D. Appeals
The applicant, owner, any person aggrieved by this Determination, any owner of land abutting the
land upon which the proposed work is to be done, or any ten residents of the city or town in which
such land is located, are hereby notified of their right to request the appropriate Department of
Environmental Protection Regional Office (see Appendix A)to issue a Superseding Determination of
Applicability. The request must be made by certified mail or hand delivery to the Department, with the
appropriate filing fee and Fee Transmittal Form (see Appendix E: Request for Departmental Action
Fee Transmittal Form) as provided in 310 CMR 10.03(7)within ten business days from the date of
issuance of this Determination. A copy of the request shall at the same time be sent by certified mail
or hand delivery to the Conservation Commission and to the applicant if he/she is not the appellant.
The request shall state clearly and concisely the objections to the Determination which is being

' C. Project Description
1. b. Area Description
The property is located at 10 Blaney Street in Salem, Massachusetts (Fig. 1). The
property is situated between Blaney Street and White Street and extends to Salem
' Harbor. The work area is depicted on Figure 2. The work area consists of a
gravel-paved parking lot, a roadway, and the Salem Ferry Landing.
' The property is located at the end of Blaney Street and abuts Salem Harbor.
Based on our review of the wetlands regulations, the property may be within a
Coastal Bank and considered Land Subject To Coastal Storm Flowage. This
' identification is based on the criteria described in 310 CMR 10.02. No other
applicable resources or buffer zones were identified.
' 2. a. Work Description
As part of a Due Diligence investigation for the Site, GEI reviewed historic maps and
' files for the property. Based on the document review, GEI identified the potential for
soil contamination. The purpose of the field investigation is to evaluate whether or
not a release to the environment of oil or hazardous materials has occurred at the Site.
' 1. Soil Probe Investigation
' GEI will engage Environmental Drilling, Inc., of Sterling, Massachusetts (EDI),
to excavate eight test pits across the Site. The test pits will be excavated with a
backhoe and observed and logged in accordance with GEI's Standard Operating
Procedures and the Department of Environmental Protection's recommended
practices. The test pits will be excavated to estimated depths approximately 10 to
12 feet below ground surface (bgs). Five of the test pits will be located in the
western portion of the property, and three of the them will be located along the
eastern portion.. Soil samples will be collected for jar headspace volatile organic
' compound(VOC) screening with a photoionizing detector(PID).
The base of each test pit will be lined with polyethylene sheeting to act as a
marker unit. All excavated material will be replaced in each test pit. Each test pit
location will be flagged, measured and added to a site plan.
Based on soil screening results and observations of staining, odor, or other
characteristics, two soil samples will be collected from each test pit, one from the
middle of the excavation walls and one from the bottom of the excavation. The
samples will be sent to Accutest Labs of Marlborough, Massachusetts for analysis.
The middle and bottom samples (16) will be analyzed for EPH/VPH by DEP Method
98-1, PCBs by EPA Method 8082, VOCs by EPA Method 8260/5035, and 13 priority
' pollutant metals by various methods. The middle samples (8) will also be analyzed
for asbestos at ProScience Labs of Woburn.
2. Work Provisions
GEI and its subcontractor will adhere to the following precautions in performing
' the tasks described above:
■ GEI and our subcontractor will have a spill management plan to handle
' hazardous materials that may be released during the course of the work.
Specifically, we will employ a quick-absorbent material, such as "Speedi-Dri"
or its equivalent to manage accidental spillage from equipment, if necessary.
' ■ Excavation equipment used in the resource areas will be checked for leakage.
We anticipate that the subcontractor will spend approximately two days in the
resource area. No petroleum products will be stored within the resource area.
' ■ If necessary, GEI and its subcontractor will place barriers such as hay bales or
silt fences around the work area, to prevent eroded materials from entering the
resource area. At this time, GEI does not anticipate generating excess soil
from the test pit investigation.
■ No equipment or unconsolidated material will be stored in the buffer zone.
1 3. Schedule
The test pit investigation at the site is scheduled to occur in April 2001. We
anticipate the test pit investigation will require two days to complete.

2. b. Exemption Provisions
The activities described in Section 2.a of this request do not remove, fill, dredge, or
' otherwise alter the work area.
Based on our review, this project meets the performance standards for the resource
' area. There are no practical alternatives to the work described and there is no
potential for significant adverse impact from the proposed work.

C. Project Description
1. b. Area Description
The property is located at 10 Blaney Street in Salem, Massachusetts (Fig. 1). The
property is situated between Blaney Street and White Street and extends to Salem
Harbor. The work area is depicted on Figure 2. The work area consists of a
gravel-paved parking lot, a roadway, and the Salem Ferry Landing.
The property is located at the end of Blaney Street and abuts Salem Harbor.
Based on our review of the wetlands regulations, the property may be within a
' Coastal Bank and considered Land Subject To Coastal Storm Flowage. This
identification is based on the criteria described in 310 CMR 10.02. No other
applicable resources or buffer zones were identified.

2. a. Work Description
As part of a Due Diligence investigation for the Site, GEI reviewed historic maps and
' files for the property. Based on the document review, GEI identified the potential for
soil contamination. The purpose of the field investigation is to evaluate whether or
not a release to the environment of oil or hazardous materials has occurred at the Site.
1. Soil Probe Investigation
' GEI will engage Environmental Drilling, Inc., of Sterling, Massachusetts (EDI),
to excavate eight test pits across the Site. The test pits will be excavated with a
' backhoe and observed and logged in accordance with GEI's Standard Operating
Procedures and the Department of Environmental Protection's recommended
practices. The test pits will be excavated to estimated depths approximately 10 to
' 12 feet below ground surface (bgs). Five of the test pits will be located in the
western portion of the property, and three of the them will be located along the
eastern portion.. Soil samples will be collected for jar headspace volatile organic
' compound (VOC) screening with a photoionizing detector (PID).
The base of each test pit will be lined with polyethylene sheeting to act as a
marker unit. All excavated material will be replaced in each test pit. Each test pit
location will be flagged, measured and added to a site plan.
Based on soil screening results and observations of staining, odor, or other
characteristics, two soil samples will be collected from each test pit, one from the
middle of the excavation walls and one from the bottom of the excavation. The
samples will be sent to Accutest Labs of Marlborough, Massachusetts for analysis.
The middle and bottom samples (16) will be analyzed for EPH/VPH by DEP Method
98-1, PCBs by EPA Method 8082, VOCs by EPA Method 8260/5035, and 13 priority
pollutant metals by various methods. The middle samples (8) will also be analyzed
for asbestos at ProScience Labs of Woburn.
' 2. Work Provisions
GEI and its subcontractor will adhere to the following precautions in performing
the tasks described above:
• GEI and our subcontractor will have a spill management plan to handle
hazardous materials that may be released during the course of the work.
Specifically, we will employ a quick-absorbent material, such as "Speedi-Dri"
or its equivalent to manage accidental spillage from equipment, if necessary.
' • Excavation equipment used in the resource areas will be checked for leakage.
We anticipate that the subcontractor will spend approximately two days in the
resource area. No petroleum products will be stored within the resource area.

r ■ If necessary, GEI and its subcontractor will place barriers such as hay bales or
silt fences around the work area, to prevent eroded materials from entering the
resource area. At this time, GEI does not anticipate generating excess soil
' from the test pit investigation.
■ No equipment or unconsolidated material will be stored in the buffer zone.
r3. Schedule
' The test pit investigation at the site is scheduled to occur in April 2001. We
anticipate the test pit investigation will require two days to complete.

r2. b. Exemption Provisions
The activities described in Section 2.a of this request do not remove, fill, dredge, or
rotherwise alter the work area.
Based on our review, this project meets the performance standards for the resource
' area. There are no practical alternatives to the work described and there is no
potential for significant adverse impact from the proposed work.
