Conditions, a copy of which is enclosed herewith, for Freeman Road in Salem,
Massachusetts.
Please be advised that no construction has been commenced. As you are
perhaps aware. The approval process was quite cumbersome and time consuming.
At the end of the process, my client, Daniel Archibald, began to experience
financial difficulties and it is only now that he has been able to address the issue of
either sale or development of the lot.

Therefore, the Commission hereby finds that the following coroitions
are necessary, in accordance with the Performance Standards set forth in the
regulations, to protect those interests checked above. The r---
orders that all work shall be performed in accordance with said conditions and
_ 4with the Notice of intent referenced above. To the extent that the following
- conditions modify or differ from the plane, specifications or other proposals
submitted with the Notice of intent, the conditions shall control.
General Conditions
1. Failure to comply with all conditions stated herein, and with all related
statutes and other regulatory measures, shall be deemed cause to revoke
or modify this order.
2. The order does not grant any property rights or any exclusive privileges;
it does not authorize any injury to private property or invasion of
private rights.
3. This order does not relieve the permittee or any other person of the
necessity of complying with all other applicable federal, state or local
statutes, ordinances, by-laws or regulations.
4. The work authorized Hereunder shall be completed within three years from
the date of this order unless either of the following apply:
(a) the work is a maintenance dredging project as provided for in the
Act; or
(b) the time for completion has been extended to a specified date more
than three years, but less than five years, from the date of issuance
and both that date and the special circumstances warranting the
extended time period are set forth in this Order.
5. This order may be extended by the issuing authority for one or more
periods of up to three years each upon application to the issuing
authority at least 30 days prior to the expiration date of the order.

7. No work shall be undertaken until all administrative appeal periods from
this order have elapsed or, if such an appeal has been filed, until all
proceedings before the Department have been completed.
8. No work shall be undertaken until the Final order has been recorded
in the Registry of Deeds or the Land Court for the district in which
the land is located, within the chain of title of the affected
property. In the case of recorded land, the Final Order shall also
be noted in the Registry's Grantor Index under the name of the owner
of the land upon which the proposed work is to be done. In the case
of registered land, the Final order shall also be noted on the Land
court certificate of Title of the owner of the land upon which the
proposed work is to be done. The recording informatin shall be
submitted to the Commission on the form at the end of this Order
prior to commencement of the work.
9. A sign shall be displayed at the site not less than two square feet or
more than three square feet in size bearing the words,

determination and to issue a Superseding order, the Conservation

SPECIAL CONDITIONS
1. All work shall conform to the above-referenced Notice of Intent, site
plan and supporting documents and those final specifications which shall be
filed with the Commission prior to construction. Any change made or intended
to be made to the approved plans shall require the applicant to inquire of
the Commission in writing whether the change is substantial enough to require
the filing of a new Notice of Intent.
2 . *Members and agents of the Commission shall have the right to enter and
inspect the premises at all reasonable times to evaluate compliance with the
conditions in this Order. The Commission may require the applicant to submit
additional data or information necessary for the Commission to conduct that
evaluation.
3. Upon completion of this project, the applicant shall submit, with the
request for a Certification of Compliance, an affidavit, prepared by a
professional engineer or land surveyor duly registered in the Commonwealth of
Massachusetts, stating that the site has been developed in accordance with
the requirements of this Order of Conditions, the referenced site plan and
supporting documents.
4 . This Order shall apply to every successor in control or successor in
interest of the property described in the Notice of Intent and accompanying
plans or part thereof. In the event this land or any part thereof changes
ownership before or during construction, the current owner shall notify the
new owner, by registered mail, of this Order prior to the transfer of
ownership and shall forward proof of this notification to the Commission.
5. Haybales identified on the site plan and discussed in the Sommer
document shall be anchored with stakes and entrenched 4 to 6 inches in depth.
Trench material shall be deposited on the upgradient side of the haybale
barrier. Haybales shall be inspected daily by applicant or his agent; those
showing signs of deterioration shall be replaced immediately. The haybale
barrier shall remain in proper functioning condition until all disturbed
areas have been stabilized.

6. Additional erosion and sedimentation control measures deemed necessary
by the Commission shall be instituted by the applicant. Any siltation caused
onto any wetland or waterway area shall be promptly reported to the
Commission. Such areas shall be restored to the satisfaction of the
Commission.
7. During construction, no debris, fill, or excavated material shall be
stockpiled within 100 feet of designated wetlands. Any other stockpile
location will be protected sufficient to prevent sediment from surface runoff
entering wetlands.
8. Equipment servicing must be conducted outside the buffer zone.
Equipment must be maintained to prevent leakage or discharge of pollutants.
No overnight equipment storage shall occur within 100 feet of the wetland
boundary.
9. *No spill or discharge of petroleum products or other pollutants will be
allowed into any wetland resource area or land within the buffer zone.
10. *Use of rock salt (sodium chloride) or other toxic de-icing chemicals
within the project area is prohibited and any arrangement for snow removal
shall so stipulate. None of these agents shall be stored onsite.
11. *The applicant will refrain from depositing snow in such a way as to
increase runoff for abutters.
12 . Notice shall be given to this Commission no more than two weeks nor less
than 2 days prior to the commencement of site preparation, blasting and of
construction activities. Said notice shall include, in writing, the name(s) ,
address (es) , and business and home telephone numbers of the project
supervisor(s) responsible for insuring that operations are conducted in
compliance with this Order.
13 . *There shall be minimal pruning and no removal of any buffer zone or
wetland vegetation downgradient of the staked haybale line delineated on the
site plan.
14 . All disturbed soils shall be immediately and similarly re-vegetated upon
completion of construction activities or shall be mulched until the next
growing season.
15. *Fertilizers used for landscaping and lawn care shall contain a low
nitrogen content and be used in moderation. Pesticides and herbicides shall
not be used within 100 feet of the resource area.
16. The applicant will provide the Conservation Commission with a $3, 000
bond to ensure the success of the wetland replication project.
The bond will be used by the Commission to hire a consultant to assess
whether the performance specifications of the replicated resource area
identified in the Sommer Environmental Technologies report have been achieved
after two growing seasons. If the Commission's consultant determines the
specifications have not been met, the Commission will hire a contractor with
the remainder of the bond to re-replicate and/or revegetate. The consultant

and the contractor may not be the same entity.
17. * Permanent iron markers exposed visually at least 3 feet above the high
water mark shall be installed at flags 10, 9, 8A, 2 , 2A, 1 and lA on the site
plan to identify the outline of the resource area. No organic material will
be deposited in the resource area.
18 . The deed recorded for lots 630A and 631A will include a description of
the precise locations of the seven iron markers identified in special
condition #17 and indicate that they are to remain in perpetuity.
19. The applicant will submit a plan for the Commission's approval prior to
commencing work that describes steps to assure the free flow of water through
the twin 18 inch drain pipes under the driveway. The plan should also
include a description of methods to be employed to prohibit small children
and animals from entering the pipes.
20. * Any discrepancies between the Notice of Intent and related documents
will be resolved in favor of the special conditions.
21. The material in the "stockpile" identified on the site plan will be
properly disposed.
22 . During construction of the replication area, a Clerk of the Works
identified by the Conservation Commission will be on site, at the applicant's
expense.
23 . During the growing season immediately following construction the
applicant will plant a minimum of 8 Evergreen trees along the driveway
abutting the Erps property. The trees will be evenly spaced, however, the
trees will not be placed within 5 feet of either side of the pipe. Any tree
that dies within one (1) year of its planting will be similarly replaced.
The trees will be properly nourished and maintained to reduce sedimentation
to the resource area.
24. In addition to conducting the pre-blast survey required by the City of
Salem's Ordinance 12-70, the applicant will instruct his blasting contractor
to perform blasting such that changes to bedrock groundwater flow patterns
will be minimized.
25. Abutters within 300 feet of the blasting area will be notified by
certified mail within 48 hours prior to construction and/or blasting .

I. - Haybale Location and Installation
A single, continuous row of staked haybales shall be
installed along the border of the wetlands as indicated on the
Plan (Site Development Plan of Land, Revised July 24 , 1992 , By
Eastern Land Survey) . This row shall extend the length of the
wetland as indicated in order to provide erosion and
sedimentation control as recommended in "Erosion & Sedimentation
Control guidelines, DEQE, 1983 . 11 Haybales furnished shall be
twice looped with wire or other cordage resistant to rot .
Haybales shall be set in an excavated trench 611 deep, oriented
with the wire loops parallel to the surface contour, tightly
butted to adjacent bales, and staked with two 211x211x31 stakes or
sections of Irebar' spaced equally in the bale and driven solidly
into the underlying material. No spoil from the excavation of
the trench shall be placed or stockpiled in the adjacent wetlands
(see plan) .
NOTE: Additional haybailing required by the Commission during
the project duration shall also be provided and installed in
accordance with the previous paragraph.
II. - Excavation of Replication Areas
All trees, topsoil, and subsoil shall be excavated from the
replacement areas to a uniform rough grade at an elevation 6"
below the proposed final grade. All excavated materials shall be
removed from the work area via the upland (northerly) side of the
wetland work area. No heavy equipment shall pass the line of
staked haybales during this work. The contractor shall take all
necessary measures to protect unremoved trees and shrubs against
damage from machinery and from excavated materials.
Through the operation of a backhoe, "Grade-All" , or other
equipment with boomed remote excavation capability, sub-soil in
thereplication area shall be removed such that the final grade of
the excavated soils shall be lowered to provide a slope from
approximately elevation 99 to elevation 98 . All excavation
accomplished under this section shall be performed in a such
manner that no heavy equipment shall enter onto the final grade,
that is, excavation to final grade shall commence in the easterly
section of the removed area and progress evenly westward.
During excavation of the crossing, the organic soils should
be collected and stockpiled for use in the restoration area.
Once the restoration site is prepared, the organic material from
the crossing shall be deposited within the area.
III. - Revegetation of Replicated Wetland
It is fully expected that opportunistic and indigenous
wetland plants will revegetate the Replicated Wetlands. The
organic soils placed in the wetlands should contain ample
rootstock, seed and spore material to provide for regeneration

required by 310 CMR 10. 55 (4) (b) (6) . The remaining surface of the
newly created replacement wetland shall be sown by hand with seed
of Reed Canary Grass (Phalaris arundinacea) , Bluejoint
(Calamaarostis canadensis) , a Fowl Meadow grass (Glviceria sp. ) or
acceptable substitute. This seed shall be raked into the upper
1/4" of the replaced soil by hand and mulched with hay.
IV. - Maintenance of Planted Wetland. Vegetation
Following planting and seeding of the replicated vegetated
wetland, the area shall be inspected on a weekly basis and shall
receive any necessary maintenance accomplished including, but not
limited to, maintenance of erosion control haybales, weeding and
pruning of planted vegetation, and removal of any invasive
Phraamites or any other so-called 'undesirable ' species.
V. - Replacement of Planted Wetland Vegetation
The contractor shall replace all plant materials which have
not shown satisfactory evidence of growth following one growing
season, 50% healthy foliage shall be assumed satisfactory
evidence of growth. All dead or unsatisfactory plants shall be
removed and replaced. Replacement planting shall conform to the
provisions of these specifications.
VI. - Reporting
The applicant will arrange for the monitoring of the
compensatory wetland area for two full growing seasons. The
wetland plant species are expected to cover 50% of the surface of
the created wetland areas after the first growing season and at
least 75% of the surface areas by the end of the second season.

If sufficient wetland vegetation should fall to remain and
regenerate within the wetland area to the prescribed quantities
within the first two growing seasons , the applicant will
subsidize the existing vegetation with additional plantings
indigenous to the area.
