Pursuant to the authority of G.L. c. 131, s. 40, the Salem
Conservation Commission has reviewed your Notice of Intent
and plans identified above, and has determined that the area on which
the proposed work is to be done is significant to one or more of the
interests listed in G.L. c. 131, s. 40. The Conservation Commission -
hereby orders that the following conditions are necessary to protect
said interests and all work shall be performed in strict accordance 7-
with them and with the Notice of Intent and plans identified above
except where such plans are modified by said conditions.
CONDITIONS -
1. Failure to comply with all conditions stated herein, and with
all related statutes and other regulatory measures, shall be
deemed cause to revoke or modify this order.

2. This order does not grant any property rights or any exclu-
sive privileges; it does not authorize any injury to private
property or invasion of private rights.
3. This order does not relieve the permittee or any other per-
son of the necessity of complying with all other applicable

federal, - state or local statutes; ordinances, by-laws and/
or regulations.
4. The work authorized hereunder shall be completed within one
(1) year from the date of this order unless it is for a
maintenance dredging project subject to Section 5(9) . The
order may be extended by the issuing authority for one or
more additional one-year periods upon application to the
said issuing authority at least thirty (30) days prior to
the expiration date of the order or its extension.
5. Any fill used in connection with this project. shall be clean
fill, containing no trash, refuse, rubbish or debris, includ-
ing, without limiting the generality of the foregoing, lumber,
bricks, plaster, wire, lath, paper, cardboard, pipe, tires,
ashes, refrigerators, motor vehicles or parts of any of the -
foregoing.
6. . No work may be commenced untill all appeal periods have
F - - elapsed- from the order of the Conservation Commission or from
,. a final .order: by .,the Department of Environmental Quality
Engineering. '
7. No work shall be undertaken until the final order, with
respect to the proposed project, has been recorded in the
Registry of Deeds for the district in which the land is

The Document number indicating such recording shall be sub-
mitted on the form at the end of this order to the 'issuer
of this order prior.;to commencement of work.
8.- A sign--shall be displayed at the site not less than two
square feet or more than three square feet bearing the

9. Where the Department of Environmental Quality Engineering
is requested to make a determination and to issue a super-

3. A PCB analysis taken in an area of worst case oil and
grease sample and run for the entire six-inch dredging
depth as suggested by the Executive Office of Environmental
Affairs, dated February 23 ,. 1983, shall be performed.
4 . An oil boom or other appropriate =surface slick contain-
ment device and a licensed spill contractor' on site or at
lease on call to contain and remove oil which will float
" to the water surface during dredging as suggested by
DEQE ;in a communication dated January 5, 1983 , is reauired,

5. In order to accommodate the sewer project which will
be occurring in the same area, it is hereby ordered that the
placement of clean sand at the beach be done after the
sewer construction is completed.

On Thursday, April 7 , 1983 , the Planning Board of the City of Salem
held a public hearing regarding the application of the Park and
Recreation Commission for a Special Permit under Section P,
Wetlands and Flood Hazard Districts, of the Salem Zoning Ordinance,
with respect to the restoration of the swim area at Pickman Park
Beach, repair to an existing sea wall, and replacement of a re-
taining wall adjacent to the swim area.
At a regularly scheduled meeting of the Planning Board on April 7 ,
1983, the Board voted, by a vote of five in favor, none opposed, .
to approve the application as complying with the requirements of
----,.. the issuance of the permit with the following conditions:
1. That all work shall be done in accordance with plan entitled ,

MINUTES OF MEETING
March 24 , 1983
The Commission met at One Salem Green, second floor on March 24 ,
1983 . Present were Philip Moran, Christopher Hagger , Alice
Akatyszewski , Richard Femino, Paul Willis , and Associate _Mem-
ber James MacDowell. Raymond Lavender and Glenn Yale were ab-
sent.
Chairman Philip Moran called the meeting to order at 8 :10 p.m.
MAINE POST AND BEAM--CONTINUATION OF PUBLIC HEARING
Chairman Philip Moran read the notice of the hearing and introduced
Mr. Reid Blute of Maine Post and Beam. Mr. Blute explained that F
in spite of the fact that they have withdrawn without prejudice -
from the Board of Appeal , they would like to continue -the`.; robess "
and clarifv a few points. He, therefore, would dike the Com-
mission to issue an Order of Conditions based on the additional
information he supplied to the Board at our previous meeting.
There being no questions from the Commission members or from
any persons present, upon the motion of Alice Akatvszewski and-
second of Richard Femino, the public hearing was closed. It was so voted
Upon the motion of Paul Willis and second of. Richard Femino, an .
Order of Conditions referencing the presented plans was approved.
It was so voted.
PICKMAN PARK--PUBLIC HEARING
Chairman Philip Moran read the notice of the hearing. The en-
gineering firm contracted to do the work, Green International,
_ were unable to send a representative to this hearing. Therefore, -_
at the designation of Mr. Tim Noonan of the Park and Recreation
Commission, Susan Madison will make the presentation to .the
Board.
The proposal is to scrape the wading pool area of Pickman Park
approximately 6" , dispose of the dredged material off site, ulacef
clean sand on the swim area bottom, and reolace -the existing__
concrete retaining wall located adjacent ,to the�swim area. ='

Susan Madison stressed that no areas of ;saltmarsh will be dist
placed, This is under order= from- Coastal zone -Management ` The
possibility of moving the saltmarsh and :replanting -it^in' a: more
appropriate spot was considered, but thiw`i11M'`not be allowed

unless a variance is granted. However , the timing of this project
is tied into the Phase V sewer project, so this is not an onti.on
at this time.
Susan noted that the dredged material will be de-watered and disposed
at the Peabody landfill due to the fact that the material has _
been designated a special waste (contains lead and cadmium) . The
dredging and replacement of the retaining wall will be done first,
then the sewer project work will be done , then .the clean sand
will be brought in.
The Water. Pollution Control Division of MEPA has suggested the use
of an oil boom to help contain anv contaminants and they have
also recommended that a licensed contractor be on site during all
phases of the Project.
Richard Femino asked if anv testing had been done on the vegetation
and Susan replied in the negative. Chris Hagger asked where the
samples were taken and upon learning a "scraping" rather than an
actual dredging was being proposed, he and Richard Femino agreed
that the testing did not have to be quite so sophisticated.
There being no further questions from the Commission , the Chairman
asked for questions from the other Persons present.
Councillor John Nutting of Ward 7 was nresent to sneak in favor of
the nronosal . He gave a brief background of the area and the
State funding which is helping to defray the costs of the projects
Ann Fournier , Secretary of .the Pickman Park Association, and
Ann Butters, co-President of the Association both spoke in

March 10, 1983
The Commission met at One Salem Green, second floor, on Thursday,
March 10, 1983. Present were Christopher Hagger, Paul Willis,
Richard Femino , Glenn Yale , Philip Moran, and Associate member
James MacDowell. Raymond Lavender and Alice Akatyszewski were
absent.
Chairman Philip Moran called the meeting to order at 8:00 p.m.
MAINE POST AND BEAM/TEDESCO POND
Reid Blute of Maine Post and Beam and Bruce Poole of Sea Planta-
tions were present to request that their public hearing be con-
tinued on March 24, 1983, and to file an amended plan reflecting
the requests of the Commission. Two letters addressing this mat-
ter were read by Chairman Philip Moran (attached hereto and made
a part hereof) .
Bruce Poole gave a synopsis of the proposal: The oil and sed-
iment retention basin would be constructed in the vicinity of
• - -the influent culvert were the largest concentration of adverse
pollutants have been found. The basin would form a foot bridge
which would be incorporated into a proposed jogging track around
the entire pond. Surface scum trapped behind the bridge could
be periodically manually removed by means of a portable skimmer.
Silt and sediment would be periodically pumped out by means
of a septic tank pumping truck . .
A sediment bar which exists to the northeast of the influent cul-
vert would remain. They would like to add to the plantings on
this bar so it would act as a natural filter to further improve
the quality.
Four catch 'basins .will drain into two leaching fields to allow
natural filtration of water draining from the roadway into the
pond. Each basin will contain an oil trap and sediment collec—
tion sump. Mr. Poole emphasized that their calculations were
made taking into account the greatest degree of flood potantial.
Further, each leaching basin will be chambered and contain an
overflow pipe.
Philip Moran asked how large the oil and sediment baffle will be .
Mr. Blute replied it will be two feet in depth and 110 feet in
length. Chris Hagger asked how it would be constructed and Mr.
. Blute stated it will be manually constructed by the use of a gas
driven pile driver. Chris asked how far down the piles will go
and Mr. Blute replied between five and seven feet. He further
noted the baffle will be constructed out of wood and will sit
approximately 6" off the bottom.

Richard Femino asked if any chemical control of algaeblooms was
• anticipated and Mr. Poole replied in the negative .
Chris Hagger asked if any discussion regarding the Stop and Shop
drain had taken place and Mr. Blute replied in the negative;
however, Health Agent Bob Blenkorn plans to help in this area.
Paul Willis asked if Stop and Shop salted their parking lot and
Mr. Poole replied that their testing did not show large concen
trations of salt.
Chris Hagger asked what the life of wooden baffles would be and `
Mr. Blute replied their life would be quite long, particularly
where they are submerged. They would be protecting the wood with
cuprinol, however.
In response to a question from Glenn Yale , Mr. Blute noted that
approximately 40% of the pond budget would be eliminated if the
desired density of 24 units was not approved.
There being no further discuss;on, it was agreed the public hear-
ing will be continued on March 24, 1983•

A letter will be sent to Mr. DeCotis requesting a statement of his
intentions within seven days of receipt.
OLD BUSINESS
The Trail Bike matter was continued without a finding, carrying a
$50.00 fine and six months probation.
Upon the motion of Glenn Yale and second of Paul Willis , a Cer-
tificate of Compliance for Clayton Smith was approved. It was
so voted.
An effort will be made to get some input from DEQE regarding the
new Wetlands regulations .

First, I would like to thank the Commission for their consideration and
their letter of March 3rd to the Salem Planning Board.
I have decided to pursue a course of optimism regarding the Board of
Appeals hearing on March 16th. Along those lines, I have commissioned the
design of the necessary detailed engineering plans requested by the Commission
at our meeting on February 24th
I intend to submit this information formally to the Commission for con—
• sideration at the Thursday, March 10 meeting. L hope that these more detailed
plans and specifications serve to answer those questions that were left hanging
at our February 24th meeting.
I would also like to submit to the Commission a written description of our
"Proposed Pond Reclamation" program. This outline should serve .to clarify our
plans and act as a future reference.
If the Commission requires any additional imput or further explanations,
I remain ready and willing to address any and all concerns.

• PROPOSED POND RECLAMATION

Description of Wetland:
* 3.1 acre kettlehole pond located entirely within a 7.5 acre parcel of
land owned by Pond View Realty Trust, adjacent to Stop & Shop at Vinnan
Square.
* The land was previously used as a gravel borrow pit.
* It is currently vacant.
* It is a holding pond for drainage run off from Vinnan Square area.
* Flow is controlled by 2- 60" State installed culverts at opposite ends of
the Pond.
* Surrounding land is from 8-15 feet above water level at pond.
Proposed oil and Sediment Retention Basin:
We plan to .construct an oil and sediment retention area in the.vicinity of
the influent culvert.. This would resemble a small footbridge in design.
Oil surface scum trapped behind the bridge would be periodically manually
removed. Sediment and silt could be pumped out by a septic tank pump truck.
Bio-Mass Filter Bar:
The existing sediment bar to the northeast of the influent culvert would
remain and be encouraged by some grooming and planting to act as a
natural filter to decrease turbidity, remove nutrients and improve wild-
life habitat.
Storm Drainage; .
* We plan to construct two leaching fields fed by four catch basins to channel
excessive drainage from the roadway into the subsoil to allow natural
filtration of water into pond. Each basin will have an oil trap and sediment
Collection sump.
* Drainage from influent culverts near the Stop & Shop end will be channeled
into the oil and sediment retention basin.

Jogging Track:
• * We plan to construct a V-6' wide footpath around the perimeter of the
pond. This will cross the bridge at the oil and sediment retention basin.
* The track will follow the natural slopes and have a minimal effect on
existing conditions.
Waterfowl Nesting Site:
* We plan to modify an area near the 60" influent culvert off the tip of the
existing sediment bar to serve as a nesting site for waterfowl.
* This island must be separated from the land to ensure waterfowl safety.
Plantings:
* We plan to plant trees and shrubs. to control erosion.
* We will minimize introduction of loam and fertilizers.
* Slope retention evergreens in place of pavement at Stop & Shop overflow.
* Aquatic vegetation will be augmented by additional species planted along
steep gradient areas using wooden terrace board submerged 1-3 ft.
* Some shore plants will be used to stabilize the edges.
Biological;
* We plan to remove all existing rubbish and refuse from the pond.
* We plan to introduce Fundulus Diaphanus (top minnow) to control mosquito
larvae.
SUMMARY
* Relativelygood water quality.
* Control algal blooms by avoiding nutrients and erosion control plantings in
impoverished- soil.
* Reduce offsite pollutants and contaminents.
