservation Commission and to the applicant, if he/she is not the appellant.
The request shall state clearly and concisely the objections to the Order which is being appealed and how
the Order does not contribute to the protection of the interests identified in the Massachusetts Wetlands
Protection Act, (M.G.L. c. 131, §40)and is inconsistent with the wetlands regulations (310 CMR 10.00).
To the extent that the Order is based on a municipal bylaw or ordinance, and not on the Massachusetts
Wetlands Protection Act or regulations, the Department of Environmental Protection has no appellate
jurisdiction.

D. Simplified Review for Buffer Zone Projects
1. If this Abbreviated Notice of Resource Area Delineation is submitted in support of Buffer Zone
Simplified Review per requirements of 310 CMR 10.02(2)(b)(i-ii) please check project

WETLAND RESOURCE AREA DESCRIPTION

The following is a summary of wetland site investigations conducted at the property
located off of Barcelona Avenue in Salem,Massachusetts. The purpose of these
investigations was to determine the extent and location of wetland resources subject to
jurisdiction under the Massachusetts Wetlands Protection Act(MGH Ch. 131 S.40)and
the City of Salem Wetlands Protection Ordinance with and immediately adjacent to the
project site.
Methods
The limits of jurisdictional wetland resources were delineated by Rimmer Environmental
Consulting on April 26, 2004 with numbered sequences of flags in accordance with the
procedures established within the Massachusetts Wetlands Protection Act Regulations
(3 10 CMR 10.00),the Department of Environmental Protection—Delineating Bordering
Vegetated Wetlands Handbook(1995),and the City of Salem Wetlands Protection
Or&trance. Wetland vegetative criteria as well as evidence of wetland hydrology,
including hydric soils were used to delineate the wetland boundary.
Wetland Resources
The following wetland systems are present at the site;
A series(A49-.f76)c Bordering-Vegetated_Wedand
- I
This wetland line extends a previously approved wetland boundary under a separate
ANRAD filing. This wetland consists of a large freshwater marsh and a forested swamp
that both border on Strongwater Brook. The dominant vegetation growing in the marsh
portion of the wetland includes purple loosestrife(Lythrum saliraria),soft rush(Juncos
effusus),reed canary grass(Phalaris arundinaaea)and speckled alder(Alnus rugosa).
The fringe of forested wetland consists of red maple(Acer rubrum),gray birch(Betula
populifolia)and green ash(Fraxinus pennsylvanica)in the overstory,and spicebush
(Lindera benzoin),sweet pepperbush(Clethra alnifolia),northern arrow-wood
(Viburnum recognitum), speckled alder and catbnar(Smr'lar rotundifolia)in the
understory. The dominant vegetation in the herb stratum includes skunk cabbage
(Symplocarpus foetidus),sensitive fern(Onoclea mwibUfs)and sphagnum moss
(Sphagnum sp.). The dominant vegetation in the adjacent upland includes red maple and
white oak(Quercus alba)in the overstory, and rnultiflora rose(Rasa multiflora), white
oak and American bittersweet(Celastrus scandem)in the understory.

[-Series (I1-112): Border_ing-_ Vegetated Welland
The I-series delineates the western boundary of the A-series wetlands from flags A52 to
A76.This portion of wetland consists of a scrub/shrub wetland that follows closely to the
toe of slope. The dominant vegetation in the wetland includes highbush blueberry
(Vaccinum eerymbosum),maleberry(Lyonia lingustrina),bristly blackberry(Rubus
hispidus)and cinnamon fern(Osmunda cinnamomea). The dominant vegetation in the
adjacent upland includes sweet pepperbush,black cherry(Prunus serotina),northern
arrow-wood and bracken fern(Pteridium aquilinum).
J-es(Jh421).'Bordering_Vegetated Wetland
This series delineates a forested wetland that borders on the northwestern side of
Strongwater Brook. The dominant vegetation in the wetland includes black cherry in the
overstory,with northern arrow-wood and sweet pepperbush in the understory. The
herbaceous layer is dominated by skunk cabbage,cinnamon fern,American bittersweet
and fox grape(Fitts labrusca). The dominant vegetation in the adjacent upland includes
black cherry,black oak(Quercus velutina)and Norway maple(Acer platanoides)in the
v and black ch and crabapple Malus runus in the understo . The herb

stratum consists of Canada mayflower(Maianthemum canadense) and wood fern
(Dryopterus marginalis)
Additional Resources
There are no certified vernal pools,estimated habitat of rare wetlands wildlife,or priority
habitats of rare species within the project area,as determined by reference to the
Massachusetts Natural Heritage and Endangered Species Program,Natural Heritage Atlas
(I P.Edition).
Summary
Any proposed construction or activity atihe site within the 100-foot Buffer Zone to
Bordering Vegetated Wetland will be subject to review by the Salem Conservation
Commission under the Massachusetts Wetlands Protection Act and the City of Salem
Wetlands Protection Ordinance.

RE: Additional Wetland Delineation Review of Property off Barcelona Avenue
Dear Mr. Taormina and Conservation Commission Members:
At your request, Wetlands&Land Management, Inc. has completed our additional
review of the wetland resource delineation at a portion of the property off Barcelona
Avenue in Salem. This recent wetland resource delineation was in addition to the
numerous series of flags I reviewed for the Commission in April, 2004.
I reviewed the wetland boundary depicted on plans entitled"Resource Area Delineation
Plan located in Salem, Mass." by Eastern Land Survey Associates, Inc. dated July 15,
2004. Wetlands were delineated by Rimmer Environmental Consulting in October to
December 2003.
I visited the site on October 1, 2004. Wetlands on the site were reviewed using
delineation methodology established in the Wetlands Protection Act and the Department
of Environmental Protection"Delineating Bordering Vegetated Wetlands Handbook"
dated 1995, and the US Army Corps of Engineers Manual (1987). These regulations and
methodology incorporate the evaluation of hydric soils, predominance of wetland
vegetation and wetland hydrology to evaluate the upper limit of vegetated wetlands.
My review was limited to wetland flags A43 to A79, 11 to I22 and JI to J21. In general,
most of the flags were located at the bottom of a steep slope where the topography
controlled the extent of wetlands. After reviewing the flags in the field, I agreed with the
location of all of the wetland flags that were found. Be advised, flags A50. A63, A65
and A76 were not found. These flags were out in the transmission line right of way
where all of the flags followed steeply sloping contours. Using the plan, I could re-create
the approximate"location of the original flag and concurred in all locations where a flag .

was lost that the topography strongly controlled the limit of wetlands and there would be
little room for difference of opinion at these locations.
