Negative Determination
Note: No further action under the Wetlands Protection Act is required by the applicant. However, if the
Department is requested to issue a Superseding Determination of Applicability, work may not proceed
on this project unless the Department fails to act on such request within 35 days of the date the
request is post-marked for certified mail or hand delivered to the Department. Work may then proceed
at the owner's risk only upon notice to the Department and to the Conservation Commission.
Requirements for requests for Superseding Determinations are listed at the end of this document.

Buffer Zone.
® 2. The work described in the Request is within an area subject to protection under the Act, but will

D. Appeals
The applicant, owner, any person aggrieved by this Determination, any owner of land abutting the land
upon which the proposed work is to be done, or any ten residents of the city or town in which such land is
located, are hereby notified of their right to request the appropriate Department of Environmental
Protection Regional Office (see http://www.mass.gov/dep/about/region.findyour.htm) to issue a
Superseding Determination of Applicability. The request must be made by certified mail or hand delivery
to the Department, with the appropriate filing fee and Fee Transmittal Form (see Request for
Departmental Action Fee Transmittal Form) as provided in 310 CMR 10.03(7)within ten business days
from the date of issuance of this Determination. A copy of the request shall at the same time be sent by
certified mail or hand delivery to the Conservation Commission and to the applicant if he/she is not the
appellant. The request shall state clearly and concisely the objections to the Determination which is being
appealed. To the extent that the Determination is based on a municipal ordinance or bylaw and not on the
Massachusetts Wetlands Protection Act or regulations, the Department of Environmental Protection has
no appellate jurisdiction.

The Salem Conservation Commission finds this Request for a Determination of Applicability negative so long as the
following Special Conditions are met:
1. The trees closest to the River shall be moved without heavy equipment and shall be hauled off site.
2. The trees stumps on site shall be left in place.
3. Debris removed from the riverbank shall be done so by hand or as appropriate without using heavy machinery.
4. All landscaping clippings shall be stored outside of the buffer zone,or at least 100 feet from the resource area.
5. If the applicant does not comply with these Special Conditions the applicant shall file a Notice of Intent

Dear Commission Members:
On behalf of my client: John Keenan (land owner and applicant), 1 respectfully request that you
review the attached Request for Determination of Applicability for yard maintenance within the
inner and outer Riparian buffer zone of the North River and within the 100-feet buffer to a wetland
resource area (coastal bank) and within land subject to coastal storm flowage.
The owner has recently purchased the existing home. The landscaping has not been maintained
for quite some time and thus is severely overgrown. The pruned vegetation and dead trees will be
removed off-site. Exposed earth and disturbed areas (including tire marks)will be foamed and
seeded for permanent stability. An existing (fallen-over)fence (around the existing pool), will be
removed and replaced with a new temporary security fence (to prevent people from falling into the
pool). The pool will be repaired and repainted. The existing pool deck will be cleaned.
Clean-up and removal of debris (by hand) will be performed within the coastal bank.
As shown on the photographs, the majority of the work area is flat lawn, therefore no erosion or
siltation is expected, and thus there will be no impact to the wetlands.
For these reasons, my client respectfully seeks a negative determination.

Dear Commission Members:
•. On behalf of my client: John Keenan (land owner and applicant), I respectfully request that you
review the attached Request for Determination of Applicability for yard maintenance within the
inner and outer Riparian buffer zone of the North River and within the 100-feet buffer to a wetland
resource area (coastal bank) and within land subject to coastal storm flowage.
The owner has recently purchased the existing home. The landscaping has not been maintained
• for quite some time and thus is severely overgrown. The pruned vegetation and dead trees will be
removed off-site. Exposed earth and disturbed areas (including tire marks) will be loamed and
seeded for permanent stability. An existing (fallen-over) fence (around the existing pool), will be
removed and replaced with a new temporary security fence (to prevent people from falling into the
pool). The pool will be repaired and repainted. The existing pool deck will be cleaned.
• Clean-up and removal of debris (by hand) will be performed within the coastal bank.
As shown on the photographs, the majority of the work area is flat lawn, therefore no erosion or
siltation is expected, and thus there will be no impact to the wetlands.
For these reasons, my client respectfully seeks a negative determination.

The purpose of this hearing is to discuss removal of overgrown vegetation and a dilapidated fence
located within a Riverfront area at 68 Dearborn Street. This hearing will be held on Thursday,
October 9, 2008 at 6:00 p.m. in City Hall Annex, Room 313, 120 Washington Street.
