Negative Determination
Note: No further action under the Wetlands Protection Act is required by the applicant. However, if the
Department is requested to issue a Superseding Determination of Applicability, work may not proceed
on this project unless the Department fails to act on such request within 35 days of the date the
request is post-marked for certified mail or hand delivered to the Department. Work may then proceed
at the owner's risk only upon notice to the Department and to the Conservation Commission.
Requirements for requests for Superseding Determinations are listed at the end of this document.
❑ 1. The area described in the Request is not an area subject to protection under the Act or the
Buffer Zone.
❑ 2. The work described in the Request is within an area subject to protection under the Act, but will
not remove, fill, dredge, or after that area. Therefore, said work does not require the filing of a

will not alter an Area subject to protection under the Act. Therefore, said work does not require

spread in the buffer zone area.

D. Appeals
The applicant, owner, any person aggrieved by this Determination, any owner of land abutting the land
upon which the proposed work is to be done, or any ten residents of the city or town in which such land is
located, are hereby notified of their right to request the appropriate Department of Environmental
Protection Regional Office(see http//www mass oov/deplabout/region findyour htm)to issue a
Superseding Determination of Applicability. The request must be made by certified mail or hand delivery
to the Department, with the appropriate filing fee and Fee Transmittal Form (see Request for
Departmental Action Fee Transmittal Form)as provided in 310 CMR 10.03(7)within ten business days
from the date of issuance of this Determination.A copy of the request shall at the same time be sent by
certified mail or hand delivery to the Conservation Commission and to the applicant if he/she is not the
appellant. The request shall state clearly and concisely the objections to the Determination which is being

Dear Mr. Taormina:
Attached please find seven copies of a Request for Determination of Applicability for the installation of a chain link
fence at the property located at 25 Colonial Road in Salem, Massachusetts. Innovative Engineering Solutions, Inc.
(IESI)has prepared this Request for Determination of Applicability on behalf of Univar,USA.
The fence is being proposed to provide site security during future building demolition activities (which will be
presented in a future NOI) and serve to complete the perimeter security fence after the building is demolished. The
east side of the building currently serves to restrict access to the site along with the existing chain link fence. Figure
1, attached, shows a site locus, and the attached Figure 2 and Figure 3, also attached, show the proposed fence
location and fence details respectively.
We are filing this Request for Determination of Applicability to request a determination from the City of Salem
Conservation Commission that the provisions of the Wetlands Protection Act and regulations for minor activities
provide an exemption for filing of a Notice of Intent for installation of the fence. Note that, by definition in the
Wetlands Protection Act Regulations(2005 Revisions), installation of a fence within the buffer zone is considered to
be a minor activity. Additionally, the fence location and alignment will not constitute a barrier to wildlife
movement across or within existing resource areas.
Enclosed with this application is a check in the amount of$25 payable to the City of Salem to cover the cost of the
local application fee. We understand that a public notification will be placed in Salem News by the Conservation
Commission and that the property owner will be billed directly for the ad. We have also submitted a copy of this
Request for Determination of Applicability to the Massachusetts Department of Environmental Protection's(DEP's)
Northeast Regional Office in Boston, Massachusetts.

The proposed scope of work includes the installation of a seven foot high, galvanized steel, chain link
fence with one foot of barbed wire (for a total height of eight feet)along the eastern upland area of the
site as shown on Figure 2. The fence will be installed from an existing chain link fence and run in a
northerly direction and ultimately intersect another section of existing fence. The fence is being proposed
to provide site security during future building demolition activities(which will be presented in a future NOI)
and serve to complete the perimeter security fence after the building is demolished (the east side of the
building currently serves to restrict access to the site along with the existing chain link fence).
The fence will include line posts at a typical spacing of 10 feet. Each post will be set to a minimum depth
of three feet below grade within a 12-inch diameter deep hole. The holes will be backfilled with concrete
to provide a stable footing for the fence posts. See Figure 3 for fence details.

Fence installation within the buffer zone is considered under 310 CMR 10.02(2)(b)(1)(1b)to be a minor
