Project Description (if applicable):
Construction of an above ground building addition on the southeasterly side of the existing hospital
building. The extent of work at ground level will be construction of concrete columns to support the
addition one story up. All work is within existing lawn or bituminous parking area and is approximately 89
feet from the adjacent wetlands. An existing bituminous parking lot, curbing and a well vegetated slope lie
between the wetlands proposed addition footprint

at the owner's risk only upon notice to the Department and to the Conservation Commission.

D. Appeals
The applicant, owner, any person aggrieved by this Determination, any owner of land abutting the
land upon which the proposed work is to be done, or any ten residents of the city or town in which
such land is located, are hereby notified of their right to request the appropriate Department of
Environmental Protection Regional Office (see Appendix A) to issue a Superseding Determination of
Applicability. The request must be made by certified mail or hand delivery to the Department, with the
appropriate filing fee and Fee Transmittal Form (see Appendix E: Request for Departmental Action
Fee Transmittal Form) as provided in 310 CMR 10.03(7)within ten business days from the date of
issuance of this Determination. A copy of the request shall at the same time be sent by certified mail
or hand delivery to the Conservation Commission and to the applicant if he/she is not the appellant.
The request shall state clearly and concisely the objections to the Determination which is being
appealed. To the extent that the Determination is based on a municipal ordinance or bylaw and not
on the Massachusetts Wetlands Protection Act or regulations, the Department of Environmental
Protection has no appellate jurisdiction.

D. Appeals
The applicant, owner, any person aggrieved by this Determination, any owner of land abutting the
land upon which the proposed work is to be done, or any ten residents of the city or town in which
such land is located, are hereby notified of their right to request the appropriate Department of
Environmental Protection Regional Office (see Appendix A) to issue a Superseding Determination of
Applicability. The request must be made by certified mail or hand delivery to the Department, with the
appropriate filing fee and Fee Transmittal Form (see Appendix E: Request for Departmental Action
Fee Transmittal Form) as provided in 310 CMR 10.03(7)within ten business days from the date of
issuance of this Determination. A copy of the request shall at the same time be sent by certified mail
or hand delivery to the Conservation Commission and to the applicant if he/she is not the appellant.
The request shall state clearly and concisely the objections to the Determination which is being

On behalf of the applicant, Wetlands&Land Management Inc.is submitting this Request
for Determination of Applicability for construction of a new cardiac care building
addition at the North Shore Medical Center—Salem Hospital. A small portion of this
building addition will extend into buffer zone to bordering vegetated wetland. The
addition however is actually attached to the building at the fourth and fifth floors, which
owing to the topography at the rear of the building is a minimum of one story off the
ground, but for the majority of the addition is two or more stories above the ground. The
extent of ground level work will be construction of columns to support the addition.
Additionally, all the work "footprint' is within paved or grassed areas around the existing
building and the work area is separated from the adjacent wetlands by an existing
bituminous parking lot complete with curbing and a thickly vegetated slope between the
parking lot and the wetlands. The separation distance from the building footprint to the
wetlands is approximately 91 feet.
Given the small impact at the ground level and the separation between the work and the
adjacent wetlands, we request the Commission issue a negative determination of
applicability, acknowledging the work is within Conservation Commission jurisdiction,
but can proceed as designed with little likelihood of impact to adjacent wetland areas.

Proposed Work
Discussion of Proposed Conditions and Wetland Resource Areas
Introduction
The site of the proposed work is located at 81 Highland Avenue, the North Shore Medical
Center—Salem Hospital. The site is developed with the existing hospital, extensive
parking areas and circulatory roads, utilities and landscaping. This application is for
construction of a new cardiac care building addition on the southerly side of the existing
building. A small portion of the "footprint' of the building addition is within the 100-
foot buffer zone,however, the building addition is actually off the ground and the extent
of ground level construction is concrete columns to support the building addition.
Approximately 240 square feet of the addition footprint is with buffer zone.
The applicant is seeking a negative determination of applicability, acknowledging that a
portion of the work is within 100 feet of the adjacent wetlands, but given the large
separation between the building and the wetlands, the work can be completed without
impact to the wetland resource areas. The extent of the building is approximately 91 feet
from the limit of wetlands, with an existing bituminous parking lot between the building
addition and the wetlands.
Wetdand Resource Areas
Wetland resource areas affecting the project were delineated on the ground by Wetlands
&Land Management, Inc. in December 2001. Wetlands on the site were evaluated using
delineation methodology established in the Wetlands Protection Act and the Department
of Environmental Protection"Delineating Bordering Vegetated Wetlands Handbook"
dated 1995, and the US Army Corps of Engineers Manual(1987). These regulations and
methodology incorporate the evaluation of hydric soils,predominance of wetland
vegetation and wetland hydrology to evaluate the upper limit of vegetated wetlands.
Blue surveyors flagging numbered Al to A16 delineate bordering vegetated wetlands
closest to the project. More wetlands exist on the hospital property, but they are more
than 100 feet from the work area.

Most of the wetland boundary is controlled by the thickly vegetated steep slope of the
existing parking lot leaving little room for interpretation of the wetland boundary. There
will be no alteration of the existing vegetated slope separating the wetlands from the
lower parking lot.
A 100-foot buffer zone extends from the limit of vegetated wetland.
Rare Species
According to the 2000-2001 edition of the Massachusetts Natural Heritage Atlas of
Estimated Habitats of Rare Wetlands Wildlife and Certified Vernal Pools, no estimated
habitat of rare wetlands wildlife or certified vernal pools are shown to exist on or near the
subject parcel.
Vegetative Cover at the Project Site
The entire work area is either grass area or bituminous parking lots/circulatory road
around the work area. There will be no loss of indigenous vegetation because of this
construction work
Discussion of Proposed Work
The proposed project involves the construction of a building addition to house the new
cardiac care building. The building addition attaches to the fourth and fifth floors of the
southerly side of the existing hospital. This configuration results in the building being
above ground by a minimum of one story in the area of the existing hospital loading
dock,and would be several stories in the air at the extreme southeast corner of the
proposed addition.
The ground level work will consist of installing concrete columns to support the addition.
Excavation for the columns will be minimal. At this time, we anticipate only one column
will be in buffer zone. All the remaining columns are out of buffer zone though three
columns fall on the steep grass slope between the upper loading area and the lower
parking lot.
Soils excavated for footings or columns will be stockpiled adjacent to the excavation as
possible, or temporarily stockpiles on a level area as close to the excavation as possible.
Stockpile areas will be protected by bay bales or silt fence. Once the footings and
columns are constructed,the excavations will be backfilled and restored to the original
grade. Any excess material will be either graded on site outside the buffer zone or taken
of site.
Sections of existing water and drainage lines will be re-routed where they conflict with
proposed pile locations,however these areas are outside the buffer zone.

An existing bituminous parking lot separates the work from the adjacent wetlands. This
parking lot will be used for construction staging, storage of heavy supplies such as steel,
job storage trailers and the lice. One existing catch basin within this lower lot will be
protected by installing hay bales around the inlet of the basin. An existing row of
siltation barrier consisting of hay bales and silt fence located at the edge of the lower
parking lot should be preserved throughout the project.
Following construction,this staging area will be restored to the original condition and
retuned to use as a parking lot.
A negative determination#3 is appropriate given the limited ground level disturbance
within the buffer zone. The Commission may wish to add additional conditions to control
the proposed activity. Suggested conditions are:
• The catch basin in the lower parking lot is to be protected by hay bales during the
length of construction.
• All disturbed areas should be landscaped or loamed and seeded following
construction.
• No hazardous material storage should be permitted in the lower parking lot.
• The existing silt fence currently installed on the south and east side of the lower
parking lot is to be maintained for the duration of the project.
