SignatIMf Applicant Date Signature of Representative(if any) Date wpafonl.doc - Page 4 of 4 APPENDIX A PROJECT DESCRIPTION Old Salem Jail Parking Improvements Salem, MA PROJECT DESCRIPTION Proiect Location The project area is town-owned land at the Old Salem Jail at the intersection of Bridge Street and St. Peter Street in Salem, MA. It is located on public land north of Map 35 Lot 0179 and Map 35 Lot 0188, approximately 190 feet west of St. Peter Street, and approximately 100 feet south of Bridge Street.The existing land is grass open space and an access driveway to the facility. Proiect Purpose The purpose of the project is to provide additional parking areas for the public to access the proposed restaurant to be developed within the Old Salem Jail. Presently,there is no parking in the project area. The purpose of this Request for Determination of Applicability is to comply with MGL Chapter 131 §40 and the City of Salem Wetlands Ordinance Section 50-2: "No person shall remove, fill, dredge, alter or build upon or within 100 feet of any brook, stream, river, pond, lake, estuary or bank, freshwater wetland, coastal wetland, beach, dune, flat, marsh, wet meadow or swamp or upon any land under such waters or any land subject to tidal action, coastal storm flowage, flooding or inundation or within 100 feet of the 100-year floodline, other than in the course of maintaining, repairing, or replacing but not substantially changing or enlarging an existing and lawfully located structure or facility used in the service of the public and used to provide electric, gas, water, telephone, telegraph and other telecommunication services, without filing written application for a permit so to remove, fill, dredge, alter, or build upon, including such plans as may be necessary to describe such proposed activity and its effect on the environment, and receiving and complying with a permit issued pursuant to this chapter." Existing Conditions Existing conditions consist of an asphalt pavement driveway and grassed areas. A retaining wall and cemetery are adjacent to the project site. There are no wetland resources within the project and the project is approximately 700 feet from the North River. A portion of the project is within the limit of the Federal Emergency Management Agency (FEMA) 100-Year Flood (Elevation 10) (FEMA Map Number 25009C0419G). The project is not located within any other known protected or regulated area. Proposed Work The proposed improvements are necessary to provide parking and safe access for the public to access the proposed restaurant. The project proposed the installation of additional parking areas along the existing driveway into the Old Salem Jail. Existing concrete walkways and brick pavers will be removed and 17 new parking spaces will be constructed. One Americans with �� Disabilities Act (ADA) compliant parking space with eight (8) foot access lane is being provided LIM. Old Salem Jail Parking Improvements Salem, MA as part of the proposed 17 spaces. Walkways and ADA compliant ramps are also proposed for the site. New landscaping will offset trees to be removed by construction. It is anticipated that six (6) 3" diameter trees and one (1) 10" diameter tree will be removed as a result of the project. Nine trees and various shrubs will be installed as part of the work and will incorporate the native species of red maple(Acerrubrum)and inkberry(Ilexglobro). Erosion Controls Prior to commencement of construction the Contractor will install catch basin protection (silt sacks) at the catchbasin adjacent to the project site and erosion control barrier to limit transport of sediments onto Bridge Street. Anticipated Construction Sequence In general,the construction scope of work will be as follows: • Install erosion controls(inspection by Conservation Agent) • Removing trees and pavement • Excavation and grading • Installation of new pavements and walkways • Installation of landscape features and site restoration • Removal of erosion controls Resource Area Impacts Bordering Land Subject to Flooding(BLSF) Portions of the site are located on bordering land subject to flooding. As a result of the proposed parking improvements,work will be occurring in 8,210 square feet of the BLSF. Proposed Mitigation Erosion and sedimentation controls will be installed prior to construction activities. The project will result in a net increase in flood storage. All disturbed areas will be restored with loam and seed and new native trees and native shrubs will be provided along the perimeter of the parking areas. Regulatory Compliance 310 CMR 10.57(4)(a) 1. Compensatory storage shall be provided for all flood storage volume that will be lost as the result of a proposed project within Bordering Land Subject to Flooding,when in the judgment of the issuing authority said loss will cause an increase or will contribute incrementally to an increase in the horizontal extent and level of flood waters during peak flows. Compensatory storage shall mean a volume not previously used for flood storage and shall be incrementally equal to the theoretical volume of flood water at each elevation, up to and including the 100- Old Salem Jail Parking Improvements Salem, MA year flood elevation, which would be displaced by the proposed project. Such compensatory volume shall have an unrestricted hydraulic connection to the same waterway or water body. Further, with respect to waterways, such compensatory volume shall be provided within the same reach of the river,stream or creek. The project area is not hydraulically constricted and will not limit flows during a flood event. The project will result in a net increase of approximately 8.7 cubic yards of flood storage as a result of the proposed grading activities. 2. Work within Bordering Land Subject to Flooding, including that work required to provide the above-specified compensatory storage,shall not restrict flows so as to cause an increase in flood stage or velocity. The proposed work will not restrict flows so as to cause an increase in flood stage or velocity. 3. Work in those portions of bordering land subject to flooding found to be significant to the protection of wildlife habitat shall not impair its capacity to provide important wildlife habitat functions. Except for work which would adversely affect vernal pool habitat, a project or projects on a single lot, for which Notice(s) of Intent is filed on or after November 1, 1987, that (cumulatively) alter(s) up to 10% or 5,000 square feet(whichever is less) of land in this resource area found to be significant to the protection of wildlife habitat, shall not be deemed to impair its capacity to provide important wildlife habitat functions. Additional alterations beyond the above threshold, or altering vernal pool habitat, may be permitted if they will have no adverse effects on wildlife habitat,as determined by procedures contained in 310 CMR 10.60. The project area is fully developed and does not support important wildlife habitatfunctions.
