Request Negative Determination regarding cleaning and maintenance
of a created stormwater detention basin
Dear Mr. Devine and Conservation Commission Members:
The applicant and property owner, Salem Hospital is requesting a negative determination
concerning a constructed detention basin on the property. The basin was constructed for
the purpose of stormwater management and should not be characterized as a wetland
resource area. The applicant seeks a formal determination to that effect that there is no
Conservation Commission jurisdiction over the detention basin. The ultimate goal is to
clean the basin of accumulated sediment and overgrown vegetation so that the basin
functions as it was originally intended. This should alleviate a ponding problem in the
adjacent parking lot as well.

Site Conditions and Use
The property collectively known as North Shore Medical Center—Salem Hospital is
developed with the hospital building including the adjacent medical offices at 55
Highland Avenue, associated circulatory roads and parking. Specifically, the area at 55
Highland Avenue is developed with medical offices formerly known as Highland Hall, an
entrance road off Highland Avenue and paved parking.
A stormwater detention basin is located at the lower end of the site adjacent to Highland
Avenue and Powder House Lane. Aerial photos dating back to 1995 show this basin and
the surrounding area on site have remained relatively unchanged. The basin was
constructed prior to 1995.
Overland stormwater flow enters the basin either by shedding off the parking lots at
various locations or entering the basin via a created swale between the parking lot
entrance and another section of paved parking.
Description of the Detention Basin
The detention basin is an excavated basin with moderately steep sides rising to the
elevation of the adjacent parking lots and the street. The limits of the basin are easily .
defined in the field owing to the steep transition between the basin side slopes and the
adjacent land.
The upper end of the basin is a constructed swale that collects surface water off the
adjacent parking lots. Presently,this swale is choked with a thick stand of an alien and
invasive plant—phragmites, or the common reed.
The bottom of the interior of the basin is choked with cattail, purple loosestrife,
phragmites,jewelweed and other opportunistic plants.
There is a steel grate catch basin outlet structure on the downstream end of the basin, near
the intersection of Highland Avenue and Powder House Lane. The basin appears to be a
catch basin with sump and a PVC outlet tee although the basin is full of sediment directly
to the top of this structure,thus short circuiting any intended function of additional
sediment collection. From here, stormwater flows out of the basin and is directed to the
municipal drainage system in Highland Avenue.
The basin obviously receives sediment washed off the adjacent lots. The bottom of the
interior of the basin is an irregular surface owing to the accumulation of sand and dirt
washed from the parking lots—no doubt as a result of winter sanding operations. It
appears that accumulated sediment will collect in a particular location, which then will
force the flow of incoming stormwater in a different direction where the process begins
again. a
Presently,the basin on the subject property is overgrown with vegetation from lack of
maintenance. The side slopes of the basin are moderately vegetated with opportunistic
shrubs which are encroaching on the basin.
Detention basins are designed to accept stormwater during storm events and release the
stormwater at a controlled rate. The basin stores excess stormwater during storm events
and then typically empties after each storm event. When basins are neglected, the storage
capacity is compromised and overtopping may occur. This is happening within the
adjacent parking lots where water ponds in the adjunct lots and creates mud, flooding and
icing hazards.
No Connection to any Resource Area
The land surrounding the basin is developed with commercial uses including other office
buildings, Highland Avenue, school building and athletic field
In the field, you can walk around the entire basin perimeter to verify there are no surface
connections to other wetlands up gradient, nor are there any pipes entering this detention
basin from any up gradient wetlands.
Using Google Earth,which has a cache of historical photos;photos dating back to 1995
show the basin and the surrounding area have not changed. In certain photos, one can
easily see the distinct, angular bends at angle points of the basin and straight, linear edges
along the parking lots suggesting this is certainly a created basin and not a natural feature.
I have attached historical Google Earth photos dating from 2008, 2005, 2001 and 1995 to
illustrate the presence of the basin since that time.

Summary and Conclusion Seeking a Negative Determination
The detention basin at 55 Highland Avenue is a drainage feature and not a wetland
resource area. The basin was constructed well before 1995 and can be clearly identified
as a detention basin on historic aerial photos.
There is no connection either via overland flow or pipe from any wetland areas on
abutting lands.
The basin has not been maintained for many years and accordingly has become vegetated
with common invasive or opportunistic plants. The plants are only present because of the
lack of maintenance on this basin and are not indicative of a natural condition. Based on
the foregoing and from on-site evaluation, it is apparent this basin is a stormwater
management BMP and is not a wetland resource area under State or Local jurisdiction.
The applicant is seeking a negative determination to formalize there is no Conservation
Commission authority over this detention basin. A Negative Determination#1 and 46 is
appropriate to formalize that the detention basin is not an area subject to jurisdiction
under the Wetlands Protection Act or the Salem Wetlands by-law and that subsequent
cleaning and maintenance can occur.

Note: No further action under the Wetlands Protection Act is required by the applicant. However, if the
Department is requested to issue a Superseding Determination of Applicability, work may not proceed
on this project unless the Department fails to act on such request within 35 days of the date the
request is post-marked for certified mail or hand delivered to the Department. Work may then proceed
at the owner's risk only upon notice to the Department and to the Conservation Commission.
Requirements for requests for Superseding Determinations are listed at the end of this document.

D. Appeals
The applicant, owner, any person aggrieved by this Determination, any owner of land abutting the land
upon which the proposed work is to be done, or any ten residents of the city or town in which such land is
located, are hereby notified of their right to request the appropriate Department of Environmental
Protection Regional Office (see httg•//www mass aov/eea/agencies/massdep/about/contacts/find the
massdeo-reoional-office-for-your-city-or-town html) to issue a Superseding Determination of Applicability.
The request must be made by certified mail or hand delivery to the Department, with the appropriate filing
fee and Fee Transmittal Form (see Request for Departmental Action Fee Transmittal Form) as provided in
310 CMR 10.03(7) within ten business days from the date of issuance of this Determination. A copy of the
request shall at the same time be sent by certified mail or hand delivery to the Conservation Commission
and to the applicant if he/she is not the appellant. The request shall state clearly and concisely the
objections to the Determination which is being appealed. To the extent that the Determination is based on
a municipal ordinance or bylaw and not on the Massachusetts Wetlands Protection Act or regulations, the
Department of Environmental Protection has no appellate jurisdiction.
