Even though this proposed boat storage area is physically located in Ward Five I am interested in this project since a long range proposal for storm drainage from so-called "Rosie's Pond" abutting this storage site, may be channeled in a swale or underground to the Forest River area. Commercial/industrial development especially where petroleum products are involved need close monitoring by city government. During the Wednesday night hearing I asked the petitioner the quantity of fuel which would be contained in tanks in vessels stored inside and outside the property. I was informed the 30 vessels inside the building would contain approximately 600 gallons of diesel fuel and the 30 vessels stored outside would also contain approximately 600 gallons of diesel fuel, making a total of approximately 1,200 gallons of diesel fuel, a Class IIIB combustible liquid. According to the provisions of Massachusetts Fire Safety Code 527 CMR 14.03:(1), the maximum amount of Class IIIA combustible fluids that may be kept or stored on this property, without a license, is 1000 gallons. The petitioner needs therefore to first obtain a license from the City Council in accordance with provisions of M.G.L. c. 148, s.13. 1 was told the Fire Department has issued a"permit". jo Itiny opinion Massachusetts General Laws dealing with fire prevention take precedence in local planning, zoning, conservation matters. Petitioners should make application for a"license" and receive approval of the head of the fire department to store, keep flammable and combustible liquids prior to any subsequent petition before any local Board or Commission.
