Upon completion of the work described herein, - the applicant shall forthwith request, in writing, that a Certificate of Compliance be issued stating that the work has been satisfactorily completed. 9. HELEN PAULINE DERFLINGER - 26 HARDY STREET SALEM, MASSACHUSETTS . On Thursday, June 1, 1978, the Planning Board of the City of Salem held a public hearing regarding the application of Mrs. Helen Pauline Derflinger, for a Special Permit under Section P, Wetlands and Flood Hazard Districts, of the Salem Zoning Ordinance, with respect to the reconstruction of a seawall on the property located at 26 Hardy Street, Salem, Massachusetts. At a regularly scheduled meeting of the Planning Board on June 1, 1978 the Board voted, by a vote of nine in favor, none opposed, to approve the application dated April 18, 1978 as complying with the requirements for the issuance of the Permit. A copy of this application is on file with the Planning Board. I hereby certify that a copy of this decision has been filed with the City Clerk. The storm of February 6 and 7 is considered to have been less than or equal to the 100 year storm magnitude . This means that 'all land flooded -b y the'" st'oxm is 'within'the: "i urisdictiori"O"'f" GL­1311`7_1_s 40 . ; However, not all activities in the areas subject to jurisdiction will require a filing of a Notice of Intent or request for an Order. Therefore , the Department offers the following guidelines as to what work, related to this storm, does not require a request for an emer- gency Order or the filing of a regular Notice of Intent . The .'Conser'- vation Commission has ''the 'authority 'to make 'the'"initi'al decision as' to the jurisdiction of?GL 131; s 40 on a"`case-by-case :basis.. I. No Emergency Order or Notice of Intent required The following activities , conducted in areas subject to GL 131, s 40 will not require an emergency Order or the filing of a Notice of Intent : 1) The clean-up and removal of debris , including wood, plaster, foundation materials and stones . 2) Repair of any building or foundation where the damage is less than 50% of pre-storm market value of the structure . If the Con- servation Commission determines that such repair would cause an alteration in a wetland , or notice of intent may be required. - 3) Minor repair of a sea wall , revetment or bulkhead, which activity does not in any way dredge , fill , or otherwise alter the wetland area subject to jurisdiction . The Conservation Commission shall determine whether the work is "minor repairs== ' Repair on a sea wall revetment or bulkhead which is only 10% , or `le be considered "minor . EmergencyOrder or a-Notice'-of Intent is required'' The following activities, conducted in areas subject to GL 131, s.40 will ' require either an emergency Order or a Notice of Intent as the Conservation . Commission determines: ✓ 1. Temporary major repairs to GL 91 previously licensed sea wall, revetments or bulkheads not exempted as minor repair above. Sandbagging is en— couraged to provide temporary protection to structures made vulnerable to further storm damage by the recent storm. Plugging •of .leaks where the high tide breaches the sea wall is encouraged. 2. Temporary replacement of sand to substitute for a damaged erosion control structure or to rebuild a bank or dune as an emergency protection against further storm damage. 3. Emergency repair and shoring up of building foundations. An emergency Order should allow only such work as is necessary to prevent further imminent damage to the structure. 4. Minor repair on a previously GL 91 licensed groin, jetty or breakwater, unless the Conservation Commission believes it may be inappropriate to rebuild the structure as it was and feels a thorough review is necessary. Repair on a groin, jetty, or breakwater that is only 10% damaged shall be considered minor. 5. Repair or. replacement of previously GL 91 licensed damaged piles and decks of existing licensed over sand wharfs which are less than 50% destroyed. /6. Movement of fill to protect structure from-imminent harm. 7. Other measures as may be necessary to protect structures from imminent danger. The Conservation Commission should be careful to permit only work that preserves the structure from imminent harm.: Complete resto— ration will require a Notice of Intent. 8. Emergency dredging for the purpose of opening commercial sea lanes filled by this storm or to protect land containing shellfish. Disposal of dredged materials must be at a site approved by the Waterways Division of DEQE. Any work done in the above, which may damage marsh or dune vegetation or shall otherwise alter or require dredging, filling, or removal of a wetland shall require a Notice of Intent. III. Notices of Intent must`be`required The following work shall in all cases require a Notice of Intent: ✓ 1. Major permanent repair of a sea wall, revetment, bulkhead, groin, jetty, or breakwater or replacement of a section of roadway, and any work on structures not heretofor licensed under GL 91. +..Page 3. 2.
