Pursuant to the authority of M.G.L.c. 131, § 40, the Conservation Commission considered your
Request for Determination of Applicability, with its supporting documentation, and made the following
Determination.
Project Description (if applicable):
Salem State College is proposing the construction of a wooden shed, approximtely 24'X 12' in size,
on an existing concrete pier located in the coastal waters of Smith Pool. The proposed shed will house
tanks that will contain larvae species. An electric line, encased in PVC piping will be installed from the
shed to the existing electric transformer located on the slated portion of the pier. No plumbing or heating
is proposed in the shed.

Negative Determination
Note: No further action under the Wetlands Protection Act is required by the applicant. However, if the
Department is requested to issue a Superseding Determination of Applicability, work may not proceed
on this project unless the Department fails to act on such request within 35 days of the date the
request is post-marked for certified mail or hand delivered to the Department.Work may then proceed
at the owner's risk only upon notice to the Department and to the Conservation Commission.
Requirements for requests for Superseding Determinations are listed at the end of this document.

Buffer Zone.
2.The work described in the Request is within an area subject to protection under the Act, but will

This Determination must be signed by a majority of the Conservation Commission. A copy must be sent
to the appropriate DEP Regional Office (see Attachment) and the property owner(if different from the
applicant).

D. Appeals
The applicant, owner, any person aggrieved by this Determination, any owner of land abutting the land
upon which the proposed work is to be done, or any ten residents of the city or town in which such land is
located, are hereby notified of their right to request the appropriate Department of Environmental
Protection Regional Office (see Attachment) to issue a Superseding Determination of Applicability. The
request must be made by certified mail or hand delivery to the Department, with the appropriate filing fee
and Fee Transmittal Form (see Request for Departmental Action Fee Transmittal Form) as provided in
310 CMR 10.03(7) within ten business days from the date of issuance of this Determination. A copy of the
request shall at the same time be sent by certified mail or hand delivery to the Conservation Commission
and to the applicant if he/she is not the appellant. The request shall state clearly and concisely the
objections to the Determination which is being appealed.To the extent that the Determination is based on
a municipal ordinance or bylaw and not on the Massachusetts Wetlands Protection Act or regulations, the
Department of Environmental Protection has no appellate jurisdiction.

ATTACHMENT A - PROJECT NARRATIVE
' 1.0 Overview
In accordance with the Massachusetts Wetland Protection Act (MGL c.131 s.40) and
implementing Regulations (310 CMR 10.00) (the "Act"), Salem State College ("SSC") ("the
Applicant") is requesting the Salem Conservation Commission (the "Commission") issue a
Negative Determination of Applicability with appropriate conditions for the construction of
an approximately 24' by 12' wood shed to be constructed on an existing concrete pier
located within Smith Pool, at 92 Fort Avenue, Salem, MA (See Figures 1 & 2). The shed
will be used to house tanks for larvae species used by the biology department for the
hatchery operation in Cat Cove.
IThe project will occur on a pier located above and adjacent to coastal wetland resource
areas including Land Under the Ocean, Coastal Bank, and Land Subject to Coastal Storm
Flowage (See Figures 2, 3 & 4).
2.0 Existing Conditions
The project site is an existing concrete pier located within Smith Pool, which is used as a
shellfish hatchery by the biology department at Salem State College. Smith Pool is a coastal
1 waterbody, which is dammed and managed by the college. Across the street from the peir
is the biology lab where the larvae of mussels and soft shell clams are grown.
As the larvae grow, they are transferred to Smith Pool until they reach an appropriate size
and are then transported to the coastal waters of the North Shore, South Shore and Boston
Harbor.
3.0 Wetland Resource Areas
Wetland scientists from Epsilon Associates, Inc. ("Epsilon") identified coastal resource areas
on the site from field investigation and review of aerial photography maps. The approximate
location of wetland resource areas are shown on Figure 4, attached. The wetland resource
area boundaries have been identified in accordance with the US Army Corps of Engineers
Wetlands Delineation Manual (January 1987) and the DEP Division of Wetlands and
Waterways (DWW) Policy 92-1, issued March 3, 1992 .
' The Massachusetts Natural Heritage and Endangered Species Program Atlas (MassGIS 2005)
does not identify an area of estimated habitat or certified vernal pools on or near the project
1 site.
3.1 Coastal Bank
Coastal Bank is defined at 310 CMR 10.30 (2) and the DWW, Policy 92-1. The Coastal
Bank adjacent to the existing concrete pier is armored with rip-stone and functions as a
vertical buffer to storm waters. The section of Coastal Bank adjacent to the pier does not

function as a sediment source to adjacent beaches. Project activities are not located on the
Coastal Bank, as they will be located on the existing pier, seaward of the Coastal Bank.
3.2 Land Subject to Coastal Storm Flowage
Land Subject to Coastal Storm Flowage ("LSCSF") is defined in 310 CMR 10.04. DEP uses
the 100-year coastal flooding event, as defined and mapped by the Federal Emergency
Management Agency ("FEMA") per the National Flood Insurance Rate Program, as the
maximum flood elevation associated with LSCSF, unless recorded storm data reveal a
higher flood elevation (which is the "storm of record"). According to the applicable Flood
Insurance Rate Map, a Zone A2, elevation 10, overlays the project site. The proposed shed
will be constructed on the existing pier, which, according to a plan entitled "Smith Pool
Regrading and Pier Construction, dated May of 1968" appears to be above the 100 year
flood elevation.
3.3 Land Under the Ocean
Land Under the Ocean ("LUO") is defined at 310 CMR 10.25 (2). It extends from the mean
low water line seaward to the boundary of the municipality's jurisdiction. The footings
associated with the existing pier exist within LUO. Project activities will be conducted on
the existing pier, therefore, no new impacts to LUO are proposed under this filing.
4.0 Proposed Activities
Proposed activities are limited to the installation of an approximately 24' by 12' foot wood
shed to be located at the end of the existing concrete pier (See Site Photographs,
Attachment B). The lab building located across the street from the pier has reached its
storage capacity for the larvae species. The proposed shed will be used to house tanks that
will contain the larvae species, until they are large enough to be deposited into Smith Pool.
Locating the shed on the existing pier will insure that the species will be quickly and safely
' transported into the water. The shed will be serviced by electricity. An electric line,
encased by pvc piping, will be installed from the shed to the existing electric transformer
located on the slated portion of the pier. (See Photograph 1, Attachment B). No plumbing
or heating will be installed in the shed.
Proposed activities will not result in any new impacts to wetland resource areas. The shed
will be located on an existing concrete pier and is not anticipated to impact the functions of
the adjacent coastal resource areas. It is unknown at this time whether the shed will be
constructed on the pier or whether it will be a prefabricated structure. Nevertheless, any
debris associated with the construction/assembly of the shed will be immediately removed
from the pier and disposed off properly

5.0 Conclusion
The project is limited to the installation of a wood shed on an existing pier associated with
the shellfish hatchery program managed by Salem State College. Impacts to wetland
resource areas have been avoided. The information contained in this Request for a
Determination of Applicability sufficiently describes the site and proposed activities. The
Applicant therefore respectfully requests that the Conservation Commission issue a
Negative Determination of Applicability approving the project with appropriate conditions.
