General Conditions 1. Failure to comply with a0 conditions stated herein,and with ail related statutes and other_regulatory meas- ures,shall be deemed cause to revoke or modify this Order. 2. This Order does not grant any property rights or any exclusive privileges;it does not authorize any injury to private property or invasion of private rights. 3. This Order does not relieve the permittee or any other person of the necessity of complying with all other appficabie federal,state or local statutes,ordinances,by-laws or regulations. 4. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply (a) the work is a maintenance dredging project as provided for in the Act;or (b) the time for completion has been extended to a specified date more than three years,but less than five years,from the date of issuance and both that date and the special circumstances warranting the extended time period are set forth in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. S. Any fill used in connection with this project shall be clean fill, containing no trash, refuse,rubbish or de- bris, including but not limited to lumber, bricks, plaster,wire, lath, paper, cardboard,pipe, tires,ashes, refrigerators, motor vehicles or parts of any of the foregoing. 7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if such an appeal has been filed, until all proceedings before the Department have been completed. S. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located,within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of registered land,the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is to be done.The recording information shall be submitted to the Commission on the forth at the end of this Order prior to commencement of the work. 9. This statement rill be art in 6 point type. 3.6 APPENDIX A SITE DESCRIPTION, PART II OF NOTICE OF INTENT A-1 APPENDIX A Part II : Site Description The site consists of a strip of land 600 ' long along the south side of the South River in Salem, Massachusetts. In colonial times, the South River was a major port which extended into the center of present-day Salem, but gradual channelization and filling over the years has reduced the river to its present state.Pickering wharf lies across the water from the site , whereas the old Naumkeag Mills Building (Shetland Industrial Park , Building No. l on the map in Appendix C) is immediately adjacent to the site. Four coastal wetland resource areas comprise the site : Coastal Bank, Rocky Intertidal Shore, Tideflat, and Land Under The Ocean. The foundation of Building No. l is a granite wall which forms the southern bank of the river at this point. This wall is a combination Coastal Bank and Rocky Intertidal Shore. However, as a bank , it does not contribute sediment to any adjacent beaches ; and as a rocky shore it displays the usual marine algae (Fucus vesiculosus and Ascophyllum nodosum) attached to the rocks which, along with barnacles , depict the usual rocky shore zonation as a result of the 9 ' to 11 ' tidal range. At the base of the wall, there is a band of Tideflat exposed at mean low tide. Land Under the Ocean comprized the sediment beneath mean low water. The narrow Tideflat appears to be grossly A-2 poluted, and there is no evidence of shell fish. Accordingly , it is unlikely that the Land Under the Ocean contains any commercially important resources . There is no evidence that the South River has supported an anadramous fish run in modern times . The upper reaches of the river have long been filled in and drainage reduced to culverts . The maximum existing elevation on the site is + 2 .9 ' (MLW) at the Wall. The minimum existing elevation on the site is 6 . 0 ' (MLW) at the channel. APPENDIX B WORK DESCRIPTION , PART III OF NOTICE OF INTENT B-1 APPENDIX B PART III : Work Description The project involves the clamshell dredging of an area approximately 600 ' x 50 ' to -7 ' (4000 cubic yards) of river bottom material (sand and silt) within the area south of the main channel and the Shetland Properties Building No. 1 wall which serves as the coastal river bank. Appendix C (sheet 2) shows the extent of the proposed dredging, its slope and depth. There are two alternatives for dealing with the dredged materials (negotiations for final disposal are still in progress) : 1. The establishment of a dewatering station for temporary storage of the dredged materials at the Shetland Properties prior to landfill disposal. 2 . Transportation of the material by scow to the Federal Disposal Site. The Department of the Army, Corps of Engineers have in accordance with Title 33 CFR, part 325 . 6 (d) revived and extended the permit expiration date MA-SALE-81-328 (dated Oct. 13, 1981) to Dec. 31, 1986 . The marine work will include (see Appendix C: sheets 1 , 3, & 4) : a. Approx. 600+ ' of main floating pier b. Twenty three (23) finger floats c. Two (2) floating sections d. Field Data (rod probes) . 5) Structural Engineering Calculations dated 10-1. 6) North Wall 'Elevation (11" X 17" sheet) . 7) Section View Looking East DESCRIPTION OF TESTING PROGRAMi Exploration of the relevant terrain including a verification of bottom of wall location was made using a combination of hand dug test pits and selected test borings . Three borings were taken at low tide using a portable drilling rig . Results of this program are attached. Wall Stability -2- 12-28-82 CONCLUSIONSt 1) EXISTING STRUCTURE As indicated in Reference #7, the existing stone wall is a continuous support element for the six-story concrete structure . Such imposed vertical loads acting on the top of the wall strongly favor wall stability. Accordingly, the stone foundation may be considered laterally restrained at the top. 2) WALL DRAINAGE The open pointed composition of the wall allows for a free drainage of tidal waters in the receding phase . Such can be observed clearly at the site during outgoing tide . The building up of undesireable wet earth pressures against the Inside of the wall is minimized. 3) SOIL COMPOSITION The test borings revealed the presence of moderately dense sand-gravel material generally from the level of the wall bottom downward. Below that, so-called refusal of the boring probe was reached between 12 and 16 feet, indicating the exlstanee of hardpan or soft rock at those levels . Such materials offer good resistance to vertical pressures and to horizontal sliding tendencies . 4) FOUNDATION TYPE The bottom of the wall was ident- ifted by test digging and probing with rods and is located as shown on Reference #7. While the presence of piling could not be confirmed, the soil materials present in the area would suggest a possible combin- ation of piling and continuous wall soil bearing . Wall Stability - 3 - 12-28-82 5) SOIL BEARING PRESSURE VECTOR The attached calc- ulations reveal that the ratio of horizontal earth pressure to vertical gravity loadings is such that the resultant pressure vector is markedly downward . Such a fact is favorable to lateral stability of the wall base , particularly where the earth near the base of the wall is counted on to resist outward movement in the event of the dredging removal of .existing materials as proposed. 6) PROTECTIVE EARTH BERM In accordance with standard foundation design. practice regarding earth bearing footings , a protective slope of undisturbed earth called a berm (or anequivalent means ) is recommended. Such an element serves the purpose of providing standard resistance to frost penetration at extreme low tides in winter, and also safeguards against long-term erosion of soils at the base of the wall. SUMMARY CONCLUSIONS On the basis of this analysis , the author confirms that a dredging configuration as shown on Reference #9 ard Including the protective feature noted above will not adversely affect the existing building wall. In previous correspondence to you (1/14/86) relative to acceptable dredging dates for this project, I indicated that dredging activity should cease on February 15th. Apparently this project has met with a time delay and Mr. Mulligan is now looking for an acceptable startup date. It would be my recommendation for this project that no dredging activity take place during the February 15 - April 15 time period This time restriction is recommended to protect the winter flounder population in the Salem - Beverly Harbor area.
