Pursuant to the authority of G.L. C.131 s.40, the Salem Conservation
Commission has considered your request for a -

has made the following determination:

2. [ ] The entire area shown on the plans is subject to the Act and shall
require a filing of the Notice of Intent.

require a filing of the Notice of Intent:

work is not dredging, filling, removing, or altering, and there-
fore a Notice of Intent is not required.
5. The determination that the work is not subject to the Act shall expire
within one (1) year from the date herein.
6. This determinaLion does not re.11eve the person requesting the determina-
tion from complying with all other applicable federal, state or local
statutes, ordinances, by-laws, and/or regulations.
7. Failure to comply with this determination and with all related statutes
and other regulatory measures shall be deemed cause to revoke or modify
the said determination.
8. No work may be commenced under this determination until 11 appeal pex�6ds�,/;
have elapsed.

Where the Department of Environmental Quality Engineering issues a negative `y
superseding determination, you are hereby notified of your right to a formal
hearing provided it is made within ten (1.0) days from the date of the super-

The proposed work is to erect an eight foot stockade fence with
metal posts in the rear section of an exsisting paved parking lot .
The project site is located on assessors map number 36, Lot
number 277 .

Dear Neighbor,
We are considering erecting a stockade fence in the rear
parking lot of the club to make a patio. In order to do this we must
have a determination of applicability of the Wetlands Protestion
Act from the Salem Conservation Commission. One of the requirement is
to notify the abutters of the proposed work site as to the work being
done . After the determination by the Conservation Commission we must
have a variance from the Building Inspecters' Office, and approval of
the Alcoholic Beverage Commission.
The proposed fence is purely a business improvement venture and
in no way should be considered as an anti-neighbor policy of the club.
On the contrary, the patio use will be restricted to certain seasons
and hours, and will be available for security parking etc . durring
the winter. These details haven't been worked out yet, and I would
appreciate any suggestions or recommendations that you may have, be
directed to me . Enclosed is a rough scetch of the proposed fence and
patio area. If you have any questions or suggestions, or if I can
