General Conditions Under Massachusetts Wetlands Protection Act (only applicable to approved projects) 1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this Order. 2. The Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3. This Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state, or local statutes, ordinances, bylaws, or regulations. 4. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: a. the work is a maintenance dredging project as provided for in the Act; or b. the time for completion has been extended to a specified date more than three years, but less than five years, from the date of issuance. If this Order is intended to be valid for more than three years, the extension date and the special circumstances warranting the extended time period are set forth as a special condition in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. Any fill used in connection with this project shall be clean fill. Any fill shall contain no trash, refuse, rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe,tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing. 7. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such an appeal has been taken, until all proceedings before the Department have been completed. S. No work shall be undertaken until the Order has become final and then has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land,the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of the registered land, the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is done. The recording information shall be submitted to this Conservation Commission on the form at the end of this Order, which form must be stamped by the Registry of Deeds, prior to the commencement of work. 9. Appropriate erosion control devices shall be in place prior to the beginning of any phase of construction, and shall be maintained during construction in the wetland areas and buffer zones. The erosion control specifications provided in the Notice of Intent and the erosion control provision in the Order will be the minimum standards for this project; the Commission may require additional measures. 23. All debris, fill and excavated material shall be stockpiled a location far enough away from the wetland resource areas to prevent sediment from entering wetland resource areas. 24. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as necessary. Any accumulated silt adjacent to the barriers shall be removed. 25. The area of construction shall remain in a stable condition at the close of each construction day. Attachment to Order of Conditions # 64-406 Page 4of 26. Any de-watering of trenches or other excavation required during construction shall be conducted so as to prevent siltation of wetland resource areas. All discharge from de-watering activities shall be filtered through hay bale sediment traps, silt filter bags or other means approved by the Commission or its Administrator. 27. Within thirty (30)days of completion of construction on any given portion of the project, all disturbed areas in the completed portion of the site shall be permanently stabilized with rapidly growing vegetative cover, using sufficient top soil to assure long-term stabilization of disturbed areas. 28. If soils are to be disturbed for longer that two(2)months, a temporary cover of rye or other grass should be established to prevent erosion and sedimentation. If the season is not appropriate for plant growth, exposed surface shall be stabilized by other appropriate erosion control measures, firmly anchored, to prevent soils from being washed by rain or flooding. DURING CONSTRUCTION 29. A copy of this Order of Conditions and the plan(s)approved in this Order shall be available on site at all times when work is in progress. 30. No alteration or activity shall occur beyond the limit of work as defined by the siltation barriers shown on the approved plan(s). 31. All waste products,grubbed stumps, slash;construction materials,etc. shall be deposited at least 100 feet from wetland resource areas and 200 feet from river. 32. Cement trucks shall not be washed out in any wetland resource or buffer zone area,nor into any drainage system. Any deposit of cement or concrete products into a buffer zone or wetland resource area shall be immediately removed. 33. All exposed sub-soils shall be covered by a minimum of three(3)inches of quality screened loam topsoil prior to seeding and final stabilization. 34. Immediately following drainage structure installation all inlets shall be protected by silt fence, haybale barriers and/or silt bags to filter silt from stormwater before it enters the drainage system. 35. There shall be no pumping of water from wetland resource areas. 36. All equipment shall be inspected regularly for leaks. Any leaking hydraulic lines,cylinders or any other components shall be fixed immediately. 37. During construction, all drainage structures shall be inspected regularly and cleaned as necessary. 38. The applicant is herby notified that failure to comply with all requirements herein may result in the issuance of enforcement actions by the Conservation Commission including,but not limited to,civil administrative penalties under M.G.L Chapter 21A, section 16. AFTER CONSTRUCTION 39. Upon completion of construction and final soil stabilization,the applicant shall submit the following to the Conservation Commission to request a Certificate of Compliance(COC): (1) A Completed Request for a Certificate of Compliance form(WPA Form 8A or other form if required by the Conservation Commission at the time of request). The project is comprised of five areas of the City�s water distribution system and includes the following work: ' Loring Avenue 8-inch Water Main Work This component of the project involves the replacement of approximately 6,000 linear ' feet of existing unlined 6-inch cast iron(CI)water main with new cement lined 8-inch ductile iron(DI) water main in Loring Avenue from Jefferson Avenue to Cedar Avenue (See Sheets 1 through 6). All work is proposed within the limits of the ' existing roadway right-of way. Currently, the existing 6-inch and 16-inch water mains in Loring Avenue cross- connect many times. The 6-inch water main is deteriorated and often breaks, essentially shutting down both water mains due to the frequent cross connections. The new 8-inch water main will provide reliability and a redundant line for the ' Loring Avenue distribution area. Forest River Culvert Crossing Constriction ' This component of the water distribution improvements involves the replacement of approximately 215 linear feet of an existing 10-inch water main on Loring Avenue at t the Forest River culvert crossing with a new 16-inch DI pipeline.This section of the existing 10-inch water main currently acts as a bottleneck in the 16-inch ductile iron water main running the length of Loring Avenue (See Sheet 3).The new 16-inch DI water main section will be installed within the roadway shoulder of Loring Avenue over the existing culvert and in a common trench with a new 8-inch DI water main. The new water mains will be installed between an existing sewer pipeline and gas ' pipeline. All work is proposed within the limits of the existing roadway right-of way. The new 16-inch water main will eliminate the constriction caused by the 10-inch ' diameter pipeline segment and will return the flow and fire protection capabilities in that line to values appropriate for a 16-inch transmission line. Looping the"Presidential"Area to Sunset Road Area '. This component of the project involves the installation of approximately 275 linear feet of an 8-inch high density polyethylene (HDPE) pipe from the end of the existing ' 8-inch water main in Pierce Road under a tidal creek tributary to the Forest River and connecting to the existing 6-inch water main on Sunset Road (See Sheet 7).The new 8- inch water main will be installed using horizontal directional drilling,a trenchless ' construction technique,to install the pipe beneath the tidal creek. Cm A-1 W1356a ' Attachment Project Narrative ' Pierce Road is supplied by the Loring Avenue water main,and the Sunset Road area is supplied by the Lafayette Street water main.This new 8-inch main will create a new loop in the distribution system for increased pressure and improved water circulation and fire protection flow in the Loring Avenue area known as"the Presidential' neighborhood. This loop will also provide a redundant means for the City to supply water to all customers on Loring Avenue if there is a major water break on Loring Avenue anywhere between the intersection of Jefferson Avenue and Harrison Road. ' Cleaning and Lining of Sunset Road Neighborhood Water Main This portion of the project involves the cleaning and cement lining of approximately ' 2,000 linear feet of existing 6-to 8-inch water main on Sunset Road, Riverbank Road, and Rosedale Avenue (see Sheet 8). All work is proposed within the limits of the existing paved roadway and right-of-way.Work is limited to the 100-Foot Buffer ' Zone. The cleaning and lining in this neighborhood will remove tuberculation and debris ' from the pipes to provide increased flow and adequate fire protection. Cleaning and Lining of Lafayette Street Water Main ' This portion of the project is proposed as a"bid alternate" and involves cleaning and cement lining of approximately 3,100 linear feet of the existing 8-inch water main on Lafayette Street from Rosedale Avenue to Loring Avenue (see Sheet 8). A bid ' alternate means that this segment of the work will proceed if there are sufficient funds based on contractor bids. ' The cleaning and lining of this stretch of Lafayette Street will remove tuberculation and debris from the pipe,allow for the replacement of broken valves,and provide up to four new fire hydrants on Lafayette Street. All work is proposed within the limits of the existing paved roadway and right-of-way. Work is limited to the 100-Foot Buffer Zone. Summary Construction of the 8-inch water main along Loring Avenue (Route 1A),horizontal ' directional drilling under a tidal creek,and the water main cleaning and lining discussed above will require work within the resource areas regulated as Coastal Bank, Land Subject to Coastal Storm Flowage (100-year flood elevation based on ' Flood Profile No. 11 of the New England Coastline Tidal Flood Survey,September 1998),Riverfront Area and the 100-Foot Buffer Zone to Coastal Bank,Salt Marsh and Bordering Vegetated Wetland. ' The following sections address wetland resource areas,work proposed in and adjacent to resource areas, and proposed measures to mitigate wetland and water ' quality impacts. cm A-2 MJ1356a Attachment A Project Narrative 2.0 Existing Conditions ' On April 20,2005,a CDM(Camp Dresser&McKee,Inc.) wetland scientist inspected the proposed project area for the presence of wetlands in accordance with Section 404 of the Clean Water Act,the Massachusetts Wetlands Protection Act(M.G.L. Ch 131 ' Sec. 40),the Massachusetts Wetlands Protection Act Regulations (310 CMR 10.00 et. seq.),and the U.S. Army Corps of Engineers 1987 Wetlands Delineation Manual.CDM ' and the Salem Conservation Commission Agent met on April 20,2005 to discuss the overall project and work proposed within and adjacent to resource areas. According to discussions with the agent,work proposed within existing roadways that fall ' within the 100-buffer zone and resource areas associated with the tidal creek do not have to be flagged for this project,as long as wetland resource areas are identified on the plans, and hay bales and/or silt fences are shown at the limit of the work areas. ' The approximate wetland boundaries were determined by the limit of wetland vegetation(limit of plant community dominated [50% or more cover] by species adapted to living in wetland conditions) by visual inspection,indicators of wetland ' hydrology,use of tidal charts and the MA DEP GIS Wetlands Database. Coastal boundaries were determined pursuant to the Wetland Protection Regulations and DEP Policies. Four wetland areas located within 100-feet of the proposed work areas ' were identified in the field and are labeled accordingly on the attached plans. Loring Avenue (Route 1A) ' The wetland located to the southeast of Loring Avenue,east of House No.455 and across from Oakview Road,is a wooded swamp and is regulated as Bordering Vegetated Wetland(BV W).This wetland is dominated by red maple(Acer rubrum), ' northern arrowwood(Viburnum recognitum) and highbush blueberry (Vaccinium corymbosum) (see Photo No.1).A dirt mound primarily vegetated with common greenbrier (Smilax rotundifolia) and Japenese knotweed (Polygonum cuspidatum) is tlocated between the edge of the wetland and sidewalk. The wetland located to the southeast of the road,east of the wetland discussed above, and across from House No.450 is an emergent marsh regulated as BV W(see Photo No. 2).The emergent marsh is dominated by common reed (Phragmites australis), cattails (Typha latifolia), purple loosestrife (Lythrum salicaria), and sedges (Carex spp). ' There is also a large wetland system located along the southeast side of Loring Avenue for approximately 950 feet,which collects drainage from the emergent marsh ' mentioned above. This wetland is regulated as salt marsh and is associated with the Forest River which drains to Salem Harbor (see Photo Nos. 3 through 5). The extensive salt marsh is composed of salt hay (Spartina patens) in the high marsh, ' smooth cordgrass (Spartina alterniflora)in the low marsh, and unvegetated inter-tidal mudflats. The Forest River is a tidal river that flows in a southeasterly direction under Loring Avenue through a 10-foot wide box culvert.Salt marsh and mudflats border ' both sides of the Forest River and Loring Avenue. 1 cm A-3 ' MJ1356a ' Attachment A Project Narrative ' Pierce Road The wetland system located at the end of Pierce Road is associated with a tidal creek that is a tributary to the Forest River (see Photo Nos. 6 through 10).The tidal creek is located northeast of the Forest River and northwest of Salem Harbor. A fringe of salt marsh approximately 30 feet wide is located along the western bank and Salt Marsh approximately 15 feet wide is found along the eastern bank.The Salt Marsh is dominated by smooth cordgrass in the low marsh,salt hay grass in the high marsh, seaside golden rod(Solidago semperoirens) and marsh orach(Atriplex patula). The channel of the creek is a mudflat,regulated as Coastal Beach,and at low tide the channel bottom is exposed.The Coastal Bank extends landward of the Salt Marsh to ' approximately the edge of the paved road. The Massachusetts Natural Heritage (11th Edition,Salem and Lynn Quadrangles) ' indicates that the work proposed herein is not located within the vicinity of an estimated habitat of state listed rare wildlife or priority habitat of rare species (see Figure 2-Estimated Habitats Map). ' 3.0 Work Proposed within Resource Areas and the 100- Foot Buffer Zone 3.1 General Construction This project will involve work in Coastal Bank,Land Subject to Coastal Storm Flowage,the 200-foot Riverfront Area and the 100-Foot Buffer Zone to Coastal Bank, Salt Marsh and Bordering Vegetated Wetland. A description of construction activities in these resource areas is described below in Sections 3.2 and 3.3. All other construction is proposed outside of resource areas and their buffer zones. Loring Avenue- Water main Construction ' Water main construction along Loring Avenue (Route 1A) will include installing hay bales or silt fence at the limit of work before any excavation commences to prevent the ' transport of sediment to downgradient wetlands during construction.Construction of the water mains will require excavation of a 5-to 6-foot wide trench approximately 6 to 7 feet deep.Trenching work will require the use of heavy equipment for excavating ' the trench and moving materials.Soils will be stockpiled next to the trench after excavation. Once the water main is installed;the trench will be backfilled to match existing street grades.Temporary paving will be installed on roadways after required tcompaction and final paving after one winter cycle. The silt fence/hay bale barrier will be inspected weekly and after all stone events of ' 1/2 inch or greater and will be repaired as needed.The barrier will be left in place until the area is permanently stabilized.Hay bales will be replaced as necessary due to sediment build-up and degradation. ' Pierce Road-Horizontal Directional Drill Construction Approximately 200 linear feet of 8-inch high density polyethylene (HDPE)will be installed under the tidal creek located at the end of Pierce Road.The new water main cm A-4 ' MJ1356a ' Attachment A Project Narrative will be open cut installed from the end of the existing 8-inch water main in Pierce Road,and then directional drilled from the end of Pierce Road under the tidal creek to connect to the existing 6-inch water main on Sunset Road. The new 8-inch water main will be installed using horizontal directional drilling,this method uses a remotely operated drilling head to"drill" underground and then pull solvent welded sections of HDPE pipe back through the drilled opening. No open-cut excavation will take place in the tidal creek(regulated as Coastal Beach) and bordering Salt Marsh for this ' work. Compared to open-cut trench methods,horizontal directional drilling decreases the effect on surface features because most of the operations are underground,generally 10 feet below ground level.The horizontal directional drilling work will require a pilot hole to be drilled for the proposed pipe from the starting point at ground level (Pierce Road) and then gradually down to a depth of about 10 feet or more below ground level (under the tidal creek),and will exit at a predetermined location on the other side (Sunset Road).The head of the drill contains ' a transmitter which enables the crew to track its location and make adjustments in the direction as needed. A reamer will be attached to the pilot drill and the carrier pipe will be attached to the reamer on Sunset Road from where it will be pulled back to Pierce Road underground. The access and egress points (staging areas)needed to install the water main via horizontal directional drilling in this area will be located within previously disturbed areas.The access and egress points are generally 10' x 10'.The access point will be located on a maintained lawn area at end of Pierce Road,adjacent to the paved road and the egress point will be located on Sunset Road (see Photos 6 through 10).The access and egress points will be surrounded by a silt fence prior to the commencement of drilling operations. Upon completion of work,the excavated area within the maintained lawn will be backfilled with clean backfill material and covered with topsoils that were originally removed from the area. All vegetated areas disturbed during construction will be returned to pre-construction contours and seeded to prevent soil erosion.The disturbed area within Sunset Road will be backfilled,patched and repaired to match existing street grades. Water Main Cleaning and Lining Work Cleaning and lining is an operation that rehabilitates existing water mains in place with minimal surface disturbance.Work in the Lafayette Street and Sunset Road neighborhood areas will involve excavating several pits that will be excavated within the roadway to access the water main.The access pits will be approximately 10'x 10' x 6' deep and are usually excavated at an existing valve location,where the pipe is saw cut opened and valve removed.The water main will be thoroughly cleaned and flushed to remove all rust,tuberculation,deposits,and other foreign materials from the existing main using a dragline method that provides a satisfactory surface for proper application and bonding of the cement lining.The interior of the existing main ' will be coated with cement mortar approximately 3/16-inches thick creating a new smooth wall surface for water flow.The open pipe is then reassembled with either a new valve or coupling,chlorinated and tested,service lateral connections are cleared Cm A-5 tW1356a Attachment A Project Narrative ' with compressed air,and then the pit locations are backfilled and returned to their original condition. 3.2 Work within Coastal Wetland Resource Areas ' Coastal Bank Coastal Bank is defined as "the seaward face or side of any elevated landform, other than a coastal dune, which lies at the landward edge of a coastal beach, land subject to tidal action,or other wetland." [310 CMR 10.30] In the project area Coastal Bank is associated with the Forest River and the tidal creek tributary to the Forest River and Salem Harbor.The top of Coastal Bank was delineated based on slope characteristics pursuant to the DEP Definition and Delineation Criteria for Coastal Bank(DWW Policy 92-1).There are two top of Coastal Banks along the western side of the tidal creek located at the end of Pierce Road where horizontal directional drilling will take place. Standard E of the Policy indicates there can be multiple coastal banks within the same site and generally occurs where coastal banks are separated by land subject to coastal storm flowage (with a slope less than 10:1)(refer to Attachment D). According to the FEMA Flood Insurance Rate Map (FIRM) Community Panel No. 250087 002B,this portion of the project area is located within the Zone B (areas between limits of the 100-year flood and 500-year flood). However,review of the New England Coastline Tidal Flood Survey indicates the 100- year tidal flood at this location extends to approximately elevation 14.36 feet-City of Salem Datum(elevation 10 feet NGVD).The top of the upper Coastal Bank is approximately at elevation 14 feet, along the edge of the maintained lawn area and ' roadway and has a slope steeper than 10:1 but shallower than 4:1. The top of the lower Coastal Bank is approximately at elevation 11 feet and has a slope steeper than 10:1. Both banks are separated by Land Subject to Coastal Storm Flowage (LSCSF) as also shown on Figure 5 of the DEP Coastal Bank Policy.The upper limit of LSCF within this area of the project is elevation 14.36 feet City of Salem Datum. ' Work within the Coastal Bank at the end of Pierce Road will consist of using the maintained lawn area as a staging area (access/egress point)for the horizontal directional drill work. The access or egress point(approximately 10' x 10')will be excavated within the limits of the maintained lawn area and will not require any disturbance to the fringing Salt Marsh bordering the tidal creek. Approximately 10 linear feet of Coastal Bank will be temporarily altered. Upon completion of construction the disturbed area will be regraded to match pre-existing contours and will be restored with loam and seeded. Staked silt fence or hay bales will be installed at the limits of work to prevent the transport of sediment.Sedimentation and erosion controls will not be placed in the salt marsh downgradient of the work area. Standard B was used to delineate the top of Coastal Bank on the easterly side of the ' tidal creek along Sunset Road. This Standard indicates that for a Coastal Bank with a slope steeper or equal to 4:1;the top of Coastal Bank is that point above the 100-year flood elevation where the slope becomes shallower than 4:1 (see Figure 2 of the DEP ' Coastal Bank Policy). The top of Coastal Bank near the proposed work area is at Cr A-6 ' MJ1356a 1 Attachment A Project Narrative ' approximately elevation 18 feet.No work is proposed within the Coastal Bank adjacent to Sunset Road.The access or egress pit for the horizontal directional drill work will be located within the paved road. The top of Coastal Bank was not delineated in areas where construction work will occur within the limits of pavement and within the 100-foot Buffer Zone,specifically Coastal Bank associated with the Forest River and Salem Harbor for water main construction and water main cleaning and lining work. Land Subject to Coastal Storm Flowage(LSCSF) Land Subject to Coastal Storm Flowage (LSCSF) is defined as"...land subject to inundation caused by coastal storms up to and including that caused by the 100-year storm, surge of record or storm of record, whichever is greater." [310 CMR 10.57] ' As indicated above, the FIRM shows the entire project area within the Zone B. Based on review of tidal flood charts, the upper limit of the 100-year tidal flood elevation at the end of Pierce Road is approximately at elevation 14.36 feet City of Salem Datum. Work within LSCSF will be associated with setting the staging areas (access/egress points) for the horizontal directional drill work and will proceed as described in Section 3.1. Approximately 100 square feet of LSCSF will be temporarily disturbed for the construction staging area at the end of Pierce Road. ' Review of the FIRM Community Panel No.250087 002B shows work associated with cleaning and lining the water main along Lafyette Street and the Sunset Road neighborhood will take place within the V-Zone (areas of 100-year coastal flood with velocity). The cleaning and lining activities will take place within existing paved roadways and will proceed as described in Section 3.1. ' Riverfront Area The Riverfront Area along tidal rivers extends 200 feet horizontally from the mean high water line of the Forest River and the tidal creek,both tidal waterways. ' [310 CMR 10.581. Proposed construction within the project area will generally take place in disturbed areas including Loring Avenue where water main construction will take place within the existing roadway. Work within the 200-foot Riverfront Area will also include construction of the access/egress points on the maintained lawn area at the end of Pierce Road and Sunset Road for the horizontal directional drill work. Additionally,a portion of the water main cleaning and lining,which is limited to roadway work will also take place within the Riverfront Area.Construction work within the 200-Foot ' Riverfront Area and overlapping resource area of LSCSF and the 100-Foot Buffer Zone to Coastal Bank and Salt Marsh will proceed as described in Section 3.1. ' Structures and activities subject to a M.G.L.c.91 waterways license or permit,are exempt from Riverfront Area regulations per 310 CMR 10.58(6)(i). The horizontal directional drilling work will require a Chapter 91 Waterways License for the cm A-7 ' W1356a Attachment A Project Narrative underground pipeline,and therefore no further discussion of Riverfront Area is provided for this portion of the project. As noted previously,the remaining work,which includes water main installation within Loring Avenue,and water main cleaning and lining in the Lafayette Street and Sunset Road areas will take place within existing roadways;therefore the short-term construction activities associated with these water system improvements are not ' anticipated to have any adverse effects within the 200-Foot Riverfront Area and adjacent wetland resource areas. 3.3 Work Within the 100-foot Buffer Zone The majority of work will take place in existing roadways within or outside of the 100-Foot Buffer Zone to Coastal Bank,Salt Marsh and BV W.Construction within the 100-foot Buffer Zone will proceed as described in Section 3.1. Disturbed areas will be restored to pre-construction conditions.The disturbed off-road areas (staging area) will be seeded with a perennial grass,maintained and re-seeded as necessary until 80 percent ground coverage is achieved,and in roadways the pavement will be repaired. After exposed soils are stabilized,the hay bales or silt fence will be removed. ' Water main construction is not anticipated to have any adverse effects on adjacent wetlands and waterways. 4.0 Mitigation Measures The following summary presents the mitigation measures that will be implemented to avoid and m n;rmze wetland impacts during construction.Please refer to the project plans for typical details of measures to protect wetlands and waterways during and after construction. Construction Period ■ Staked silt fence or hay bales will be installed at the limit of work prior to commencement of construction to prevent the transport of sediment and debris to ' downgradient wetlands and to demarcate the limit of work. The silt fence or hay bale barrier will be inspected weekly and after all storm events of Y2 inch or greater and will be repaired as needed.The barrier will be left in place until the ' area is permanently stabilized.Hay bales will be replaced as necessary due to sediment build-up and degradation.See Miscellaneous Detail Sheet No. 9 for details of these barriers. ■ Stockpiled soils will be enclosed within a line of staked silt fence or hay bales to prevent erosion or siltation into resource areas.The silt fence or hay bale barrier will be inspected weekly and after all storm events 1/2 inch or greater and repaired as needed.The barrier will be left in place until the area is permanently stabilized. ' Hay bales will be replaced as necessary due to sediment build-up and degradation. 1 cm A-8 MJ1356a ' Attachment A Project Narrative ■ Work in and adjacent to wetland resource areas will proceed as rapidly as possible. Limiting the exposure time of disturbed soils to wind and precipitation will mini.mze the soil erosion and subsequent sedimentation. 1 ■ Storm drain inlet protection will be provided for all storm drains which will collect runoff from the work area. This protection will prevent sediment from entering the storm drain system and being conveyed to wetlands or waterways. Typical inlet protection includes a filter box,constructed by enclosing the catch basin grate with a 2" X 4" wood frame covered with Y4"woven wire mesh,and filling the wood frame with crushed stone,or other approved inlet protection. ■ Periodic inspections will be made by the Resident Engineer and applicant to ensure compliance with the permit conditions. ' ■ Spill containment equipment(e.g.,oil absorbent pads, oil absorbent materials, containment booms,shovels,etc.)will be stored in the equipment and refueling areas in an easily accessible manner for use in the cleanup of accidental releases of fuel or other hazardous substances. ' ■ The contractor will be required to maintain water quality in all waterbodies during construction or discharging from dewatering activities,if necessary. Increases in turbidity will be limited to using construction BMPs.The contractor ' will obtain a NPDES permit if dewatering is necessary. Post Construction Measures The following summary of mitigation measures will be implemented to restore any short term impacts that occur in or adjacent to wetlands. ■ If seeding occurs outside of the growing season,temporary stabilization measures ' (i.e.,mulching or erosion control blankets)will be used to prevent erosion until the area can be seeded during the following growing season. ' ■ All disturbed soils will be permanently stabilized with grass to match preconstruction conditions.The area will be maintained and re-seeded to ensure that grass cover is adequate to stabilize the exposed soil. ■ The silt fence or hay bale barrier will not be removed until a vegetative cover dense enough to prevent erosion is established in the work area. 5.0 Review of Performance Standards Work proposed herein and shown on the attached project plans (bound separately) was designed to comply with the Wetlands Protection Act and Wetland Protection Regulations (Regulations) [310 CMR 10.00 et seq.j. Work is proposed within the resource areas of Coastal Bank,LSCSF, and RFA.Work is also proposed in the 100- foot Buffer Zone to Coastal Bank,Salt Marsh,and BV W. This project qualifies as a 1 Limited Project in accordance with Sections CMR 10.24(7)(b) and 310 CMR 10.53 (3)(d) Cm A-9 ' W1356a Attachment A Project Narrative of the Wetlands Protection Regulations,which includes"The construction, ' reconstruction, operation and maintenance of underground and overhead public utilities, such as electrical distribution or transmission lines, or communication, sewer, water and natural gas lines." The following presents how this project complies with these resource area performance standards. 1 Coastal Bank Work along Coastal Bank is limited to setting up an access/egress point for the ' horizontal directional drill work at the end of Pierce Road. The portion of Coastal Bank to be temporarily disturbed is currently a maintained lawn. ' This resource area is considered to be significant to the storm damage prevention and flood control interests of the Act because it supplies sediment to coastal beaches, coastal dunes or barrier beaches,and therefore the provisions pursuant to 310 CMR 10.30(3) through(5) apply: (3) No new bulkhead, revetment, seawall,groin or other coastal engineering structure shall be permitted on such a coastal bank except that such a coastal engineering structure shall be permitted when required to prevent storm damage to buildings constructed prior to the effective date of 310 CMR 10.21 through 10.37 or constructed pursuant to a ' Notice of Intent filed prior to of such buildings subsequent to the effective date of 310 CMR 10.21 through 10.37,provided that the following requirements are met: ' (a) a coastal engineering structure ora modification thereto shall be designed and constructed so as to minimize, using best available measures,adverse effects on adjacent or nearby coastal beaches due to changes in wave actions,and ' (b) the applicant demonstrates that no method of protecting the building other than the proposed coastal engineering structure is feasible. r (c) protective planting designed to reduce erosion may be permitted. Not applicable,no new coastal engineering structure is proposed as part of this project. (4) Any project on a coastal bank or within 100 feet landward of the top of coastal bank, other than a structure permitted by 310 CMR 10.30(3), shall not have an adverse effect due to wave action on the movement of sediment from the coastal bank to coastal beaches or land subject to tidal action. The proposed temporary staging area (access/egress point)will not have an adverse effect on the stability of the coastal bank or its ability to supply sediment to coastal beaches,coastal dunes or barrier beaches.Approximately 10 linear feet of Coastal Bank will be temporarily altered for the access/egress point. cm A-10 ' MJ1956a 1 Attachment A Project Narrative The Coastal Bank along the project site;comprised of maintained lawn,is significant to storm damage prevention or flood control.Upon completion of work,the disturbed ' area will be regraded to match pre-existing contours and will be restored with loam and seeded to stabilize the disturbed work area.The silt fence/hay bale barrier will not be removed until a vegetative cover dense enough to prevent erosion is established in the work area. The proposed temporary staging area will not adversely affect the stability and integrity of the Bank at this site. (5) The Order of Conditions and the Certificate of Compliance for any new building within 100 feet landward of the top of a coastal bank permitted by the issuing authority under M.G.L.c.131,§40 shall contain the specific condition:310 CMR 10.30(3),promulgated ' under the M.G.L.c.131,§40, requires that no coastal engineering structure, such as a bulkhead, revetment, or seawall shall be permitted on an eroding bank at any time in the future to protect the project allowed by this Order of Conditions. Not applicable,no new coastal engineering structure is proposed as part of this project. As noted previously,it is our opinion that the proposed temporary staging area will not adversely affect the Coastal Bank's stability or ability to supply sediment to coastal beaches,coastal dunes or barrier beaches. ' Land Subject to Coastal Storm Flowage(LSCSF) The FIRM shows the entire project area within the Zone B. Based on review of tidal flood charts,the 100-year tidal flood elevation at the end of Pierce Road is ' approximately at elevation 14.36 feet City of Salem Datum. Work within LSCSF will be associated with setting the staging areas (access/egress points)for the horizontal directional drill work and will proceed as described in Section 3.1. There are no performance standards for working in LSCSF.This resource area is considered to be significant to the storm damage prevention and flood control interests of the Act.Whereas there will be no permanent placement of fill or new structures within LSCSF, the proposed project is not anticipated to result in an increase in the horizontal or vertical extent of coastal storm flooding. However, ' projects should still be designed to mimm;ze impacts to coastal flooding and avoid placing structures or fill that could be susceptible to storm damage, to the maximum extent possible. Riverfront Area (RFA) Temporary work in RFA is described in Section 3.1 and includes pipeline installation ' and a temporary staging area (access/egress point) for the horizontal directional drill work at the end of Pierce Road. Additional work in the 200-Foot Riverfront area includes water main construction within Loring Avenue and water main cleaning and lining in the Lafayette Street and Sunset Road areas. Structures and activities subject to a M.G.L.c.91 waterways license or permit,are ' exempt from Riverfront Area regulations per 310 CMR 10.58(6)(1),and no further CDM A-i i ' W1356a Attachment A Project Narrative ' discussion of Riverfront Area is required for horizontal directional drill work.Note, temporary work within the Riverfront Area for this portion of the project will take place within previously disturbed areas (i.e.,roadway and maintained lawn). Upon construction completion,all disturbed areas will be stabilized and restored to match tpreconstruction conditions. Work associated with water main installation within Loring Avenue and water main cleaning and lining will take place within the 200-Riverfront Area,and therefore the general performance standard 310 CMR 10.58(4)applies to the project. (a) Protection of Other Resource Areas-When work is proposed within RFA and '. the presumption of significance is not overcome, the applicant must demonstrate that the project meets the performance standards of the resource areas,including 310 CMR 10.30 (Coastal Bank),10.32(Salt Marsh),10.55 (Bordering Vegetated Wetland),and 10.57(Land Subject to Flooding),located within the RFA. This project will require work within other wetland resource areas including Coastal Bank and LSCSF. The performance standards for Coastal Bank are addressed above and there are no performance standards for work in LSCSF. A portion of the proposed work will occur within the 100-foot Buffer Zone to Coastal Bank,Salt Marsh and BV W. There are no performance standards for work in the buffer zone in the Regulations,however, the guiding principle for work in buffer zone is that work shall not adversely affect adjacent wetland resource areas ability to protect the Interests of Wetlands Protection Act. The proposed work within the buffer zone is designed to avoid the alteration of adjacent wetland resources,and with implementation of erosion and sedimentation control measures is anticipated to avoid impacts to wetland resources. (b) Protection of Rare Species -When work is proposed within RFA,no project may be permitted which will have any adverse effect on specified habitat sites or rare wetland or upland,vertebrate or invertebrate species or which will have any adverse effect on certified vernal pool habitat. The Massachusetts Natural Heritage (11th Edition,Salem and Lynn Quadrangles) indicates that the work proposed herein is not located within the vicinity of an estimated habitat of state listed rare wildlife or priority habitat of rare species (see Figure 2-Estimated Habitats Map). ' (c) Practicable and Substantially Equivalent Economic Alternative-The applicant must also prove by a preponderance of evidence that there are no practicable and substantially equivalent economic alternatives to the proposed project with ' less adverse effects. There are no other alternatives to the proposed project that would result in less adverse effects. All work is already proposed within existing roadways with the CDM A-12 ' W1356a Attachment A Project Narrative 1 exception of the horizontal directional drill (trenchless method) work at the end of ' Pierce Road. The purpose of the proposed water system improvements is to improve water quality,water system reliability,redundancy, and fire protection capabilities in five areas of the City's water distribution system.Therefore the public need for the project is extremely important and the"no build" alternative was rejected from consideration. ' (d) No Significant Adverse Impacts-This project will have no adverse impacts on the ability of the RFA to protect the interest of the Wetlands Protection Act.This project does meet all of the standards set forth in 310 CMR 10.58 (4)(d) 1 (a-d). ' Within the 200 Riverfront Area,the Conservation Commission may allow the alteration of up to 5,000 square feet or 10% of the RFA within the lot,whichever is ' greater,on a lot recorded on or before October 6,1997. Alteration of the RFA is limited to approximately 6,700 square feet within existing paved roadways that will be temporarily altered for pipeline construction. No permanent alteration is proposed ' as part of this project. (a) At a minimum, a 100 foot wide area of undisturbed vegetation must be provided from ' the MAHW. Structural stormwater management measures may be allowed when there is no practicable altemative. ' Work will occur within the first 100 feet of the lower limit of RFA. However,this work is limited to pipeline construction within existing paved roadways.Where utility pipes are located within paved areas,the trench will be backfilled and repaved, ' thus this alteration is only a temporary alteration of RFA. (b) Stormwater must be managed according to standards established by the DEP. ' Stormwater will be managed in accordance with the DEP Stormwater Management Policy. ' (c) Proposed work shall not impair the capacity of the RFA to provide important wildlife habitat functions. ' The majority of RFA alteration is limited to pipeline installation within existing paved roadways and the use of existing lawn area for a temporary construction staging area. ' These areas will be restored to match existing conditions.Therefore,no long-term impact to wildlife habitat is anticipated. ' (d) Proposed work shall not impair groundwater or surface water quality by incorporating erosion and sedimentation controls and other measures to attenuate nonpoint source pollution. ' Lastly, the project as designed will protect groundwater and surface water quality during construction and for the long-term.The project design includes all necessary conn A-13 ' MJ1355a Attachment A Project Narrative controls to prevent and contain accidental releases of materials used during construction. 100-Foot Buffer Zone to Coastal Bank, Salt Marsh and BVW t Work within the 100-foot Buffer Zone to these resource areas is described above. There are no performance standards for working in Buffer Zone,however the guiding principle is to prevent adverse impacts to the downgradient resource areas.As ' designed,work in the 100-foot Buffer Zone will not adversely affect the downgradient resource areas. Construction phase erosion and sedimentation control measures will protect these areas from erosion or deposition of sediment. The short-term and long- term mitigation measures will protect the interests of Coastal Bank,Salt Marsh,and BV W within the project area. 6.0 Summary The proposed infrastructure improvements will improve water system reliability and ' provide a redundant water line for the Loring Avenue distribution area. Additionally, this project will create a new loop in the distribution system for increased pressure, and improved water circulation and fire protection in the Loring Avenue area tbetween Pierce Road area and Sunset Road area. Construction work within resource areas is limited to pipeline construction along ' Loring Avenue (Route 1A) and a temporary staging area for the horizontal directional drilling work at the end of Pierce Road.Approximately 10 linear feet of Coastal Bank will be temporarily disturbed for the construction staging area. DEP general topics: E ' Coastal Banks: Definition and Delineation Criteria for Coastal Bank (DWW Policy 92-1) Issued: March 3, 1992 Purpose The purpose of this policy is to clarify the definition of coastal bank ' contained in the Wetlands Regulations, 310 CMR 10.00, by providing guidance for identifying 'top of coastal bank'. Regulatory Standards Coastal wetlands are defined in the Wetlands Protection Act (MGL c. 131, s.40) as: r "any bank, marsh, swamp, meadow, flat or other lowland subject to tidal action or coastal storm flowage". ' Coastal banks are defined at 310 CMR 10.30(2) as: "the seaward face or side of any elevated landform, other than a coastal dune, which lies at the landward edge of a coastal beach, land subject to tidal action, or other wetland". When these two definitions are read together, coastal banks can be inferred to be associated with lowlands subject to tidal action or subject to coastal storm 1 flowage. Coastal banks, therefore, can occur around non-tidal ponds, lakes and streams provided that these elevated landforms confine water associated with coastal storm events, up to the 100-year storm elevation or storm of record. ' Land Subject to Coastal Storm Flowage, in turn, is defined at 310 CMR 10.04 as: ' "land subject to any inundation caused by coastal storms up to and including that caused by the 100-year storm, surge of record or storm of record, whichever is greater'. ' The Department uses the 100-year coastal flooding event as defined and mapped by the Federal Emergency Management Agency (FEMA) per the i ' National Flood Insurance Program, as the maximum flood elevation associated with land subject to coastal storm flowage, unless recorded storm data reveals a higher flood elevation (which is the storm of record). There is no definition for ' "top of coastal bank" provided in the Act or the Regulations. A Guide to the Coastal Wetlands Regulations, prepared by the Massachusetts Coastal Zone Management Office, upon which Conservation Commissions and the Department have relied for guidance, states that the landward boundary of a coastal bank is "the top of, or first major break in, the face of the coastal bank", and implies that it is easily identified using United States Geologic Survey ' topographic quadrangles. However, the scale of topographic quadrangle maps generally do not allow for parcel specific analysis. No further definition of"top of and "major break" is provided. The following standards should be used to delineate the "top of coastal bank" [refer to figures 1-7 for a graphic ' presentation of the information below]: A) The slope of a coastal bank must be greater than or equal to 10:1 (see Figure 1). ' B) For a coastal bank with a slope greater than or equal to 4:1 the "top of coastal bank" is that point above the 100-year flood elevation where the slope becomes less than 4:1. (see Figure 2). ' C) For a coastal bank with a slope greater than or equal to 10:1 but less than 4:1, the top of coastal bank is the 100-year flood elevation. ' (see Figure 3). D) A "top of coastal bank" will fall below the 100-year flood elevation ' and is the point where the slope ceases to be greater than or equal to 10:1. (see Figure 4). E) There can be multiple coastal banks within the same site. This can occur where the coastal banks are separated by land subject to coastal storm flowage [an area less than 10:1]. (See Figures 5 and When a landform, other than a coastal dune, has a slope that is so gentle and ' continuous that it does not act as a vertical buffer and confine elevated storm waters, that landform does not qualify as a coastal bank. Rather, gently sloping landforms at or below the 100-year flood elevation which have a slope less than 10:1 shall be regulated as "land subject to coastal storm flowage" and not as coastal bank (see Figure 7). Land subject to coastal storm flowage may overlap other wetland resource areas such as coastal beaches and dunes. Information Requirements for Project Review Due to the complex topography associated with coastal banks, the following requirements are intended to promote consistent delineations. In order to accurately delineate a coastal bank, the following information should be submitted, at a minimum„ to the Conservation Commission and the Department of Environmental Protection: the coastal bank should be delineated and mapped on a plan(s) to a scale of not greater than 1 ' inch = 50 feet, including a plan view and a cross section(s) of the area being delineated showing the slope profile, the linear distance used to calculate the slope profile, and the location of this linear distance.
