(GMRC) hereby requests a Positive Determination of Applicability pursuant to the Massachusetts Wetlands Protection Act (MGL c.131 s.40; "the Act") and Regulations (310 CMR 10.00; "the Regulations )for the property at 224 Highland Avenue, Salem, Massachusetts ("the Site", ' Figure 1). This Determination is sought as a confirmation of the boundary of a Bordering Vegetated Wetland identified on the property by Gulf of Maine Research Center scientists. ' Site Location and Description The Site is located at the intersection of Highland Avenue and Glenn Avenue in Salem, Massachusetts, and consists of 1.61 acres of commercial property. The enclosed plan, entitled 'Plan of Land prepared for: JAM Realty Trust; Reid Land Surveyors; December 28, 1993" depicts current Site conditions and topography. The only structure ' on the lot is a concrete block building in the southern comer that is currently occupied by the Salem Sign Company. Glenn Avenue, which borders the property to the south, has not been completed to its intersection with Highland Avenue, and currently exists only as ' a right-of way (Figure 2). The property is bordered to the southwest by vacant land, to the northwest by vacant and residential properties, and to the southeast by a commercial lot containing the Sunburst Fruit Juices building. Gulf of Maine Research Center scientists have made several inspections of the Site at the request of Mr. Finocchio. The purpose of these Site visits was to assess the presence of Resource Areas,pursuant to the Act and Regulations. The Salem Sign building is situated at approximately the same elevation as ' Highland Avenue. There is a moderate drop in elevation behind the building, beyond which most of the property is relatively flat. In the western corer of the property, topography slopes steeply upward to a residential area. An area of low relief is located ' along the boundary between the subject property and the Sunburst building. The portion of the property surrounding the Salem Sign building is cleared and consists of a driveway and parking area. Proposed Activities ' The applicant plans to improve the portion of the property adjacent to Highland Avenue. These improvements may include minor grading,paving, and structural alterations to the existing building. However, the applicant wishes to work only in portions of the property that are outside of protectable Resource Areas and Buffer Zones. ' Thus, the final design of the proposed improvements will depend on the issuance of a Determination of Applicability. ' Site Resource Areas Gulf of Maine Research Center scientists inspected the Site and reviewed ' pertinent maps and plans to determine if any protected Resource Areas were present. The Site visit included inspection of the Site plant community, topography, and proximity to known water bodies and wetlands. The protectable Resource Areas Bordering Vegetated Wetland (310 CMR 10.55) was identified at the Site. ' Bordering Vegetated Wetland ' The Regulations establish a 50% wetland vegetative composition standard as the definition of Bordering Vegetated Wetlands (310 CMR 10.55). Areas composed of greater than 50% wetland vegetation must border on a creek,river, stream,pond or lake to be considered Bordering Vegetated Wetlands. There is an area of low topography in ' the northern corner of the property in which the plant community is composed of greater than 50% wetland species. This low lying area borders on an intermittent stream on the Sunburst Juices property, and thus meets the regulatory definition of a Bordering ' Vegetated Wetland. The boundary of this area was delineated by Gulf of Maine Research Center using surveyor's flagging. This boundary is shown on the enclosed plans. Wetland vegetation in the Bordering Vegetated Wetland is dominated by common ' buckthorn (Rhamnus cathartica),highbush blueberry (Vaccinium corymbosum) and northern arrowwood (Viburnum recognition). According to the Regulations (310 CMR 10.04), the Buffer Zone is defined as the area extending 100 feet laterally outward from the boundary of a Bordering Vegetated Wetland. Any activity within the Resource Area or Buffer Zone that could have an adverse impact on the Resource Area requires the filing of a Notice of Intent. No other areas containing greater than 50% wetland plant species were identified ' by Gulf of Maine Research Center. Other Resource Areas ' The Regulations define Isolated Land Subject to Flooding (310 CMR 10.57) as "an isolated depression or closed basin without an inlet or an outlet...which at least once a year confines standing water to a volume of at least 1/4 acre-feet and to an average depth of at least six (6) inches." Topography at the Site does not create any isolated depressions which meet the above criteria. Therefore, Isolated Land Subject to Flooding does not occur at the Site. The Resource Area Bordering Land Subject to Flooding (310 CMR 10.57(2)(a)) is defined as "an area with low,flat topography adjacent to and inundated be flood waters rising from creeks,rivers, streams,ponds or lakes." The boundary of this Resource Area is the maximum lateral extent of flooding resulting from the statistical 100-year storm. ' According to the Federal Emergency Management Agency Flood Insurance Rate Map for Salem(Figure 3), no such areas of flooding occur on the Site during the 100-year storm. Therefore, Bordering Land Subject to Flooding does not occur at the Site. ' 224 Highland Avenue,Salem,Request for Determination;Page 2 of 4 GULF OF MAINE RESEARCH CENTER INC. Land Under Water Bodies and Waterways (310 CMR 10.56) is defined as "the land beneath any creek,river, stream pond or lake." The boundary of this Resource Area t is the mean annual low water level. By definition, an intermittent stream does not contain this Resource area because the mean annual low flow level is zero. Therefore, the intermittent stream on the property consists of continuous Inland Bank from one edge to the other, with no Land Under Water Bodies and Waterways separating the stream into ' two Banks. The Regulations also provide definitions and Performance Standards for several Coastal Resource Areas. Based on the Site elevations and the distance of the Site from ' coastal waters, no Coastal Wetland Resource Areas are present at the Site. Site Soils ' A review of the Soil Conservation Services Soil Survey of Essex County, Massachusetts (1984; Figure 4),revealed that Site soils are classified as Urban Land (UR). These areas are nearly level to moderately steep, and soils are usually obscured by ' urban works and structures. Soil types near the Site include Ridgebury extremely stony fine sandy loam (RiB) and Chatfield-Hollis-Rock Outcrop complex (CrC), upland soil types that are rated by the Soil Conservation Service as "poor" to 'very poor" for their ' potential for wetland plants and shallow water areas. Because the soils associated with the Site are not typical hydric soils, wetlands are not likely to be present in these areas. The Soils map also indicates the presence of an area of Freetown Muck, Ponded (Fp) northeast of the property. This soil type is a saturated, highly organic soil that is typically found in wetlands. Based on the small dimensions of the identified wetland, it is likely that it consists of an area of Freetown Muck that was too small to be mapped separately at the scale of the soils map. There were no indications from the soil map of ' the presence of other wetlands at the Site. National Wetland Inventory Map ' The National Wetland Inventory (NWI)is a series of maps produced by the U.S. Fish and Wildlife Service that shows the locations of wetlands based on aerial photography. The maps are based on USGS topographic maps, and also describe wetland types based on accepted USFWS classification criteria (Classification of Wetlands and Deepwater Habitats of the United States;FWSIOBS-79/31; Cowardin et. a11979). The NWI map for the Site and vicinity (Figure 5) indicates the presence of a large emergent ' marsh to the north and east of the property. However, the map does not indicate the presence of wetlands at the Site. The location of this marsh is consistent with the Freetown Muck soil type identified in the soil survey map. It is likely that the Bordering . ' Vegetated Wetland identified by Gulf of Maine Research Center is a small extension of this wetland system that is too small to be indicated at the topographic map scale. City of Salem Wetland Maps The wetland maps of the City of Salem (1979; Figure 6) indicate the presence of wetlands in the rear of the property. The wetland indicated is a narrow corridor that ' passes through the rear portion of the property. Gulf of Maine Research Center scientists thoroughly inspected this area, and identified no areas that contained greater than 50% wetland vegetation. Thus, the area indicated on the City wetland map does not correspond to an area subject to protection under the Act and Regulations. 1 ' 224 Highland Avenue,Salem,Request for Determination;Page 3 of 4 GULF OF MAINE RESEARCH CENTER INC. ' Summary and Conclusions ' The Site inspection by Gulf of Maine Research Center scientists revealed the presence of protected Bordering Vegetated Wetland on the subject property. In addition, this area is surrounded by a 100-foot Buffer Zone. No additional areas of wetland vegetation or land subject to flooding were identified. We respectfully request that the ' Salem Conservation Commission issue a Positive Determination of Applicability, indicating that the boundary of the Bordering Vegetated Wetland as shown on the accompanying Site Plan is accurate. A low-lying area in the northern comer of the property borders on an intermittent stream and contains a plant community with greater than 50%wetland plant species. This area meets the regulatory criteria for a Bordering Vegetated Welland. The intermittent stream also contains the Resource Area Inland Bank. The applicant plans to grade and pave a portion of the uplands on the property. Final design of the 1 Site improvements will depend on the boundaries of Resource Areas. Site Location and Description ' The Site is located at the intersection of Highland Avenue and Glenn Avenue in Salem,Massachusetts, and consists of 1.61 acres of commercial property. The enclosed plan,entitled 'Plan of Land prepared for: JAM Realty Trust; Reid Land Surveyors; December 28, 1993" depicts current Site conditions and topography. The only structure on the lot is a concrete block building in the southern corner that is currently occupied by the Salem Sign Company. Glenn Avenue, which borders the property to the south, has ' not been completed to its intersection with Highland Avenue, and currently exists only as a right-of way (Figure 2). The property is bordered to the southwest by vacant land,to the northwest by vacant and residential properties, and to the southeast by a commercial ' lot containing the Sunburst Fruit Juices building. Gulf of Maine Research Center scientists have made several inspections of the Site at the request of Mr. Finocchio. The purpose of these Site visits was to assess the presence of Resource Areas,pursuant to the Act and Regulations. The Salem Sign building is situated at approximately the same elevation as Highland Avenue. There is a moderate drop in elevation behind the building, beyond which most of the property is relatively flat. In the western corner of the property, ' topography slopes steeply upward to a residential area. An area of low relief is located along the boundary between the subject property and the Sunburst building. The portion of the property surrounding the Salem Sign building is cleared and consists of a driveway ' and parking area. It appears that the property has been historically filled. Proposed Activities I ' The applicant.plans to improve the portion of the property adjacent to Highland Avenue. These improvements may include minor grading,paving,and structural alterations to the existing building. However,the applicant wishes to work only in ' portions of the property that are outside of protectable Resource Areas and Buffer Zones. Thus, the final design of the proposed improvements will depend on the issuance of a Determination of Applicability. ' Site Resource Areas ' Gulf of Maine Research Center scientists inspected the Site and reviewed pertinent maps and plans to determine if any protected Resource Areas were present. The Site visit included inspection of the Site plant community, topography, and proximity to known water bodies and wetlands. The protectable Resource Areas Bordering Vegetated ' Wetland(310 CMR 1055) was identified at the Site. Bordering Vegetated Wetland t The Regulations establish a 50% wetland vegetative composition standard as the definition of Bordering Vegetated Wetlands(310 CMR 1055). Areas composed of greater than 50% wetland vegetation must border on a creek,river, stream,pond or lake to be considered Bordering Vegetated Wetlands. There is an area of low topography in the northern corner of the property in which the plant community is composed of greater than 50% wetland species. This low lying area borders on an intermittent stream on the II ' Sunburst Juices property,and thus meets the regulatory definition of a Bordering Vegetated Wetland. The boundary of this area was delineated by Gulf of Maine Research Center using surveyor's flagging. This boundary is shown on the enclosed plans. ' Wetland vegetation in the Bordering Vegetated Wetland is dominated by common buckthorn (Rhamnus cathartica),highbush blueberry (Vaccinum corymbosum) and northern arrowwood(Viburnum recognitwn). According to the Regulations (310 CMR 10.04),the Buffer Zone is defined as the area extending 100 feet laterally outward from ' the boundary of a Bordering Vegetated Wetland. Any activity within the Resource Area or Buffer Zone that could have an adverse impact on the Resource Area requires the filing of a Notice of Intent. ' No other areas containing greater than 50% wetland plant species were identified by Gulf of Maine Research Center. Other Resource Areas The Regulations define Isolated Land Subject to Flooding (310 CMR 1057)as an isolated depression or closed basin without an inlet or an outlet...which at least once a ' year confines standing water to a volume of at least 1/4 acre-feet and to an average depth of at least six (6) inches." Topography at the Site does not create any isolated depressions which meet the above criteria. Therefore,Isolated Land Subject to Flooding does not ' occur at the Site. The Resource Area Bordering Land Subject to Flooding (310 CMR 1057(2)(a)) is defined as an area with low,flat topography adjacent to and inundated be flood waters rising from creeks,rivers, streams,ponds or lakes." The boundary of this Resource Area is the maximum lateral extent of flooding resulting from the statistical 100-year storm. According to the Federal Emergency Management Agency Flood Insurance Rate Map for Salem(Figure 3), no such areas of flooding occur on the Site during the 100-year storm. Therefore, Bordering Land Subject to Flooding does not occur at the Site. ' 224 Highland Avenue,Salem,Request for Determination;Page 2 of 4 1 ' GULF OF MAINE RESEARCH CENTER INC. Land Under Water Bodies and Waterways (310 CMR 1056)is defined as "the ' land beneath any creek,river, stream pond or lake." The boundary of this Resource Area is the mean annual low water level. By definition, an intermittent stream does not contain this Resource area because the mean annual low flow level is zero. Therefore,the intermittent stream on the property consists of continuous Inland Bank from one edge to ' the other,with no Land Under Water Bodies and Waterways separating the stream into two Banks. The Regulations also provide definitions and Performance Standards for several ' Coastal Resource Areas. Based on the Site elevations and the distance of the Site from coastal waters,no Coastal Wetland Resource Areas are present at the Site. Site Soils A review of the Soil Conservation Services Soil Survey of Essex County, Massachusetts (1984;Figure 4),revealed that Site soils are classified as Urban Land (UR). These areas are nearly level to moderately steep, and soils are usually obscured by urban works and structures. Soil types near the Site include Ridgebury extremely stony fine sandy loam (RiB) and Chatfield-Hollis-Rock Outcrop complex (CrC), upland soil ' types that are rated by the Soil Conservation Service as"poor" to "very poor' for their potential for wetland plants and shallow water areas. Because the soils associated with the Site are not typical hydric soils,wetlands are not likely to be present in these areas. The Soils map also indicates the presence of an area of Freetown Muck,Ponded ' (Fp) northeast of the property. This soil type is a saturated, highly organic soil that is typically found in wetlands. Based on the small dimensions of the identified wetland,it is likely that it consists of an area of Freetown Muck that was too small to be mapped separately at the scale of the soils map. There were no indications from the soil map of the presence of other wetlands at the Site. National Wetland Inventory Map The National Wetland Inventory (NWI)is a series of maps produced by the U.S. Fish and Wildlife Service that shows the locations of wetlands based on aerial ' photography. The maps are based on USGS topographic maps, and also describe wetland types based on accepted USFWS classification criteria(Classification of Wetlands and Deepwater Habitats of the United States;FWSIOBS-79/31; Cowardin et. al 1979). The ' NWI map for the Site and vicinity (Figure 5) indicates the presence of a large emergent marsh to the north and east of the property. However,the map does not indicate the presence of wetlands at the Site. The location of this marsh is consistent with the Freetown Muck soil type identified in the soil survey map. It is likely that the Bordering ' Vegetated Wetland identified by Gulf of Maine Research Center is a small extension of this wetland system that is too small to be indicated at the topographic map scale. ' City of Salem Wetland Maps The wetland maps of the City of Salem(1979;Figure 6)indicate the presence of wetlands in the rear of the property. The wetland indicated is a narrow corridor that passes through the rear portion of the property. Gulf of Maine Research Center scientists thoroughly inspected this area, and identified no areas that contained greater than 50% wetland vegetation. Thus,the area indicated on the City wetland map does not correspond to an area subject to protection under the Act and Regulations. Summary and Conclusions ' The Site inspection by Gulf of Maine Research Center scientists revealed the presence of protected Bordering Vegetated Wetland on the subject property. In addition, this area is surrounded by a 100-foot Buffer Zone. No additional areas of wetland ' vegetation or land subject to flooding were identified.
