Dear Mr. Bornstein,
The Ruggles-Klingemann Manufacturing Company, Inc. , hereby grants
permission to the city of Salem, Massachusetts, to install two (2)
drainage systems on .its property. Further, the City is qranted
permission to enter upon the property at reasonable times to alter
or repair the systems as necessary. This permission will last to
eternity and will follow to new owners should the property be sold.
The City of Salem will assume all responsibility for clean up and
disposal pos of all excess materials, etc. created as a result of the
original construction project and alteration and repair in the future.

' Enclosed is a Request for Determination of Applicability(RDA) for the property at
5 Foster Court, Salem,Massachusetts(Locus Map, Attachment, 1).

I have inspected this property on several occasions and noted three buildings, an upland
' area and a drainage ditch, which retains water during rainy periods. This drainage ditch
is part of the City of Salem Storm Drainage System (Attachment 2). Water is added to
' this drainage ditch by sheet flow from Foster Street, from catchbasins on Goodell Street
and Lovett Street,and from two catch basins which(according to Mr. Churchill of
' Ruggles Klingeman) were installed on the property by the Salem Public works
Department.

A review of the Flood Map(Attachment 3); Soil Map(Attachment 4);USGS Map
' (Attachment 5); and,Fish and Wildlife Service Map(Attachment 6) shows no indication
of wetland resource areas at the Site. Furthermore, my site inspection did not detect any
' areas of the site that are protectable as Wetland Resource Areas as defined in the
Massachusetts Wetland Protection Act(MGL c. 131; Section 40)and
GULF OF MAINE RESEARCH CENTER INC.
' Regulations (3 10 CMR 10.00). Therefore, as a result of this record review and site
inspection, I recommend that you issue a Negative Determination of Applicability (WPA
' Form 2, Revised 10/98) and check No. 1, "The area described in the Request is not an
area subject to protection under the Act or the Buffer Zone."
