Four conditions were established by the Salem Conservation Commission under the Negative Determination, these being: 1) Submit a Materials Handling Contingency Plan; 2) Submit a copy of the Site Plan showing the approximate test pit locations and access paths; 3) Require that an oil containment kit be on site during proposed activities; and, 4) Require that the Commission Agent be contacted regarding significant changes in location of any test pit. ATTACHMENT A MATERIALS HANDLING CONTINGENCY PLAN Assessment and Monitoring Activities Glover Estates (Former Lead Mills Site) The proposed test pits are being advanced within known areas of lead contamination. Excavated soils will be stockpiled adjacent to the test pits and will be returned to the test pit on the same day. The subject property is a disposal site under the jurisdiction of the Massachusetts Contingency Plan (MCP). In the event conditions are encountered which suggest that an imminent threat to human health and/or the environment exists, the Massachusetts Department of Environmental Protection (DEP) Bureau of Waste Site Cleanup (BWSC) will be notified and an Immediate Response Action, if required, will be performed under their approval. If soil must be stockpiled overnight for any reason, it will be placed on and covered with 6 mil polyethylene sheeting and the Salem Conservation Commission will be notified. An oil spill containment kit will be kept on-site during excavation activities. The oil spill containment kit will consist of a shovel, a 5 gallon plastic tub, 20 pounds (min.) absorbent granules, 2' x 2' absorbent pads, 6 mil polyethylene sheeting, and a bulk absorbent pillow. Tom Dalton wrote an upbeat article on February 2nd describing your upcoming plans to build a new 50-75 unit assisted living facility somewhere on the 4.5 acre Forest River Tide Mills site. Can you kindly place us on your list of neighbors and interested parties to whom you are sending letters and explanations about what is proposed? We would also like to review and discuss conceptual plans with you at your earliest convenience. As you may be aware,the entire Forest River Tide Mills site here in Salem has long been viewed not only as a private development opportunity,but also as a public open space,and passive recreation and heritage park development opportunity. About nine years ago—in 1991 according to the Salem Evening News—both the City of Salem and the Town of Marblehead announced plans to jointly purchase the entire site for open space conservation,as it is easily accessible from--and links--both communities. Lack of funding forced those initial plans to be abandoned,but after that the old railroad line which crosses the site was converted into a fine new pedestrian trail—I believe with public funds— further anchoring public use and enjoyment of the waterfront property. More recently,I am told that Marcia Mollay visited the site(and was photographed there by a journalist)while trying to promote the Community Preservation bill which would raise moneys for open space land acquisition. Furthermore,I believe a new photograph of the site was forwarded by the City of Salem to the State House just last year—again to underscore what could and would be acquired for long term public use and enjoyment--if only Massachusetts public preservation and conservation acquisition funds were made available. With the new Rivers Act effectively prohibiting any new construction within 100 or 200 feet of the Forest River,my casual"read"of the site is that you will have little,if any direct use for the triangular portion of the property which runs stepped back 100 or 200 feet from along the southeast border of the River,and which then is bounded by the old railroad track(pedestrian trail)on the north,and Lafayette Street on the west. This is also the part of the property which is most pubhcly visible,most publicly accessible,and which contains the highest concentration of historically significant features-e.g..old 1730s-1930s Capt. John Gardner,Francis Peabody&Forest River Lead Works mill foundations, building post foundations,mill raceways,etc. (and with broken mill stones and clay corroding pot fragments nearby). Have you considered donating this unbuildable portion of the site to the City of Salem,both to assist it in its open space conservation efforts,and to realize some significant new tax benefits? With a little cooperative discussion and group planning,we might be able to convert the overgrown"front"part of your property into a nice small 21st century Forest River Tide Mills riverfront park—which would also reduce your tax burden,liability concerns,and maintenance expenses while also greatly priming the pump towards enthusiastic public approval of your project.
