hereby orders that the following conditions are

and with the Notice of Intent and Plans, unless modified by said conditions.
CONDITIONS:
1. Failure to comply with all conditions stated herein, and with all related statutes
and other regulatory measures, shall be deemed cause to revoke or modify this
order.
2. This order does not grant any property rights or any exclusive privileges; it
does not authorize any injury to private property or invasion of private rights.
3. This order does not relieve the permittee or any other person of the necessity
of complying with all other applicable federal, state or local statutes, ordinances,
by-laws and/or regulations.
4. The work authorized hereunder shall be completed within one (1) year from the date
of this order unless otherwise stated below pursuant to Regulation 6.7 The order
may be extended by the issuing authority for one or more additional one-year periods
upon application to the said issuing authority at least thirty days prior to the
expiration date of the order or its extension.
5. Any fill used in connection with this project shall be clean fill, containing no
trash, refuse, rubbish or debris, including, without limiting the generality of
the foregoing, lumber, bricks, plaster, wire, lath, paper, cardboard, :pipe, tires,
ashes, refrigerators, motor vehicles or parts or any of the foregoing.

6. No work may be commenced-until all appeal periods have elapsed from the
order of the Conservation Commission or from a final order by the Department
Of Environmental Quality Engineering.
7. No work shall be undertaken until the final Order, with respect to the proposed
project, has been recorded in the Registry of Deeds for the district in which
the land is located within the chain of title of the affected property. Copy
to be furnished to issuer of this Order showing book and page prior to
commencement of work.
8. Upon completion of the work described herein, the applicant shall forthwith
request, in writing, that a Certificate of Compliance be issued stating that
the work has been satisfactorily completed.
9. A sign shall be displayed at the site not lessthan two square feet or more
than three square feet bearing the words, "Massachusetts Department of

Gentlemen:
Please be advised that this office represents Robert F. Yates and
Mary F. Yates of 53 Osgood Street, Salem, who are direct abutters to
the property which is the subject of the above captioned Notice of Intent
and Order• giving a dwelling house on the abutting lot as well as a lot of
abutting flats.
Your department is hereby requested pursuant to MGLA Chapter 131,
Section 40 to determine whether the area on which the proposed work is to
be done is significant to public or private water supply, to the ground
water supply, to flood control, to storm drainage prevention, to prevention
of pollution, to protection of land containing shellfish or to the protection
of fisheries.
Specifically Mr. and Mrs. Yates allege that the work requested to be
performed is upon land not owned by the applicant and upon land which has
been illegally filled by the applicant over a period of years with no approval
from the Conservation Commission. The work previously performed and the
work sought to be performed have and will unnaturally alter the tidal flow of
the area.

Dear Mr. Northrup:
After review of the LaChapelle property, I find that the installation cost of an
ejector system to serve this residence is beyond the means of the City. Further, annual
operating and maintenance costs would be prohibitive.
I understand that your commission proposed to purchase, or take, this property for
conservation purposes. The present septic system, as shown on the attached sketch, is
within the area under your consideration. Should your commission act on this property,
consideration will have to be given to relocating the septic system. Present Water Pol -
lution Control requirements for septic systems will prevail .

to #320 Highland Ave.
The LaChapelle residence at 320 Highland Ave. has
been found to be too low to make a gravity connection
from the existing sewer service to the new 12" A.C. sewer
in Highland Ave. The existing sewer service exits the
house . @ an elevation approximately 11. 0 V.F. below the sill
elevation of 119 . 54. This service is therefore approximately
7. 0 V.F. below the new 6" A.C. "WYE" elev. of 115.5+ at
Sta. 1+76 of the Barcelona Interceptor on Highland Ave.
This information was obtained following an;i_riquiryby�Phr
LaChapelle as to how his residence would be connected
into the new sewer system.
Due to these previously mentioned elevations, it
becomes apparent that a pumping system is the only method
of connecting the LaChapelle residence.
Through previous conversations with the City on a
taking of his land for the Messing Interceptor, he believes
the City is to bear the responsibility for the pump and he
will make the connection to Highland Ave At this time
nothing has been promised Mr. LaChapelle other than the
fact "we will investigate the situation. " This question
follows - Is the City going to require -a connection to
#320 and if so, who bears the responsibility for the pump?
It must be noted that the Conservation Commission
intends to take a section of his property adjacent to his
house. This land taking as suggested; includes his cesspool.
If the City decides that the .house does not have 'to be
connected, the location of the cesspool might pose a
problem if the land taking is made.
Attached is drawing #25 showing the location &
elevation data; also enclosed is a copy of the proposed
land taking.
Your comments and ideas on the subject would be
appreciated.
