Proposed project improvements will improve vehicular, bicycle/pedestrian movement and safety along the North River Canal Corridor (NRCC) by providing a consistent roadway cross-section and improve intersection geometry. With respect to stormwater management, the existing stormwater management facilities located within the project limits are comprised of a closed drainage system consisting of catch basins, manholes and piping. Proposed stormwater improvements include where applicable, retrofitting of the existing closed drainage system by adjusting, relocating or providing new deep sump/hooded catch basins, piping, and drainage manholes within the project limits. Segments of the closed drainage system to be abandoned or removed and proposed improvements are identified on the NCI Plans. Existing drainage patterns will be maintained as part of the proposed stormwater management system. No new drainage outfalls will be created as part of the project as existing storm drainage outfalls will be retained and utilized as part of the stormwater management system. Proposed roadway and intersection improvements will result in a decrease of pavement and impervious area within the project limits. The location and selection of BMPs are being evaluated to improve existing conditions such as water quality and minimize impacts to the greatest extent practicable of stormwater runoff to the North River Canal. COMPLIANCE WITH DEP STORMWATER MANAGEMENT STANDARDS As defined in Volume 1 Chapter 1 page 20 of the Massachusetts Stormwater Handbook, (a.k.a. the MA Stormwater Handbook) this project qualifies as a REDEVELOPMENT project. The handbook states that redevelopment projects are defined to include "maintenance and improvement of existing roadways, including widening less than a single lane, adding shoulders, correcting substandard intersections, improving existing drainage systems, and repaving." and no net increase in impervious area The Project will provide needed improvements to the existing North River Canal Corridor (NRCC). As such, proposed vehicular, bicycle/pedestrian movement and safety improvements associated with the NRCC are in accord with this definition. Under the criteria outlined in the handbook "a redevelopment project is required to meet the following Stormwater Management Standards only to the maximum extent practicable: Standard 2, Standard 3, and the pretreatment and structural best management practice (BMP) requirements of Standards 4, 5, and 6." In contrast,the project must meet Standards 1, 8, 9 and 10 in full. The following summarizes the extent to which the proposed project complies with the new Stormwater Management Standards: Page 1 of 4 Grove Street Improvements Project May 8, 2014 Salem, MA Standard No. 1—No New Untreated Discharges: No new untreated stormwater outfalls will be constructed as part of the project. Existing storm drainage outfalls will be retained and utilized as part of the proposed stormwater management system. The existing closed drainage system will be retrofitted,where applicable, by providing deep sump hooded catch basins. Standard No. 2—Peak Rate Attenuation: The proposed project post-development peak discharge rates will not exceed pre-development peak discharge rates. Proposed improvements will result in an overall decrease in pavement and impervious surface area of approximately 31,850 s.f. within the site. Existing drainage patterns will be maintained as part of the proposed stormwater management system. Standard No. 3—Recharge: The intent of Standard 3 is to ensure that the infiltration volume of precipitation into the ground under post-development conditions is at least as much as the infiltration volume under pre-development conditions. As noted above, the proposed project will result in an overall decrease in impervious area, resulting in no loss of annual recharge to groundwater under post-development conditions. Standard No. 4 —Water Quality: The proposed project meets the definition of redevelopment project, thereby requiring the 80%TSS removal standard to be met only to the maximum extent practicable. The proposed Deep Sump and Hooded Catch Basins typically remove TSS at a rate of 25%. While it is acknowledged that the proposed BMP will not meet the 80% TSS removal pretreatment requirement at the outfall, as a redevelopment project, the proposed BMP and above-mentioned reduction in pavement area will provide an improvement to existing conditions. Standard No.5—Land Uses With Higher Potential Pollutant Loads(LUHPPLsI: This standard is not applicable due to the fact that the proposed use is not associated with higher potential pollutant loads Standard No.6-Critical Areas: There are no stormwater critical areas located within the project limits. Standard No.7-Redevelopments and Other Projects Subject to the Standards only to the maximum extent practicable: The applicable stormwater standards have been met to the maximum extent practicable. Standard No.8—Construction Period Pollution Prevention and Erosion and Sedimentation Control: The proposed project involves more than one acre of earth disturbance. Therefore, a Stormwater Construction General Permit in accordance with EPA's NPDES program will be required. The need for a NPDES Permit also will necessitate the preparation of a Stormwater Pollution Prevention Plan (SWPPP). This Plan will be prepared by the selected Contractor and,as required, a copy will be retained onsite during construction. Page 2 of 4 •Rr �' Grove Street Improvements Project May 8, 2014 Salem, MA A Construction Period Pollution Prevention/Soil Erosion and Sediment Control Plan has been developed to address activities associated with proposed roadway construction in a manner that minimizes erosion,sediment, debris,and other pollutants from contaminating the resource areas and receiving waters.The installation of soil erosion and sediment controls will comply with the Massachusetts Erosion and Sediment Control Guidelines for Urban and Suburban Areas (Massachusetts Executive Office of Environmental Affairs et. al.; 2003), and all aspects of Standard No. 8. These controls will be inspected daily and after each rainfall event,and maintained,as required, until such time that all disturbed areas associated with construction have been stabilized with vegetation and their removal has been authorized by the Conservation Commission. Construction Sequence The order of construction activities shall be as follows: 1. Place erosion and sedimentation control measures within limits of riverfront area resources and buffer zones 2. Remove and dispose of existing pavement and other site features, as needed 3. Soil will be removed as needed for roadway improvements. Soil to be reused onsite will be stockpiled at locations outside the 100-foot buffer zones,as determined by the contractor prior to construction. 4. Begin construction of roadway and sidewalks, including upgrades to existing storm drainage system. 5. Install proposed landscaping 6. Permanently stabilize all disturbed areas with loam and seed 7. Remove erosion and sedimentation control measures Erosion and Sedimentation Controls In accordance with the contract documents erosion and sedimentation controls will be incorporated during all phases of the project. Temporary Controls: 1. Contractor shall minimize site disturbance as much as possible during the phasing of the project. 2. All areas to be seeded shall be stabilized as soon as the phasing and schedule permits.Areas outside the work limits that are disturbed shall be restored and stabilized as soon as possible. 3. No stockpiling of materials or equipment will be permitted within wetland resource areas. Temporary stockpiles shall be protected. 4. Silt fence/haybaIe/compost filter tube or approved equal will be placed to protect all wetland resource areas before the start of construction operations and removed following construction and site stabilization. Permanent Controls: 1. When the project is completed,all disturbed areas will be permanently stabilized by placing loam and seed. New trees will be planted, and disturbed areas within the construction footprint will be loamed and seeded,as noted on the plans. Standard No.9-Operation and Maintenance Plan: The City of Salem is responsible operation and maintenance of the Grove Street improvement project. The schedule for inspection and maintenance will be according to the municipality's annual maintenance program. Standard No. 10—Prohibition of Illicit Discharges: A "No Illicit Discharge Compliance Statement"will be submitted prior to the discharge of any stormwater to post construction BMP. No work shall be undertaken until the Order has become final and then has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of the registered land, the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is done. The recording information shall be submitted to the Conservation Commission on the form at the end of this Order, which form must be stamped by the Registry of Deeds, prior to the commencement of work. 10. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of Compliance (WPA Form 8A)to the Conservation Commission. 13. The work shall conform to the plans and special conditions referenced in this order. 14. Any change to the plans identified in Condition #13 above shall require the applicant to inquire of the Conservation Commission in writing whether the change is significant enough to require the filing of a new Notice of Intent. 15, The Agent or members of the Conservation Commission and the Department of Environmental Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours to evaluate compliance with the conditions stated in this Order, and may require the submittal of any data deemed necessary by the Conservation Commission or Department for that evaluation. 16. This Order of Conditions shall apply to any successor in interest or successor in control of , the property subject to this Order and to any contractor or other person performing work - conditioned by this Order. 17. Prior to the start of work and if the project involves work adjacent to a Bordering Vegetated Wetland, the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden stakes or flagging. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his/her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to require additional erosion and/or damage prevention controls it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of work line has been approved by this Order. NOTICE OF STORMWATER CONTROL AND MAINTENANCE REQUIREMENTS 19. The work associated with this Order(the"Project') is (t) ® is not(2)❑ subject to the Massachusetts Stormwater Standards. If the work is subject to the Stormwater Standards,then the project is subject to the following conditions: a) All work, including site preparation, land disturbance, construction and redevelopment, shall be implemented in accordance with the construction period pollution prevention and erosion and sedimentation control plan and, if applicable, the Stormwater Pollution Prevention Plan required by the National Pollution Discharge Elimination System Construction General Permit as required by Stormwater Condition 8. Construction period erosion, sedimentation and pollution control measures and best management practices (BMPs) shall remain in place until the site is fully stabilized. b) No stormwater runoff may be discharged to the post-construction stormwater BMPs unless and until a Registered Professional Engineer provides a Certification that: i. all construction period BMPs have been removed or will be removed by a date certain specified in the Certification. Prior to requesting a Certificate of Compliance, or Partial Certificate of Compliance, the responsible party (defined in General Condition 18(e)) shall execute and submit to the issuing authority an Operation and Maintenance Compliance Statement("O&M Statement) for the Stormwater BMPs identifying the party responsible for implementing the stormwater BMP Operation and Maintenance Plan ("O&M Plan") and certifying the following: i.) the O&M Plan is complete and will be implemented upon receipt of the Certificate of Compliance, and ii.) the future responsible parties shall be notified in writing of their ongoing legal responsibility to operate and maintain the stormwater management BMPs and implement the Stormwater Pollution Prevention Plan. d) ;Post-construction pollution prevention and source control shall be implemented in accordance with the long-term pollution prevention plan section of the approved Stormwater Report and, if applicable, the Stormwater Pollution Prevention Plan required by the National Pollution Discharge Elimination System Multi-Sector General Permit. e) ,Unless and until another party accepts responsibility, the landowner, or owner of any drainage easement, assumes responsibility for maintaining each BMP. To overcome this presumption, the landowner of the property must submit to the issuing authority a legally binding agreement of record, acceptable to the issuing authority, evidencing that another entity has accepted responsibility for maintaining the BMP, and that the proposed responsible party shall be treated as a permittee for purposes of implementing the requirements of Conditions 18(f)through 18(k)with respect to that BMP. Any failure of the proposed responsible party to implement the requirements of Conditions 18(f) through 18(k)with respect to that BMP shall be a violation of the Order of Conditions or Certificate of Compliance. In the case of stormwater BMPs that are serving more than one lot, the legally binding agreement shall also identify the lots that will be serviced by the stormwater BMPs. Any de-watering of trenches or other excavation required during construction shall be conducted sous to prevent siltation of wetland resource areas. All discharge from de-watering activities shall be filtered through hay bale sediment traps, silt filter bags or other means approved by the Commission or its Administrator. 26. Within thirty (30) days of completion of construction on any given portion of the project, all disturbed areas in the completed portion of the site shall be permanently stabilized with rapidly growing vegetative cover, using sufficient top soil to assure long-term stabilization of disturbed areas. 27. If soils are to be disturbed for longer than two(2) months, a temporary cover of rye or other grass should be established to prevent erosion and sedimentation. If the season is not appropriate for plant growth, exposed surface shall be stabilized by other appropriate erosion control measures, firmly anchored, to prevent soils from being washed by rain or flooding. DURING CONSTRUCTION t t 28. A copy of this Order of Conditions and the plan(s)approved in this Order shall be available on site at all times when work is in progress. 29. No alteration or activity shall occur beyond the limit of work as defined by the siltation barriers shown on the approved plan(s). 30.` Cement trucks shall not be washed out in any wetland resource or buffer zone area,nor into any drainage system. Any deposit of cement or concrete products into a buffer zone or wetland resource area shall be immediately removed. 31. All exposed sub-soils shall be covered by a minimum of three(3) inches of quality screened loam topsoil prior to seeding and final stabilization. 32. Immediately following drainage structure installation all inlets shall be protected by, silt fence, haybale . barriers and/or silt bags to filter silt from stormwater before it enters the drainage system. 33. There shall be no pumping of water from wetland resource areas. 34. All equipment shall be inspected regularly for leaks. Any leaking hydraulic lines,cylinders or any other components shall be fixed immediately. 35. During construction,all drainage structures shall be inspected regularly and cleaned as necessary. 36. The applicant is herby notified that failure to comply with all requirements herein may result in the issuance of enforcement actions by the Conservation Commission including, but not limited to,civil administrative penalties under M.G.LChapter 21A, section 16. The City is proposing to reconstruct Grove Street from Harmony Grove Road to Goodhue Street, a distance of approximately 1,100 feet. Improvements to the existing Grove Street/Harmony Grove Road/Mason Street and Grove/Beaver/Goodhue Street intersections are also proposed. The proposed upgrades aim to improve traffic safety and operations, reduce localized air pollution, and enhance the pedestrian/bicycle circulation in the vicinity. The infrastructure improvements will directly support the five redevelopment sites currently proposed within the North River Canal Corridor (NRCC). These projects aim to revitalize this former industrial area into a mixed-use neighborhood consistent with the goals of the city's NRCC Master Plan. The proposed work occurs within Bordering Land Subject to Flooding (BLSF), Riverfront Area (RFA) and 100-foot buffer to bank of the North River Canal, protectable under the Massachusetts Wetlands Protection Act (M.G.L. c. 131, §40) and its implementing Regulations (310 CMR 10.00), (see Locus Maps included as Attachment B). According to the Massachusetts Office of Geographic Information (MassGIS) MassDEP Wetlands datalayer, there are no existing Bordering Vegetated Wetlands (BVW) within the project limits. The Wetland Resource Area boundaries for bank and BLSF elevation related to the North River Canal in the project area were approved under a Final Order of Resource Area Delineation (ORAD) issued by the Salem Conservation Commission on June 26, 2012 for the Legacy Park Apartments Project (DEP #064-0516, Attachment C). Details of the proposed work activities are depicted on the Grove Street Improvements NOI Plans, prepared by Fay, Spofford & Thorndike, dated April 23, 2014 (Attachment D). The following provides a description of the existing site conditions and resource areas, and the proposed project and mitigating measures proposed to protect the interests and values of adjacent Wetland Resource Areas. A copy of the completed and executed Notice of Intent/WPA Form 3 is included as Attachment A. 2.0 PROJECT DESCRIPTION Grove Street is classified as a Major Urban Collector and is under the jurisdiction of the City of Salem. The roadway is oriented in a north-south direction and is used by people traveling between the Center of Salem and the Center of Peabody or North Salem. The existing roadway is generally 28-38 feet wide, providing one travel lane in each direction, with granite curb and 5-foot sidewalks on either side. Existing land use features industrial and residential development, and City-owned (Mack Park) and privately-owned (Harmony Grove Cemetery) open space north of the Grove Street/Harmony Grove Road/Mason Street intersection. Grove Street Improvements Project Notice of Intent Page 1 of 5 2.1 PROPOSED PROJECT The proposed corridor improvements aim to improve traffic safety and operations, reduce localized air pollution, and enhance pedestrian/bicycle circulation in the vicinity. All components have been designed to fit within the existing roadway footprint, from back of sidewalk to back of sidewalk. The streetscape will be improved with 5-foot wide concrete sidewalks on both sides of the roadway for approximately 1100 linear feet. Grove St. corridor improvements between Goodhue St. and Harmony Grove Road include providing a typical paved cross section of 32-feet, including two 5-foot bike lanes, where feasible,for a length of approximately 550 feet. Two T-intersections are proposed to replace the four way, all-way stop intersection at Grove Street/Harmony Grove Road/Mason Street. Grove Street, north of Harmony Grove Road, will become a T-intersection with Harmony Grove Road. Mason Street will become a T-intersection to Grove Street, where the Harkin Square monument will be relocated and the removal of excess pavement will create green space/pervious surface. New sidewalks and pedestrian crosswalks will be provided. Currently, the Grove/Beaver/Goodhue Streets intersection contains a large triangular asphalt area, which serves as an informal, unmarked parking area that often accommodates large truck rigs and creates a confusing and hazardous traffic pattern. A T-intersection is proposed to replace the existing condition. The new intersection will remove excess pavement, and increase green space/pervious surface in the area. New sidewalks and pedestrian crosswalks will be installed. It is anticipated that the proposed project will include a combination of full-depth reconstruction and the milling and resurfacing of the existing pavements and the installation of new signs and pavement markings. Also included are improvements to the stormwater management system including specific Best Management Practices (BMPs) to meet the DEP Stormwater Standards to the maximum extent practicable. Disturbed areas within the proposed slope limits will be restored with loam and seed, and landscaping will be provided where feasible. 2.2 SOIL EROSION AND SEDIMENT CONTROLS A soil erosion and sediment control plan will be implemented before the start of construction operations and removed following construction and site stabilization. An erosion control system consisting of compost filter tubes and silt sacks will be installed along any areas where earth disturbance is proposed, behind the back of sidewalk, adjacent to Wetland Resource Areas. The installation of soil erosion and sediment controls will comply with the Massachusetts Erosion and Sediment Control Guidelines for Urban and Suburban Areas (Massachusetts Executive Office of Environmental Affairs et. al.; 2003). These controls will be inspected and maintained periodically, as required, until such time that all disturbed areas associated with the construction have been stabilized with loam and seed and their removal has been approved by the Commission. The above-referenced soil erosion and sediment control plan will protect the adjacent wetland resource areas during and following the proposed Grove Street Improvements Project Notice of Intent Page 2 of 5 construction activities. The locations and details for the proposed erosion and sediment controls are depicted on the NOI plans. It should also be noted that the proposed project will involve more than one acre of earth disturbance. Therefore, a Stormwater Construction General Permit in accordance with EPA's NPDES program will be required. The need for a NPDES Permit also will necessitate the preparation of a Stormwater Pollution Prevention Plan (SWPPP). This Plan will be prepared by the selected Contractor and, as required, a copy will be retained onsite during construction. 2.3 STORMWATER MANAGEMENT In accordance with the definitions set forth in Volume 1 of the Stormwater Handbook, the proposed project constitutes a redevelopment project. The handbook states that redevelopment projects are defined to include "maintenance and improvement of existing roadways, including widening less than a single lane,adding shoulders,correcting substandard intersections, improving existing drainage systems, and repaving." The existing stormwater management system located within the project limits consists of a closed drainage system which discharges to the North River. Proposed stormwater improvements include where applicable, retrofitting of the existing closed drainage system by adjusting, relocating or providing new deep sump/hooded catch basins, piping, and drainage manholes within the project limits. No new drainage outfalls are proposed as part of the project. The stormwater Report included as Attachment F documents the project's compliance with the Stormwater Management Standards. 3.0 RESOURCE AREAS The Massachusetts Wetlands Protection Act (M.G.L. c. 131, s. 40) and its implementing Regulations (310 CMR 10.00) set forth specific performance standards for work within RFA and BLSF. There are no performance standards for work within the Buffer Zone under the Act. The following sections document the proposed project's compliance with the pertinent performance standards. 3.1 LIMITED PROJECT The WPA sets forth provisions to allow certain work to be permitted as Limited Projects.This project has been filed as a Limited Project pursuant to: Section 310 CMR 10.53 (3) (f): Maintenance and improvement of existing public roadways, but limited to widening less than a single lane, adding shoulders, correcting substandard intersections, and improving drainage systems. Grove Street Improvements Project Notice of Intent Page 3 of 5 3.2 RIVERFRONT AREA(RFA) The RFA associated with the North River Canal is 200 feet from the top of the Canal's walls, as this is indicated as bank on the Legacy Park Apartments Project ORAD. The RFA within the project limits constitutes previously developed areas (e.g. roadway, existing and degraded sidewalk, driveway) as depicted in the Site Photographs (Attachment E) and NOI Plans. The roadway improvements will impact approximately 34,105 square feet of RFA. 9,020 square feet of this area will convert existing pavement to pervious surface,due to the improvements at the Grove/Beaver/Goodhue Streets intersection. The project elements will not impair the ability of the Riverfront Area to protect other resource areas or rare species. No practicable and substantially equivalent economic alternative is available for this project. A no-build alternative would not meet the project goal to improve the roadway in support of the North River Canal Corridor revitalization. As noted above, project construction will occur within the existing roadway footprint and some existing, excess pavement will be eliminated. 3.3 BORDERING LAND SUBJECTTO FLOODING (BLSF) Flood Insurance Rate Map Number 25009C0418G for Essex County effective July 16, 2014 (Attachment B) shows a portion of the project area within Zone AE, with a Base Flood Elevation of 10' NAVD 88 (10.8' NGVD29 / 15.16' City of Salem datum). There will be no structural bridge modifications as part of this project. As noted above, project improvements will occur within the existing roadway footprint. The project area within BLSF equals 28,665 square feet. 710 cubic feet of fill within floodplain will occur due to filling pot holes and correcting steep cross slopes along the corridor. No replacement area is proposed as all work must occur within the existing roadway right of way. 3.4 100-FOOT BUFFER TO BANK AND BLSF Reconstruction of the existing roadway will occur within the 100-foot Buffer to Bank (approximately 1,195 square feet), and 100-foot Buffer to BLSF (approximately 41,800 square feet, 16,530 square feet of this will convert pavement to pervious surface). As noted above, the work within these buffers is for roadway improvement and has been designed to fit within the existing roadway footprint. The work does not substantially change or enlarge the existing facility and, in fact, some of the pavement will be converted to pervious surface. 3.5 MASSACHUSETTS NATURAL HERITAGE& ENDANGERED SPECIES PROGRAM Based on the MA Natural Heritage Atlas [MA Natural Heritage & Endangered Species Program (NHESP); 13th Edition, Effective October 1, 2008] and related MassGIS datalayers, the project limit is not located within a Priority Habitat of Rare Species or Estimated Habitat of Rare Wildlife. The project area is located within Bordering Land Subject to Flooding (BLSF), Riverfront Area (RFA) and 100-foot buffer to bank of the North River Canal, and 100-foot Buffer to the 100-year floodline (BLSF). The proposed improvements will be limited to the existing roadway footprint and there will be a decrease in impervious area due to improvements at the Grove Street/Harmony Grove Road/Mason Street and Grove/Beaver/Goodhue Streets intersections. Introduction Important:when A Stormwater Report must be submitted with the Notice of Intent permit application to document filling out forms compliance with the Stormwater Management Standards. Grove St—stormwater checklist.doc•04/01/08 Stormwater Report Checklist•Page 8 of 8 Grove Street Improvements Project April 23, 2014 Salem, MA Stormwater Report For Grove Street Improvements Project PROJECT DESCRIPTION The City of Salem is proposing to perform roadway improvements to Grove Street from Harmony Grove Road to Goodhue Street for a distance of approximately 1,100 feet. Proposed project improvements will improve vehicular, bicycle/pedestrian movement and safety along the North River Canal Corridor (NRCC) by providing a consistent roadway cross-section and improve intersection geometry. With respect to stormwater management, the existing stormwater management facilities located within the project limits are comprised of a closed drainage system consisting of catch basins, manholes and piping. Proposed stormwater improvements include where applicable, retrofitting of the existing closed drainage system by adjusting, relocating or providing new deep sump/hooded catch basins, piping, and drainage manholes within the project limits. Segments of the closed drainage system to be abandoned or removed and proposed improvements are identified on the NOI Plans. Existing drainage patterns will be maintained as part of the proposed stormwater management system. No new drainage outfalls will be created as part of the project as existing storm drainage outfalls will be retained and utilized as part of the stormwater management system. Proposed roadway and intersection improvements will result in a decrease of pavement and impervious area within the proiect limits. The location and selection of BMPs are being evaluated to improve existing conditions such as water quality and minimize impacts to the greatest extent practicable of stormwater runoff to the North River Canal. COMPLIANCE WITH DEP STORMWATER MANAGEMENT STANDARDS As defined in Volume 1 Chapter 1 page 20 of the Massachusetts stormwater Handbook, (a.k.a. the MA Stormwater Handbook) this project qualifies as a REDEVELOPMENT project. The handbook states that redevelopment projects are defined to include "maintenance and improvement of existing roadways, including widening less than a single lane, adding shoulders, correcting substandard intersections, improving existing drainage systems, and repaving." and no net increase in impervious area The Project will provide needed improvements to the existing North River Canal Corridor (NRCC). As such, proposed vehicular, bicycle/pedestrian movement and safety improvements associated with the NRCC are in accord with this definition. Under the criteria outlined in the handbook "a redevelopment project is required to meet the following Stormwater Management Standards only to the maximum extent practicable: Standard 2, Standard 3, and the pretreatment and structural best management practice (BMP) requirements of Standards 4, 5, and 6." In contrast,the project must meet Standards 1, 8, 9 and 10 in full. The following summarizes the extent to which the proposed project complies with the new Stormwater Management Standards: Page 1 of 4 Grove Street Improvements Project April 23,2014 Salem, MA Standard No. 1—No New Untreated Discharges: No new untreated stormwater outfalls will be constructed as part of the project. Existing storm drainage outfalls will be retained and utilized as part of the proposed stormwater management system. The existing closed drainage system will be retrofitted,where applicable, by providing deep sump hooded catch basins. Standard No.2—Peak Rate Attenuation: The proposed project post-development peak discharge rates will not exceed pre-development peak discharge rates. Proposed improvements will result in an overall decrease in pavement and impervious surface area of approximately 64,190 s.f. within the site. Existing drainage patterns will be maintained as part of the proposed stormwater management system. Standard No. 3—Recharge: The intent of Standard 3 is to ensure that the infiltration volume of precipitation into the ground under post-development conditions is at least as much as the infiltration volume under pre-development conditions. The proposed project will result in an overall decrease in impervious area of 64,190 s.f., thereby, resulting in no loss of annual recharge to groundwater under post-development conditions. Standard No. 4—Water Quality: The proposed project meets the definition of redevelopment project, thereby requiring the 80%TSS removal standard to be met only to the maximum extent practicable. The proposed Deep Sump and Hooded Catch Basins typically remove TSS at a rate of 25%. While it is acknowledged that the proposed BMP will not meet the 80% TSS removal pretreatment requirement at the outfall, as a redevelopment project, the proposed BMP and 64,190 s.f. reduction in pavement area will provide an improvement to existing conditions. Standard No.5—Land Uses With Higher Potential Pollutant Loads(LUHPPLs): This standard is not applicable due to the fact that the proposed use is not associated with higher potential pollutant loads Standard No.6-Critical Areas: There are no stormwater critical areas located within the project limits. Standard No.7—Redevelopments and Other Projects Subject to the Standards only to the maximum extent practicable: The applicable stormwater standards have been met to the maximum extent practicable. Standard No.8—Construction Period Pollution Prevention and Erosion and Sedimentation Control: The proposed project involves more than one acre of earth disturbance. Therefore, a Stormwater Construction General Permit in accordance with EPA's NPDES program will be required. The need for a NPDES Permit also will necessitate the preparation of a Stormwater Pollution Prevention Plan (SWPPP). This Plan will be prepared by the selected Contractor and,as required, a copy will be retained onsite during construction. Page 2 of 4 Grove Street Improvements Project April23,2014 Salem, MA A Construction Period Pollution Prevention/Soil Erosion and Sediment Control Plan has been developed to address activities associated with proposed roadway construction in a manner that minimizes erosion, sediment, debris,and other pollutants from contaminating the resource areas and receiving waters.The installation of soil erosion and sediment controls will comply with the Massachusetts Erosion and Sediment Control Guidelines for Urban and Suburban Areas (Massachusetts Executive Office of Environmental Affairs et. al.; 2003), and all aspects of Standard No. 8.These controls will be inspected daily and after each rainfall event, and maintained, as required, until such time that all disturbed areas associated with construction have been stabilized with vegetation and their removal has been authorized by the Conservation Commission. Construction Sequence The order of construction activities shall be as follows: 1. Place erosion and sedimentation control measures within limits of riverfront area resources and buffer zones 2. Remove and dispose of existing pavement and other site features,as needed 3. Soil will be removed as needed for roadway improvements. Soil to be reused onsite will be stockpiled at locations outside the 100-foot buffer zones,as determined by the contractor prior to construction. 4. Begin construction of roadway and sidewalks, including upgrades to existing storm drainage system. 5. Install proposed landscaping 6. Permanently stabilize all disturbed areas with loam and seed 7. Remove erosion and sedimentation control measures Erosion and Sedimentation Controls In accordance with the contract documents, erosion and sedimentation controls will be incorporated during all phases of the project. Temporary Controls: 1. Contractor shall minimize site disturbance as much as possible during the phasing of the project. 2. All areas to be seeded shall be stabilized as soon as the phasing and schedule permits. Areas outside the work limits that are disturbed shall be restored and stabilized as soon as possible. 3. No stockpiling of materials or equipment will be permitted within wetland resource areas. Temporary stockpiles shall be protected. 4. Silt fence/haybale/co mpost filter tube or approved equal will be placed to protect all wetland resource areas before the start of construction operations and removed following construction and site stabilization. Permanent Controls: 1. When the project is completed,all disturbed areas will be permanently stabilized by placing loam and seed. New trees will be planted,and disturbed areas within the construction footprint will be foamed and seeded, as noted on the plans. Standard No.9-Operation and Maintenance Plan: The City of Salem is responsible operation and maintenance of the Grove Street improvement project. The schedule for inspection and maintenance will be according to the municipality's annual maintenance program. Standard No. 10—Prohibition of Illicit Discharges: A"No Illicit Discharge Compliance Statement" will be submitted prior to the discharge of any stormwater to post construction BMP.
