significance of the Wetlands Protection Act, Massachusetts

The approximately 0.58 acre site contains a single story brick building which covers approximately 10%of the site.
IU remainder of the Site is occupied by a concrete parking lot and driveway. The southem portion of the site falls
' within the 100 year flood plain of the South River,which bounds the site to the south. 'Site topography is flat and
the site is serviced by municipal utilities. Mitch of the site falls within the 100 foot buffer zone of the South River,
a tidally influenced coastal wetland resource area.
' In January, 1988, two monitoring wells were.installed at this Site. At this time,petroleum hydrocarbon (fuel oil)
contaminated groundwater was observed beneath the site's parking area,within the 100 foot wetland buffer zone. In
February, 1988,a passive recovery well was installed in an Wart to collect free phase fuel oil from within the site's
groundwater.' For the past two years,free phase fuel oil
product has baa periodically observed within one of the two
monitoring hells,and occassionally has been niaatmlly skimmed Gom the auface of the passive recovery well.
3. The work in said area is described below.(Use additional paper.I necessary,to describe the
Proposed work.)
' Because the passive recovery system has been unsuccessful in collecting all free phase fuel oil contaminated
groundwater.the applicant proposes to enhance die performance of ithe existing recovery system and proceed with an
active groundwater recovery system. The passive recovery system will be upgraded by placement of a submersible
sump pump in the passive recovery well. The oil/groundwater mixture will be pumped into an off/water separator,
' and oil will be removed from the water,and disposed of properly. The applicant proposes pumping the groundwater,
after treatment. into the South River. Prior to discharge into the South River,an NPDES permit will be obtained,
or an EPA waiver from NPDES permit requirements granted. In addition,as necessary,the applicant proposes the
removal of petroleum hydrocarbon-cauamirrced sails 6om this Site in accordance with all appropriate regulations.

' This letter constitutes an addition to the September 4, 1990 Request for
Determination of Applicability under the Massachusetts Wetlands Protection Act (M.GL.
' c.131, s.40) and the City of Salem Wetlands Ordinance, for a parcel of property at 285
Derby Street, Salem, Massachusetts,hereinafter referred to as the "Site". The purpose of
' this communication is to provide further information regarding proposed remedial activities
associated with the clean-up of petroleum hydrocarbon contaminated groundwater and soils
at the above-referenced Site. The applicant proposes to conduct Site modifications required
to reach compliance with the current provisions of Massachusetts General Law (MGL)
Chapter 21E and all implementing regulations.
' All Wetland Resource Areas described herein by Gulf of Maine Research Center,
' Inc. (GMRC) are defined according to the Massachusetts Wetlands Protection Act (M.GL.
Chapter 131, Section 40) and Regulations(310 CMR 10.00), as well as the City of Salem
' Wetlands Bylaw.

Site Location and Description
' The approximately 0.58 acre Site is located at 285 Derby Street(U.S. Route 1A),
within metropolitan Salem(Central Development District, City of Salem zoning B-5) (see
' Figure 1). A single story brick building occupies much of the western portion of the Site;
the remainder of the Site contains a concrete driveway and parking area. The property is
serviced with municipal utilities,including water and sewerage. Four 275 gallon above-
ground fuel storage tanks are located in the buidling's boiler room. Directly to the south of
the Site is the South River, a tidally influenced body of water isolated from the Site by a
granite seawall. Site topography is nearly level and the property is situated within an
elevation of 10-20 feet NGVD.
' Wetland Resource Areas
' The Site contains the following Coastal Wetland Resource Areas: Coastal Bank (the
granite seawall, 310 CMR 10.30) and Land Subject to Coastal Storm Flowage (3 10 CMR
' 10.02).
Any activity proposed or undertaken within an area subject to protection under the
' Act which will remove, fill, dredge, or alter that area subject to protection under the Act
requires the filing of a permit application describing the proposed project to the
' Conservation Commission. The state Wetlands Regulations also provide a 100 foot Buffer
Zone outside of the resource area Coastal Bank, but not outside of Land Subject to Coastal
' Storm Flowage. Any activity in this Buffer Zone must not destroy or otherwise impair a
protected Wetland Resource Area.
Site History and Assessment
' Based on a visual assesment of the Site,research with state and local officials, and
results from subsurface testing,evidence indicates that the Site contains petroleum
' hydrocarbon(fuel oil)contamination.
' In January, 1988, two monitoring wells were installed by GMRC beneath the Site's
parking area. At this time,petroleum hydrocarbon contaminated groundwater was observed within
the 100 foot wetland buffer zone. In February, 1988, Kurz Associates, of Bridgewater,
Massachusetts, installed a passive recovery well in the parking area in an effort to collect free phase
fuel oil from the site's groundwater. For the past two years, free phase fuel oil product has been

periodically observed within one of the two GMRC monitoring wells; however,only limited
quantities of fuel oil have been recovered(via manual skimming) from the surface of the passive
recovery well since 1988.
' Because the passive recovery system has been unsuccessful in collecting all free phase fuel
' oil contaminated groundwater,the applicant, and their environmental consultant, Kurz Associates,
Inc.,propose to enhance the performance of the existing recovery system and proceed with an
active groundwater recovery system. The passive recovery system will be upgraded by placement
' of a submersible sump pump in the passive recovery well. The oil/groundwater mixture will be
pumped into an oil/water separator, and oil will be removed from the water, and disposed of
' properly.
' There are three means of handling the effluent water after the groundwater has
passed through the oil/water separator: 1)It can be disposed of at an off-site facility; 2)The
' treated groundwater can be sampled, analyzed, and if appropriate, discharged into the
municipal sanitary sewer system; 3)The treated groundwater can be sampled, analyzed,
and if appropriate, discharged into the South River.

Because the treated groundwater is expected to contain minimal concentrations of
' petroleum hydrocarbons,discharge of the effluent into the municipal sanitary sewer system
or off-site disposal are not appropriate effluent disposal alternatives. The applicant
proposes pumping the treated groundwater into the South River. Prior to discharge into the
South River, an NPDES discharge permit (or an EPA exemption from NPDES discharge
' permit requirements),and any other permits required by state, local, and federal agencies
will be obtained.
' In addition, sampling and analyses of soils at the Site indicate that petroleum
hydrocarbon soil contamination exists. All contaminated soil will be handled in accordance
' with the Massachusetts Contingency Plan ( 310 CMR 40.00 ) and DEP Policy WSC 89-
001. In order to meet these regulatory requirements,contaminated soils must be excavated,
' temporarily stockpiled, and covered with polypropylene sheeting to prevent potential
erosion, siltation, and contamination of the coastal resource area. The excavation pit will
' be filled with clean soil and graded, and all stockpiled soil will be surrounded by an oil-
containment boom and hay bales will be placed down-gradient to prevent any leachate from
impacting the coastal waterway. Once permission from the DEP Hazardous Waste

Division is granted,the applicant proposes to dispose of all contaminated soils at an off-site
' facility.
' Summary
Because proposed construction activties will take place approximately 50 feet from
' the granite seawall of South River(coastal bank),the applicant has filed the accompanying
Request for Determination under the Wetlands Protection Act. The applicant proposes
excavation of petroleum hydrocarbon contaminated soils, stockpiling of these soils on-site,
' and soil removal in accordance with DEP requirements. In addition, the applicant proposes
discharging treated groundwater into the South River. All work done at the Site will be
conducted so as to prevent any further impact to the coastal resource area and it is
anticipated that the removal of oil-contaminated fill as a potential source of contamination
' will improve the area as a coastal resource.
' We respectfully request that the Salem Conservation Commission issue a negative
Determination of Applicability (#3 ), because the work described in this request "is within
the Buffer Zone, as defined in the regulations,but will not alter an Area Subject to

' The activities in which GMRC engages are multi-disciplinary,
and they involve interacting with facility managers, attorneys,
engineers, geologists, geohydrologists, chemists, biologists,
' economists and planners. GMRC often works with solid and .liquid
waste disposal alternatives, treatability of wastes, surface and
ground water contamination, and the impacts of hazardous materials
' and chemicals on the environment and on public health and safety.
The Center evaluates ocean outfalls and impacts to other water uses,
defines wetland boundaries, defines compensation for wetland
' utilization, evaluates feasibility of dredging and disposal of
dredge spoils, and prepares Environmental Impact Statements,
Environmental Impact Reports and applications for environmental
permits and approvals.
tDr. Hugh F. Mulligan, the Director of the Gulf of Maine
Research Center, Inc. , consults with other individuals or firms, as

necessary, to carry out the Center' s environmental programs. Prior
to establishing this company, Dr. Mulligan worked for ten years with
engineering and environmental consulting firms and spent fifteen
' years in academic research, teaching and public service.
Dr. Mulligan has authored more than 50 scientific publications
on Limnology, Aquatic Botany, Phytoplankton, and Oceanography and
' has presented papers at national and international symposia. He was
awarded an NSF Fellowship at Cornell in 1961, .was awarded a
Fulbright Fellowship to develop a Center of Excellence in
' Oceanography at the University of Karachi in Pakistan in 1975-76 ,
and in 1975 was selected by the U.S. and Rumanian Academies of
Sciences for a ten-month Exchange Research Fellowship to study the
' Danube Delta of the Black Sea. He has worked closely with
scientists from the Agency for International Development, World
Bank, The United Nations Food and Agricultural Organization, United
Nations Development Program, and other international agencies.
' Dr. Mulligan has had considerable experience in working on
projects that were quite controversial and often precedent setting.
' His role has been to design and receive industry and regulatory
approval for special studies which satisfied the letter of the
regulatory requirements and which were technically sound and cost

' This letter constitutes an addition to the September 4, 1990 Request for
Determination of Applicability under the Massachusetts Wetlands Protection Act (M.GL.
' c.131,s.40) and the City of Salem Wetlands Ordinance,for a parcel of property at 285
Derby Street, Salem,Massachusetts,hereinafter referred to as the"Site". The purpose of
tthis communication is to provide further information regarding proposed remedial activities
associated with the clean-up of petroleum hydrocarbon contaminated groundwater and soils
at the above-referenced Site. The applicant proposes to conduct Site modifications required
to reach compliance with the current provisions of Massachusetts General Law(MGL)

' Site Location and Description
The approximately 0.58 acre Site is located at 285 Derby Street(U.S. Route 1A),
within metropolitan Salem(Central Development District, City of Salem zoning B-5) (see
Figure 1). A single story brick building occupies much of the western portion of the Site;
the remainder of the Site contains a concrete driveway and parking area. The property is
' serviced with municipal utilities,including water and sewerage. Four 275 gallon above-
ground fuel storage tanks are located in the buidling's boiler room. Directly to the south of
' the Site is the South River,a tidally influenced body of water isolated from the Site by a
granite seawall. Site topography is nearly level and the proo'erty is situated within an
' elevation of 10-20 feet NGVD.
Wetland Resource Areas
' The Site contains the following Coastal Wetland Resource Areas: Coastal Bank (the
granite seawall, 310 CMR 10.30) and Land Subject to Coastal Storm Flowage (310 CMR
' 10.02).
' Any activity proposed or undertaken within an area subject to protection under the
Act which will remove, fill,dredge,or alter that area subject to protection under the Act
requires the filing of a permit application describing the proposed project to the
Conservation Commission. The state Wetlands Regulations also provide a 100 foot Buffer
Zone outside of the resource area Coastal Bank, but not outside of Land Subject to Coastal -
Storm Flowage. Any activity in this Buffer Zone must not destroy or otherwise impair a
protected Wetland Resource Area.
' Site History and Assessment
Based on a visual assesment of the Site,research with state and local officials, and
t results from subsurface testing,evidence indicates that the Site contains petroleum
hydrocarbon(fuel oil)contamination.

In addition, the staff •of the Gulf of Maine Research Center,
Inc. , has experience in siting numerous land based and offshore
' energy facilities including:
* Obtaining U.S. Environmental Protection Agency (Region 2)
' N.P.D.E.S. permit to allow ocean disposal of drilling mud
and cuttings in the Mid Atlantic and therefore enabled
offshore oil and gas exploration to proceed.
' * Preparing permit strategy, documents and environmental
reports and designing, subcontracting and supervising
studies of land, water, and air environment for EG&G New
' England Energy Park 10,000 ton/day coal gasification
plant proposed for Fall River, MA.
' * Preparing permit strategy and documents for proposed New
England Electric - EG&G co-generation plant to generate
process steam and electricity at Millers Falls, MA.
' * Directing application for waiver of stack tests at NASA
Hazardous Waste Rocket Fuel Incinerator at Kennedy Space
Center.
' Gulf of Maine Research Center has also arranged and conducted
a series of U.S. Industrial Pollution Control Tours for selected
' international environmental officials. This work is being
undertaken for the World Environment Center and U.S. Department of
State (Agency for International Development) . The Center has
arranged the itinerary and conducted a tour for the Environmental
Protection Minister of Tunisia, who visited industrial facilities in
Massachusetts, Pennsylvania, New York, Texas and Florida. Similar
visits are planned for other senior international environmental
' officials.

The activities in which GMRC engages are multi-disciplinary,
and they involve interacting with facility managers, attorneys,
' engineers, geologists, geohydrologists, chemists, biologists,
economists and planners. GMRC often works with solid and liquid
waste disposal alternatives, treatability of wastes, surface and
' ground water contamination, and the impacts of hazardous materials
and chemicals on the environment and on public health and safety.
The Center evaluates ocean outfalls and impacts to other water uses,
defines wetland boundaries, defines compensation for wetland
' utilization, evaluates feasibility of dredging and disposal of
dredge spoils, and prepares Environmental Impact Statements,
Environmental Impact Reports and applications for environmental
permits and approvals.
Dr. Hugh F. Mulligan, the Director of the Gulf of Maine
' Research Center, Inc. , consults with other individuals or firms, as
necessary, . to carry out the Center' s environmental programs. Prior
to establishing this company, Dr. Mulligan worked for ten years with
engineering and environmental consulting firms and spent fifteen
' years in academic research, teaching and public service.
Dr. Mulligan has authored more than 50 scientific publications
' on Limnology, Aquatic Botany, Phytoplankton, and Oceanography and
has presented papers at national and international symposia. He was
awarded an NSF Fellowship at Cornell in 1961, .was awarded a
Fulbright Fellowship to develop a Center of Excellence in -
' Oceanography at the University of Karachi in Pakistan in 1975-76,
and in 1975 was selected by the U.S. and Rumanian Academies of
Sciences for a ten-month Exchange Research Fellowship to study the
' Danube Delta of the Black Sea. He has worked closely with
scientists from the Agency for International Development, world
Bank, The United Nations Food and Agricultural Organization, United
' Nations Development Program, and other international agencies.
Dr. Mulligan has had considerable experience in working on
' projects that were quite controversial and often precedent setting.
His role has been to design and receive industry and regulatory
approval for special studies which satisfied the letter of the
regulatory requirements and which were technically sound and cost
' effective. As the studies are being performed, he works closely
with regulatory officials to insure that they are well informed and
that the statutory requirements are met.

Additional projects completed by Dr. Mulligan include:
* Obtaining all environmental permits for Allied Specialty
' Chemical Oximes Plant in Hopewell, VA.
* Designing regulatory studies, preparing a compliance plan
and obtaining ocean dumping permits for Allied Chemical
Company enabling them to discharge industrial wastes into
' an approved disposal area in the Mid-Atlantic.
* Preparing the first Environmental Reports which achieved
compliance with U.S.G.S. Regulations and consistency
t with Coastal Zone Management Regulations for companies
exploring for oil and gas off Mid and North Atlantic coasts.
* Obtaining N.P.D.E.S. permits for Hudson River Power Plants
' with Thermal Discharge Demonstration Compliance Studies.
* Designing and conducting complex studies on the
Phytoplankton Productivity of Georges Bank for the U.S.
' Bureau of Land Management which were essential to permit
oil and gas exploration.
* Designing an Ocean Dumping Compliance Program for the
Government of Australia.
' * Evaluating dredging and ocean disposal of dredged
materials for the U.S.Army Corps of Engineers at
Roosevelt Roads Naval Base, Puerto Rico.
' Experience with projects such as these has enabled Dr.
Mulligan to analyze environmental problems and identify the most
cost effective - technically sound solution. Dr. Mulligan can -
t provide a third party role by preparing or reviewing proposed
scopes-of-work; reviewing proposals and performing a technical
overview of reports and studies while the work is in progress.
