at the owner's risk only upon notice to the Department and to the Conservation Commission.

The applicant, owner, any person aggrieved by this Determination, any owner of land abutting the land
upon which the proposed work is to be done, or any ten residents of the city or town in which such land is
located, are hereby notified of their right to request the appropriate Department of Environmental
Protection Regional Office (see http://www.mass.qov/eea/agencies/massdep/about(contacts/)to issue a
Superseding Determination of Applicability. The request must be made by certified mail or hand delivery
to the Department, with the appropriate filing fee and Fee Transmittal Form (see Request for
Departmental Action Fee Transmittal Form)as provided in 310 CMR 10.03(7)within ten business days
from the date of issuance of this Determination. A copy of the request shall at the same time be sent by

1.0 PROJECT NARRATIVE
1.1 Introduction
This Request for Determination of Applicability(RDA)is being submitted by Coneco
Engineers& Scientists, Incorporated(Coneco)on behalf of the Massachusetts Electric
Company d/b/a National Grid(MECO) for a proposed underground electrical conduit along
Bridge Street in Salem, Massachusetts (refer to Figure 1 - Site Locus Map and Figure 2—
Aerial Image). This project is pursuant to the Massachusetts Wetlands Protection Act(WPA;
MGL Ch. 131 § 40), and Massachusetts Wetlands Protection Regulations(MWPR; 310 CMR
10.00 et seq.) and the City of Salem Wetlands Protection Ordinance(Chapter 50) and
Regulations(Regulations). Refer to WPA Form 1 which is included as Appendix 1.
The purpose of the 375± linear foot(If)electrical conduit installation (the"Project Route) is
to service a new building being constructed at 401 Bridge Street. Portions of the proposed
work will be located within the 100-Foot Buffer Zone to Bank(approximately 180 If)and the
200-foot Riverfront Area(approximately 350 If). The entire Project Route is located within
Bordering Land Subject to Flooding (BLSF). In reviewing the proposal with the City of
Salem Conservation Agent, it was concluded that this work should be filed as an RDA
pursuant to the WPA and the Bylaw.
1.2 Existing Site Conditions
The Project Route consists of a 375± if corridor between the roadway right-of-way(ROW)of
Bridge Street and the existing property at 401 Bridge Street. Surrounding areas consist of
commercial and residential development.
A review of the current Mass Geographic Information System(GIS)data layer for the
Natural Heritage and Endangered Species Program's(NHESP) Massachusetts Natural
Heritage Atlas (I P Edition, October 2008)indicates that the Project Route is not located
within Estimated Habitat of Rare Wildlife or Priority Habitat of Rare Species. No certified
vernal pools under the jurisdiction of the Wetlands Protection Act Regulations or the
Massachusetts Endangered Species Act(321 CMR 10.00 et seq.)occur along the Project
Route(See Figure 3 —NHESP Map).
According to the November 2014 Federal Emergency Management Agency(FEMA)Flood
Insurance Rate Map for Middlesex County, the Project Route is located within a FEMA
Special Flood Hazard Area(Zone AE). Zone AE is an area ...subject to inundation by the 1-
percent-annual-chance flood event generally determined by approximate methodologies(See
Figure 4—FEMA Map). The Project Route is not located within an Area of Critical
Environmental Concern(ACEC) or within an Outstanding Resource Water(ORW).
Wetland resource areas are described in the following section. Photographs representative of
existing conditions in the vicinity of the proposed Project Route are included in Appendix 2.

1.3 Wetland Resource Areas
An Environmental Scientist conducted a wetland reconnaissance along the Project Route on
April 24, 2015 to identify wetlands,watercourses and other resource areas subject to local,
state, and federal jurisdiction. Areas within 200 feet of the Project Route were reviewed. A
formal delineation was not completed. The reconnaissance was conducted in accordance
with the WPA and Regulations; the Bylaw and Bylaw Regulations; and the Clean Water Act.
Methods follow the technical guidance outlined in Delineating Bordering Vegetated
Wetlands Under the Massachusetts Wetlands Protection Act:A Handbook(1995); the Corps
of Engineers Wetlands Delineation Manual(1987); the Regional Supplement to the Corps of
Engineers Wetland Delineation Manual:Northcentral and Northeast Region (Version 2.0,
2012), and others, as applicable. Three jurisdictional resource areas were identified in the
vicinity of the Project Route: Bank, BLSF, and Riverfront Area. The resource areas are
defined as follows:
Bank—310 CMR 10.54
310 CMR 10.54 defines a Bank as the portion of the land surface which normally
abuts and confines a water body. It occurs between a water body and a vegetated
bordering wetland and adjacent flood plain, or, in the absence of these, it occurs
between a water body and an upland. The upper boundary of a Bank is the first
observable break in the slope or the mean annual flood level, whichever is lower. The
lower boundary of a Bank is the mean annual low flow level.
Bordering Land Subject to Flooding—310 CMR 10.57
310 CMR 10.57 defines a Bordering Land Subject to Flooding as an area which floods
from a rise in a bordering waterway or water body. Such areas are likely to be
significant to flood control and storm damage prevention and provide temporary storage
areas for flood water which has overtopped the bank of the main channel of a creek,
river, or stream or the basin ofa pond or lake.
Riverfront Area—310 CMR 10.58
The Riverfront Area is the area of land between a river's mean annual high-water
line measured horizontally outward from the river and a parallel line located 200 feet
away. The Mean Annual High Water line of a river is the line that is apparent from
visible markings or changes in the character of soils or vegetation due to the
prolonged presence of water and that distinguishes between predominantly aquatic
and predominantly terrestrial land. Field indicators of bankfull conditions shall be
used to determine the mean annual high-water line. Bankfull field indicators include
but are not limited to: changes in slope, changes in vegetation, stain lines, top of
pointbars, changes in bank materials, or bank undercuts.
The approximate locations of resource areas and buffer zones are shown in Figure 5 —
Resource Area and BMP Map. These resource areas and buffer zones, while based on GIS
data, appear to be generally representative of field conditions.

2.O PROPOSED WORK DESCRIPTION
2.1 Introduction
Approximately 375 if of six new 4-inch underground electrical conduits will be installed
within the Project Route. The majority of the work area lies within the paved extents of
Bridge Street. However, a portion will extend onto the current vacant property at 401 Bridge
Street. All work is temporary in nature, and disturbed areas will be returned to their pre-
existing condition(to the extent practicable) following completion of work.
The Project Route will run along the south side of Bridge Street,adjacent to the 401 Bridge
Street property. The Project Route will be located approximately 70 feet south of the North
River which runs adjacent to the northern portion of Bridge Street. This section of the North
River is bound on the north and south sides by concrete anchored banks which run adjacent
to Bridge Street for approximately 700 If. As such, the Project Route will be located within
the 100-foot buffer zone to Bank and the 200-foot Riverfront Area(Figure 5 -Resource Area
and Best Management Practices(BMP) Map). Construction associated with the project will
occur within previously developed/disturbed areas, and will be restored to its previous
conditions(to the extent practicable)upon completion of work. BMP placement is depicted
in the Figure 5 —Resource Area and BMP Map.
2.2 Erosion Control
To guard against potential impacts from the proposed electrical conduit installation,erosion
and sedimentation control BMPs consisting of silt sacks will be installed for inlet protection
(e.g., catch basins)as necessary.
2.3 General Construction Details
The following is a general construction sequence for the proposed electrical conduit
installation along the Project Route. The sequence of construction may vary slightly as
necessary to assure completion of the overall project.
General Construction Sequence:
1. Erosion controls will be installed at the site, as necessary.
2. Pavement will be saw cut to the dimensions of the excavation. This will be
approximately three feet in width.
3. Soil will be excavated to a depth of four to five feet and either sidecast (deposited
temporarily adjacent to the excavation)onsite or into a dump truck.
4. A gravel bed will be laid within the trench to cradle the conduits.
5. Conduits will be joined and placed in the trench.
6. Concrete will be poured over the top of the newly installed conduits for protection.
7. The trench will be backfilled either with the excavated soil or with clean fill as
necessary. No excavated soil will be left on-Site at the conclusion of each work day.
8. The road will be repaved, following existing contours. Disturbed, unpaved areas will
be returned to their prior condition to the extent practicable.

9. Project area cleanup and erosion control removal will include proper disposal of any
surplus soil or other materials.
3.0 REGULATORY COMPLIANCE
As a result of the proposed work, there will be impacts within the 100-Foot Buffer Zone,
200-Foot Riverfront Area, and BLSF. These impacts are temporary, and the proposed work
area will be returned to pre-existing conditions (to the extent practicable)upon completion of
the installation. The project is not anticipated to result in impacts to adjacent Resource
Areas. Proposed work qualifies as a Limited Project under 310 CMR 10.53(3)(d) of the
WPA regulations: The construction, reconstruction, operation and maintenance of
underground and overhead utilities, such as...natural gas lines, may he permitted...
Additionally,the installation of underground utilities (gas,electric,water)within existing
paved or unpaved roadways and driveways is exempt from regulation under MGL 131, § 40,
provided said work is conducted soley within the buffer zone and within the roadway or
driveway and that all trenches are closed at the completion of each work day(310 CMR
10.02(2)(b)(2)(i).
4.0 SUMMARY
A 375± linear foot electrical conduit installation is being proposed along Bridge Street. The
purpose of the underground electrical conduit installation is to service a new building being
constructed at 401 Bridge Street. A portion of the project lies within the 100-Foot Buffer
Zone to Bank,the 200-foot Riverfront Area and BLSF, and temporary impacts are
anticipated within these areas. Proposed work qualifies as a Limited Project under
310 CMR 10.53(3)(d)of the Wetlands Protection Act. Given this designation,the fact that
work is temporary in nature and limited to previously developed areas, and the proposed
employment of erosion and sediment control BMP's to protect adjacent resource areas during
construction, Coneco(on behalf of MECO)respectfully requests that the City of Salem
Conservation Commission issue a Negative Determination(boxes c and d), allowing the
electrical conduit installation to proceed as proposed.

Any deviation from the approved Best Management Practices shown in the EFI and/or
SWPPP plans shall be communicated immediately to the National Grid Environmental
Scientist as it may require additional permitting or could result in a permit violation.
4.1 Sedimentation and Erosion Controls
Appropriate sedimentation and erosion control devices shall be installed at work sites, in
accordance with permit conditions and/or regulatory approvals, and as needed to prevent
adverse impacts to water resources and adjacent properties.
The overall purpose of such controls is to prevent and control the movement of disturbed soil
and sediment from work sites to adjacent, undisturbed areas, and particularly to water
resources, public roads and adjacent properties. All proprietary controls shall be installed per
manufacturer's recommendations and specifications.
Appropriate sedimentation and erosion control devices include but are not limited to: silt
fencing, straw bales, wood chip bags, straw wattles, compost socks, erosion control blankets,
mulch, slope interruption practices, flocculent powder/blocks and storm drain/catch basin inlet
protection. Such controls shall be installed between the work area and environmentally
sensitive areas such as wetlands, streams, drainage courses, roads and adjacent property when
work activities shall disturb soils and result in a potential for causing sedimentation and
erosion.
Staked straw bales often serve as the demarcation of the limits of work and/or sensitive areas to
be avoided. Work shall never be conducted outside the limit of erosion controls without prior
approval from the National Grid Environmental Scientist.
Project plans depict proposed erosion controls, however field conditions may warrant
additional practices be implemented (e.g., wet conditions, frozen conditions, poorly drained
soils, steep slopes, materials used for work pads, transition areas to swamp mats, number of
trips across work areas, etc.).
Any deviation from the approved erosion controls shown in the EFI and/or SWPPP plans
needs to be communicated immediately to the National Grid Environmental Scientist as it
may require additional permitting or result in a permit violation.
Appendix 7 provides typical sketches of common sedimentation and erosion controls. If a
SWPPP is required for the project, maintenance and inspection of erosion controls shall follow
the SWPPP requirements. Sedimentation and erosion controls shall be properly maintained and
inspected on a periodic basis, until work sites are properly stabilized and restored. Inspections
shall be documented using the Inspection Form "Storm Water, Wetlands & Priority Habitat
Environmental Compliance Site Inspection/Monitoring Report" (Appendix 6).

Best Management Practices Protection (Chapter 6)
The sequence and timing of the installation of sedimentation and erosion control measures is
critical to their success. Sedimentation and erosion controls shall be installed prior to
commencing construction activities that may result in any soil disturbance or cause otherwise
polluted site runoff. Inspection of these devices may be required by the National Grid
Environmental Scientist or by regulators prior to the start of work. The installation of water
bars and other erosion control measures shall be installed shortly thereafter.
4.2 Concrete Wash Outs
Concrete wash outs shall be used for management of concrete waste. Concrete and concrete
washout water shall not be deposited or discharged directly on the ground, in wetlands or
waterbodies, or in catch basins or other drainage structures. Where possible, concrete washouts
shall be located away from wetlands or other sensitive areas. Consult the National Grid
Environmental Scientist on proposed concrete wash out locations prior to their use. Following
the completion of concrete pouring operations, the wash outs shall be disposed of off-site with
other construction debris. Refer to BMPs in Appendix 7.
4.3 Construction Activities in Standing Water
The use of silt curtains or turbidity barriers may be required when working in or adjacent to
standing water such as ponds, reservoirs, low flowing rivers/streams, or coastal areas. Silt
curtains and turbidity barriers prevent sediment from migrating beyond the immediate work
area into the resource areas.
Coffer dams constructed using sheet piling or large sandbags (Trade names such as "the Big
Bag"or"DamItDams") may be used to temporarily isolate and contain a work area in standing
water.
When working in standing water, an oil absorbent boom, in addition to a silt curtain or other
temporary barrier, shall be placed around the work area for spill prevention.
Work in drinking water reservoirs or other waters may require extensive regulatory agency
review, even for maintenance work, which could result in additional time required for
permitting,review and material procurement prior to the start of work.
4.4 Dewatering
Where excavations require the need for dewatering of groundwater or accumulated stormwater,
the water shall be treated before discharge. Appropriate controls include dewatering basins,
flocculent blocks, filter bags, filter socks, or weir tanks. Schematics of these BMPs are
included as in Appendix 7. Water trucks or fractionation tanks may be utilized if watertight
containers are desired for controlled on-site discharge or for off-site discharge into an approved
dewatering area when site restrictions make it difficult to utilize other dewatering methods on-
