During the Conservation Commission meeting on March 12, 2009 the Commission determined that,to their knowledge, the project occurring at 25 Cloverdale Avenue is proceeding according to the approved Order of Conditions, DEP #64-431, issued on October 2, 2006. The Conservation Commission has requested as-built plans stamped by an engineer to ensure that the slope behind the home was built as permitted, prior to issuing a full Certificate of Compliance. The change in the planting plan was approved as described in the letter from John Dick, Hancock Associates received on February 25, 2009, see attached. I have reference to the following documents: • Order of Conditions issued 2 October, 2006 (ESRD book 26383 page 501 et seg.) • Site Plan - # 25 Cloverdale Avenue (Patrowicz Land Development Engineering 30 August, revised 9/28/06) • Definitive Subdivision Plan Cloverdale Avenue(Parsons & Faia Inc. 12 February 2001, revised 5/17/01 (ESRD plan 16, book 357 -4 pages) Grading and Erosion Control I visited the site on 29 December 2008 and again on 6 January 2009, in order to inspect a slope failure and the repairs made to that slope. On both occasions, the siltation barrier was in place and in function and I observed no migration of silt past the barrier. The attached photographs show a section of faile&tiprap-paved-slope-and the repairs effected `by-'your:contractor. In the earlier pictures, poorly graded broken stone of sizes ranging from 6 inches to 24 inches has moved downslope and come to rest above and against the intact siltation barrier. In the later pictures, material has been removed from the lower slope, restored to pre-failure grade, and surfaced with broken stone in the 6 inch plus range. The finished slope appears both stable and consistent with location and grades shown on the 2001 Subdivision Plan. Slope Stabilization Planting Specifications At Mr. Ambler's request, I have reviewed the Buffer Zone Enhancement planting specifications. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: a. the work is a maintenance dredging project as provided for in the Act; or b. the time for completion has been extended to a specified date more than three years, but less than five years, from the date of issuance. If this Order is intended to be valid for more than three years, the extension date and the special circumstances warranting the extended time period are set forth as a special condition in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. S. Any fill used in connection with this project shall be clean fill. Any fill shall contain no trash, refuse, rubbish, or debris, including but not limited to lumber, bricks, plaster,wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles,or parts of any of the foregoing. 7. Appropriate erosion control devices shall be in place prior to the beginning of any phase of construction, and shall be maintained during construction in the wetland areas and buffer zones. The erosion control specifications provided in the Notice of Intent and the erosion control provision in the Order will be the minimum standards for this project;the Commission may require additional measures. 22. All debris,fill and excavated material shall be stockpiled a location far enough away from the wetland resource areas to prevent sediment from entering wetland resource areas. 23. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as necessary. Any accumulated silt adjacent to the barriers shall be removed. 24. The area of construction shall remain in a stable condition at the close of each construction day. 25. Any de-watering of trenches or other excavation required during construction shall be conducted so as to prevent siltation of wetland resource areas. All discharge from de-watering activities shall be filtered through hay bale sediment traps,silt filter bags or other means approved by the Commission or its Administrator. Within thirty(30)days of completion of construction on any given portion of the project,all disturbed areas in the completed portion of the site shall be permanently stabilized with rapidly growing vegetative cover,using sufficient top soil to assure long-term stabilization of disturbed areas. 27. If soils are to be disturbed for longer that two(2)months,a temporary cover of rye or other grass should be established to prevent erosion and sedimentation. If the season is not appropriate for plant growth, exposed surface shall be stabilized by other appropriate erosion control measures,firmly anchored,to prevent soils from being washed by rain or flooding. DURING CONSTRUCTION 28. A copy of this Order of Conditions and the plan(s)approved in this Order shall be available on site at all times when work is in progress. 29. No alteration or activity shall occur beyond the limit of work as defined by the siltation barriers shown on the approved plan(s). 30. All waste products,grubbed stumps,slash;construction materials,etc.shall be deposited at least 100 feet from wetland resource areas and 200 feet from river. 31. Cement trucks shall not be washed out in any wetland resource or buffer zone area,nor into any drainage system. Any deposit of cement or concrete products into a buffer zone or wetland resource area shall be immediately removed. 32. All exposed sub-soils shall be covered by a minimum of three(3)inches of quality screened loam topsoil prior to seeding and final stabilization. 33. Immediately following drainage structure installation all inlets shall be protected by silt fence,haybale barriers and/or silt bags to filter silt from stormwater before it enters the drainage system. 34. There shall be no pumping of water from wetland resource areas. 35. All equipment shall be inspected regularly for leaks. Arry leaking hydraulic lines,cylinders or any other components shall be fixed immediately. 36. During construction,all drainage structures shall be inspected regularly and cleaned as necessary. 37. The applicant is herby notified that failure to comply with all requirements herein may result in the issuance of enforcement actions by the Conservation Commission including,but not limited to,civil administrative penalties under M.G.L Chapter 21 A, section 16. AFTER CONSTRUCTION 38. Upon completion of construction and final soil stabilization,the applicant shall submit the following to the Conservation Commission to request a Certificate of Compliance(COC): (1) A Completed Request for a Certificate of Compliance form(WPA Form 8A or other form if required by the Conservation Commission at the time of request). Patrowicz Land Development Engineering 10 Derby Street—4Floor Salem, MA 01970 i• RE: Wetland delineation at Cloverdale Road, Salem Dear Mr. Patrowicz: • Wetlands &Land Management, Inc. has completed our evaluation of wetland resource areas at or near the vacant lot at the end of Cloverdale Road in Salem. Wetlands on the site were evaluated using delineation methodology established in the Wetlands Protection Act and the Department of Environmental Protection"Delineating • Bordering Vegetated Wetlands Handbook" dated 1995, and the US Army Corps of Engineers Manual (1987). These regulations and methodology incorporate the evaluation of hydric soils, predominance of wetland vegetation and wetland hydrology to evaluate the upper limit of vegetated wetlands. • 1 noted a shrub swamp/forested wetland at the base of slope at the rear of the property. The near side of bordering vegetated wetlands on the property was identified with sequentially numbered blue surveyors flagging labeled flags Al to A14. The adjacent buffer zone vegetation was extremely thick however once the edge of wetlands was reached, we found that the edge of wetlands was strongly controlled by a clear topographic break in slope between the wetlands and the adjacent uplands. Wetland vegetation included sweet pepperbush, high bush blueberry, red maple trees and shrubs, cinnamon fern, lady fern and sensitive fern. Buffer zone vegetation included thick bittersweet vine, European buckthorn, black cherry and various other opportunistic weeds closer to the Cloverdale Road pavement. • Work in buffer zones to, or in the bordering vegetated wetland falls under Conservation Commission jurisdiction. Regulations found at 310 CMR 10.55 apply. Figure 1 shows a 17,582 square foot parcel based on an October 3, 2005 "Partial Topographic • Site Plan" prepared by Parsons and Faia, Inc. (Parson). According to the Parson plan, the site is relatively level on the southwestern portion at about elevation (El) 128 feet. To the north and northeast, the grade drops rapidly at an approximate 1.5H:1 V slope and steepens to a 0.5H:1 V rip-rap slope/boulder wall. The base of the approximate 10-foot tall boulder wall is shown to be near El 113 feet. Based on information provide to us by Mr. Patrowicz, the proposed 1,800- square foot house will be constructed southwest of the boulder wall as shown in Figure 1. We "• understand the house will have a basement/garage approximately 10 feet below surface grade. Subsurface Explorations and Conditions On December 12, 2005, we monitored an exploration program that included excavating three test • pits, noted as JTP-1 through JTP-3 at the approximate locations shown on Figure 1. The steep slopes to the north and northeast made it difficult to excavate test pits at the exact planned locations. Minor amounts of organic • matter and construction debris were also found within the fill. The thickness of the fill increased towards the northeast. A 1.5-foot thick layer of clayey silt fill was encountered beneath the sand and gravel fill in JTP-3. Black to brown former topsoil was encountered in JTP-2 and 3 overlying till consisting of gray coarse to fine sand and gravel, little silt. Pockets of the clayey silt were found in the other test pits. Each test pit was excavated to presumed bedrock at depths varying from 9.5 to 11.5 feet. • Groundwater was observed seeping from the walls of JTP-3 above the clayey silt at a depth of 3.5 feet. Groundwater was not observed in the remaining test pits. Foundation Design and Earthwork Recommendations • The sand and gravel fill, clayey silt fill and topsoil are not suitable for support of the house foundations or slabs. It appears, through conventional foundation depth, most of the unsuitable materials will be excavated to achieve bearing surface. However, over-excavation below foundation bearing and slab level will be required to remove unsuitable soils at the northeast • portion of the house. Based on the elevation of the base of the boulder wall, presumably constructed on naturally occurring glacial till, over-excavation should not exceed 5 feet. We recommend that fill and topsoil be excavated within 3 feet of the house foundations. Where the resulting subgrade is below foundation or slab grade, the area should be backfilled with • compacted sand and gravel conforming to the gradation specification outlined in Table 1. Prior to backfilling, the subgrade should be reviewed by a geotechnical engineer and proofrolled with heavy vibratory compactors. Backfill should be compacted to at least 95 percent of the maximum dry density as determined by ASTM Test Method D-1557. The adequacy of compactive efforts should be measured by field density testing. • _ Foundation walls should be dampproofed in accordance with the Massachusetts Building Code. As groundwater was observed in one of the test pits, we recommend underdrains be installed around the building foundation. The underdrains should be installed at least 12 inches below slab grade and consist of 4 inch perforated pipe surrounded by a minimum of 6 inches of crushed stone wrapped in a filter fabric. We recommend existing fill not be used as backfill within 24 • inches of the foundation walls as it may impede drainage. Sand and gravel conforming to the gradation specification in Table 1 should be used as drain backfill. The existing earth slopes and boulder walls are potentially unstable due to either erosion or collapse. Earth slopes should be no steeper than 2H:1 V. Fill removed for foundation • construction might be used to flatten the existing earth slopes north of the proposed house and west of the boulder wall. Fill should placed in compacted lifts and the resulting surface vegetated to resist erosion. • Mr. Darren Ambler Page 2 • January 4, 2006 Boulder walls should be designed by a geotechnical engineer and constructed by an experienced contractor. Based on our observations it does not appear the walls were designed, pp or properly • constructed. Rather than removing the boulder wall, it could be supported by an earthen berm no steeper than 2H:1 V. The berm should be constructed in compacted lifts to within 2 feet of the top of the wall. Alternatively, a rockfill slope no steeper than 1.5H:IV could be constructed in front of the wall. The amount of fill (soil or rock) needed to support the wall will require more topographic measurements to the northeast. Also, wetland restrictions and property lines may • impact how the boulder wall is supported. Prior to constructing either the earthen berm or rockfill slope, existing topsoil should be excavated and the resulting subgrade proofrolled. Limitations The recommendations submitted in this report are based upon the data obtained from preliminary • subsurface explorations. The nature and extent of variations between the explorations may not become evident until construction. If variations then appear evident, it will be necessary to reevaluate the recommendations of this report. In the event that changes in the location of the proposed structures are planned, the conclusions and recommendations contained herein are not valid unless the changes are reviewed and conclusions of the report verified in writing by us.
