General Conditions Under Massachusetts Wetlands Protection Act (cont.) b) No stormwater runoff may be discharged to the post-construction stormwater BMPs unless and until a Registered Professional Engineer provides a Certification that: i. all construction period BMPs have been removed or will be removed by a date certain specified in the Certification. For any construction period BMPs intended to be converted to post construction operation for stormwater attenuation, recharge, and/or treatment, the conversion is allowed by the MassDEP Stormwater Handbook BMP specifications and that the BMP has been properly cleaned or prepared for post construction operation, including removal of all construction period sediment trapped in inlet and outlet control structures; ii. as-built final construction BMP plans are included, signed and stamped by a Registered Professional Engineer, certifying the site is fully stabilized; iii. any illicit discharges to the stormwater management system have been removed, as per the requirements of Stormwater Standard 10; iv. all post-construction stormwater BMPs are installed in accordance with the plans (including all planting plans) approved by the issuing authority, and have been inspected to ensure that they are not damaged and that they are in proper working condition; v. any vegetation associated with post-construction BMPs is suitably established to withstand erosion. c) The landowner is responsible for BMP maintenance until the issuing authority is notified that another party has legally assumed responsibility for BMP maintenance. This Order is issued under the Massachusetts Wetlands Protection Act, M.G.L. Chapter 131, Section 40 and the City of Salem Wetlands Protection Ordinance, Salem Code Chapter 34, Section 34-1 —34-13. This Order permits the construction of a cul-de-sac (an extension of the existing Circle Hill Road) and construction of three single family homes. A portion of the roadway and cul-de-sac and two of the house lots (Lots#2 and 3)are located within the 100 foot buffer zone of a bordering vegetated wetland (as delineated by Mr. Bill Manuel, report dated July 29, 2008). A limit of work line was agreed to be constructed along the proximity of the wetlands (a minimum of 25 feet inland from the wetland flags) to ensure the wetlands would not be disturbed during construction. Since this project still requires approval from other local boards, any deviation from the plan approved by the Conservation Commission shall be submitted to the Conservation Agent for review, prior to construction, to determine if a full amendment is required. May 12, 2008 • Scott Patrowicz, P.E. Patrowicz Land Development Engineering 14 Brown Street Salem, MA 01970 • RE: Wetland delineation at 40 Circle Hill Road, Salem, MA Dear Mr. Patrowicz: Wetlands&Land Management, Inc. has completed our evaluation of wetland resource areas at the property at 40 Circle Hill Road in Salem. • Wetlands on the site were evaluated using delineation methodology established in the Wetlands Protection Act and the Department of Environmental Protection"Delineating Bordering Vegetated Wetlands Handbook" dated 1995, and the US Army Corps of Engineers Manual (1987). These regulations and methodology incorporate the evaluation • of hydric soils, predominance of wetland vegetation and wetland hydrology to evaluate the upper limit of vegetated wetlands. These methods are appropriate to evaluate the limits of wetlands in the City of Salem. The parcel is vacant land at the end of Circle Hill Road. The parcel and the surrounding • area is thickly vegetated with second growth pioneering vegetation including quaking aspen, gray birch, meadowsweet and willow shrubs. The topography is undulating and bedrock outcrops are common. I noted a shrub swamp wetland area near the southerly side of the parcel. This swamp area drained overland along a narrow portion of bordering vegetated wetlands which trended in a northeasterly direction, along the low side of the • City Park located at the end of Circle Hill Road. In the field, the near side of bordering vegetated wetlands was identified with sequentially numbered blue surveyors flagging labeled Al to A39 and B1 to B7. The A series flag line begins at the low end of the wetland near the park. The flag line trends up gradient, crossing a mowed path along the unconstructed portion of Circle Hill Road, • southerly of the park, and then trending along the southern side of the subject property. The wetland boundary turned away from the parcel and I stopped flagging at this point at flag A39. • 100 Conifer Hill Drive, #516, Danvers, Massachusetts 01923 Tel 978-777-0004 • Fax 978-539-0005 • • The wetland re-occurred closer to the southwest corner of the parcel. Here I placed flags B 1 to B7 to identify a lobe of wetland area that approaches the property in this location. • Again, I stopped flagging at B7 where the wetland boundary was trending away from the parcel. A 100-foot buffer zone extends out from the limit of wetlands. Work in buffer zones to, or in the bordering vegetated wetland falls under Conservation Commission jurisdiction. Regulations found at 310 CMR 10.55 apply. • Be advised, I noted some historic filling along portions of the wetland line—generally near the park at flags A5 to A10. Surrounding land use and historic alterations on or adjacent to the subject property have disturbed some areas and have possibly created and/or eliminated portions of the wetlands noted. The flags on the ground depict my professional judgment of the limits and characterization of the wetlands given the extent • of human intervention in some areas of the flag line. Rare Species and Certified Vernal Pools The Natural Heritage Atlas, October 2006 indicates there is no estimated habitat of rare wetlands wildlife or priority habitat of endangered species on or near the parcel. The • atlas does not indicate any certified vernal pools as well. I trust this information will be useful to you. Be advised, the Conservation Commission is the authority that will make a final determination of the limits of resource areas. You may wish to file an Abbreviated Notice of Resource Area Delineation to have the flag • limits verified.
