Pursuant to the authority of G.L. C. 131 s.40, the Salem
Conservation Commission has considered your notice of intent and plans submitted
therewith, and has determined that the area on which the proposed work is to bp-
done
edone is significant to one or more of the interests described in the said act. .
The Salem Conservation Commission hereby orders that the
following conditions are necessary and all work must be performed in strict con-
formance therewith:
CONDITIONS
1. Failure to comply with all condition stated herein, and with all related
statutes and other regulatory measures, shall be deemed cause to revolve or
modify this order.
2. This order does not grant any property rights or any exclusive privileges;
` it does not authorize any injury to private property or invasion of private
rights.
3. This order does not relieve the permittee or any other person of the neces-
sity of complying with all other applicable federal,state,or local statutes,
ordinances, by-laws and/or regulations.
4. The work authorized hereunder shall be completed within one '(1) year from
the date of this order. The order may be extended by the issuing authority
for one or more additional one-year periods .upon application to the said
issuing authority at least thirty days prior to the expiration date of the
order or its extension. ''

5. Any fill used in connection with this project shall be clean fill, contain-
ing no trash, refuse, rubbish or debris, including, without limiting the
generality of the foregoing, lumber, bricks plaster,wire, lath, paper, card-
board, pipe, tires, ashes, refrigerators, motor vehicles or parts of any of
the foregoing.
6. No work may be commenced untill all appeal periods have elapsefi from the or-
der of the Conservation Commission or from a final order by the Department
of Natural Resources has elapsed.

. 7. No work shall be undertaken untill the final Order, with respect to the
proposed project, has been recorded in the Registry of Deeds for the dis-
trict in which the land is located. Copy to be furnished to issuer of this

8. Upon completion of the work described herein, the applicant shall forthwith
request, in writing, that a certificate of compliance be issued stating that
the work has been satisfactorily completed.
9. A sign shall be displayed� at the site not less than two square feet or moTe
than three square feet bearing the words,"Massachusetts Department of
Natural Resources, File Number 64-51 "
10. Where the Department of Natural Resources is requested to make a determina-
tion and to issue a supperceding order, the Conservation Commission shall ba
the party to all agency proceedings and hearings before the Department of
Natural Resources.

This is to inform you that an Order of Conditions (DEQE File 1164-51)
was issued by the Salem Conservation Commission on August 21, 1979 to
William McKinnon for the construction of a townhouse at 18-20 Kosciusko
St. , Salem, Mass. The plan submitted entitled "Proposed Duplex Townhouse
Koscuiusko Street, Salem, Mass. , revised 7/26/79", prepared by James
Ballou, 125 Derby St. , Salem, Mass calls for a slab foundation and the
first floor elevation at 16.50 mlw. The 100 year flood level for Salem
is 15.36 mlw. Since the elevation of this building will be above the 100
year flood elevation, a Wetlands/Flood Hazard Special Permit from the
Planning Board was not required.

Dear Mr. Hingson:
An actual "Certificate of Compliance" cannot be issued relative to the Order
of Conditions (DEQE File # 64-51) at the .present time. An official "Certificate
of Compliance" can only be issued after the project is complete.
At your request 'I did inspect the project as it exists at the present time.
The structure does have a slab foundation and does conform to the plan
submitted July 27, 1979 and presented at the Public Hearing on August
21, 1979. Thus far the construction does conform to the Order of Conditions
issued by the Conservation Commission on August 21, 1979 and the applicant
is showing good faith relative to compliance with the Wetlands Protection
Act.

Dear Ladies and Gentlemen of the Planning Board:
Relative to the application of William F. and Adele D. McKinnon for the construc-
tion of a duplex house at 18-20 Kosciusko. Street, Salem and approval by your planning
board, please be advised that there is an eight inch seeder line in Kosciusko Street
to which the proposed residents can be tied in. Upon the construction of the proposed
duplex residence, the owner may connect to this sewer line upon taking the usual steps
with the City of Salem.

Dear Mr. Power:
I have reviewed the resubmission of the construction plans for this dwelling
and have determined that the elimination of the basement does not significantly differ
from the original plan presented to the Board. The first floor elevation is in con-
formance with the Wetlands Flood Hazard Zoning Laws, and all other siting and construc-
tion has not been altered.
