The work shall be complete by March 31, 1979. Prior to the start of work the area shall be laid out by a registered surveyor in accordance with the above plan. All stone beyond the constructed toe of the bank shall be removed and all execess rock, stone and soil shall be removed from the site and shall not be disposed of in adjacent areas of the harbor. The Commission expressed concern that the calculations submitted did not reflect the actual water level which could occur. They further would prefer that these calculations be prepared and stamped by a Registered Professional Engineer. STORAGE AND PRESSURE TANKS•STEEL PLATE FABRICATION LICENSED UNDER:ASME•API• UL• STI I MINUTES OF MEETING July 26, 1984 The Salem Conservation Commission met at One Salem Green, second floor conference room, on Thursday, July 26, 1984. Present were Philip Moran, Alice Akatyszewski, Raymond Lavender, James MacDowell, and Curtis Hussey. Also present were Conservation Aide Charles Frederiksen and City Planner Gerard Kavanaugh. The meeting was called to order at 7:35 p.m. by Chairman Philip Moran. NEW MEMBER Chairman Philip Moran opened the meeting by welcoming our new member Curtis Hussey to the board. Mr. Hussey was recently appointed to replace Richard Femino. A copy of a letter sent to the Council from Mayor Salvo nominating Mr. Hussey was read for the record. DETERMINATION OF APPLICABILITY--RICHDALE, BRIDGE STREET Chairman Moran read the notice of the Determination and noted he had been contacted by Attorney Gregory Demakis on behalf of Richdale. They were unaware they had to appear before the Commission and would very much like to open their store on July 27. Attorney Demakis stated that the store is ready to open on July 27 and no one informed him of the need to appear before the Conservation Commission. The Building Inspector and Fire Department have issued their permits and the City Council has issued a license for storage tanks for the fueling operation. Three weeks ago it came to his attention that there was a wetland area involved and he immediately filed a request for Determination. Mr. Arthur Bouras, manager of the store, felt he had obtained all the necessary permits. He was not told he needed to appear before the Conservation Commission but now is present and would like to clear up all the necessary questions so he may open tomorrow. He added he felt the installation of the new tanks would improve the site and his operation will be top notch and an improvement to the area. Conservation Aide Charles Frederiksen confirmed that Mr. Bouras has been cooperative. Glenn Yale asked if the site is within the 100-year flood plain and Mr. Frederiksen replied that part of the parking lot is within that area, but the remainder of the site, including the store and the storage tanks is in the 500-year flood plain. However, the lot does drain into Beverly Harbor. Further, DEQE has determined that a monitoring well must be installed on the site which they have done. Glenn Yale asked if buoyancy calculations were done on the storage tanks and Mr. Bouras replied that when the new tanks were installed they were placed on concrete Minutes of Meeting--July 26, 1984 Page 2 pads and more concrete was added above the tanks. He felt they were very securely anchored. Glenn Yale asked the size of the tanks and Mr. Bouras replied that two tanks totalling 31,000 gallon capacity. Glenn Yale noted that he felt there was a potential that the tanks could pop up. Mr. Bouras felt this was unlikely. Jim MacDowell felt the installation as described by Mr. Bouras was accepted engineering practice; however, factor of safety calculations should be submitted. Charles Frederiksen stated the lot does slope so there would be no puddling of water. Jim MacDowell felt there could be a problem in a high tide storm event such as the 1978 blizzard. Glenn Yale asked if the tanks were filled presently and Mr. Bouras replied in the affirmative. Mr. Yale felt strongly that calculations should be submitted to the Commission for their perusal. We would like uplift and factor of safety calculations. Mr. Bouras will submit these to Charles Frederiksen prior to our next meeting and the Commission will determine the applicability of the work. Upon the motion of Alice Akatyszewski and second of Glenn Yale, the matter will be continued until our next meeting. It was so voted. WINTER ISLAND YACHT YARD Raymond Lavender noted he had inspected the site today and based on his past knowledge of the area, he saw very littlechange in the area. There is some levelling on the seaward side. Charles Frederiksen added that there were no outstanding permits from the Division of Waterways for either Mr. Hayward or Mr. Cahill, the previous owner. He also spoke with Mr. Grinnell of SESD and there are no plans available for the pipe installation. Jim MacDowell noted that any encroachment of fill was due to the failure of the bulkhead and Mr. Hayward has indicated he will replace this. Following some further discussion, the consensus of the Board was to do nothing until plans are submitted for repair work. Upon the motion of James MacDowell and second of Raymond Lavender, the matter was tabled. It was so voted. RIVERVIEW ROAD Conservation Aide Charles Frederiksen stated that three lots which border the Forest River Conservation Area, owned by the City, have been requested to be sold. Chairman Brian French called the meeting to order at 8:45 P.M. ANCHOR GAS STATION--BRIDGE STREET Mr. James Crowell of A & A Construction Company spoke regarding the intention of Anchor U. S . A . to install three new gasoline tanks . (also present were Nondas Lagonakis , Landlord for the property and Pbter DaVekos of Anchor U. S . A . ) One of the present tanks has been leaking gasoline and the station has been closed . down by order of the Coast Guard and the Fire Department . Even though only one tank is leaking, they plan to replace all three . Brian French asked out of what material the tanks would be con- structed. Mr. Crowell replied that they would be steel tanks . Mr. French questioned why the tanks would not be fiberglass . Mr. Crowell answered that they are prohibitively expensive and also cannot withstand the climate changes in this part of the country. Dir. French stated that Tony Fletcher had approved the uplift calculations and the insulation is adequate . The Commission's concern is for the potential storm damage prevention. A motion was made by Philip Moran to approve the work as pre- scribed significant to the provisions of the Wetlands Protection Act. The motion was seconded by David DeVoe . It was so voted. It was further stated that the work will be done in compliance with the Fire Marshall and City Engineer. There being no further questions or comments, the gentlemen were excused with the Commission' s thanks. APPROVAL OF MINUTES Mr. French pointed out that it is "Youth Conservation Corps , " rather than "Youth Conservation Commission" as stated on p. 4. Mr. DeVoe wished to change the phrase on p. 2 , paragraph 30 "the slope is not rip-rapped" to "the slope is not supported. Massachusetts 01970 Memorandum To: Gerard Kavanaugh From: Charles Frederiksen Date: 7-24-84 RE: Conservation Commission Agenda 7-26-84 1) Determination of Applicability-- Richdale, 3 Bridge Street. This site was formally a Gulf service station and has now been rehabi- litated into a- Richdale store and self serve gas station. It falls within 100 feet of Beverly Harbor. JThe project is t completeA New gas storage tanks have been installed on site and the building has been completely renovated. The 3 owner obtained a building permit from the Building Inspector to rehab the building. He also went before the City Council and gained approval to install underground tanks to contain 31,000 gallons of gasoline and replace the old underground tanks which hold approximately 20,000 gallons. The owner never notified ConCom. Since he has not significantly changed M the use or structure on the site he would not have been altering the buffer zone in anyway. The increase in the amount of storage of gas on-site, however, �'in my opinion is an alteration. Particularly since the entire paved area Q_of the site including a portion of the neighboring Bill and Bob's restaurant V"paved surface, drain directly into the harbor. S7 When the new storage tanks were installed, the Fire Marshall, Capt. Turner \notice leakage in the ground from the old tanks. He notified DEQE in Woburn. Uack Duggen, DEQE Field Inspector, investigated the tanks and confirmed that thereas, into the ground from a leak that occurred in 1981 from the old tanks. Mr. Duggen has required the owner to (1) removed the soil where leak- age has occurred and (2) install a monitoring well next to the new tanks. The owner has re-surfaced the paved area of the site, but has not changed the topography in any way. The building on the site is the same structure that was there before. The only change .that has occurred is the increase in underground storage. Since the owner has met the requirements of the Fire Marshall, the Building Inspector, and City Council and since DEQE has already inspected the site and set conditions upon it, I expect the Commission will consider the project not applicable to the Wetlands Act. However, since the owner, Nondus Laganakus has been before the Commission many times in the past and is aware that he must go before the Commission when working within 100 feet of any wetland, the Commission may require that a full Notice of Intent be filed with plans to resolve on-site drainage. 2) Winter Island Yatch Yard Discussion At the last meeting it was decided to defer any further discussions on this matter until ConCom members could view the site. As directed, I contact- ed John Zajac at the Division of Waterways and he confirms that neither Phil Cahill nor Peter Haywood has ever applied for any permits with his office. I spoke again with Mr. Grennel at SESD to confirm my conversation with him where he stated that the inlet was there after the Macke work was completed. He now says that the inlet was not there. Mr. Haywood has admitted to the existence of boulders falling off his retaining wall facing the Pelletier's property. He also stated that his rip rap wall facing the cove is very suscepatble to storms. He is willing to resolve these issues with the Commission. Since the filled inlet is not on Haywood''s land and since the filling was done by SESD and the City is onASESD easement which supersedes the Wetlands Protection Act, I don't think the Commission can or should ask that the fill there be removed. I suggest that ConCom request that a Notice of Intent be filed with the Commission to replace the retention walls and that the plans filed show the exact location of the high water mark and existing bank to ensure no future filling. 3) Riverview Road- Disposition of City Land We have discussed this and it was your recommendation that we present it to ConCom before recommending to the Council that it be sold. 4) Clayman Update I viewed the Clayman site today. The Company has reopened after their Summer break and has ignored our request to stop the discharge of air- conditioning water into the North River. I suggest we issue as Cease and Desist Order to them and require that they discharge into the City drains that are less than 50 feet from their air-conditioning units. I have viewed some buildings on the North River to see if anyone else discharges into the river. I found nothing, but it was high tide and I could not view every building from the road. Present were Christopher Hagger, Glenn Yale, Raymond Lavender, James MacDowell, and Alice Akatyszewski. Also present were City Planner Gerard Kavanaugh and Conservation Aide Charles Frederiksen. Philip Moran, Richard Femino, and Associate Member Paul Willis were absent. The meeting was called to order at 7:35 by Vice-chairman Glenn Yale. WINTER ISLAND YACHT YARD Two letters (attached hereto) from attorneys representing Mr. and Mrs. Pelletier of Winter Island Road and Peter Hayward of Hayward's Boatyard were read for the record. Attorney Francis Mayo, 30 Federal Street, representing the Pelletiers, noted that his clients have no intention of harassing anyone; they feel they have a reasonable complaint. They have reason to believe that illegal fill has been placed in the cove on the Hayward Boatyard property. Several neighbors have concurred. He also raised the issue of a retaining wall on the easterly side of the Pelletier's property which is crumbling and several boulders have fallen on the Pelletier's property. Mr. Mayo showed an aerial photograph which he felt showed that a great deal of fill had been placed on the waterfront. James MacDowell asked what the date of the photographs was and Mr. Mayo _ replied they were taken in 1964. Mr. MacDowell asked if there were any more recent photographs and Mr. Mayo replied in the negative.. Attorney William Lundregan, 221 Essex Street, representing Mr. Hayward, noted that this evening's meeting was an informal discussion. He stated that Mr. Cahill formerly owned the boatyard (since 1920) and was not available this evening. However, Mr. Lundregan recently appeared before the Board of Appeal on an ancillary matter and Mr. Cahill confirmed at that time that the configuration of the boatyard was the same today as it was in the 1940's, with the exception of the culvert which is not owned by Mr. Hayward. The last expansion of the boatyard was in 1947 when two tons of gravel was placed in the area. No expansion has been done since that time. Mr. Lundregan felt there were three issues that were to be addressed: 1. Regarding the retaining wall on the boundary of the Pelletier's property. Mr. Hayward agrees that some boulders have fallen from the wall on to the Pelletier's property. They will remove the stones forthwith. They are prepared to come before the Commission for permission to construct a new retaining wall. They feel this will help the problem considerably. Glenn Yale asked when the retaining wall was built originally and Mr. Hayward replied it was built in 1964. Nothing has been added since that time. He added that the area in question is a relatively small area. i r Minutes of Meeting--July 12, 1984 Page 2 Jim MacDowell asked if there were any outstanding licenses from the Corps of Engineers or the Division of Waterways and Mr. Hayward replied in the negative. Mr. Lundregan added that some repair was done to the wall following the blizzard of 1978 and approval was received for that repair. Jim MacDowell suggested that the Division of Waterways be contacted to make sure that there are no outstanding licenses. Peter Hayward stated that the only work he has done on the site is to replace some wooden sleepers. He added some lin-pak to the area. Mrs. Louise Pelletier, an abuttor to the boatyard stated that it took years for Mr. Cahill to bring in truckloads of fill in to the boatyard. She and several of her neighbors have noticed dramatic changes in the configuration of the yard over the years. Several letters from neighbors were read for the record by the vice- chairman. Mr. Lundregan stated there were several abuttors who would refute that claim. He did not ask them to be present this evening as he was under the impression it was an informal meeting. However, several neighbors were present at the recent Board of Appeal meeting to speak in favor of Mr. Hayward's petition. Mr. Hayward added that his storage capacity of boats has not increased dramatically since 1970. He is prepared to remove the rocks which have fallen on to the Pelletier's property. A second issue is an inlet which contains a pipe placed by SESD several years ago. Mrs. Pelletier claims that the inlet has been filled. She showed a photograph to the Board which depicts a structure on that property. Mr. Lundregan noted that in the late 1970's SESD extended their outfall line and this was the result. Dr. Hugh Mulligan, a consultant speaking on behalf of Mr. Hayward, noted that there is an _ easement for SESD to place a 66" pipeline 10' below the top of the road. Work was completed on this in 1977. In 1980, neighbors complained of experiencing drainage problems and former City Engineer AnthonyFletcher went to SESD for permission to place a drain and extend the pipe to 16'. This was done--a 12" or 16" storm drain was placed and the pipe was actually extended to 20' and filled in. In 1982, the pipe was still not draining properly, so the City hired Mackey Construction to extend the pipe to 801. The area was then filled in and brought up to the grade of the boatyard. Mrs. Pelletier claimed that the area was not filled in in 1982. Glenn Yale asked about the structure located in that area and Mr. Hayward replied that it was a temporary structure and it is actually located on a Mrs. Jebb's property and she had given permission for Mr. Hayward to use the site. Charles Frederiksen stated that there have been no Requests for Determination of Applicability or Notices of Intent filed on the property. Mr. Cahill came before the Planning Board for the repair work he needed to do as a result of storm damage in 1978. The Engineering Department never filed any Notice of Intent for any work done on that site. Copies will be requested of any SESD records. A neighbor of the area noted that up until two years ago there was a right of way there and now Mr. Hayward has filled the area and erected a fence. Mr. Hayward replied there was always a fence there. SESD built a new fence from the Jebb's fence to the picket fence erected by Mr. Cahill. Dr. Mulligan added that he spoke y ' Minutes of Meeting--July 12, 1984 Page 3 with Mr. Mackey and he said the work was done under the supervision of former City Engineer Fletcher. The contract called for extending the pipe and rip-rapping the top. Mrs. Pelletier claimed that Mr. Hayward had constructed a new pier without Y benefit of permit and Mr. Hayward noted that the photograph dated 1977 shows the same as exists today. The 1964 aerial also shows the same pier. Glenn Yale noted that Mr. Hayward has indicated his willingness to remove the rocks on the Pelletier's property. Regarding the pier, Mr. Hayward has a right to maintain the pier. Attorney Mayo would like the Commission to investigate further the matter of the configuration of the boatyard and the shoreline being changed. He feels there has been substantial changes and a great deal of fill has been placed there. James MacDowell suggested the matter be taken under advisement and the site be inspected prior to our next meeting. Glenn Yale asked when Mr. Hayward will submit a Notice of Intent for the repair to the retaining wall and Mr. Hayward replied he hopes to as soon as time and funds permit. Jim MacDowell urged Mr. Hayward to begin the permit process early. Mr. Mayo reiterated his concern for the configuration change in the boatyard and Vice-chairman Yale encouraged the Commission members to inspect the area. Mr. Lundregan stated he feels the configuration has not changed. CONSERVATION AIDE REPORT Charles Frederiksen noted that upon inspection of the Ragone site, he found the fill had been removed. Upon the motion of James MacDowell and second of Raymond Lavender, the Cease and Desist order was lifted. It was so voted. Regarding Legg's Hill Pond, City Planner Gerard Kavanaugh noted the City Engineer felt the design and funding for a new control structure was not his department's responsibility. Following some discussion, upon the motion of James MacDowell and second of Raymond Lavender, Mr. Kavanaugh will speak with the Mayor regarding the possibility of supplemental funding for a structure for Legg's Hill Pond. It was so voted. Further, input will be provided to the City Engineer from the Commission as to the design of the structure. Regarding Clayman and the matter of the discharge of air-conditioning water into the North River, Mr. Frederiksen reported that he visited the site with Health Agent Robert Blenkorn and two air-conditioning units were discharging directly into the North River. It is clearly air-conditioning water only. Chris Hagger stated he would prefer to see any discharges go into a drain which will ultimately go into the sewer system. Upon the motion of Chris Hagger and second of Alice Akatyszewski, a letter will be sent to Mr. Clayman stating that the Commission is not in favor of any discharge into the North River. It was so voted. Commission members attending were: Brad Northrup, Brian French, Cleti Cervoni, Paul Willis and Jim Rienhardt. Conservation Aide Joseph Antonelli was also present. Commission Member not attending: David DeVoe Chairman Brad Northrup opened the Wetlands Public Hearing for Helen and Donald Durflinger of 26 Hardy St. at 8:00 P.M. Brad next read excerpts from the Wetlands Protection Act which govern the public hearing. In re- reiewing the Notice of. Intent it was noted that the plans were prepared and stamped by a certified Civil Engineer in compliance with the regulations adopted by the Commission qoverning sea wall construction and reconstruction. Thomas Curran, the contractor for the project, was present and presented the standard retaining wall design which will be utilized for this project. i Mr. Curran also informed the Commission that he had added riprap below the weep hole on the submitted plans. Brian French suggested that granular fill be added to direct the water to the weep hole. Mr Curran also explained that the plans call for removal of the fill that's there so that this fill will be used for backfill. He noted that the path behind the garage will have to be made wider in order to get the equipment in to reconstruct the seawall. Brian French informed Mr. Curran that cement and mortar had been left in the harbor when Henry O'Donnell',s is,eawall was repaired. He asked if Mr. Curran, since he was the contractor for that project, if he would make arrange- nents to have it removed. Mr. Curran replied he would. Mr. Durflirger noted that children have been playing on his old seawall and he expressed concern that if it continues a child will be injured. Brad Northrup stated that the Commission had no jurisdiction in this matter but he suggested that a sign be installed. Mr. Lagonakis further explained that he proposes to repair the washout erosion that occurred after the February 6th storm by filling jof e eroded embarkment with crushed stone and rocks. ian French, in noting that Mr. Lagonakis has purchased the gas station xt to his property at 5 Bridge St. , reminded Mr. Lagonakis that the Order Conditions issued to the previous owners are still in effect. ` Mr. Lagonakis stated that because of the current plans for the connector road he did not want to incur the expense of a seawall. Mr. Lagonakis also informed the Commission that he has receive4 17,000 from the Federal Gov't to do this work. Mr. Lagonakis also stated that he had an opportunity to obtain crushed stone for the fill for $50 a truck load. Cleti Cervoni reiterated that there should be no stone placed on the beach. Brian French questioned when Mr. Lagonakis planned to begin the work. He stated he wanted to begin immediately. Brad Northrup informed Mr. Lagonakis that if the Commission found the proposed work inapplicable to the Wetlands Protection Act there would still be a 10 day appeal period be- fore work can begin. A motion was made by Brian French and seconded by Paul Willis that the Wetlands Protection Act is not applicable to the work proposed by Mr. Lagonakis in his "Request for a Determination" on the condition that the work does not involve filling beyond the line of existing protective stone ad- jacent to the beach. Lagonaltis was present to ask the Commission for a Determination of Applicability relevant to correcting the pavement problems on his property and to pave a portion of the fill in the rear of his property by the embankment. Brad Northrup informed NIr. Lagonakis that the Commission' s major objection was regarding how close to the edge of the embankment he planned to pave. Dave DeVoe and Ray Lavender viewed the property. Dave DeVoe noted that Pr. Lagor_akis does not propose to change neither the existing drainage pattern that presently eixsts on the slope of the land nor the elevation. Brian French took exception to the method of this application of applicability. He considered this work to be significant enough to require the filing of a Notice of Intent to clearly define the scope of the work to be done. He noted that this was a coastal bank and is clearly significant to storm damage prevention. Cleti Cervoni disagreed with Brian French. She felt a Notice of Intent would not be necessary. Brian French made a motion that the proposed v,,ork is significant to the Wetlands Protection Act and requires a Notice of Intent. A second was not called. Dave DeVoe noted that the plans submitted had a -final elevation, a line mark along the edge and the paving would follow the existing contour of the present paving without any overlap. After some discussion a motion was made by Cleti Cervoni and seconded by Dave DeVoe that the area is subject to the Act but the proposed %:.ork was not dredging, filling, removing or altering and therefore a Notice of Intent was not reouired. The Chairman declared the motion carried. Brian French voted in opposition. HERITAGE TRUST II - DREDGING A continuation of a, public hearing for Heritage Trust II was held primarily because of the omission of the stability calculations. Hr. Plunkett noted that Schoenfeld Associates submitted a letter stating that the depth of the existing wall below the present mud line had been researched and further investigation is now being made for proper engineering evaluation of the wall stability due to the proposed dredging. It was also stated that at the Planning Board meeting of July 6, 1978 the Planning Board voted to request the Zoning Enforcement Officer to grant an extension to Sept. 1, 1978 for Mr. Lagonakis to correct this Zoning violation with the following two conditions: 1. The violation is corrected by removing the additional fill to the line of the original embankment as it existed prior to the February 6th storm. The exact location of this line will be determined by a cooperative effort between the Army Corps of Engineers and the Salem Conservation Commission. 2. That Mr. Lagonakis meet with the Conservation Commission relevant to their requirements under the WetlandsProtection Act. This will include filing a Notice of Intent with the Conservation Commission. It was the consensus of the Commission that the Commissioners with a representative from the Army Corps of Engineers and Mr. Lagonakis meet at 7:30 P.M. on July 31, 1978 to determine the line of the original embankment. Special Permit Comments on George Kastrinakis and Andrew Ginkus After a brief discussion it was the consensus of the Board members present that these comments be made at the next regular meeting of the Commission. CZM Special Assistance Funding It was noted that the first round of funding for a CZM grant will be submitted and will be a South River WaterfrontProject. Brad is to speak to Nancy Kepes relevant to a future grant proposal for the Harbor Islands. Conservation Assistant Position Brad Northrup will be pursuing the position of Conservation Aide with CETA. He noted that he has mailed the job description to two local colleges. Hewitt Construction Co. - Clark St. Joe informed the Commission that a complaint has been made by Mrs. Agnes George relevant to the dumping of materials on Mr. Hewitt's property on Clark St. Mr. Hewitt has been given permission to dump rock up to the buffer zone on his property. Alan Randell of the Army Corps of Engineers has also informed the Commission that he feels that the aerial photo of the property will serve as the input from the Army Corps in the establishing the line for the removal of fill. It was the consensus of the Commission that Commission members meet to view the site on Monday, August 14, 1978 at 7:30 P.M. UDAG David Lash of the Planning Department informed the Commission that the City has just received an UDAG grant^'.in the amount of 1.9 million. He pointed out that at this point he does not know which parts of th original grant proposal are being included in the 1.9 million. At this point he thinks that the money will be primarily for the housing rehabilitation program and will not include the South River park or the work proposed for Derby St. David also informed the Commission that the Planning Department will be submitting a Urban Self Help Grant proposal for the South River area. He stated that a proposal could not be submitted for the Forest River until the appraisals are completed. He next informed the Commission that the Planning Department is also submitting 2 proposals for funding by CZM. One would be a proposal for $30,000 from surplus funds through the Federal CZM Program. The other is a $20,000 grant proposal through the state CZM Program. Both proposals are for the South River Waterfront area. It would consist of site analysis, schematic designs and construc- tion cost estimates for a proposed 6 acre park and recreation area, seaside walkway and public marina to be located on Salem's downtown waterfront. David asked if the Commission would write a letter of endorsement to be included with the $20,000 CZM Grant Proposal. It was the consensus of the members present that a letter of endorsement be written. Forest River Brad Northrup questioned the endorsement letter relative to the Order of Taking for the Forest River Conservation Area. After a brief discussion, it was decided that David Lash would prepare a chronological review of the events from 3 months before the land taking for the Commission to review and vote upon. A brief discussion was next held relative to the second round funding for the Forest River Conservation Area. David suggested that since the second phase consists of primarily land in the buffer zone it would probably be advisable to speak to the individual owners before any decisions are made. David also pointed out that development money will also be included in the second phase. David also informed the Commission that a sign is needed for Loring Ave. for the Conservation area. Because of this, their structural engineer has designed a new beam that represents an alteration from their original design. After a brief discussion, a motion was made by Brian French and seconded by Paul Willis that the Wetlands Protection Act is not applicable to the change in the plans for Heritage Trust II at Pickering Wharf described in a letter from James Vansickle of Add Inc. The vote was unanimous and the chairman declared the motion carried. Nondas Lagonakis A discussion was held on the inspection that was done by the Commission as well as Bill Tinti, Michael Moniz, Steve Sklover and Nondas Lagonakis on August 14, 1978. A motion was made by Brian French and seconded by Paul Willis that the deviations in the work on the Miller Wharf marina from the Order of Conditions (DEQE file #64-8) issued by the Commission on February 17, 1976 are not significant to the purposes of the Wetlands Protection Act and the commission grant a one year extension for the completion of the work covered in that Order of Conditions. One of the conditions contained in the "Order of Conditions" is that all stone beyond the constructed toe of the bank shall be removed and all excess rock, stone and soil shall be removed from the site and shall not be disposed of in adjecent areas of the harbor. The berm of stone that presently exists at the bottom of the rip rap embankment has to be removed before a "Certificate of Compliance" can be issued by the Commission. As far as your proposed paving to the edge of the embankment, the Commission has been informed by the City Engineer that a paving permit is required from the Engineering Department. In addition, under the Wetlands Protection Act, Chapter 131, Section--40,it w I'1 be--necessary for you to submit a "Request for a Determination of Applicability'to the� Conservation Commission. Massachusetts 01970 =4 Memorandum To: Gerard Kavanaugh From: Charles Frederiksen Date: 7-24-84 RE: Conservation Commission Agenda 7-26-84 1) Determination of Applicability-- Richdale, 3 Bridge Street. This site was formally a Gulf service station and has now been rehabi- litated into a_Richdaie store and self serve gas station. It falls within 100 feet of Beverly Harbor. The project is 90 percent complete. New gas storage tanks have been installed on site and the building has been completely renovated. The owner obtained a building permit from the Building Inspector to rehab the building. He also went before the City Council and gained approval to install underground tanks to contain 31,000 gallons of gasoline and replace the old underground tanks which hold approximately 20,000 gallons. The owner never notified ConCom. Since he has not significantly changed the use or structure on the site he would not have been altering the buffer zone in anyway. The increase in the amount of storage of gas on-site, however, in my opinion is an alteration. Particularly since the entire paved area of the site including a portion of the neighboring Bill and Bob's restaurant paved surface, drain - directly into the harbor. When the new storage tanks were installed, the Fire Marshall, Capt. Turner notice leakage in the ground from the old tanks. He notified DEQE in Woburn. Jack Duggen, DEQE Field Inspector, investigated the tanks and confirmed that there,,Leakage into the ground from a leak that occurred in 1981 from the old tanks. Mr. Duggen has required the owner to (1) removed the soil where leak- age has occurred and (2) install a monitoring well next to the new tanks. The owner has re-surfaced the paved area of the site, but has not changed the topography in any way. The building on the site is the same structure that was there before. The only change .that has occurred is the increase in underground storage. Since the owner has met the requirements of the Fire Marshall, the Building Inspector, and City Council and since DEQE has already inspected the site and set conditions upon it, I expect the Commission will consider the project not applicable to the Wetlands Act. However, since the owner, Nondus Laganakus has been before the Commission many times in the past and is aware that he must go before the Commission when working within 100 feet of any wetland, the Commission may require that a full Notice of Intent be filed with plans to resolve on-site drainage. 2) Winter Island Yatch Yard Discussion At the last meeting it was decided to defer any further discussions on this matter until ConCom members could view the site. As directed, I contact- ed John Zajac at the Division of Waterways and he confirms that neither Phil Cahill nor Peter Haywood has ever applied for any permits with his office. I spoke again with Mr. Grennel at SESD to confirm my conversation with him where he stated that the inlet was there after the Macke work was completed. He now says that the inlet was not there. Mr. Haywood has admitted to the existence of boulders falling off his retaining wall facing the Pelletier's property. He also stated that his rip rap wall facing the cove is very suscepatble to storms. He is willing to resolve these issues with the Commission. Since the filled inlet is not on Haywood''s 'land and since the filling was done by SESD and the City is on ESD easement which supersedes the Wetlands Protection Act, I don't think the Commission can or should ask that the fill there be removed. I suggest' that ConCom request that a Notice of Intent be filed with the Commission to replace the retention walls and that the plans filed show the exact location of the high water mark and existing bank to ensure no future filling. 3) Riverview Road- Disposition of City Land We have discussed this and it was your recommendation that we present it to ConCom before recommending to the Council that it be sold. 4) Clayman Update I viewed the Clayman site today. The Company has reopened after their Summer break and has ignored our request to stop the discharge of air- conditioning water into the North River. I suggest we issue as Cease and Desist Order to them and require that they discharge into the City drains that are less than 50 feet from their air-conditioning units. I have viewed some buildings on the North River to see if anyone else discharges into the river. I found nothing, but it was high tide and I could not view every building from the road. I will walk the entire river at low tide in August and compile a list of any discharges.
