The Site is owned by Mr.Joseph A.Finocchio,owner of the Salem Sign Company,which is located on Lot#123,immediately east of Glenn Avenue. The subject property is partially wooded,with dominant species including staghorn sumac,apple, t and oak. Several species of upland herbaceous vegetation are also present A drainage culvert which collects drainage from Highland Avenue empties onto the property. No sign of ponding or a seasonally high water table was noted on the Site. No areas were noted on the property in which the vegetative community met the 50%wetland vegetation composition criteria necessary for a Bordering Vegetated Wetland. There are no protectable Wetland Resource Areas or Buffer Zones on the Site. 3. The work in said area is described below. (Use additional paper.H necessary,to describe the proposed work.) ' The applicant proposes to market the subject property as a lot with the potential for construction and operation of a commercial business. (GMAC) hereby requests a Negative Determination of Applicability pursuant to the Massachusetts Wetlands Protection Act ' (M.G.L. c.131 s.40; hereinafter "the Act") Regulations (310 CMR 10.00; hereinafter"the Regulations")and the City of Salem Wetland and Flood Hazard District Regulations (hereinafter the "City Ordinance") for proposed activities at 230 Highland Avenue ' (Figure 1). Mr. Finocchio wishes to develop the referenced lot (identified as Salem Assessor's Map#8,Lot#120 [Figure 2]) for commercial purposes, and is seeking this Determination from the Commission regarding the presence of protectable Resource ' Areas on the site. Site Location and Description The Site is located at the intersection of Highland Avenue and Glenn Avenue in ' Salem, Massachusetts, and consists of 1.43 acres. The enclosed plan,entitled"Salem, Massachusetts; Plan of land prepared for: Joseph A. and Irene B. Finocchio; Reid Land Surveyors; January 26, 1993" depicts current Site conditions and topography. The lot is ' currently vacant, and abuts Lot 123, where the Salem Sign Company is located. Glenn Avenue, which separates Lots 120 and 123 (Figure 2), has not been completed to its intersection with Highland Avenue, and currently exists only as a right-of-way. Gulf of ' Maine Research Center scientists have made several inspections of the site at the request of Mr. Finocchio. The purpose of the GMRC site visits was to assess the presence of protectable Resource Areas,pursuant to the Act,Regulations and the City Ordinance. Topography at the Site is sloping, with the wester portion of the lot at the highest ' elevation. A drain pipe on the Site receives drainage from a catch basin on Highland Avenue. However, there are no areas of ponding evident on the Site. The easter edge of the lot appears to have been historically filled. The vegetative community at the Site is ' dominated by upland tree species such as apple (Malas spp.), white oak(Quercus alba), black oak(Q. nigra), smooth sumac (Rhus glabra), staghorn sumac (R. typhina),quaking aspen(Populus tremuloides), white ash (Fraxinus americana), sycamore (Platanus occidentalis) and American larch (Larix laricina). An area of low relief in the eastern ' 230 Highland Avenue,Salem,Request for Determination;Page 1 of 3 GULF OF MAINE RESEARCH CENTER INC. ' portion of the lot contains scattered wetland plant species (see below), but does not meet the criteria in the Regulations for any protectable Resource Area. ' Proposed Activities The applicant proposes to develop the site for commercial business. Following ' the issuance of a Negative Determination of Applicability, Mr. Finocchio plans to market the referenced lot as a lot buildable for commercial purposes. Bordering Vegetated Wetlands ' The Regulations establish a 50% wetland vegetative composition standard as the definition of Bordering Vegetated Wetlands (310 CMR 10.55(2)(c)). Additionally, Bordering Vegetated Wetlands border on creeks,rivers, streams,ponds or lakes. ' Topography at 230 Highland Avenue includes an area of low relief at the base of the slope in the eastern portion of the lot. The eastern edge of this area of low relief is bordered by the parking area adjacent to Salem Sign Company. There are several small ' areas (less than 100 square feet) where the soil surface is moist, but vegetation does not indicate the presence of wetlands. Primary growth in the lowest portion of the property includes staghom sumac, apple,red maple (Acer rubrum) and American elm(Ulmus americana). However, in no portion of the site do wetland species such as red maple and ' American elm comprise 50% of the vegetation. There are no bogs, swamps, wet meadows or marshes upgradient of this culvert. Therefore,pursuant to the Regulations (310 CMR 10.02), the area of low relief does not meet the definition of a stream. There is ' no hydraulic or vegetative connection between the area of low relief and the culvert under Highland Avenue. Thus,Gulf of Maine Research Center is of the opinion that the Resource Area Bordering Vegetated Wetland is not present on the site. ' Other Resource Areas According to the 1985 Federal Emergency Management Agency Flood Insurance Rate Map for the City of Salem(Figure 3), the site is above the upper limits of the ' theoretical 100-year flood elevation. Therefore, the Resource Area Land Subject to Coastal Storm Flowage (310 CMR 10.04)does not occur at the site. According to the U.S.G.S. Salem Quadrangle Topographic Map (Figure 1), Site elevations range from 80 ' to 100 feet N.G.V.D. Based on Site elevations and the GMRC Site inspections, no Coastal Wetland Resource Areas are present at the Site. The Regulations define Isolated Land Subject to Flooding(310 CMR 10.57) as "an isolated depression or closed basin without an inlet or an outlet...which at least once a ' year confines standing water to a volume of at least 1/4 acre-feet and to an average depth of at least six (6) inches." Topography at the Site does not create any isolated depressions which meet the above criteria. The Resource Area Bordering Land Subject to Flooding ' (310 CMR 10.57(2)(a)) is defined as "an area with low, flat topography adjacent to and inundated be flood waters rising from creeks,rivers, streams,ponds or lakes." There are no areas present at the Site which meet these stated criteria. Therefore,neither Isolated ' nor Bordering Land Subject to Flooding exists at the Site. Site Soils A review of the Soil Conservation Service's Soil Survey of Essex County, ' Massachusetts (1984; Figure 4),revealed that Site soils are classified as Urban Land (UR). These areas are nearly level to moderately steep, and soils are usually obscured by urban works and structures. Soil types near the Site include Ridgebury extremely stony t fine sandy loam (RiB) and Chatfield-Hollis-Rock Outcrop complex (CrC), upland soil types that are rated by the Soil Conservation Service as "poor" to "very poor" for their potential for wetland plants and shallow water areas. Because the soils associated with ' the Site are not typical hydric soils, wetlands are not likely to be present. ' Buffer Zones The Regulations require the filing of a Notice of Intent for any activity that would ' affect a protectable Resource Area or its associated 100-foot Buffer Zone. During the Site inspections and map review by Gulf of Maine Research Center,no protectable Resource Areas were identified on any property adjacent to 230 Highland Avenue within 100 feet of the property boundary. Therefore, the proposed activities at 230 Highland ' Avenue will not require the filing of a Notice of Intent due to presence of protectable Resource Areas on adjoining property. ' Summary and Conclusions Based upon Gulf of Maine Research Center's Site inspections and review of pertinent maps and documents, we are of the belief that no Resource Areas protectable ' under the Act, Regulations or City Ordinance are present at 230 Highland Avenue. (GMRC) hereby submits additional information to the Request for Determination of Applicability filed on 2 February 1993 for property at 230 Highland Avenue, Salem,Massachusetts. At the request of the Commission, the public hearing for this filing has been extended to allow inspection of the site during the growing season. GMRC scientists have recently inspected the site and are providing the results of the site inspection to the Commission to aid in determining the site's wetland status. Since the 22 April public hearing,mush of the woody vegetation on the site has leafed out, and several species of herbaceous vegetation have emerged. The plant species list provided as an attachment to this letter details all species identified by GMRC at the site. Although some of the newly emergent species are wetland indicators,GMRC maintains its position that the wetland plant community does not border on any stream or pond and does not contain wetland vegetation in sufficient quantity to meet the criteria for a Bordering Vegetated Wetland. In a few isolated locations, the herbaceous community contains Virginia fern and sensitive fern, both wetland indicator species. However, the herbaceous community comprises only one third of the plant community as a whole, and the addition of these wetland indicators is insufficient to create a plant community composed of at least 50% wetland vegetation. An additional observation made during the recent GMRC site inspection is that there is no identifiable vegetative or hydraulic connection between the patches of wetland herbs and the culvert draining from Highland Avenue, and no identifiable vegetative connection between these patches and the downstream wetlands. Therefore, GMRC maintains its position that the area of low topography does not qualify as a stream pursuant to the Massachusetts Wetlands Protection Regulations(310 CMR 10.00). Based on our review of pertinent regulations,maps,plans and site characteristics, GMRC is of the opinion that the area of low topography on the 230 Highland Avenue property does not meet the criteria for protection under the Massachusetts Wetlands Protection Act. The enclosed plan, entitled"Salem, Massachusetts; Plan of land prepared for: Joseph A. and Irene B.Finocchio; Reid Land Surveyors; January 26, 1993" depicts current Site conditions and topography. The lot is ' currently vacant, and abuts Lot 123, where the Salem Sign Company is located. Glenn Avenue, which separates Lots 120 and 123 (Figure 2),has not been completed to its intersection with Highland Avenue,and currently exists only as a right-of-way. Gulf of Maine Research Center scientists have made several inspections of the site at the request ' of Mr. Finocchio. The purpose of the GMRC site visits was to assess the presence of protectable Resource Areas,pursuant to the Act,Regulations and the City Ordinance. Topography at the Site is sloping, with the western portion of the lot at the highest ' elevation. A drain pipe on the Site receives drainage from a catch basin on Highland Avenue. However,there are no areas of ponding evident on the Site. The eastern edge of the lot appears to have been historically filled The vegetative community at the Site is ' dominated by upland tree species such as apple (Malus spp.), white oak(Quercus alba), black oak(Q. nigra), smooth sumac (Rhus glabra), staghorn sumac (R. typhina), quaking aspen (Populus tremuloides), white ash (Fraxinus americana), sycamore (Platanus occidentalis) and American larch (Larix laricina). ' portion of the lot contains scattered wetland plant species (see below), but does not meet the criteria in the Regulations for any protectable Resource Area. ' Proposed Activities The applicant proposes to develop the site for commercial business. Following the issuance of a Negative Determination of Applicability, Mr. Finocchio plans to market ' the referenced lot as a lot buildable for commercial purposes. Bordering Vegetated Wetlands The Regulations establish a 50% wetland vegetative composition standard as the definition of Bordering Vegetated Wetlands (310 CMR 10.55(2)(c)). Additionally, Bordering Vegetated Wetlands border on creeks,rivers, streams,ponds or lakes. Topography at 230 Highland Avenue includes an area of low relief at the base of the ' slope in the eastern portion of the lot. The eastern edge of this area of low relief is bordered by the parking area adjacent to Salem Sign Company. There are several small areas (less than 100 square feet) where the soil surface is moist, but vegetation does not ' indicate the presence of wetlands. Primary growth in the lowest portion of the property includes staghorn sumac, apple,red maple (Acer rubrum) and American elm(Ulmus americana). However,in no portion of the site do wetland species such as red maple and American elm comprise 50% of the vegetation. There are no bogs, swamps, wet ' meadows or marshes upgradient of this culvert. Therefore,pursuant to the Regulations (310 CMR 10.02), the area of low relief does not meet the definition of a stream. There is no hydraulic or vegetative connection between the area of low relief and the culvert under ' Highland Avenue. Thus, Gulf of Maine Research Center is of the opinion that the Resource Area Bordering Vegetated Wetland is not present on the site. Other Resource Areas According to the 1985 Federal Emergency Management Agency Flood Insurance Rate Map for the City of Salem(Figure 3), the site is above the upper limits of the theoretical 100-year flood elevation. Therefore, the Resource Area Land Subject to ' Coastal Storm Flowage (310 CMR 10.04) does not occur at the site. According to the U.S.G.S. Salem Quadrangle Topographic Map (Figure 1), Site elevations range from 80 to 100 feet N.G.V.D. Based on Site elevations and the GMRC Site inspections, no ' Coastal Wetland Resource Areas are present at the Site. The Regulations define Isolated Land Subject to Flooding (310 CMR 10.57) as an isolated depression or closed basin without an inlet or an outlet...which at least once a ' year confines standing water to a volume of at least 1/4 acre-feet and to an average depth of at least six (6) inches." Topography at the Site does not create any isolated depressions which meet the above criteria. The Resource Area Bordering Land Subject to Flooding (310 CMR 1057(2)(a)) is defined as "an area with low,flat topography adjacent to and inundated be flood waters rising from creeks, rivers, streams,ponds or lakes." There are no areas present at the Site which meet these stated criteria. Therefore, neither Isolated nor Bordering Land Subject to Flooding exists at the Site. ' Site Soils A review of the Soil Conservation Service's Soil Survey of Essex County, Massachusetts (1984; Figure 4),revealed that Site soils are classified as Urban Land ' (UR). These areas are nearly level to moderately steep, and soils are usually obscured by urban works and structures. Soil types near the Site include Ridgebury extremely stony fine sandy loam (RiB) and Chatfield-Hollis-Rock Outcrop complex (CrC), upland soil types that are rated by the Soil Conservation Service as "poor" to "very poor" for their potential for wetland plants and shallow water areas. Because the soils associated with the Site are not typical hydric soils, wetlands are not likely to be present. 1 230 Highland Avenue,Salem,Request for Determination;Page 2 of 3 t ' GULF OF MAINE RESEARCH CENTER INC. ' Buffer Zones The Regulations require the filing of a Notice of Intent for any activity that would affect a protectable Resource Area or its associated 100-foot Buffer Zone. During the Site inspections and map review by Gulf of Maine Research Center, no protectable Resource Areas were identified on any property adjacent to 230 Highland Avenue within 100 feet of the property boundary. Therefore, the proposed activities at 230 Highland ' Avenue will not require the filing of a Notice of Intent due to presence of protectable Resource Areas on adjoining property. Summary and Conclusions Based upon Gulf of Maine Research Center's Site inspections and review of pertinent maps and documents, we are of the belief that no Resource Areas protectable under the Act, Regulations or City Ordinance are present at 230 Highland Avenue. We ' therefore respectfully request that the Salem Conservation Commission issue a Negative Determination of Applicability pursuant to the Regulations (310 CMR 10.05(3)(6)) in reference to this Site.
