Following the review of the above-referenced Notice of Intent and based on the information provided in
this application and presented at the public hearing, this Commission finds that the areas in which work is

General Conditions (only applicable to approved projects)
1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory
measures, shall be deemed cause to revoke or modify this Order.
2. The Order does not grant any property rights or any exclusive privileges; it does not authorize any
injury to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal, state, or local statutes, ordinances, bylaws, or regulations.

4. The work authorized hereunder shall be completed within three years from the date of this Order
unless either of the following apply:
a. the work is a maintenance dredging project as provided for in the Act; or
b. the time for completion has been extended to a specified date more than three years, but less
than five years, from the date of issuance. If this Order is intended to be valid for more than three
years, the extension date and the special circumstances warranting the extended time period are
set forth as a special condition in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill.Any fill shall contain no trash, refuse,
rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard,
pipe, tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing.
7. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such
an appeal has been taken, until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Order has become final and then has been recorded in the
Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title
of the affected property. In the case of recorded land, the Final Order shall also be noted in the
Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to
be done. In the case of the registered land, the Final Order shall also be noted on the Land Court
Certificate of Title of the owner of the land upon which the proposed work is done. The recording
information shall be submitted to this Conservation Commission on the form at the end of this Order,
which form must be stamped by the Registry of Deeds, prior to the commencement of work.
9. A sign shall be displayed at the site not less then two square feet or more than three square feet in
size bearing the words,
"Massachusetts Department of Environmental Protection" [or, "MA DER]

10. Where the Department of Environmental Protection is requested to issue a Superseding Order, the
Conservation Commission shall be a party to all agency proceedings and hearings before DEP.
11. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of
Compliance (WPA Form 8A)to the Conservation Commission.
12. The work shall conform to the plans and special conditions referenced in this order.
13. Any change to the plans identified in Condition#12 above shall require the applicant to inquire of the
Conservation Commission in writing whether the change is significant enough to require the filing of a
new Notice of Intent.
14. The Agent or members of the Conservation Commission and the Department of Environmental
Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours
to evaluate compliance with the conditions stated in this Order, and may require the submittal of any
data deemed necessary by the Conservation Commission or Department for that evaluation.

15. This Order of Conditions shall apply to any successor in interest or successor in control of the
property subject to this Order and to any Contractor or other person performing work conditioned by
this Order.
16. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland,
the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden
stakes or flagging. Once in place, the wetland boundary markers shall be maintained until a
Certificate of Compliance has been issued by the Conservation Commission.
17. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully
stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or
water body. During construction, the applicant or his/her designee shall inspect the erosion controls
on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately
control any erosion problems that occur at the site and shall also immediately notify the Conservation
Commission, which reserves the right to require additional erosion and/or damage prevention controls
it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of
work line has been approved by this Order.

C. Appeals
The applicant, the owner, any person aggrieved by this Order, any owner of land abutting the land subject
to this Order, or any ten residents of the city or town in which such land is located, are hereby notified of
their right to request the appropriate DEP Regional Office to issue a Superseding Order of Conditions.
The request must be made by certified mail or hand delivery to the,Department, with the appropriate filing
fee and a completed Appendix E: Request of Departmental Action Fee Transmittal Form, as provided in
310 CIVIR 10.03(7)within ten business days from the date of issuance of this Order. A copy of the request
shall at the same time be sent by certified mail or hand delivery to the Conservation Commission and to
the applicant, if he/she is not the appellant.
The request shall state clearly and concisely the objections to the Order which is being appealed and how
the Order does not contribute to the protection of the interests identified in the Massachusetts Wetlands
Protection Act, (M.G.L. c. 131, § 40)and is inconsistent with the wetlands regulations (310 CIVIR 10.00).
To the extent that the Order is based on a municipal ordinance or bylaw, and not on the Massachusetts
Wetlands Protection Act or regulations, the Department has no appellate jurisdiction.
D. Recording Information
This Order of Conditions must be recorded in the Registry of Deeds or the Land Court for the district in
which the land is located, within the chain of title of the affected property. In the case of recorded land, the
Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land
subject to the Order. In the case of registered land, this Order shall also be noted on the Land Court
Certificate of Title of the owner of the land subject to the Order of Conditions. The recording information

DERBY WHARF ,
1. All work shall conforin to the above-referenced Notice of Intent, site plan and supporting
documents and those final specifications which shall be filed with the Commission prior to
construction. Any change made or intended to be made to the approved plans shall require the
applicant to inquire of theCommission in writing whether the change is substantial enough to
require the filing of a new Notice of Intent.
2. Members.and agents of the Commission shall have the right to enter and inspeathe
premises at all reasonable times to evaluate compliance with the conditions in this Order. The
Commission may require the applicant to submit additional data or information necessary for the
Commission to conduct that evaluation.,
3. Upon completion of the project,the applicant shall submit,with the request for a
Certification of Compliance, an affidavit,prepared by a professional engineer or land surveyor
registered in the Commonwealth of Massachusetts, stating that the site has been'developed in
accordance with the requirements of this Order of Conditiorls,the referenced site-plan and
supporting documents.
4. This Order shall apply to every successor in control or successor in interest of the
property described int he Notice of Intent and accompanying plans or part thereof. In the event
this land or any part thereof changes ownership before or during construction,the current owner
shall notify the new owner,by registered mail,of this Order prior to the transfer of ownership
and shall forward proof of this notification to the Commission.
5. Additional erosion and sedimentation control measures deemed necessary by the
Commission shall be instituted by the applicant. Any siltation caused onto any welland or
waterway area shall be promptly reported to the Commission. Such areas shall be restored to the
satisfaction of the Commission.
6. During construction,no debris,fill,or excavated material shall be stockpiled within 100
feet of the high tide line. Any other stockpile location will be protected sufficient to prevent
sediment ftom surface runoff entering wetlands and be located only on the southwesterly comer
of the wharf area,be kept covered,with material removed weekly. Haybales shall be anchored
with stakes and entrenched 4 to 6 inches in depth. Excavated material shall be stockpiled on the
upgradient side of the haybale barrier. Haybales shall be inspected daily;those showing signs of
deterioration shall be replaced immediately. The haybale barrier shall remain in proper
functioning condition until all stockpiling has ceased and material removed.
7. Equipment servicing and overnight equipment storage must be conducted outside the
buffer zone. Equipment must be maintained to prevent leakage or discharge of pollutants.
8. *No spill or discharge of petroleum products or other pollutants will occur within 100
feet of any wetland resource area.
9. Notice shall be given this Comrmission no more than 2 weeks nor less than 2 days prior to
the commencement of construction activities. Said notice shall include, in writing,the names(s),
address(es),and business and home telephone numbers of the project supervisor(s)responsible
for insuring that operations are conducted in compliance with this Order.
10. All disturbed soils shall be immediately and similarly re-vegetated upon completion of.
construction activities or shall be mulched until the next growing season. Hydroseeding will be
initiated no later than September 15.
11. *Fertilizers used for landscaping and lawn care shall contain a low nitrogen content and
be used in moderation. Pesticides and herbicides shall not be used within 100 feet of the
resource area.
12. ' A pI.an for landscaping and maintenance of vegetation for the buffer zone shall be
developed and submitted for Conservation Commission approval prior to commencement of
work.
13. An erosion control subsurface filter fabric shall be installed in a line running from
Building I to Building 5 and installed in a vertical position in area between the existing northerly
seawall and the proposed building foundations.
14. A full depth silt curtain shall be installed and maintained atietty during construction.
15. All work shall be performed from wharf excluding instaUation of 2 piles for Friendship.
16. The order of Conditions including these Special Conditions shall be posted on site.

The National Park Service, Salem Maritime National Historic Site, respectfully
requests that the above referenced DEP permit, Order of Conditions issued on
December 14, 2000, for construction of a permanent mooring and boarding
facility at Derby Wharf to support the vessel Friendship, be extended for one
additional year.
Within the next thirty days the National Park Service will be issuing a
construction contract for the work to begin sometime this fall with a
completion date of June 2004.

authorizing you to perform certain activities pursuant to M.G.L. Chapter 91 and regulations 3 10
CMR'9.00. Any'unauthorized substantial change in use or substantial structural alteration of any
structure or fill authorized by this license shall render it void.
Pursuant to 3 10 CMR 9.17(l)(a) and 9.17(2), the Licensee may appeal this decision within
twenty-one(21) days of the date of license issuance, by submitting a written request, by certified
mail, for an adjudicatory hearing. Any notice of claim for an adjudicatory hearing must include
the following information: the DEP Waterways Application File Number; the complete name,
address and telephone number of the party filing the request; if represented by counsel, the name,
address and telephone number of the attorney; a clear statement that a formal adjudicatory
hearing is being requested; and a clear and concise statement of the specific objections to the
Department's license decision, and the relief sought through the adjudicatory hearing, including,
specifically, the changes desired in the final Waterways License.
The hearing request, along with a valid check made payable to the Commonwealth of
Massachusetts in the amount of one hundred dollars($1 00.00), must be mailed to:

The structures hereby authorized shall be limited to the following use(s): to provide commercial
docking and boating access to navigable waters.
This license has no term limitation.
The existing bulkhead, fill and structures where previously authorized pursuant to Harbor and
Lands License No.s 98, 206, and 1938 and DEQE License No. 436 and shall be maintained in
accordance with said license conditions.
All work authorized herein shall,be completed within five (5) years of the date of license
issuance. Said construction period may be extended by the Department for one or more one year
periods without public notice,provided that the Applicant submits to the Department,thirty (30)
days prior to the expiration of said construction period, a written request to extend the period and
provides an adequate justification for said extension.

STANDARD WATERWAYS LICENSE CONDITIONS
1. Acceptance of this Waterways License shall.constitute an agreement by the Licensee to conform with all terms and conditions
stated herein.
2. This License is granted upon the express condition that any and all other applicable authorizations necessitated due to the
provisions hereof shall be secured by the Licensee RE!E to the commencement of any activity or use authorized pursuant to this
License.
3. Any change in use of any substantial structural alteration of any structure of fill authorized herein shall require the issuance
by the Department of a new Waterways License in accordance with the provisions and procedures established in Chapter 91 of
the Massachuseus General Laws. Any unauthorized substantial change in use or unauthorized substantial structural alteration of
my structure of fill authorized herein shall render this Waterways License void.
4. This Waterways License shall be revocable by the Department for noncompliance with the terms and conditions set forth
herein. This license may be revoked after the Department has given written notice of the alleged noncompliance to the Licensee
and those persons who have filed a written request for such notice with the Department and those persons who have filed a
written request for such notice with the Department and afforded them a reasonable opportunity to correct said noncompliance.
Failure to correct said noncompliance after the issuance of a written notice by the Department shall render this Waterways
License void and the Commonwealth may proceed to remove or cause removal of my structure or fill authorized herein at the
expense of the Licensee,its successors and assigns as an unauthorized and unlawful structure and/or fill..
5. The structure(s)and/or fill authorized herein shall be maintained in good repair and in accordance with the terms and
conditions stated herein and the details indicated on the accompanying license plans.
6. Nothing in this Waterways License shall be construed as authorizing encroachment in,on or over property not owned or
controlled by the Licensee,except with the written consent of the owner or owners thereof
7. This Waterways License is granted subject to all applicable Federal,State,County,and Municipal laws,ordinances and
regulations including but not limited to a valid final Order of Conditions issued pursuant to the Wetlands Protection Act,G.L.
Chapter 13 1,s.40.
8. This Waterways License is granted upon the express condition that the use of the structure(s)and/or fill authorized herein
shall be in strict conformance with all applicable requirements and authorizations of the DEP,Division of Water Pollution
Control.
9, This License authorizes structure(s)and/or fill on:
• Private Tidelands. In accordance with the public easement that exists by the law on private tidelands,the licensee
shall allow the public to use and to pass freely upon the area of the subject property lying between the high and
low water marks,for the purposes of fishing,fowling,navigation,and the natural derivatives thereof
• Commonwealth Tidelands. This Licensee shall not restrict the public's right to use and to pass freely,for any
purpose,upon lands lying seaward of the low water mark. Said lands are held in trust by the Commonwealth
for the benefit of the public.
A Great Pond of the Commonwealth. The Licensee shall not restrict the public's rights to use and to pass
freely upon lands lying seaward of the high water mark for any lawful purpose.
No restriction on the exercise of these public rights shall be imposed unless otherwise expressly provided in this I
icense.
10. Unless otherwise expressly provided by this license,the licensee shall not limit the hours of availability of any areas of the
subject property designated for public passage,nor place any gates,fences,or other structures on such areas in a manner that
would impede or discourage the free flow of pedestrian movement thereon.

The amount of tidewater displaced by the work hereby authorized has been ascertained by said
Department, and compensation thereof has been made by the said—City of Salem and National
Park Service -- by paying into the treasury of the Commonwealth -- two dollars and zero cents
($2.00) -- for each cubic yard so displaced,being the amount hereby assessed by said

Nothing in this License shall be so construed as to impair the legal rights of any person. This
License shall be void unless the same and the accompanying plan are recorded within 60 days

Massachusetts General Laws, Chapter 13 1, Section 40 and Salem's Ordinance Pertaining to
General Wetlands at the request of U.S. National Park Service, 174 Derby Street, Salem, MA.

Dear Ms. Hurlburt:
Attached for the Salem Conservation Commission's consideration are eight
copies of a Notice of Intent to construct a mooring and docking facility and
accessible ramps on the westerly side of Derby Wharf in Salem Harbor.
As requested by Mr. Don Giard, we have also included eight copies of a
Certificate of Compliance to close out the Order of Conditions issued on March
13, 1997, for the above referenced project. (see attached correspondence dated
3/ 13/97; 4/29/97; 5/17/2000 and 6/6/2000).
The National Park Service originally filed a Notice of Intent for this project in
February 1997, DEP File No. 64-24. The project was subsequently delayed due
to funding issues and through an oversight, the National Park Service did not
request a time extension for the Order of Conditions issued March 13, 1997,
which expired earlier this year. The purpose of this Notice of Intent filing is to
correct this oversight and obtain a valid Order of Conditions. Attached please
find copies of a similar extension request granted by the Army Corps of
Engineers on July 3, 2000.
The proposed project remains as described in the original Notice of Intent and
involves the construction of a permanent mooring and docking facility for the
SV Friendship; the installation of accessible ramps to the ship for the visiting
public along the westerly side of Derby Wharf; and the construction of
warehouse exhibits and site improvements.
The project is divided into two phases. The mooring and boarding facility is
considered Phase I and is expected to be constructed as one package
commencing in the spring of 2001, funding permitting. Proposed activities
include the placement of two ramps, gangway systems accessing a steel pile
secured float as well as installation of electrical lines to provide shore power to
the ship.
Phase Il of the proposed project would involve the installation of warehouse
exhibits and associated site improvements along Derby Wharf and is not
expected to commence before 2005. Phase II work would include the
construction of five warehouse exhibit structures; site improvements to the
wharf surface; seating and landscaping and the continuation of site utilities to
support the exhibit area.
To accommodate our funding cycles, we request that the Order of Conditions
remain valid for 5 years from issuance.

your December 14, 2000, meeting.

The Conservation Commission reviewed your request to extend the Orders of Conditions
(DEP File No. 264)issued on March 13, 1997 for construction necessary to build a

Dear Ms. Hurlburt:
The National Park Service, Salem Maritime National Historic Site, respectfully requests that
the above referenced DEP permit, Order of Conditions issued on March 13, 1997, for
construction necessary to build a permanent docking facility at Derby Wharf for the SV
Friendship, be extended for an additional three years. WPA Form - 7 Extension Permit for
Orders of Condition is attached.
Our original plan was to complete the construction of Friendship during 1999 and to construct
the permanent mooring piles and access ramps to accommodate the docking facility in late
1999. Issues involved with the construction of the ship have set the time frame for completion
bqck to mid - 2001. We are now into the last phase of construction on the vessel and would
like to begin construction of the mooring facility at Derby Wharf.
We have requested a similar extension with the Army Corps of Engineers and look forward to
working with the Salem Conservation Commission in obtaining the necessary time extension.

DERBY WHARF(3/13/97)
1. All work shall conform to the above-referenced Notice of Intent, site plan and supporting
documents and those final specifications which shall be filed with the Commission prior to
construction. Any change made or intended to be made to the approved plans shall require the
applicant to inquire of the Commission in writing whether the change is substantial enough to
require the filing of a new Notice of Intent.
2. Members and agents of the Commission shall have the right to enter and inspect the
premises at all reasonable times to evaluate compliance with the conditions in this Order. The
Commission may require the applicant to submit additional data or information necessary for the
Commission to conduct that evaluation.
3. Upon completion of die project,the applicant shall submit,with the request for a
Certification of Compliance, an affidavit,prepared by a professional engineer or land surveyor
registered in the Commonwealth of Massachusetts, stating that the site has been-developed in
accordance with the requirements of this Order of Conditions,the referenced site-plan and
supporting documents.
4. This Order shall apply to every successor in control or successor in interest of the
property described int he Notice of Intent and accompanying plans or part thereof. In the event
this land or any part thereof changes ownership before or during construction,the current owner
shall notify the new owner, by registered mail,of this Order prior to the transfer of ownership
and shall forward proof of this notification to the Commission.
5. Additional erosion and sedimentation control measures deemed necessary by the
Commission shall be instituted by the applicant. Any siltation caused onto any wetland or
waterway area shall be promptly reported to the Commission. Such areas shall be restored to the
satisfaction of the Commission.
6. During construction,no debris, fill,or excavated material shall be stockpiled within 100
feet of the high tide line. Any other stockpile location will be protected sufficient to prevent
sediment from surface runoff entering wetlands and be located only on the southwesterly comer
of the wharf area,be kepf covered,with material removed weekly. Haybales shall be anchored
with stakes and entrenched 4 to 6 inches in depth. Excavated material shall be stockpiled on the
upgradient side of the haybale barrier. Haybales shall be inspected daily;those showing signs of
deterioration shall be replaced immediately. The haybale barrier shall remain in proper
functioning condition until all stockpiling has ceased and material removed.
7. Equipment servicing and overnight equipment storage must be conducted outside the
buffer zone. Equipment must be maintained to prevent leakage or discharge of pollutants.
8. *No spill or discharge of petroleum products or other pollutants will occur within 100
feet of any wetland resource area.
9. Notice shall be given this Commission no more than 2 weeks nor less than 2 days prior to
the commencement of construction activities. Said notice shall include, in writing,the names(s),
address(es), and business and home telephone numbers of the project supervisor(s)responsible
for insuring that operations are conducted in compliance with this Order.
10. All disturbed soils shall be inumediately and similarly re-vegetated upon completion of
construction activities or shall be mulched until the next growing season. Hydroseeding will be
initiated no later than September 15.
11. *Fertilizers used for landscaping and lawn care shall contain a low nitrogen content and
be used in moderation. Pesticides and herbicides shall not be used within 100 feet of the
resource area.
12. ' A plan for landscaping and maintenance of vegetation for the buffer zone shall be
developed and submitted for Conservation Commission approval prior to corrunencement of
work.
13. An erosion control subsurface filter fabric shall be installed in a line running from
Building I to Building 5 and installed in a vertical position in area between the existing northerly
seawall and the proposed building foundations.
14. A full depth silt curtain shall be installed and maintained atjetty during construction.
15. All work shall be performed from wharf excluding installation of 2 piles for Friendship.
16. The Order of Conditions including these Special Conditions shall be posted on site.

conditions modify or differ from the plans, specifications or other proposals
submitted with the Notice of Intent, the conditions shall control.
General Conditions
1. Failure to comply with all conditions stated herein, and with all related
statutes and other regulatory measures, shall be deemed cause to revoke
or modify this Order.
2. The order does not grant any property rights or any exclusive privileges;
it does not authorize any injury. to private property or invasion of
private rights.
3. This Order does not relieve the permittee or any other person of the
necessity of complying with all other applicable federal, state or local
statutes, ordinances, by-laws or regulations.
4. The work authorized hereunder shall be completed within three years from
the date of this Order unless either of the following apply:
(a) the work is a maintenance dredging project as provided for in the
Act; or
(b) the time for completion has been extended to a specified date more
than three years, but less than five years, from the date of issuance
and both that date and the special circumstances warranting the
extended time period are set forth in this' Order.
S. This Order may be extended by the issuing authority for one .or more
periods of up to three years each upon application to the issuing
aut�ority at least 30 days prior to the expiration date of the Order.

property. In the case of recorded lard, the Final Order shall also
be noted inthe Registry's Grantor Index under the name of the owner
of the land upon which the proposed work is to be done. In the case
of registered land, the Final order shall also be noted on the Land
Court Certificate of Title of the owner of the land upon which the
proposed work is to be done. The recording informatin shall be

will have only minimal individual or cumulative environmental impacts. This activity is
therefore authorized under the Federal permit known as the Massachusetts Programmatic General
Permit(PGP).
Your project is located within, or may affect resources within the coastal zone. Therefore,
in order for the above determination of eligibility to become the Federal authorization, a Federal
consistency concurrence from the Massachusetts Office of Coastal Zone Management(MCZM)
is required. However,MCZM has already determined that no further Federal Consistency
Review is required.
You must perform the activity authorized herein in compliance with all the terms and
conditions of the PGP. Enclosed is a copy of the PGP. Please review it carefully to familiarize
yourself with its contents. You are responsible for complying with all of the PGP requirements;
therefore,you should be certain that whoever does the work fully understands all of the
conditions. You may wish to discuss the conditions of this authorization with your contractor to
ensure the contractor can accomplish the work in a manner that conforms to all requirements.
Please note that this determination does not constitute an authorization to proceed until all
other applicable state and local permits are obtained. Performing work not specifically
authorized by this permit, starting work without obtaining other applicable State and local
approvals, or failing to comply with the permit conditions may subject you to the enforcement
provisions of our regulations.
Condition 33 of the PGP (page 12)provides one year for completion of work that has
commenced prior to the expiration of this PGP on January 11,2005. You will need to apply for
reauthorization for any work within Corps jurisdiction that is not completed by January 11,2006.

Project Description
The Derby Wharf mooring and boarding facility will provide accessible
boarding ramps to the SV Friendship for all visitors to Derby Wharf.
Friendship is a working reproduction of a 1797 Salem East India
Merchantman is under construction in Salem at Central Wharf. She is 108
ft. LOD with 171 ft. sparred length. Her beam is 29 ft. and she draws 11 1/2
ft. at her full load of approximately 350 tons. Friendship's main mast will
rise 110 feet above the deck and she will carry roughly 9,000 square feet of
sail (17,000 with stunsails and staysails set) and is complete with 17 miles
of rigging. She has auxiliary power and is equipped with all Coast Guard
required tanks, piping, alarms etc. She will be certified by the United States
Coast Guard as a small passenger vessel carrying 149 passengers on day
trips into partially protected (coastwise) waters. She will be certified as a
sailing school vessel capable of carrying 49 students and instructors on
domestic ocean voyages.
The construction associated with SV Friendship mooring and boarding
structures will take place in the tidal area between Derby and Central
wharves as well as on land. The fore and aft steel fender piles (30 inches in
diameter), used to secure the 87-ft. long prefabricated steel float will be
driven into the bottom of the berthing area. The anchoring steel piles and
concrete deadmen, boarding aprons, stairs and ramps will be constructed on
the wharf and extend from Derby Wharf to the float.
The proposed construction which is the subject of this application includes
information previously submitted under DEP File No. 64-264 which outlined
and described the installation of a permanent mooring facility as described
above and for the future construction of the period warehouse exhibit on
Derby Wharf. The SV Friendship is scheduled for completion by the summer
of 2001 and requires a permanent berth with accessible ramps for the
visiting public.
Funding is currently only available for the construction of the permanent
mooring and boarding facility, Phase 1. Funding for the improvements to
Derby Wharf, Phase II, including warehouse exhibit buildings and related
site development may be available before 2005.
Activities within State Wetland Resource Areas
Attached Figure 3 indicates resources within the general area of the
proposed construction. The activities proposed under Phase I occur within
the state wetland resource areas, Land Under Ocean; Coastal Bank and
Land Subject to Coastal Storm Flowage (LSCSF), as discussed below:
Land Under Ocean
The mooring and boarding facility will be installed adjacent to Derby Wharf
in water depths of approximately 13-feet (MLW=O). 10 sf of Land Under
Ocean will be directly affected by the installation of two 30-inch diameter
steel piles.
In addition, a 5 ft. x 87 ft., steel float will be installed indirectly affecting the
Land Under Ocean.
Coastal Bank
Approximately 30 linear feet of Coastal Bank (granite/concrete seawall) will
be affected by the installation of four steel piling anchors and deadmen into
the existing seawall.
Buffer Zone and LSCSF
Activities within the Buffer Zone and Land Subject to Coastal Storm Flowage
include:
* Installation of (2) 4'-6" x 15 aluminum gangways with 640 sq. ft. of timber
ramps and stair. Minor regrading will also occur to provide an approach
for the ramps.
* (2) concrete deadmen with 4 steel piling anchors to support the 30 inch
diameter steel piles will be installed through and inboard of the granite
and concrete bulkhead of Derby Wharf
* Utilities installed will require excavation for trenches and backfilling.
* Future Warehouse Exhibits will require excavation for foundations and
ramping.
Best M�nagement Practices
Pile driving may occur from barge mounted or land-based equipment or
both. During construction any debris that enters the water will be removed
immediately. Silt fencing and straw bales will surround the excavation zone.
All areas will be hydroseeded immediately after construction is complete.

each of the resource areas altered, including standards requiring
consideration of alternative project design or location.
Phase I Mooring and Boarding Facilit : Attached Figure 3 shows the
wetland resource area. The proposed project activities which affect Land
Under Ocean are piles and pile anchors to support a mooring float, for
access to and from the SV Friendship. Ramps and gangways extending to
the mooring float from Derby Wharf will affect Land Subject to Coastal
Storm Flowage. Impacts to the Coastal Bank, which is identified as the
granite/concrete bulkhead, under this proposal include the installation
of steel tiebacks and concrete deadmen. There will be minimum
disturbance to marine life during construction. Sedimentation and
erosion controls will be in place and during pile jetting a full depth silt
curtain will be employed. During construction of accessible ramps and
platforms to the ship, sedimentation control measures will be in place.
No adverse impacts result.
Phase II Warehouse Exhibits: Work within the buffer zone which
extends from the bulkhead wall inland 100 feet is primarily associated
with construction of the warehouse exhibits and regrading of the grassed
areas and pathways along Derby Street. Work proposed also includes the
installation of utilities along Derby Wharf to support the exhibits. Clean
granular fill will be used in the grading and the area will be quickly
mulched and hydroseeded. During construction, all efforts will be made
to temporarily or permanently cover exposed material to limit erosion
and/or dust. Hay bales and/or silt fencing will be in place at all times.

Applicants must include the following with this Notice of Intent(NOI):
• USGS or other map of the area (along with a narrative description, if necessary), containing sufficient
information for the Conservation Commission and the Department to locate the site.
• Plans identifying the location of proposed activities (including activities proposed to serve as a
Bordering Vegetated Weiland (BVW)replication area or other mitigating measure) relative to the
boundaries of each affected resource area.
• Other material identifying and explaining the determination of resource area boundaries shown on
plans (e.g., a DEP BVW Field Data Form).
• List the titles and final revision dates for all plans and other materials submitted with this NOI.
F. Fees
The fees for work proposed under each Notice of Intent must be calculated and submitted to the
Conservation Commission and the Department (see Instructions and Appendix B. Weiland Fee
Transmittal Form).
No fee shall be assessed for projects of the federal government, the Department, or cities and towns of
the Commonwealth.
