Therefore, the Commission hereby finds that the following conditions
are necessary, in accordance with the Performance standards s� ossh .An the
regulations, to protect those interests checked above. The

orders that all work shall be performed in accordance with said conditions and
with the Notice of Intent referenced above. To the extent that the following
conditions modify or differ from the plans, specifications or other proposals
submitted with the Notice of Intent, the conditions shall control.
General Conditions
1. Failure to comply with all conditions stated herein, and with all related
statutes and other regulatory measures, shall be deemed cause to revoke
or modify this order.
2. The order does not grant any property rights or any exclusive privileges;
it does not authorize any injury to private property or invasion of
private rights.
3. This order does not relieve the permittee or any other person of the
necessity of complying
with all other applicable federal, state or local
statutes, ordinances,-by-laws or regulations.
4. The work authorized hereunder shall be completed within three years from
the date of this order unless either of the following apply:
(a) the work is a maintenance dredging project as provided for in the
Act; or
(b) the time for completion has been. extended to a specified date more
than three years, but less than five years, from the date of issuance
and both that date and the special circumstances warranting the
extended time period are set forth in this Order.
5. This order may be extended by the issuing authority for one or more
periods of up to three years each upon application to the issuing
authority at least 30 days prior to the expiration date of the order.
6. Any fill used in-connection with-this project shall be clean fill,
containing no trash, refuse, rubbish or debris, including but not limited
to lumber, bricks,. plaster, wire, lath, paper, cardboard, pipe, tires,
ashes, refrigerators, motor vehicles or parts of any of the foregoing.
7. No work shall be undertaken until all administrative appeal periods from
this order have elapsed or, if such an appeal has been filed, until all
proceedings before the Department have been completed.
8. No work shall be undertaken until the Final order has been recorded
in the Registry of Deeds or the Land Court for the district in which
the land is located, within the chain of title of the affected
property. In the case of recorded land, the Final order shall also
be noted in the Registry's Grantor Index under the name of the owner
of the land upon which the proposed work is to. be done. in the case
of registered land, the Final order shall also be noted on the Land
Court Certificate of Title of the owner of the land upon which the
proposed work is to be done. The recording informatin shall be
submitted to the Commission on the, form at the end of this Order
prior to commencement of the work.
9. A sign shall be displayed at the site not less than two square feet or
more than three square feet in size bearing the words,

10. where the Department of Environmental Protection is requested to make a
determination and to issue a superseding order, the Conservation
Commission shall be a party to all agency proceedings and hearings before
the Department.

1 . All work shall conform to the above-referenced Notice of Intent (NO1), site
plan and supporting documents and those final specifications which shall be
filed with the Commission prior to construction. Any change made or
intended to be made to the approved plans shall require the applicant to
inquire of the Commission in writing whether the change is substantial
enough to require the filing of a new Notice Of Intent (NOI).
2. Members and agents of the Commission shall have the right to enter and
inspect the premises at all reasonable times to evaluate compliance with the
conditions in this Order. The Commission may require the applicant to
submit additional data or information necessary for the Commission to
conduct that evaluation.
3. Upon completion of the project, the applicant shall submit, with the request
for a Certification of Compliance, an affidavit, prepared by a professional
engineer or land surveyor registered in the Commonwealth of Massachusetts,
stating that the site has been developed, in accordance with the
requirements of this Order of Conditions, the referenced site plan and
supporting documents.
4. This Order shall apply to every successor in control or successor in interest
of the property described in the Notice of Intent and accompanying plans or
part thereof. In the event this land or any part thereof changes ownership
before or during construction, the current owner shall notify the new owner,
by registered mail, of this Order prior to the transfer of ownership and shall
forward proof of this notification to the Commission.
5. Prior to commencement of construction activity, a haybale barrier and
siltation fence shall be placed down gradient of construction to prevent
siltation to the adjacent wetland. Haybales and siltation fence shall be
anchored with stakes and entrenched 4 to 6 inches in depth. Trench
material shall be deposited on the up gradient side of the haybale barrier.
Haybales and siltation fence shall be inspected daily; those showing signs of
deterioration shall be replaced immediately. The haybale barrier and siltation
fence shall remain in proper functioning condition until all disturbed areas
have been stabilized.
6. During construction, no debris, fill, or excavated material shall be stockpiled
within 100 feet of designated wetlands. Any other stockpile location will be
protected sufficient to prevent sediment from surface runoff entering
wetlands.

7. * No spill or discharge of petroleum products or other pollutants will occur
within 100 feet of any wetland resource area.
8. Notice shall be given to this Commission no more than 2 weeks nor less than
2 days prior to the commencement of construction activities. Said notice
shall include, in writing, the name(s), address(es), and business and home
telephone numbers of the project supervisor(s) responsible for insuring that
operations are conducted in compliance with this Order.
9. * Minimal pruning and no removal of any buffer zone or wetland vegetation
will occur down gradient of the staked haybale line.
10. Construction Specifications to include some form of covering of materials
during heavy rainfall.
11 . Applicant shall keep the driveway and adjacent road clean during removal of
materials and provide street sweeping as necessary.

Compliance.

1.0 Introduction
• 1.1 Site Background
The Peabody Grit and Grease Chamber site (the Site) is owned by the South Essex
Sewerage District (the District). The Site includes 0.47 acres (8,019 sq. ft. in Peabody
and 12,250 sq. ft. in Salem) located on Walnut Street/Harmony Grove Road on the
• Peabody/Salem city line. Refer to Figure 1, for the Site Locus Map which is a portion
of USGS Salem Quadrangle topographic map for the location of the Site. Refer to
Figure 2 for a plan of the Site.
The chamber is an underground concrete structure which is divided into two
• subchambers each with approximate dimensions of 114 feet long by 16 feet wide.
The depth of the subchambers is approximately 19.5 feet with sloping sidewalls at
the bottom five feet of the chamber. Prior to the construction of the District's
sewerage treatment plant in the 1970s, the chamber was used to separate grease and
grit from the sewerage flow. Once the treatment plant began operations, the
• chamber was disconnected from the sewer system. Incinerator ash that was
generated at the District's sewage treatment plant in Salem, Massachusetts and was
transported to the chamber during the late 1970s. The ash contains high levels of
chromium and was stored in the chamber under the supervision of the
Massachusetts Department of Environmental Quality Engineering. Refer to Figure
3 for detailed drawings of the chamber.
•
The District plans to remove and dispose of the ash and interstitial pore water as a
waste in accordance with EPA Resource Conservation and Recovery Act (RCRA)
regulations. All applicable local, State, and federal regulations will be complied
with, including but not limited to the Massachusetts Wetlands Protection Act.
•
The portion of the Site to be impacted by the proposed ash removal project falls
within the 100-foot buffer zone of the North River Canal bank. In addition, the
project work area is located within the 100-year floodplain of the canal as depicted
on the Peabody and Salem National Flood Insurance Program Maps. Therefore, the
• project work area is located in an area designated as a "Bordering Land Subject to
Flooding" (310 CMR 10.57) by the Massachusetts Wetlands Protection Act.
Approximately 9,600 square feet of the project area falls within the 100-foot buffer
zone. The scale of the flood insurance map prevents an accurate determination of
the project area located within the floodplain.
•
Accordingly, on behalf of the South Essex Sewerage District, ATC Environmental,
Inc. (ATC) has prepared a Notice of Intent for submission to the Cities of Peabody
and Salem Conservation Commissions and the DEP. This document serves to
provide the Site descriptive information required in 310 CMR 10.99, Part II.
•

•
1.2 Regulatory Compliance
• The Massachusetts Department of Environmental Protection (DEP) placed the Site
on the Transition List in April 1988. The Site was listed as a Location to be
Investigated (LTBI) under the name Grit and Grease Chamber, and assigned site
number 3-1703. In August 1995, a Class B-1 Response Action Outcome Statement
• was prepared and submitted to the DEP for the Site.
The Massachusetts Contingency Plan (MCP) regulates the response of responsible
parties to releases or threats of releases of oil or hazardous material to the
environment. Other Massachusetts regulations, found principally in 310 CMR
30.0000 regulate the handling and disposal of hazardous wastes, and are based upon
• RCRA which regulates both hazardous and non-hazardous waste treatment, storage,
and disposal. The waste stored in the grit chamber at the Site has been determined
by the DEP to be a "characteristic" (toxic, as defined by the toxicity characteristics
leaching procedure [TCLP] test) hazardous waste under Massachusetts and RCRA
regulations tiue to it's chromium content. Based on the threat of release of
• hazardous substances to the environment from the chamber, the DEP listed the Site
as a LTBI.
Federal EPA regulations, specifically Land Disposal Regulations (LDR; 40 CFR 268)
prohibit the land disposal of hazardous waste which has not been treated in
• accordance with standards defined in Part 268.40 through 268.43. In the case of the
Peabody Grit and Grease Chamber ash, the 1 LTRs require the removal, treatment,
and disposal of the ash.
As more particularly described in Section 4.0 below, the District plans to remove the
• ash from the chamber and have it treated and disposed of at appropriate facilities.
The chamber itself will then be decontaminated, filled with clean backfill and the
disturbed surface area will be seeded.

2.0 Natural Features
2.1 Soils
The Site is underlain by two layers of sand directly beneath the ground surface. Soil
borings completed on the Site by Metcalf & Eddy in 1945, Camp Dresser & McKee in
• 1993, and ATC Environmental, Inc. in 1995 indicated that a 7 to 10-foot thick layer of
brown fine grained sand and silt overlies a gray fine to medium grained sand with
little silt. Leather scraps were encountered in the lower layer during the Metcalf &
Eddy investigation.
• 2.2 Vegetation
The portion of the Site within the buffer to be impacted by the project is vegetated
with brush and occasional trees.
• 2.3 Tonogr,�, aphv
As depicted on Figure 1 and 2, the ground surface at the Site is relatively flat with a
gentle slope toward the embankment of the North River Canal. Refer to Figure 2
for site topography. The Site elevation is between 9 feet above mean sea level at the
• bank of the North River Canal and 12 feet above mean sea level in the central
portion of the Site. Surface water runoff from the Site appears to drain toward the
municipal storm sewer that runs along the street and toward the North River
Canal.
2.4 Open Water Bodies
•
No open water bodies are located at or within 0.5 miles of the Site.
2.5 Flowing Water Bodies
• The North River Canal is located immediately adjacent to the southern Site
property boundary. The canal is a sand/gravel/muck bottomed stream which flows
east into the North River. The North River empties into Beverly Harbor in Salem,
Massachusetts. The canal has steep vegetated banks approximately 3 to 5 foot high
and meanders slightly.

2.6 Water Supplies
There are no documented public or private surface water or groundwater supplies
located on or within 100 feet of the Site.

2.7 Groundwater Elevations
•
The highest groundwater elevation was determined by Camp Dresser & McKee on
January 5, 1994. Groundwater elevations were recorded to be from 7.27 feet above
mean sea level in SB/MW-1 to 2.86 feet above mean sea level in SB/MW-4. Refer
to Figure 2 for monitoring well locations. Depths to groundwater ranged from 7.22
• feet in SB/MW-2 to 4.15 feet in SB/MW-3. The following table presents the
groundwater elevation and depth data.

2.8 Resource Areas
• No Estimated Habitat of State-Listed Rare Wetland Wildlife were identified on the
May 26, 1994 Priority Resource Map for the Salem US Geological Suivey 7.5 Minute
Series Quadrangle. Since the Site is completely fenced and has been altered by
construction of a building, an underground concrete chamber, underground
utilities, and pavement, it is not expected to be an important wildlife habitat
• pursuant to 310 CMR 10.57(1)(a)(3).

3.0 Man-Made Features
•
3.1 Structures
Figure 2 depicts the structures located on the Site. These include the ash-filled grit
and grease chamber and the Service Bay Building. Before its use as an ash
• repository, the chamber was utilized as a sewage treatment system for grit and grease
removal. Previously, the chamber was housed within a building which was
destroyed by a fire in 1972. Currently, the Service Bay Building houses active
wastewater monitoring equipment. The site is surrounded by chain-link fencing
with locked gates.
•
3.2 Drainage and Flood Control Facilities
No flood control facilities are located on the Site. In addition, no flood control
structures such as floodgates are located immediately adjacent to the Site.
• Stormwater catch basins are located along Harmony Grove Road/Walnut Street
adjacent to the Site.
3.3 Subsurface Sewage Disposal Systems
• No subsurface sewage disposal systems are located on the Site or immediately
adjacent to the Site.
3.4 Underground Utilities
• Figure 2 depicts the underground utilities located on and in the immediate vicinity
of the Site. A 52-inch circular sanitary sewer is located in the approximate middle
and along the center of Harmony Grove Road. A 54-inch sanitary sewer
perpendicular to the 52-inch sewer runs to the head of the grit chamber and into the
chamber. A 48-inch pipe at the other end of the chamber was designed to collect
• wastewater treated in the chamber and convey it back to the 52-inch sanitary sewer
in Harmony Grove Road. When the chamber was taken out of service, a 36-inch
pipe was installed to convey sewage directly from the chamber inlet pipe to the
outlet pipe. Currently, the Site's function is to record flow with monitoring
equipment which is located in the Service Bay Bui'_ding. A headwall is located
along the north bank of the canal at the southern property line. The headwall, now
• abandoned, formerly received overflow from the grit and grease chamber.
A 12-inch storm drain is located adjacent to and parallel to the 52-inch sanitary
sewer in Harmony Grove Road. A set of catch basins is located on the opposite side
of Harmony Grove Road, north-northwest of the chamber. The catch basins drain
• into a 12-inch storm drain. The discharge point of the storm drain system is not on
or immediately adjacent to the Site.

0 A 10-inch water main is located in Walnut Street. A water service to the Service
Bay Building enters the Site from Walnut Street. There is no water service on
Harmony Grove Road in Salem.
There is no natural gas service on Walnut Street and Harmony Grove Road at the
0 Site. A natural gas line on Walnut Street ends at Howley Street approximately 150
feet northwest of the Site.
Overhead pole mounted electrical wires and telephone service run along Harmony
Grove Road and Walnut Street. The Service Bay Building is operated by an
0 electrical overhead service.
3.5 Roadways and Parking Areas
Harmony Grove Road/Walnut Street border the Site to the north. A paved
• driveway is located at the entrance gate to the Service Bay Building and extends
along the northern edge of the grit and grease chamber to the other entrance gate.
3.6 Property Boundaries. Easements. and Rights-of-Way
The Site property boundaries are approximately the location of the chain-link fence
0 surrounding the Site, as depicted on Figure 2. There are no easements or rights-of-
way on the Site.

4.0 Work Description
•
•The project will include the removal of approximately 2,500 cubic yards of ash from
the grit and grease chamber. The ash will be excavated and loaded directly into
trucks for shipment to a RCRA treatment and disposal facility. Pore water in the
chamber will be pumped directly into a tanker for shipment to a disposal facility.
• After removal of ash and water from the chamber, the chamber will be
decontaminated. Clean backfill material will be placed into the chamber to original
grade and the surface will be loamed and seeded. The original topography of the
Site will not be altered during the completion of the project. In addition, personnel
and equipment decontamination facilities will be located on the Site. The facilities
• will be constructed such that materials generated during the decontamination will
be contained on the Site prior to off-site disposal.
An erosion control barrier consisting of silt fence secured with stakes will be
constructed at the southerly limit of the work area adjacent and upslope of the canal
• bank. Figure 2 contains a schematic diagram of the silt fence and shows the location
of the fence.
Since the project will not alter the topography of the Site, the flood storage volume
of the North River Canal floodplain on the Site will not be affected. In addition, the
• project will not alter or restrict flows in the North River Canal floodplain so as to
cause an increase in flood stage or velocity. The ash removal and grading will take
place at lease 20 feet from the embankment of the canal and will not alter the bank
in any manner. 'The chain-link fence and silt fence will separate the work area from
the canal bank.

determine if a Chapter 91 License is required.

D. 401 Water Quality Certification
The project described in your Notice of Intent requires a 401 Water
Quality Certification from the Department of Environmental Protection and may
require submittal of a 401 application form. See below for further details :
1 . ( ) Based upon the information submitted in and with your Notice of
Intent a separate 401 Water Quality Certification application form is
not required. The Department of Environmental Protection has
reviewed the plans submitted by the applicant and finds that there is
reasonable assurance that the project or activity will be conducted
in a manner that will not violate the Massachusetts Surface Water
Quality Standards, provided that :
a) the applicant receives and complies with a Final Order of
Conditions from the local conservation commission or the
Department ;
b) the Order of Conditions does not cause the loss of more than
5 , 000 sq. ft . of bordering vegetated wetlands and land under
water and/or the dredging of more than 100 cubic yards of land
under water;
C) any loss of vegetated wetlands has been mitigated with a minimum
replication of 1 : 1 ; and
d) the project is not exempt from the M.G.L . c . 131 , §40 - the
Wetlands Protection Act ; is not part of a subdivisic-; does not
cause the loss of any wetlands designated as Outstanding
Resource Waters; and does not cause the loss of any salt marsh.
Therefore, provided that the above conditions are satisfied, the
Final Order of Conditions will serve as the Water Quality
Certification for this project . This does not relieve the applicant
of the duty to comply with any other statutes or regulations .
2 . ( ) Before the activity described in the Notice of Intent can commence,
you must obtain a Water Quality Certification from this Regional

Office . Please complete the enclosed 401 Water Quality Certification
application form and file it with this Regional Office for review.

chromium-rich incinerator ash from an underground concrete chamber located
