SM ACCESS AGREEMENT
This Site Access Agreement is entered into this day of August 2001, by and
between the Town of Salem (`Salem') acting by and through the Salem Conservation
Commission as the owner of certain property abutting the Salem Harbor and located off of
Lafayette Street in Salem Massachusetts ("Salem Property, and Glover Estates, LLC ("Gloves
Estates'), as the owner of the former Chadwick Lead Mill Property, Lafayette Street,
Marblehead and Said(the"Mill Property-).
WHEREAS,Glover Estates desires access to the Salem Property in order to conduct soil
and/or groundwater sampling in accordance with the scope of work and sampling location map
attached hereto.
NOW,THEREFORE,in consideration of the mutual covenants set forth hereto the
parties agree to the following
1. Subject to the terms and conditions contained in this Agreement, Glover Estates,its
agents,employees,contractors and/or subcontractors may enter upon the Salem Property
for the limited purpose of performing sampling in accordance with the attached scope of
work and sampling location map_
2. Before entering the Salem Property to conduct sampling,Glover Estates will(a)apply for
and receive any necessary governmental permits and approvals,(b)provide to Salem
certificates of main==under paragraph 8 hereof evidencing that Glover Estates and its
agents,employees,contractors and/or subcontractors perforr nmg work under this
Agreement have caused Salem to be named as an additional insured on their general
liability insurance policies,(c)provide at least 48 hours advance notice to Salem before
accessing the Salem Property for this purpose,and(d)comply with all applicable Dig
Safe requirement&
3. Glover Estates will take all practical and reasonable efforts to minimize the dimiption to
and alteration of the Salem Property. Glover Estates shall repair any damage to the
Salem Property caused by its activities or that of its agents, employees,contractors and/or
subcontractors.
4_ Glover Estates will perform all work pursuant to this Agreement under the supervision of
a Licensed Site Professional engaged at its sole cost and expense.
- 5- Glover Estates will perform all wank pumas to this Agreement in compliance with all
applicable federal,state, and local laws.
6. To the extent that any soil from the Salem Property is excavated during the sampling,
Glover Estates shall remove such soil for proper off-site disposal in accordance with the
Massachusetts Contingency Plan,310 CMR 40.0000("MCP").

occurrence,for activities permitted by this Agreement.
9. Glover Estates shall defend,indemnify and hold harmless Salem for all damages or
injuries caused by any action or omission of Glover Estates and its agents,employees.

10. All notices to Salem under this Agreement shall be sent by certified mail,return receipt

SAMPLING AND ANALYSIS PLAN
The proposed activities outlined in this Scope of Work(SOW)will involve the investigation of
soil and groundwater associated with site-mlated impacts fmm the Former Chadwick Lead Mill
Sita All work will be conducted in acccr&noe with the Site Realth and Sefety Plan (RASP,
dated January 2001). The locations of duo proposed investigation activities ere shown on
Figure 1. It should be noted that Figure 1 also contain the proposed sampling locations within
the Town of Marblehead walldng hail.

Task 01—Shallow SOB Sampling

will be collected from the upper OS feet of the beach face area located on the western side of the
Forest River(refer to Figure 1). This area represents the intertidal portion of the property(area
between high and low tide). These composite samples will be collected from up to five sample
locations within the composite area(noted as dashed lines on Figure 1). These samples will also
be submitted to the laboratory for total lead anaysiS.

It is anticipated that soil boring SW34 will be advanced to approzimetely 16 feet below ground
swiace or until natural soils (i.e., former sediment or otgattic layer) are encountered. The
proposed well point will be advanced to np to g feet below Wo and surface_ Based on 8tis
auaimlAm and to aid in determining the presence of lead in the material within these arms,it is
estimated that a soil samples will be collected soil boring and 2 samples will be collected from
the well potnt All samples collected will be submitted to the laboratory atesotuoe Laboratories–
Portsurouth,MI)for total lead analysis(refer to Table 1).
The well point will be consauoted of 1.25-inch ID, Schedule 40, threaded, flush jointed, PVC
riser pipe, with 0.010-inch(10 slot) factory slotted, 1.25-inch ID, Schedule 40,threaded, flush-
jointed,PVC well screen. The well semen depth and lengths will be determined in the fieidbased
on ihe depth to water With the well screen in position, a clean silica and filter pack will be
imsUned in the annular space from die bonom of the borehole to a minimum of one foot above the
top of the well screen. A bentonite seal(I to 3 feet thick)Will be placed above the filter pack,
followed by a cemeavbentow Hite shiny grout to withvt a flew feet of the ground sutthee. The
monitoring wells will be completed with a concrete pad and a stickup protective steel casing The
monitoring well identification number will be marked on the outside and inside lid of the
protective casing.
Task#3—Groundwater Sanop4e Collection
Following well point installation, a groundwater sample will be collected using low flaw and
filtering techniques and submitted to the laboratory (Resource Laboratories–Portsmouth, M
for total and dissolved lead analysis by Method 6010B to provide sufficient information to
investigate whether a release of dissolved lead to groundwater is evident Purge water generated
as a result of groundwater sampling will be disposed of in accordance with the applicable
provisions of the MCP.
