(Applicant),Oak Consulting Group,LLC is submitting the following Request for Determination of Applicability (RDA)for expanding site parking on the Domino's Pizza site located at 4 Canal Street in Salem, Massachusetts. The project was constructed during July and August 2016. As such,this RDA is being submitted after the fact. Attached with this request, please find: • Massachusetts Department of Environmental Protection(MA DEP)Form 1 —Request for Determination of Applicability (Attachment A); • HydroCAD Stormwater Calculations(Attachment B); • Site Layout Plan, Sheet C-1,revised through March 31,2017; • Grading and Drainage Plan, Sheet C-2,also revised through March 31,2017; • Local filing fee check in the amount of$25.. PROJECT DESCRIPTION The project, consists of expanding the existing driveway to the west to provide 17 new parking spaces. The additional parking will encroach upon abutting land owned by the Massachusetts Bay Transit Authority(MBTA). A lease area has been established for use of MBTA property for this purpose. The project layout and relationship of the new spaces to the existing/former driveway are shown on the Site Layout Plan, Sheet C-1. Grading and drainage details are provided on Sheet C-2. The details of the project have been closely coordinated with City plans to construct a bike path, also running through the MBTA property. Draft plans were submitted to the City Engineer during the design process and a coordination meeting was held in July 2016 to review grading details. At that time, it was determined that the Dominos project should provide a temporary 2:1 slope onto the bike path area and that a future retaining wall, if necessary, would be provided as part of the bike path project based on the final design for that project. During the July meeting, additional drainage measures were requested for the Domino's project and two new catch basins were proposed to connect into an existing drain on the project site as shown on Sheet C-2. RESOURCE AREAS SUBJECT TO PROTECTION Resource areas subject to projection under the Massachusetts Wetlands Protection Act and the City of Salem Wetlands Protection and Conservation Ordinance are limited to the Flood Zone AEI I as depicted on Flood Insurance Rate Map Panel 25009C0419G, revised July 16,2014 and the associated buffer zone. The flood zone is considered to be Land Subject to Coastal Storm Flowage(LSCSF)with recent precedents including MA DEP File No. 64-610 for the project located at Dodge and Washington Streets. STORMWATER MANAGEMENT Existing/Former Conditions Prior to constructing the new parking spaces,project, stormwater runoff from the site flowed west, across the site and onto a wooded portion of the MBTA property. This wooded area is bounded by a retaining wall rising up from the active MBTA tracks further to the west. There is a catch basin located within the wooded area which drains runoff from the site and the wooded area of the MBTA property. This catch basin drains back to the east by means of a 12-inch reinforced concrete pipe(RCP)to the City of Salem storm drain beneath the Domino's site. Proposed Conditions The project expands the driveway and parking area of the Domino's site further to the west and onto the MBTA property. The expanded parking lot is curbed. Two new catch basins capture runoff from the site and discharge it directly to the City of Salem storm drain minimizing offsite runoff onto MBTA property and the future City of Salem bike path. Pre-and Post-Development runoff rates from the Domino's site to the City of Salem storm drain were calculated using HydroCAD and summarized in the table below. Complete HydroCAD calculations are enclosed in Attachment B. In addition,the project work performed within the LSCSF is subject to further alteration from the bike path project. However,the increases are minor and are not expected to have a measurable impact on the City of Salem storm drain. Further,offsite impacts to the MBTA property and future City of Salem bike path have been substantially reduced by capturing site runoff and discharging directly to the City of Salem storm drain. I look forward to working with you to resolve the violation, and I wanted to let you know we appreciate your investment in the restaurant and site. The improvements look great, and we believe the new bike path will serve the restaurant and the community well. However, as we discussed, a portion of the site is located within FEMA's 100-year flood zone, which is an area of jurisdiction under the Massachusetts Wetlands Protection Act (M.G.L.ch.131§40) and its associated regulations (3 10 CMR 10.00). In addition to the Act,the City of Salem Wetlands Protection&Conservation Ordinance (ch.50) adds a 100-foot jurisdictional buffer zone around the flood zone. The Act and the Ordinance state that a jurisdictional area may not be altered, dredged, filled, or removed without a valid permit from the local Conservation Commission. Any violation of the Act or the Ordinance may result in enforcement actions including up to a $200 fine per day,per violation. Furthermore, the responsible party may be required to restore any unlawfully altered protected areas. In order to resolve this violation, the Salem Conservation Commission requires the following actions: 1. Submit a complete Request for Determination of Applicability or Notice of Intent no later than May 25, 2017 to be reviewed at the June 8, 2017 Conservation Commission meeting. The submittal must document the following: conditions onsite prior to the unpermitted work,the work that was completed, and any mitigation necessary to comply with the Wetlands Protection Act and Ordinance. 2. Supply any additional information requested by the Conservation Commission or Conservation Agent in order to facilitate a speedy review of the submittal. The Conservation Commission reserves the right to issue a subsequent violation letter requiring further actions to resolve this matter, such as implementation of any mitigation or restoration 1 required as a condition of a Determination of Applicability or Order of Conditions issued by the Commission.
