OW 95 Therefore,the commission hereby finds that the following conditions are necessary, in accordance with the Performance Standards set forth in the regulations, to protect those inter- ests checked above.The Commission orders that all work shall be performed in accordance with said conditions and with the Notice of Intent referenced above.To the extent that the fola lowing conditions modify or differ from the plans,specifications or other proposals submitted with the Notice of Intent,the conditions shall control. General Conditions 1. Failure to comply with all conditions stated herein,and with all related statutes and other regulatory meas- ures,shall be deemed cause to revoke or modify this Order. 2. This Order does not grant any property rights or any exclusive privileges;it does not authorize any injury to private property or invasion of private rights. 3. This Order does not relieve the permittee gr any other person of the necessity of complying with all other applicable federal,state or local statutes,ordinances, by-laws or regulations. v 4. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: (a) the work is a maintenance dredging project as provided for in the Act; or (b) the time for completion has been extended to a specified date more than three years, but less than five years,from the date of issuance and both that date and the special circumstances warranting the extended time period are set forth in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon apprication to the issuing authority at least 30 days prior to the'expiration date of the Order. 8, Any fill used in connection with this project shall be clean fill, containing no trash,refuse, rubbish or de- bris, including but not limited to lumber,bricks, plaster,wire, lath, paper, cardboard, pipe, tires,ashes, refrigerators, motor vehicles or parts of any of the foregoing. 7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or,if such an appeal has been filed, until all proceedings before the Department have been completed. s S. However, certain portions of the Control Plan and some of the specific structures may and should stay in place until the establishment of final growth. The general pattern of construction will be the establishment of control structures prior to the actual construction of the stripping of soils prior to the construction of any of the work contemplated herein. Inasmuch as these constructions will be phased so will the Sedimentation Control Plan be phased in its implementation. General Principles The following is a summary of the general principles which are, to be incorporated in the Soil Erosion and Sedimentation Control Plan. 1. Construction of required control structures (see attached details) . 2. Stripping of vegetative cover and excavation of excess materials (see attached Site Plans). 3. Wherever feasible, natural vegetative cover shall be retained and protected. 4. The extent of the disturbed area shall be kept to a minimum, limits to be as shown on the plans or as determined by the Engineer in the field. 5. Temporary seeding, mulching, or other approved methods of stabilization shall be employed, to protect critical exposed areas, during prolonged periods of construction. 6. Water runoff shall be contained, as much as practical, within the confines of the construction area, and controlled at other times to facilitate ground water recharge. 7. All sediment is to be retained on the site as much as practicable. f Construction Sequence The following construction sequence is recommended to minimize potential sediment losses and to prevent the siltation of wetlands, brooks, streams and drainage structures (existing and/or new). At no time will excessively large areas be allowed to be disturbed. All control measures and structures are shown in the Soil Erosion and Sedimentation Control Plan. 1. Construct Haybale Check Dams at all points as indicated or directed. 2. Construct siltation fence(s) at the base of all slopes indicated to be protected. The fence(s) shall extend to the limits indicated on the plans, or as directed by the Engineer. 3. Strip and stock pile all top soils, as directed, from areas as indicated to be stripped on the Site Plan. 4. Construct drainage systems, in prescribed order, to control storm runoff from construction site. 5. Excavate and grade areas indicated on the Site Plan (Topographic Plan) to approximate sub grade levels. 6. Construct Utility systems and other constructions as indicated. All catch basins and drains are to be protected by prescribed filters. 7. Construct finish surface(s) as indicated on the Site Plan (Topographic Plan) and immediately seed and/or protect all areas by temporary vegetation or permanent planting. 8. Stabilize all cut and/or fill slopes immediately after seeding to curtail erosion while plantings become established. A. Straw Mulch (70-90 lbs. per square yard) ' B. Jute mesh (see detail) C. Wood chips (275 lbs. per 1000 square feet) 9. Construct haybale diversion dikes at the top of slopes, as indicated, to divert runoff from slope. 10. Runoff from all areas where velocity exceeds three (3) f.p.s. shall be directed to suitable stabilized areas and/or silt control areas. 11 . Energy dissipating devices, rip-rap, etc. , shall be installed at all outfalls, as directed, to reduce velocities to three (3) f.p.s. Upon completion of construction, and earlier as required, silt and sediment, that has been trapped in control devices, shall be removed and disposed of in an approved manner and in an approved location. All control structures shall be inspected weekly and after all storm occurrences and cleaned and repaired as directed or required. Description of Sediment Control Structures Siltation Fence - All flow from the construction areas will flow naturally to the low (wetland) areas off the site. At the low areas the flow will be intercepted by the siltation fence which consists of standard manufacture "snow fencing" covered, on the up stream side, with the polypropylene filter fabric (fabric has minute openings which permit the passage of water but contain the silts and sediments) . Haybale Dams —These structures are to be placed in existing and proposed drainage ways to serve as sediment traps to prevent the sediment from leaving the site and entering the existing drainage system(s). Haybales will allow the water to pass through and leave the site but will retain and trap the sediment on the upsteam side. These are constructed of standard baled hay staked in position with two (2) (min. ) steel stakes per bale. Haybale Diversion - Similar in construction to the "Dam" this ,structure is used to divert runoff flows away from disturbed slopes and to controlled areas as overland flow. Catch Basin Filters - These filters are to be placed on all catch basins to prevent the sediment from entering the drainage system. The construction of these facilities is shown on the accompanying "DETAIL". Planting - Planting will be used on all exposed areas as both a temporary and a permanent erosion control method (see Tables I and II) .
