Findings Findings pursuant to the Massachusetts Wetlands Protection Act: Following the review of the above-referenced Notice of Intent and based on the information provided in this application and presented at the public hearing, this Commission finds that the areas in which work is proposed is significant to the following interests of the Wetlands Protection Act. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this Order. 2. The Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3. This Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state, or local statutes, ordinances, bylaws, or regulations. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: a. the work is a maintenance dredging project as provided for in the Act; or b. the time for completion has been extended to a specified date more than three years, but less than five years, from the date of issuance. If this Order is intended to be valid for more than three years, the extension date and the special circumstances warranting the extended time period are set forth as a special condition in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. Any fill used in connection with this project shall be clean fill. Any fill shall contain no trash, refuse, rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing. 7. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such an appeal has been taken, until all proceedings before the Department have been completed. 8. No work shall be undertaken until the Order has become final and then has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of the registered land, the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is done. The recording information shall be submitted to this Conservation Commission on the form at the end of this Order, which form must be stamped by the Registry of Deeds, prior to the commencement of work. 9. A sign shall be displayed at the site not less then two square feet or more than three square feet in size bearing the words, "Massachusetts Department of Environmental Protection" [or, WA DEP] "File Number 64-344 " 10. Where the Department of Environmental Protection is requested to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings and hearings before DEP. 11. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of Compliance (WPA Form 8A)to the Conservation Commission. 12. The work shall conform to the plans and special conditions referenced in this order. 13. Any change to the plans identified in Condition#12 above shall require the applicant to inquire of the Conservation Commission in writing whether the change is significant enough to require the filing of a new Notice of Intent. 14. The Agent or members of the Conservation Commission and the Department of Environmental Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours to evaluate compliance with the conditions stated in this Order, and may require the submittal of any data deemed necessary by the Conservation Commission or Department for that evaluation. This Order of Conditions shall apply to any successor in interest or successor in control of the property subject to this Order and to any contractor or other person performing work conditioned by this Order. 16. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland, the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden stakes or flagging. Once in place, the wetland boundary markers shall be maintained until a Certificate of Compliance has been issued by the Conservation Commission. 17. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means.At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his/her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to require additional erosion and/or damage prevention controls it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of work line has been approved by this Order. Appeals The applicant, the owner, any person aggrieved by this Order, any owner of land abutting the land subject to this Order, or any ten residents of the city or town in which such land is located, are hereby notified of their right to request the appropriate DEP Regional Office to issue a Superseding Order of Conditions. The request must be made by certified mail or hand delivery to the Department, with the appropriate filing fee and a completed Appendix E: Request of Departmental Action Fee Transmittal Form, as provided in 310 CMR 10.03(7) within ten business days from the date of issuance of this Order. The Conservation Agent will be notified 48 hours prior to commencement of construction activities(978-745- 9595 ext. 311). Members and agents of the Salem Conservation Commission(Commission)shall have the right to enter and inspect the premises to evaluate and ensure compliance with the conditions and performance standards stated in this Order,the Notice of Intent,the referenced plans,the Act,and 310 CMR 10.00, and may require any information,measurements,photographs,observation and/or materials or may require the submittal of any data or information deemed necessary by the Commission,agent, or DEP determines that any of the work is not in compliance with this Order of Conditions. Work shall not resume until the Commission is satisfied that the work will comply, and has so notified the applicant in writing. 2. Approval of this application does not constitute compliance with any law or regulation other than MGL Chapter 131, Section 40,and Wetlands Regulations 310 CMR 10.00. 3. This Order shall apply to any successor in control or successor in interest of the property described in the Notice of Intent and accompanying plans. These obligations shall be expressed in covenants in all deeds to succeeding owners or portions of the property. 4. The form provided at the end of this Order shall be completed and stamped at the Registry of Deeds after the expiration of the 10-day appeal period and within 30 days of the issuance if no request for appeal has been filed with the Department of Environmental Protection. This form shall be returned to the Commission within 21 days of recording accordance and prior to commencement of any activities subject to the Order of Conditions. 5. Prior to any work commencing,a sign shall be displayed showing DEP file#64-344,and not placed on a living tree. 6. The term"Applicant'as used in this Order of Conditions shall refer to the owner,any successor in interest or successor in control of the property referenced in the Notice of Intent,supporting documents and this Order of Conditions. The Commission shall be notified in writing within 30 days of all transfers of title of any portion of the property that takes place prior to issuance of the Certificate of Compliance. 7. It is the responsibility of the applicant to procure all other applicable federal,state and local permits and approvals associated with this project. These permits may include but are not necessarily limited to the following: (1) Section 404 of the Federal Water Pollution Control Act(P.L. 92-500, 86 stat. 816),U.S.Army Corp of Engineers. (2) Water Quality Certification in accordance with the Federal Water Pollution Control under authority of sec. 27(5)of Chapter 21 of the Massachusetts General Laws as codified (3) Flood Plain (4) Grading Ordinance 8. If there are conflicting conditions within this Order,the stricter condition(s)shall rule. 9. All work shall be performed so as to ensure that there will be no sedimentation into wetlands and surface waters during construction or after completion of the project. 10. The Commission and its Administrator shall have the discretion to modify the erosion/siltation control methods and boundary during construction if necessary. 11. All work shall be performed in accordance with this Order of Conditions and approved site plans(s). No alteration of wetland resource areas or associated buffer zone,other than that approved in this Order, shall occur on this property without prior approval from the Commission. 12. If any changes are made in the above-described plants)which may or will alter an area subject to protection under the Wetlands Protection Act, or any changes in activity subject to regulations under G.L. Ch. 131, Section 40,the applicant shall inquire from this Commission in writing,prior to their implementation in the field, whether the change(s)is significant enough to require the filing of a new Notice of Intent. Any error in the plans or information submitted by the applicant shall be considered changes and the above procedures shall be followed. A copy of such request shall at the same time be sent to the Department of Environmental Protection. 13. In conjunction with the sale of this property or any portion thereof before a Certificate of Compliance has been issued,the applicant or current landowner shall submit to the Commission a signed statement by the buyer that he/she is aware of an outstanding Order of Conditions on the property and has received a copy of the Order of Conditions. 14. Conditions number NA as indicated shall continue in force beyond the Certificate of Compliance, in perpetuity, and shall be referred to in all future deeds to this property. PRIOR TO CONSTRUCTION 15. Prior to commencement of any activity on this site,there shall be a PRECONSTRUCTION MEETING between the project supervision;the contractor responsible for the work or its administrator to and phone numbers of all responsible parties shall be registered with the Commission at the pre-construction meeting. 16. Prior to the pre-construction meeting and commencement of any activity on this site,sedimentation and erosion control barriers shall be installed as shown on the approval plan(s)and detail drawings. The Commssion and/or its Administrator shall inspect and approve such installation at the pre-construction meeting. 17. Prior to the commencement of any activity on this site, the applicant or current landowner shall submit to the Commission in writing a construction schedule/sequence of work to complete this project. 18. Prior to any work on site,the proposed limits of work shall be clearly marked with stakes or flags and shall be confirmed by the Commission or its Administrator. Such markers shall be checked and replaced as necessary and shall be maintained until all construction is complete. Workers shall be informed that no use of machinery, storage of machinery or materials,stockpiling of soil or construction activity is to occur beyond this line at anytime. 19. Prior to commencement of construction on site,the limits of wetland resource areas closest to construction activity shall be flagged with surveyor's tape and shall remain in place during construction. The limits of areas to be impacted and the limits of work in the replication area(s)shall be clearly flagged. 20. There shall be 20 hay bales and wooden staked stored under cover on the site to be used only for emergency erosion control. EROSION CONTROL 21. Appropriate erosion control devices shall be in place prior to the beginning of any phases of construction,and shall be maintained during construction in the wetland areas and buffer zones. The erosion control specification provided in the Notice of Intent and the erosion control provision in the Order will be the minimum standards for this project; additional measures may be required by the Commission. 22. All debris,fill and excavated material shall be stockpiled a location far enough away from the wetland resource areas to prevent sediment from entering wetland resource areas. 23. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as necessary. Any accumulated silt adjacent to the barriers shall be removed. 24. The areas of construction shall remain in a stable condition at the close of each construction day. 25. Any de-watering of trenches or other excavations required during construction shall be conducted so as to prevent siltation of wetland resource areas. All discharges from de-watering activities shall be filtered through haybale sediment traps,silt filter bags or other means approved by the Commission or its Administrator. 26. Within thirty days of completion of construction on any given portion of the project,all disturbed areas in the completed portion of the site shall be permanently stabilized with rapidly growing vegetative cover,using sufficient top soil to assure long-term stabilization of disturbed areas. 27. If soils are to be disturbed for longer than two months,a temporary cover of rye or other grass should be established to prevent erosion and sedimentation. If the season is not appropriate for plant growth,exposed surfaces shall be stabilized by other appropriate erosion control measures,firmly anchored,to prevent soils from being washed by rain or flooding. DURING CONSTRUCTION 28. A copy of the Order of Conditions construction plans,and copies of the documents and reports cited in Condition# 11, shall be on the site upon commencement and during any site work for contractors to view and adhere to. 29. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as necessary. Any accumulated silt adjacent to the barriers shall be removed. 30. Only clean fill, free of masonry, stumps,asphalt,and any other kind of waste material shall be used on the site. 31. All waste products,grubbed stumps, slash, construction materials, etc. shall be deposited at least 100 feet from wetland resource areas and 200 feet from rivers. 32. All filling or removal of waste material from the site shall be done in accordance with the regulations of the City of Salem Health Department. 33. Cement trucks shall not be washed out in any wetland resource or buffer zone area. Any deposit of cement or concrete products into a buffer zone or wetland resource area shall be removed by hand. 34. No fuel, oil,or other pollutants shall be stored in any resource area or the buffer zone thereto,unless specified in this Order of Conditions. 35. There shall be no pumping of water from wetland resource areas. 36. During construction,all drainage structures shall be inspected regularly and cleaned as necessary. 37. The project shall not cause an increase in run-off onto adjacent properties,either during construction or when completed. 38. The applicant is hereby notified that failure to comply with all requirements herein may result in the issuance of enforcement actions by the Conservation Commission including,but not limited to,civil administrative penalties under M.G.L. Chapter 21A,section 16. POST CONSTRUCTION 39. All disturbed areas,slopes and proposed landscape areas shall be loamed and seeded or stabilized through the use of erosion control blankets or other approved means. All disturbed areas will be graded, loamed, and seeded prior to November 1 of each year, if possible. No disturbed areas or stockpiled material will be left unprotected or without erosion controls during the winter. 40. Upon completion of construction,the applicant or current landowner shall submit the following to the Commission to request a Certificate of Compliance: (1) A letter requesting a Certificate including the following information: a. Name and address of current landowner; b. Name and address of the individual/trust or other entity to whom the Certificate is to be issued: c. Street address and lot number for the project;and d. DEP file number (2) A letter from a Registered Professional Engineering or Land Surveyor certifying compliance of the property with this Order of Conditions (3) An"As-Built'plan signed and stamped by a Registered Professional Engineer showing post-construction conditions and: a. As-built elevations of all drainage ways constructed within 100 feet of any wetland resource area; b. Why is Stormwater Standard 8 N/A? Because the site apparently exists as either partially paved or bare soil, and the project consists of re-vegetating existing bare soil and/or providing pavement, erosion control measures were not shown on the Notice of Intent Plan. Such measures could be incorporated by placing a hay bale line along the existing seawall if the Department and/or Commission feel that is necessary. Staking them would be difficult. 2. Where is page 3 of the Stormwater Management Form? The Stormwater Management Form, page 3, must not have copied, but was definitely included in the original. A copy is attached to this letter. 3. Where are the calcs for Vortechnics sizing? The calculations for the Vortechs sizing were included in the NOI, and a copy is attached to this letter. Sizing was based on a 25-year storm flow for the paved areas, as recommended by the manufacturer. We were unaware that the DEP has only rated the Vortechnics at 52% removal as the design information indicates 80%. Site constraints make it extremely difficult to provide other treatment, and the 52% removal would represent a substantial improvement over the untreated flow from pavement and bare soil currently entering the South River. 4. How is the Vortechnics numerically sized? The Vortechnics were sized based on the manufacturer's recommendation for size, knowing the 25- year storm. 5. Where are runoff calculations? What are provisions for 100-year flow? The existing drain system will be over capacity in the 100-year storm, and the site has been designed such that the flow will be over land, through the proposed swale, directly to the South River which, at this point, is tidal. 7. What are sump depths of yard drain, cbs, Dmh? Yard drains were proposed to be constructed out of a piece of 24-inch concrete pipe, and would have a sump depth of approximately one foot. That dimension was not labeled on the detail. It should be noted that the yard drains are designed to take only landscaped areas and walkways, and should not contain excessive amounts of particulate matter. No catch basins, per se, are proposed on the site as we cannot dig to include pipes for such a system over the 110,000-volt electric line. The one proposed drain manhole for the site, as shown on the detail, is proposed to have no sump. 8. How will ALL flows be treated by the Vortechnics? We do not propose to treat all flows with the Vortechnics, only flows from the paved area. Runoff from the landscaped area and walkways is designed to by-pass the Vortechnics and discharge directly to the South River. 9. O & M plan must l.d. responsible party, not use "should" other non-mandatory words. It is our understanding that the requirements of the Operation and Maintenance Plan will be mandatory to the Beverly Cooperative Bank, which will hold the lease on this parcel of land from the City of Salem. I would request that the mandatory requirements of this O&M plan be handled by a perpetual condition, making the easement holder responsible in perpetuity for all of the suggested maintenance procedures in the Operation and Maintenance Plan. The Vortechs System stormwater treatment system was chosen as a BMP (Best management practice)for TSS removal because it allows the stormwater flow from all paved areas to be conveyed through the system while still meeting maximum TSS removal. In addition, maintenance of accumulated sediments is easily accomplished with a vacuum truck. Based on previous designs, the engineers at Vortechs have determined that treatment system sizing should be based on the peak flow gererated from the 25-year 24-hour storm event. The peak flow is compared to their charts and an appropriately sized system is selected. The drainage calculations were based on the rational method. The only stormwater to be treated is the runoff from the paved area which is 0.202 acres. The intensity used for the 25-year storm is 6.0 inches/hour. Using these values with the rational method will produce a peak flow of 1.15 cubic feet per second.At this design flow rate the Vortechs Model 1000 (rated up to 1.6 CFS)was chosen as the appropriate design model for stormwater treatment. The room shall be available for use by community groups at no charge. Special Condition 5:The Licensee shall maintain a publicly-accessible interior walkway through the bank building connecting the public sidewalk on Lafayette Street to the public walkways on the seaward side of the building, as shown on the final license plans. The walkway shall be approximately 7 feet wide, and shall be open to the public free of charge during the bank's hours of operation. Special Condition 6: The Licensee shall make a monetary contribution of$10,000.00(Ten Thousand Dollars)to an account established by the City of Salem for the purpose of planning, programming, designing, constructing, and/or maintaining watersheet activation elements in the South River, consistent with the Salem Municipal Harbor Plan as approved by the Secretary of the Executive Office of Environmental Affairs on November 9,2000("MHP"). The payment shall be made to the City prior to the issuance of the Certificate of Occupancy for the bank. The Licensee shall provide proof of such payment to the Department within 10 days of said payment having been made. License No. 9814 Page 3 Special Condition 7: All exterior publicly accessible facilities, such as the open space,pathways benches,and parking spaces shall be open to the public,free of charge,twenty-four hours per day, seven days a week. The Licensee may adopt rules governing the publicly accessible areas of the site, subject to prior review and written approval by the Department, as are necessary for the protection of public health and safety and private property, and to ensure public use and enjoyment by minimizing conflicts between user groups. No amendment to said rules shall be made without prior written approval by the Department. The use by the public of the free open space facilities and Harborwalk in accordance with this License shall be considered a permitted use to which the limited liability provisions of M.G.L. Chapter 21 § 17c shall apply. Special Condition 8: The Licensee shall place and maintain in good repair signage of an adequate size to be clearly visible to pedestrians from all walkway connections entering onto the site from Lafayette Street, and any other adjacent streets, sidewalks, walkways or bicycle paths. Unless otherwise approved by the Department, said signage shall: notify the public of the availability of the publicly accessible waterfront walkways and related facilities; state the hours of access; state that the walkways and other public amenities were required by the Department of Environmental Protection, specifically referring to the Waterways License number of the project, and the location on the site where a copy of the License may be inspected by the public. Prior to placement of said signage,the Licensee shall submit a draft signage plan to the Department for its review and approval. Said plan shall identify the text and design of each sign, as well as the proposed location of each sign. Said signage shall be consistent with all local laws and regulations. Said signage specified in this condition shall be completed and installed on site in accordance with the schedule specified in Special Condition 9. Special Condition 9: Except as otherwise specified in this License,the publicly accessible pathways, open spaces,signage,interpretive elements,and other exterior public amenities required herein shall be constructed,installed,and opened to the public prior to the issuance of the Certificate of Occupancy for the bank. The community room in the south building shall be available to the public no later than the issuance of the Certificate of Occupancy for the south building,but in any event no later than six months after the issuance of the Certificate of Occupancy for the bank. The Licensee shall provide the Department with copies of the Certificates of Occupancy within 15 days of issuance. Special Condition 10: Public views of the South River from the pathways and public streets shall be maintained as shown on the final license plans. All open spaces shall remain clear of view- obstructing landscaping, awnings, or other visual obstructions unless approved in advance by the Department. Special Condition 11:The Licensee shall allow the public to pass on foot, free of charge, from dawn to dusk,for any lawful purpose within the area of the subject property lying seaward of the present mean high water mark. This condition shall not be construed to prevent the Licensee from taking reasonable measures to discourage unlawful activity by users of the area intended for public passage,including but not limited to trespassing on adjacent private areas,depositing refuse of any kind or nature in the water and shore, and from excluding the public from portions of said structure(s) or property not intended for pedestrian passage. Further, the exercise by the public of free on-foot passage in accordance with this condition shall be considered a permitted use to which the limited liability provisions of M.G.L. Chapter 21 § 17c shall apply. The intent of this condition is to provide access in and across the intertidal zone located ori-site for activities such as strolling and viewing of the harbor in addition to the public rights of fishing, fowling, and navigation which already exist in private tidelands. Said allowance of passage shall commence upon issuance of the license to be issued pursuant hereto. License No. 9814 Page 4 Special Condition 12: The Licensee shall allow connections to be made to the pathway authorized herein from any adjacent existing or future pathways,bikeways,sidewalks, or any other non- automobile public way. Soeeial Condition 13:Within sixty days of the completion of the project,but in no event later than five years from the date of license issuance,or any extension thereof, the Licensee shall apply to the Department for a Certificate of Compliance pursuant to the Waterways Regulations,and provide the Department with an as-built plan stamped and signed by a registered professional engineer licensed to do business in the Commonwealth. Special Condition 14: All work authorized herein shall be completed within five (5) years of the date of License issuance. Said construction period may be extended by the Department for one or more one year periods without public notice, provided that the Applicant submits a written „ request for an extension to the Department no later than thirty(30) days prior to the expiration of said construction. Special Condition 15: This License will be subject to an annual compliance fee for nonwater- dependent uses of tidelands pursuant to 310 CMR 4.00. Any unauthorized substantial change in use or unauthorized substantial structural alteration of any structure or fill authorized herein shall render this Waterways License void. 4.This Waterways License shall be revocable by the Department for noncompliance with the terms and conditions set forth herein. This License may be revoked after the Department has given written notice of the alleged noncompliance to the Licensee and those persons who have filed a written request for such notice with the Department and afforded them a reasonable opportunity to correct said noncompliance. Currently, the locus is fully developed, containing three commercial / industrial buildings, a variety of structures, fill material and areas of pavement. Portions of the project are within Land Subject to Coastal Storm Flowage, riverfront area and buffer zone areas as shown on the accompanying Hayes Engineering, Inc plan titled "Site Plan, Beverly Cooperative Bank, Derby and Lafayette Street, Salem, MA" and as described below. Activities proposed within coastal resource and buffer zone areas are jurisdictional under both the Massachusetts Wetlands Protection Act and the Salem Wetlands Protection Ordinance and are thus required to comply with regulatory standards. These standards and how the project will meet them are outlined below. Regulations Wetlands Protection Act (310 CMR 10.00 et. an ' Land Subject to Coastal Storm Flowage (310 CMR 10.04) Land Subject to Coastal Storm Flowage (LSCSF) is defined in 310 CMR 10.04 as "Land subject to any inundation caused by coastal storms up to and including that caused by the 100-year storm, surge of record or storm of record, whichever is greater". For this site, the upper extent of Land Subject to Coastal Storm Flowage is at elevation 10'. Approximately 11,800 square feet of this resource area will be altered by activities associated with construction of the parking lot as shown on the aforementioned plan and is therefore subject to regulation under the Massachusetts Wetlands Protection Act (M.G.L.ch. 131, sec. 40). However, there are no performance standards for activities ' proposed in this resource area specified within the Wetlands Protection Act Regulations. Buffer Zone Work will be conducted within the 100' buffer zone associated with a coastal Bank resource area located along the existing seawall. Approximately 20,250 s.f. of buffer zone disturbance will result from this project, as described above. The project will provide improvements to the buffer zone consisting of introduction of comprehensive stormwater management system to intercept and provide on-site treatment of runoff, reduction of impervious surface area, beautification through removal of unsightly materials, introduction of landscaped areas and creation of public walkways. Since there are no performance standards specified in the Ordinance, or any associated Regulations for work within these areas, no additional measures are proposed other than those described for the Massachusetts Wetlands Protection Act. 1 2 PROPOSED VORTECHS SIZING 1 BEVERLY CO-OPERATIVE BANK LAFAYETTE STREET @ DERBY STREET tSALEM, MASSACHUSETTS October 21, 2002 • ' The purpose of the following analysis is to determine the peak flow to the proposed treatment system (Vortechs system) such that 80%total suspended solids can be removed to meet as closely as possible the DEP Stormwater Management Policy criteria for water quality treatment. The Vortechs System stormwater treatment system was chosen as a BMP (Best management practice)for TSS removal because it allows the stormwater flow from all paved areas to be conveyed through the system while still meeting maximum TSS removal. In addition, maintenance of accumulated sediments is easily accomplished with a vacuum truck. , ' Based on previous designs, the engineers at Vortechs have determined that treatment system sizing should be based on the peak flow gererated from the 25-year 24-hour storm event. The peak flow is compared to their charts and an appropriately sized system is selected. ' The drainage calculations were based on the rational method. The only stormwater to be treated is the runoff from the paved area which is 0.202 acres. The intensity used for the 25-year storm is 6.0 inches/hour. Using these values with the rational method will produce a peak flow of 1.15 cubic feet per second. At this design flow rate the Vortechs Model 1000 (rated up to 1.6 CFS)was chosen as the appropriate design model for stormwater treatment. Introduction of stormwater treatment components on the site will be an improvement over current conditions, wherein most of the current runoff remains untreated. Runoff will be directed into a Best Management Practice consisting of a "Vortechs Stormwater Treatment System", which is designed as detailed in the accompanying document, "Proposed Vortechs Sizing" and as shown on the accompanying "Detail Plan". Maintenance of the Vortech Treatment System will be accomplished by adherence procedures specified in the attached "Maintenance" excerpt from the Vortechnics company 'Technical Design Manual". ' In the case of all stormwater management facilities, during construction if the proposed stormwater management system, the developer shall be the owner and party responsible for maintenance. Upon the satisfactory completion of site construction, is is assumed that the maintenance responsibilities of the stormwater management system shall be undertaken by the Owner. VORTECHSTM STORMWATER TREATMENT SYSTEM ' MAINTENANCE The Vortechs System should be inspected at regular intervals and maintained when necessary ' to ensure optimum performance. The rate at which the System collects pollutants will depend more heavily on site activities than the size of the unit, e.g., unstable soils or heavy winter sanding will cause the grit chamber to fill more quickly but regular sweeping will slow accumulation. ' Inspection Inspection is the key to effective maintenance and is easily performed. Vortechnics recommends ongoing quarterly inspections of the accumulated sediment. Pollutant deposition and transport may vary from year to year and quarterly inspections will help insure that Systems are cleaned out at the appropriate time. Inspections should be performed more often in the i ' winter months in climates where sanding operations may lead to rapid accumulations, or in equipment washdown areas. It is very useful to keep a record of each inspection. A simple form for doing so is provided. ' The Vortechs System should be cleaned when inspection reveals that the sediment depth has accumulated to within six inches of the dry-weather water surface elevation. This determination can be made by taking 2 measurements with a stadia rod or similar measuring device; one measurement from the manhole opening to the top of the sediment pile and the other from the manhole opening to the water surface. The System should be cleaned out if the difference between the two measurements is six inches or less. Note: to avoid underestimating the ' volume of sediment in the chamber, the measuring device must be lowered to the top of the sediment pile carefully. Finer, silty particles at the top of the pile typically offer less resistance to the end of the rod than larger particles toward the bottom of the pile. ' Cleaning Maintaining the Vortechs System is easiest when there is no flow entering the System. For this ' reason, it is a good idea to schedule the cleanout during dry weather. Cleanout of the Vortechs System with a vacuum truck is generally the most effective and convenient method of excavating pollutants from the System. If such a truck is not available, a "clamshell' grab may be used, but it is difficult to remove all accumulated pollutants with such devices. In Vortechs installations where the risk of large petroleum spills is small, liquid contaminants may not accumulate as quickly as sediment. However, an oil or gasoline spill should be ' cleaned out immediately. Motor oil and other hydrocarbons that accumulate on a more routine basis should be removed when an appreciable layer has been captured. To remove these pollutants, it may be preferable to use adsorbent pads since they are usually cheaper to dispose ' of than the oil water emulsion that may be created by vacuuming the oily layer. Trash can be netted out if you wish to separate it from the other pollutants. ' Accumulated sediment is typically evacuated through the manhole over the grit chamber. Simply remove the cover and insert the vacuum hose into the grit chamber. As water is evacuated, the water level outside of the grit chamber will drop to the same level as the crest of the lower aperture of the grit chamber. It will not drop below this level due to the fact that the ' bottom and sides of the grit chamber are sealed to the tank floor and walls. This "Water Lock" ' VORTECHSTM STORMWATER TREATMENT SYSTEM feature prevents water from migrating into the grit chamber, exposing the bottom of the baffle wall. Floating pollutants will decant into the grit chamber as the water level there is drawn down. This allows most floating material to be withdrawn from the same access point above the grit chamber. ' If maintenance is not performed as recommended, sediment may accumulate outside the grit chamber. If this is the case, it may be necessary to pump out all chambers. It is a good idea to check for accumulation in all chambers during each maintenance event to prevent sediment ' build up there. Manhole covers should be securely seated following cleaning activities, to ensure that surface ' runoff does not leak into the unit from above. The improvements include the renovation of the existing building, the construction of a drive through facility situated at the rear of the Building and the creation of seven (7)parking spaces situated at the rear of the Building. In connection with the Bank renovations, the Bank plans to renovate the existing buildings on this parcel into a branch office of approximately 6,700 square feet, with two (2)drive-thru teller lanes. The remainder of the buildings will be devoted to the following uses: 1. A semi-public access way through the building connecting Lafayette Street to the South Canal, which way would be open to the public during banking hours. 2. A community room at the south side of the complex for use by community groups for meetings. 3. Tenant spaces for professional offices complimentary to the banks business. These would consist of businesses such as real estate brokers, lawyers and accountants. To achieve these Improvements, the Bank proposes to participate in the development of public and private property situated at the rear of the building and adjacent to the proposed"Salem Harbor Walk"at the South Canal. While the development and construction of the Salem Harbor Walk will be undertaken by other third parties in the future, the Bank maintains that by acquiring control of these adjacent properties,the Bank will (1) improve access to the South River; (2)create green space (a park), (3) provide public parking and (4)furnish ' better access to the bank's drive-thru teller lanes. The Bank proposes to develop the following underutilized land at the rear of the property fronting the future"Salem Harbor Walk"and South Canal as follows: 1. Mass Electric(National Grid) Property The majority of the land to the rear of the buildings is owned by the City of Salem and Massachusetts Electric(National Grid). The National Grid lot contains approximately 9,009 square feet and is presently used by Mass Electric as a staging and cathode protection area for a 115,000 volt concrete encased power lines that lie underneath the site. There is a brick wall at the edge of the site toward the city's property.A chain link fence surrounds the remainder of the site. The majority of the site is a cracked concrete slab presently over grown with weeds and Sumac Saplings. After extensive negotiations, the Bank has secured a long-term lease of over 9,000 square feet of land owned by Mass Electric. The Bank plans to develop this land into seven public parking spaces (away from the river)adjacent to a landscaped area. Mass Electric will have easement rights to gain ' access to the electric cabinet. Of the original 9,009 SF, 4,087 SF will be devoted to landscaped areas and walkways. The Bank will also assume responsibility for making the improvements and maintaining the park, ' 3 additional green space and the public parking area. Adding the Mass Electric parcel to this project, at the expense of Beverly Cooperative Bank, is a unique feature of this project and will enable full public access that would be denied without this parcel. PROJECT DESCRIPTION (Continued) 2. City of Salem Property This lot contains approximately 12,953 SF and is presently used as an ad hoc gravel parking lot. A portion of the land (±910 SF) is occupied by an elevated concrete and steel ramp structure to the second floor of the corner building. It appears that this ramp was placed on city land without a formal easement being granted by the city. The bank will remove the ramp at its expense. There is also a large underground culvert with access hatches near and under the proposed Harborwalk. The Bank plans to develop this property into a landscaped ' park, walkways, a drive-thru canopy and supporting driveways. Of the original 12,963 SF,the Bank plans to convert 8,167 SF into landscaped areas and walkways.The Bank also plans to remove the elevated ramp. 3. Early Radio/TV Property(Now owned by Beverly Cooperative Bank) This lot contains 5,015 SF, which is mostly occupied by a single story building. To the rear or east of the lot is a small driveway and shed building containing approximately 1,524 SF. Presently 1,002 SF is devoted to ' driveways and shed, except for a small triangular plot of 522 SF next to the elevated ramp on the City of Salem property. The open areas of this property will be used as walkway access to the rear of the tenant areas and community room as well as landscaped space.A small portion will contain two public parking spaces. Of the original 1,524 SF, 1,220 SF will be allotted to landscaped areas and walkways. WATERWAYS AND TIDELANDS SECTION (Section IV B) Description of the Project's Consistency with the Municipal Harbor Plan The Salem Harbor Plan outlines a comprehensive strategy for protecting and enhancing the economic, environmental, historic and cultural resources related to Salem Harbor. In connection with the land-side components to the Plan, the Plan cites as a major objective the development of"Salem Harbor Walk,"a continuous pedestrian access along the edge of Salem Harbor from Winder Island to Palmer Cove. Because the proposed walkway may take significant time to develop, the Plan proposes that the City take advantage of opportunities to establish public access entitlements as they arise, either through ' municipal purchase of land or easements, state regulation under Chapter 91 or voluntary agreements with landowners. To achieve this result,the Plan includes several recommendations to make Salem's waterfront more recognizable as a distinct City district, and more easily accessible by foot, water, transit ' and automobile. The City also identified two regulatory parameters to proactively shape future development: (1) regulating the distribution of maritime industrial activity and the penetration of non-port development ' within the Designated Port area identified in the Plan; and (2)the imposition of two numerical standards alternative to those that the Department of Environmental Protection would ordinarily apply in controlling the footprint of new or expanded buildings for non-water dependent uses. As this Project is not situated ' within the Designated Port Area, item (1)above is not applicable. However,where, as here,the proposed project is situated along the South River, bounded by Peabody, Lafayette, Derby and Congress Streets,the aggregate site coverage of all non-water dependent buildings in the area (existing and new) shall (1) not exceed fifty percent of the total area, with the remaining area to be preserved as open space; (2) have a minimum setback of at least 20 feet from the existing shoreline; and (c)contain five"no-build" zones to provide public waterfront access. The Salem Harbor Plan calls for the City-owned parcel to be one of the three planned locations for future open space. The parcel is 12,963 square feet and currently contains a gravel parking area and a large ramp attached to the second floor of the adjacent structure. The Applicant proposes to construct two drive-thru teller lanes on a small portion of the lot. The remaining portion will be utilized for public ' open space, public parking and public walkways, all of which to be developed in connection with the Salem Harbor Walkway and consistent with the Salem Harbor Plan. Of the 12,963 square feet, 8,167 square feet will remain open, with landscaped areas and walkways. ' This Project involves renovations to existing buildings owned by the applicant at 73, 77, and 85 Lafayette Street, to be used as a bank branch with a drive-thru facility and leased units intended for professional offices. Except for the drive-thru facility, no new building construction will take place. In ' addition, the Bank proposes to develop property leased by the applicant from Massachusetts Electric and a proposed easement over land of the City of Salem, a portion of which to be used to provide access to the drive-through, with the remaining portions to be developed into a park and used for the Salem Harbor ' Walk. All landscaping, driveways, sidewalks, and lighting to the rear of the buildings will be constructed and maintained by the applicant in conjunction with City of Salem plans for construction of the Salem Harbor Walk along the South River. Existing natural features will be enhanced by the landscaping plan and pedestrian access. The existing topography will be maintained except for landscaping additions. ' Existing utilities will be utilized. The Bank proposes to make available public access to the Salem Harbor Walk and South River via the Lafayette and Derby Street entrances to the project site. The Bank also intends to create limited public access through the bank building and make available a community room for use by community groups. In Addition to the creation of the open space, the Applicant's project will highlight the following additional overall public benefits: 1. Parking spaces will be open to the public, and not limited to bank customers, to access ' the Salem Harbor Walk; 2. The interior of the new development will include a community room, available for neighborhood meetings and other public events; 3. The Bank will be creating a "front door"on the public walkway; 1 4. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: a. the work is a maintenance dredging project as provided for in the Act; or b. the time for completion has been extended to a specified date more than three years, but less than five years, from the date of issuance. If this Order is intended to be valid for more than three years, the extension date and the special circumstances warranting the extended time period are set forth as a special condition in this Order. ' 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. Any fill used in connection with this project shall be clean fill. Any fill shall contain no trash, refuse, rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing. 7. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such an appeal has been taken, until all proceedings before the Department have been completed. 8. No work shall be undertaken until the Order has become final and then has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his/her designee shall inspect the erosion controls ' on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to require additional erosion and/or damage prevention controls ' it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of work line has been approved by this Order. The Conservation Agent will be notified 48 hours prior to commencement of construction activities(978-745- 9595 ext. 311). Members and agents of the Salem Conservation Commission(Commission)shall have the right ' to enter and inspect the premises to evaluate and ensure compliance with the conditions and performance standards stated in this Order,the Notice of Intent,the referenced plans,the Act, and 310 CMR 10.00,and may require any information,measurements,photographs,observation and/or materials or may require the submittal ' of any data or information deemed necessary by the Commission,agent, or DEP determines that any of the work is not in compliance with this Order of Conditions. This form shall be returned to the Commission within 21 days of recording accordance and prior to commencement of any activities subject to the Order of Conditions. 5. The term"Applicant'as used in this Order of Conditions shall refer to the owner,any successor in interest or successor in control of the property yreferenced in the Notice of Intent,supporting documents and this Order of ' Conditions. The Commission shall be notified in writing within 30 days of all transfers of title of any portion of the property that takes place prior to issuance of the Certificate of Compliance. 7. It is the responsibility of the applicant to procure all other applicable federal, state and local permits and ' approvals associated with this project. These permits may include but are not necessarily limited to the following: (1) Section 404 of the Federal Water Pollution Control Act(P.L. 92-500,86 stat. 816),U.S.Army Corp of Engineers. All work shall be performed so as to ensure that there will be no sedimentation into wetlands and surface waters during construction or after completion of the project. ' 10. The Commission and its Administrator shall have the discretion to modify the erosion/siltation control methods and boundary during construction if necessary. 11. All work shall be performed in accordance with this Order of Conditions and approved site plans(s). No ' alteration of wetland resource areas or associated buffer zone,other than that approved in this Order,shall occur on this property without prior approval from the Commission. r ' 12. If any changes are made in the above-described plan(s)which may or will alter an area subject to protection under the Wetlands Protection Act,or any changes in activity subject to regulations under G.L. Ch. 131,Section 40,the applicant shall inquire from this Commission in writing,prior to their implementation in the field, ' whether the change(s) is significant enough to require the filing of a new Notice of Intent. Any error in the plans or information submitted by the applicant shall be considered changes and the above procedures shall be followed. A copy of such request shall at the same time be sent to the Department of Environmental Protection. 13. In conjunction with the sale of this property or any portion thereof before a Certificate of Compliance has been issued,the applicant or current landowner shall submit to the Commission a signed statement by the buyer that he/she is aware of an outstanding Order of Conditions on the property and has received a copy of the Order of Conditions. 14. Conditions number NA as indicated shall continue in force beyond the Certificate of Compliance, in perpetuity, and shall be referred to in all future deeds to this property. PRIOR TO CONSTRUCTION 15. Prior to commencement of any activity on this site,there shall be a PRECONSTRUCTION MEETING between the project supervision;the contractor responsible for the work or its administrator to and phone numbers of all responsible parties shall be registered with the Commission at the pre-construction meeting. ' 16. Prior to the pre-construction meeting and commencement of any activity on this site, sedimentation and erosion control barriers shall be installed as shown on the approval plan(s)and detail drawings. The Commssion and/or its Administrator shall inspect and approve such installation at the pre-construction meeting. ' 17. Prior to the commencement of any activity on this site,the applicant or current landowner shall submit to the Commission in writing a construction schedule/sequence of work to complete this project. ' 18. Prior to any work on site,the proposed limits of work shall be clearly marked with stakes or flags and shall be confirmed by the Commission or its Administrator. Such markers shall be checked and replaced as necessary and shall be maintained until all construction is complete. Workers shall be informed that no use of machinery, t storage of machinery or materials,stockpiling of soil or construction activity is to occur beyond this line at anytime. 19. Prior to commencement of construction on site,the limits of wetland resource areas closest to construction activity shall be flagged with surveyor's tape and shall remain in place during construction. The limits of areas to be impacted and the limits of work in the replication area(s)shall be clearly flagged. ' 20. There shall be 20 hay bales and wooden staked stored under cover on the site to be used only for emergency erosion control. EROSION CONTROL 21. Appropriate erosion control devices shall be in place prior to the beginning of any phases of construction,and shall be maintained during construction in the wetland areas and buffer zones. The erosion control specification ' provided in the Notice of Intent and the erosion control provision in the Order will be the minimum standards for this project;additional measures may be required by the Commission. 22. All debris,fill and excavated material shall be stockpiled a location far enough away from the wetland resource ' areas to prevent sediment from entering wetland resource areas. 23. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as ' necessary. Any accumulated silt adjacent to the barriers shall be removed. 24. The areas of construction shall remain in a stable condition at the close of each construction day. ' 25. Any de-watering of trenches or other excavations required during construction shall be conducted so as to prevent siltation of wetland resource areas. All discharges from de-watering activities shall be filtered through haybale sediment traps,silt filter bags or other means approved by the Commission or its Administrator. ' 26. Within thirty days of completion of construction on any given portion of the project, all disturbed areas in the completed portion of the site shall be permanently stabilized with rapidly growing vegetative cover,using sufficient top soil to assure long-term stabilization of disturbed areas. 27. If soils are to be disturbed for longer than two months,a temporary cover of rye or other grass should be established to prevent erosion and sedimentation. If the season is not appropriate for plant growth,exposed ' surfaces shall be stabilized by other appropriate erosion control measures,firmly anchored,to prevent soils from being washed by rain or flooding. DURING CONSTRUCTION ' 28. A copy of the Order of Conditions,construction plans,and copies of the documents and reports cited in Condition# 11, shall be on the site upon commencement and during any site work for contractors to view and ' adhere to. 29. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as necessary. Any accumulated silt adjacent to the barriers shall be removed. 30. Only clean fill,free of masonry,stumps,asphalt,and any other kind of waste material shall be used on the site. ' 31. All waste products,grubbed stumps,slash,construction materials,etc.shall be deposited at least 100 feet from wetland resource areas and 200 feet from rivers. 32. All filling or removal of waste material from the site shall be done in accordance with the regulations of the ' City of Salem Health Department. 33. Cement trucks shall not be washed out in any wetland resource or buffer zone area. Any deposit of cement or ' concrete products into a buffer zone or wetland resource area shall be removed by hand. 34. No fuel,oil,or other pollutants shall be stored in any resource area or the buffer zone thereto,unless specified in this Order of Conditions. 35. There shall be no pumping of water from wetland resource areas. ' 36. During construction,all drainage structures 'shall be inspected regularly and cleaned as necessary. 37. The project shall not cause an increase in run-off onto adjacent properties,either during construction or when completed. 38. The applicant is hereby notified that failure to comply with all requirements herein may result in the issuance of enforcement actions by the Conservation Commission including,but not limited to,civil administrative ' penalties under M.G.L. Chapter 21A,section 16. POST CONSTRUCTION 39. All disturbed areas,slopes and proposed landscape areas shall be loamed and seeded or stabilized through the use of erosion control blankets or other approved means. All disturbed areas will be graded, learned,and seeded prior to November 1 of each year, if possible. No disturbed areas or stockpiled material will be left ' unprotected or without erosion controls during the winter. ' 40. Upon completion of construction,the applicant or current landowner shall submit the following to the Commission to request a Certificate of Compliance: ' (1) A letter requesting a Certificate including the following information: a. Name and address of current landowner; b. Name and address of the individual/trust or other entity to whom the Certificate is to be issued: c. Street address and lot number for the project;and ' d. DEP file number (2) A letter from a Registered Professional Engineering or Land Surveyor certifying compliance of the property with this Order of Conditions ' (3) An"As-Built'plan signed and stamped by a Registered Professional Engineer showing post-construction conditions and: a. As-built elevations of all drainage ways constructed within 100 feet of any wetland resource area; b. As-built elevations and grades of all filled or altered wetland resource areas,buffer zones and ' replicated areas;and c. Distances to all structures within 100 feet of any wetland resource area. ' 41. When issued,the Certificate of Compliance must be recorded at the Essex County Registry of Deeds. 42. If the completed work differs from that in the original plans and conditions,the report must specify how the work differs;at which time the applicant shall first request a modification to the Order. Only upon review and ' approval by the Commission,may the applicant request in writing a Certificate of Compliance as described above. ' 43.
