Failure to comply with all conditions stated herein,and with all related statutes and other regulatory meas- ures,shall be deemed cause to revoke or modify this Order. 2. This Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3. This Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state or local statutes, ordinances, by-laws or regulations. 4. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: (a) the work is a maintenance dredging project as provided for in the Act;or (b) the time for completion has been extended to a specified date more than three years, but less than five years,from the date of issuance and both that date and the special circumstances warranting the extended time period are set forth in this Order. �5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 8. Any fill used in connection with this project shall be clean fill,containing no trash, refuse, rubbish or de- bris,including but not limited to lumber, bricks, plaster,wire,lath, paper, cardboard, pipe, tires,ashes, refrigerators, motor vehicles or parts of any of the foregoing. 7!1:!No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if such an appeal has been filed, until all proceedings before the Department have been completed. The work the company proposes to do involves Placing two four- inch nch armored telephone cables across the Danvers River just east of the Route, 1A bridge. Divers will excavate the subtidal trench one foot deep where sediments permit, otherwise the cables will be placed on the bottom. The excavation will disturb about 1250 s. f. of mussel bed. The construction period for work below mean high water is expected to be five workdays. In accordance with the provisions of Section 401 of the Federal Water Pollution Control Act as amended (Public Law 95-217) , this Division issues the following Water Quality Certification relative to this project, subject to the following conditions: 1. This project could result. in a violation of water quality standards adopted by this Division. Therefore, reasonable care and diligence shall be. taken by the contractor to assure that the proposed activity will be conducted in a manner which will minimize violations of said standards. 2. No water jetting shall be used to place the cables in the bottom sediments of the river. j i 3. No work shall occur during the period of February 15 through May 15 in order to avoid impacts on flounder and mussels during their spawning periods. i i R A -2- Should any violation of the water quality standards or the terms of this certification occur as a result of the proposed activity, this Division will direct that the condition be corrected. Non-compliance on the part of the permittee will be cause for this Division to recommend the revocation of the permit(s) issued therefor or to take such other action as is authorized by the General .Laws of the Commonwealth. Substantial civil and criminal penalties are authorized under MGL Ch. 21, Section 42 for discharging into Massachusetts waters in violation of an order or permit issued by this Division. WETLANDS REPORT For the Proposed Submarine cable conduit crossing of Beverly Harbor along the harbor bottom from Salem to Beverly Prepared For: New England Telephone Company Prepared By: Hugh F. Mulligan, Ph.D. Director December 30, 1987 ENVIRONMENTAL CONSULTING SERVICES SITE DESCRIPTION The New England Telephone Company proposes to place two 4 inch armored submarine telephone cable conduits across Beverly Harbor from the City of Salem to the City of Beverly. The location of the crossing is east of the Beverly-Salem Bridge which connects Rte lA Salem to Rte. lA Beverly. Route lA is a narrow, heavily-travelled two-lane road over the bridge. On each side of the bridge, the road widens to allow more vehicular manuverability. The Beverly-Salem Bridge is an attended swing bridge supported by large granite blocks and a steel and concrete form. Beneath the center of the bridge a channel is defined with timber pilings extending up and downstream on each side of the channel. At the Beverly side of the bridge, a vertical seawall of granite extends from the river bottom to a point above mean high water. On the Salem side of the bridge are intertidal flats and a rip-rap seawall. The proposed cable conduits would be placed east of the Salem end of the bridge as shown in Figure 1. The conduits would continue north towards the McDonalds Restaurant on the Beverly side of the harbor and into the seawall west of the public dock by the McDonalds Restaurant Park (see Figure 2 ) . At the bridge the tidal fluctuation is approximately 9 feet from mean low water to mean high water. The depth of water in the channel at mean high water is approximately 28 feet (Figure 2) . On the Beverly side of the harbor, a "Designated Port" extends from immediately east of the public dock past the yacht club to the east. This area will not be affected by the work proposed. -1- DESCRIPTION OF WORK At the Salem side of the river, the two conduits will extend from the rip-rapped bridge support structure which abuts the Richdale Store at 3 Bridge Street. These conduits for submarine cables will be placed in a trench approximately 12 inches deep which will be excavated with hand tools alongside the rip-rap to its termination, then proceed directly north towards Beverly. At the mean low tide mark, the hand dug trench will continue, and hand trenching may be augmented by the use of a hydraulic jet across the harbor to the Beverly side. All work will be done by divers utilizing hand-held equipment. At the Beverly side of the river, the cable will be laid in the excavated trench along the northern line of a proposed fixed pier (not associated with this project) , under the public docking area near the McDonalds Restaurant Park, and enter the seawall to connect with a proposed manhole and existing cables at the street (please refer to Figure 2) . It is anticipated that the two armored conduits will be placed from the Beverly side to the Salem side within one tidal cycle. The hand excavating and possible water jetting (if necessary and possible) to bury the conduits should be completed within 4 to 5 days, primarily during low tides. It is determined that another two work days could be needed on the Salem side to splice the armored conduits to underground conduits and install an anchoring device. On the Salem side, this anchoring device will consist of a galvanized chain attached to an eye bolt, which will be secured to bedrock. During field survey probes it was estimated that bedrock is located 1 to 2 feet below the sediment surface. On the Beverly -2- side, the, proposed conduits will be anchored to the proposed man-hole, which is to be placed in the upland area ( see Figures 2,3 ) If it is found that the sediments are unacceptable for trenching operations (e.g. bedrock or large cobble substrate) in the subtidal zone, the armored conduits will be laid on the harbor bottom along the same proposed route. III. RESOURCE AREAS There are four Wetland Resource Areas involved in this project. They are Coastal Beach, Coastal Bank, Land Under the Ocean, and Land Containing Shellfish. There is no Barrier Beach listed under Coastal Zone Management Barrier Beach Inventory that would be associated with this project. This area is also not listed as a "Fish Run" in the Guide to the Coastal Wetland Regulations. Land Under the Ocean: The subtidal portion of the harbor and channel is considered "Land Under the Ocean" . This land appears to consist of exposed bedrock and soft sediments subject to scouring and deposition during strong tidal surges. The two conduits shall be placed across the harbor bottom to a maximum depth of approximately 28 feet (mean high water) alongside one another in order to minimize disturbance. Coastal Beach: On the Salem side of the harbor, the Rip-Rapped fill supporting the bridge slopes from the road to the harbor. A partially intertidal beach and a tidal flat which is exposed at low tide is at the base of the rip-rap. The flat consists of a mixture of sand and -3- silt and has a substantial cover of Blue Mussels (Mytilis edulis) . Also noted were Barnacles, (Balanus spp. ) , Periwinkles (Littorina sp.. ) rock weed (Fucus vesiculosis) , and outside the zone of work, a small stand of salt marsh grass, (Spartina alterniflora) . Coastal Bank- The vertical seawall on the Beverly side, and the Rip-Rap bridge support on the Salem side can be classified as "Coastal Bank" . These banks are manmade and designed to protect the landward portions of the site from wave and storm action in the harbor. On each side of the river, a hole will be drilled through the seawall to accommodate the conduits to hook up to existing cables on the streets in Beverly and Salem. On the seawall and rip-rap more barnacles were noted, as well as rockweed (Fucus s22. ) , Sea lettuce (Ulva lactuca) , and Sea Anemones (Metridium senile) . Land Containing Shellfish: This classification includes "La " "Land Under the Ocean and Coastal Beach" lands. On the Salem side there is a large bed of Blue Mussel shells (Mytilus edulis) . The beds continue into the subtidal and the extent is not known, although no mussel beds are evident on the Beverly side of the proposed route. Few live blue mussels were noted on this bed, but the existence of the shellfish must be taken into account. The cable trench will cut through approximately 125 feet or more of this area, and the installation of the trench, cable, and backfilling the trench may disturb over 1250 square feet of the mussel bed (assuming a 10 foot wide work area) . There is minor evidence of softshelled clams around the zone of construction, -4- but the scarcity of live shellfish and mildly polluted nature of the area precludes the possibility that a viable commercial or recreational fishery would be seriously affected by this project. Buffer Zone• For this project, the "Buffer Zone" includes the streets and parking areas behind the seawalls. A hole will be drilled through the seawall on the Beverly side underneath a small parking and staging area owned by the City of Beverly which abuts MCDonalds Restaurant park directly to the northeast. On the Salem side, a similar hole will be drilled into the Rip-Rap under the street (Rte. IA) , to an existing New England Telephone Company manhole (please refer to Figure 2) . These two areas, for which the Telephone Company has obtained easements, will be temporarily affected by construction activities which will be very short in duration. The trench above mean low water on the Salem side will also enter the buffer zone of a small saltmarsh area (Figure 2) . No work will be done within this area and no alteration of salt marsh, either permanent or temporary, will occur. IV. MITIGATING MEASURES Several mitigating measures will be employed during the project to minimize impact to the Resource Areas. These measures include selected of least sensitive route location, short duration, and limited and cautious dredging techniques. The project is anticipated to be accomplished during early summer, and is expected to be completed in approximately seven work days. Despite the dynamic activity of the aquatic biota in this season, the -5- disturbance from this project will be of the same type as that which accompanies the excessive boating traffic in the area throughout the summer months. The brief duration of cable conduit placement operations will have minimal impact to waterfowl and fish in the area. The dredging and filling above mean low tide will be done with hand tools at low tide, in order to minimize impact on shellfish and potential finfish which could be disturbed by siltation produced during other methods of dredging. If possible, a hand-held hydraulic jet shall be used by divers to trench and backfill the proposed conduit route along the harbor bottom. This operation, which trenches, places cable and backfills in a single step, minimizes interference from tidal and river currents, avoids. relocation of dredged spoil and tends to maintain sediment disturbance within a relatively small region of the harbor. The potential for the use of this method depends on the sediment composition in the channel and harbor bottom. If there are not enough soft sediments to allow burial of cable, the conduits will be laid along the bottom the the harbor as is shown in Figure 2. It is anticipated that the two armored conduits will be placed from the Beverly side to the Salem side within one tidal cycle. The water jetting ( if necessary to bury the conduits) and the hand excavation necessary to bury the conduits should be completed within 4 to 5 days at low tide. It is estimated that another 2 work days could be needed on the Salem side to splice the armored conduits to underground conduits and place an anchoring device in the ledge. This anchoring device on the Salem side will consist of a galvanized chain attached to an eye bolt which will be secured to -6- ledge substrate, which was found during field survey to be approximately 1-2 feet below the sediment surface. Existing federal, state and local laws are being modified and new laws enacted in order to protect the environment and the public health and safety. Compliance with these laws requires the submission of technical information to local, state, and federal regulatory agencies when operations are modified or new facilities are constructed. Some of the projects which have recently been undertaken by the Gulf of Maine Research Center, Inc. , include: * Conducted numerous MGL c.21E site assessments ( 200-300 per year) for the presence of oil or hazardous materials. As necessary, we have coordinated and supervised remedial action programs on contaminated properties, including underground tank removal, groundwater recovery system installation and contaminated soil removal. * Prepared Notices of Intent and Wetland Compliance Reports for Conservation Commissions throughout the state for installation of submarine cables, seawalls, sewer lines, roadways, houses and drainage structures within the buffer zones of coastal and inland wetland resource areas. * Prepared expert testimony and adjudicatory hearing testimony for Wetland Filings before Mass. DEQE for projects in Wetland Buffer Zones. * Reviewed and recommended options to engineering companies, and city and state officials relative to alteration and restoration of ponds, lakes and fresh and salt water wetlands. * Recommended sewer outfall locations in Lynn, Salem, and Boston Harbor and evaluated impact of sewer pipeline through wetland and shellfish areas in Quincy, Weymouth, and Braintree. * Obtained Conservation Commission approvals for Eastern Route MBTA track, bridge and drainage improvements in Salem, Beverly, Wenham, Hamilton, Ipswich, Manchester, Gloucester and Rockport. * Analyzed technical reports and records of Acid Rain Damage in Massachusetts for New England Electric, Boston Edison, Commonwealth Electric, Northeast Utilities and Eastern Utilities Associates. 2. In addition, the staff of the Gulf of Maine Research Center, Inc. , has experience in siting numerous land based and offshore energy facilities including: * Obtained U.S. Environmental Protection Agency (Region 2) N.P.D.E.S. permit to allow ocean disposal of drilling mud And cuttings in the Mid Atlantic and therefore enabled oil and gas exploration to proceed. * Prepared permit strategy, documents and environmental reports and designed, subcontracted and supervised studies of land, water, and air environment for EG&G New England Energy Park 10,000 ton/day coal gasification plant proposed for Fall River, MA. * Prepared permit strategy and documents for proposed New England Electric - EG&G co-generation plant to generate process steam and electricity at Millers Falls, MA. * Directed application for waiver of stack tests at NASA Hazardous Waste Rocket Fuel Incinerator at Kennedy Space Center. Working in conjunction with Roy F. Weston, Inc. , we developed a plan for siting a central pretreatment facility for the tanneries in Peabody and Salem, Massachusetts, to achieve compliance with U.S. EPA Tannery Pretreatment Regulations which will be enforced beginning November 1985. Our responsibilities on that project include acquisition and analysis of potential site - specific information and the coordination of the project with the tanners and various governmental and regulatory officials. We, also, are arranging and conducting a series of U.S. Industrial Pollution Control Tours for International Environmental Officials. This work is being undertaken for the world Environment Center and U.S. Department of State (Agency for International Development) . We have arranged the itinerary and conducted a tour for the Environmental Protection Minister of Tunisia. He visited industrial facilities in Massachusetts, Pennsylvania, New York, Texas and Florida. Similar visits are planned for other senior International Environmental Officials. The activities in which we engage are multi-disciplinary in nature. They involve interacting with facility managers, attorneys, engineers, geologists, geohydrologists, chemists, biologists, economists and planners. We are often involved in work which deals with solid and liquid waste disposal alternatives, treatability of wastes, surface and ground water contamination, and the impacts of hazardous materials and chemicals on the environment and on public health and safety. We evaluate ocean outfalls, evaluate impacts to other water uses, define wetland boundaries, define compensation for wetland utilization, evaluate feasibility of dredging and disposal of dredge spoils, and prepare Environmental Impact Statements, Environmental Impact Reports and applications for environmental permits and approvals. 3 . Dr. Hugh F. Mulligan is the Director of the Gulf of Maine Research Center, Inc. , and he utilizes other individuals or firms, as necessary, to carry out the Center' s environmental programs. Prior to establishing this company, Hugh Mulligan worked for ten years with engineering and environmental consulting firms and spent fifteen years in academic research, teaching and public service. He has authored more than 50 scientific publications on Limnology, Aquatic Botany, Phytoplankton, and Oceanography and has presented papers at national and international symposia. He was awarded an NSF Fellowship at Cornell in 1961, was awarded a Fullbrigbt Fellowship to develop a Center of Excellence in Oceanography at the University of Karachi in Pakistan in 1975-76 and, in 1975, was selected by the U.S. and Rumanian Academies of Sciences for a 10-month Exchange Research Fellowship to study the Danube Delta of the Black Sea. He has worked closely with scientists from AID, World Bank, FAO, UNDP, and other international agencies. Dr. Mulligan has had considerable experience in working on projects that were quite controversial and often precedent setting. His role has been to design and receive industry and regulatory approval for special studies which satisfied the letter of the regulatory requirements and which were technically sound and cost effective. As the studies are being performed, he works closely with regulatory officials to insure that they are well informed and that the statutory requirements are met. Projects he has carried out include: * Obtained all environmental permits for Allied Specialty Chemical Oximes Plant in Hopewell, VA. * Designed regulatory studies, prepared a compliance plan and obtained ocean dumping permits for Allied Chemical Company enabling them to discharge industrial wastes into approved disposal area in the Mid-Atlantic. * Prepared the first Environmental Reports which achieved compliance with U.S.G.S. Regulations and consistency with CZM Regulations for companies exploring for oil and gas off Mid and North Atlantic coasts. * Obtained N.P.D.E.S. permits for Hudson River Power Plants with Thermal Discharge Demonstration Compliance Studies. * Designed and conducted complex studies on the Phytoplankton Productivity of Georges Bank for the U.S. Bureau of Land Management which were essential to permit oil and gas exploration. * Designed an Ocean Dumping Compliance Program for the Government of Australia. * Evaluated dredging and ocean disposal of dredged materials for the U.S.Army Corps of Engineers at Roosevelt Roads Naval Base, Puerto Rico. 4.
