Based on our.request, the scope of work originally outlined in these proposals has been revised to'cut costs on the' project. This has been accomplished by reducing the amount of excavation associated with the two salt panties: The suggested change in scopewas "developed in consultation with the National Marine Fisheries Service ar_d the United 'States Environmental Protection. The suggested change results in a substantial cost savings down from approximately$30,000.00.to $7,655.00. . " The City and.Goldeneye need to sign the attached proposals and return them to Walter Montgomery for his signature. A letter must also be,sent to Brian Valiton at the United . States Army Corps of Engineers which includes maps of the proposed mitigation areas, a, description of the scope of work and an estimated,schedule for undertaking the work. Additional erosion and sedimentation control measures deemed necessary by the Commission shall be instituted by the applicant. Any siltation caused onto any wetland or waterway area shall be promptly reported to the Commission. Such areas shall be restored to the satisfaction of the Commission. 5. During construction,debris,fill,or excavated material shall be stockpiled 25 feet away from top of slope and for no longer than 1 day. 6. Equipment servicing and overnight equipment storage must be conducted on northwesterly comer of property. Equipment must be maintained to prevent leakage or discharge of pollutants. 7. *Use or storage of rock salt(sodium chloride)or other toxic de-icing chemicals is prohibited within 100 feet of the resource area. Any arrangement for snow removal shall stipulate the ban. 8. Notice shall be given this Commission no more than 2 weeks nor less than 2 days prior to the commencement of construction activities. Said notice shall include, in writing,the names(s),address(es),and business and home telephone numbers of the project supervisor(s)responsible for insuring that operations are conducted in compliance with this Order. 9. *Only organic fertilizers shall be used for landscaping and lawn care and shall contain a low nitrogen content and be used in moderation. Pesticides and herbicides shall not be used within 100 feet of the resource area. 10. No additional impervious surfacing shall be permitted outside of trailer and apron. Apron shall be pitched to landside to prevent sheetflow directly to harbor. Parking lot and driveways shall be set back a minimum of eight feet from top of slope. 11. Construction barge shall have adequate spill kit and be accessible for aggressive containment. No running machinery shall be left unattended. Equipment servicing and overnight equipment storage must be conducted outside the buffer zone. Equipment must be maintained to prevent leakage or discharge of pollutants. Trash barrels shall have dome cover with doors or equivalent litter preventing design,and debris,dumpster,and lynnpak shall be contained and managed on site by operator. 12. All improvements shall be removed by December 1, 1998 absent the following five items which shall be allowed to remain on site per the request of Goldeneye Corporation letter of 11/9/98: 5 -35ft installed wooden utility poles, light fixtures and associated utility wires,terminal boxes and connections. Underground water lines and precast concrete holding tank. Concrete gangway abutment and chain link safety fence. 10—60ft. H-piles installed to anchor floats. Goldeneye Corporation 4 Blaney Street Salem, Massachusetts 01970 USA City of Salem Conservation Commission City Hall Annex Attention: Mark George, Chairperson 11/9/98 Goldeneye Corporation requests an amendment to the order of conditions issued to the City of Salem on 5/19/98, DEP #64278 at the Blaney St. property of Goldeneye Corporation. The requested amendments to allow for certain installed fixtures and improvements made to the property by the city to remain. These fixtures are 1. 5 - 35 ft. installed wooden utility poles, light fixtures and associated utility wires, terminal boxes and connections. 2. Underground water lines and pre-cast concrete holding tank. 3. Concrete-gangway abutment and chain link.safety fence. 4. 10 - 60 ft. H-pilesinstalled to anchor floats. 5. Paved access apron and handicap parking area. These items would continue to have value to the property and the future of commercial ferry vessel operations. To remove them and then replace them in tine future would only cause additional unnecessary disturbance of the site. We will expect that the ferry trailer and float system will be removed within a reasonable time. We also expect that the pre-cast concrete storage tank will be emptied and sanitized as well. As you may not be aware, the property line between US Gen NE and Goldeneye is approximately ten feet to the south of the fence in that area. US Gen NE and Goldeneye are presently working to confirm the exact location of the property line, whereupon US Gen NE will relocate the fence accordingly. However,results of surveys in the area reveal that a septic tank was installed in order to support the trial ferry service. That septic tank straddles what is expected to be the confirmed property line. One Salem Green Salem, MA 01970 Re: :Salem Ferry Soil Rem�yal Dear Steve, I am pleased to prepare this correspondence describing the soil removal conducted at the Salem Ferry Site on Blaney Street, pursuant to the proposal letter dated November 3, 1998. After authorization in December, the soils over a 3' x 8' area, adjacent to the barge fill line, were manually removed on December 28, 1998. While there was no visible staining or odor observed, the removal was conducted as a precaution. The remaining soils between the jetty rocks were sampled and analyzed. The Total Petroleum Hydrocarbons results were 238 mg/kg, which is well below the DEP S-I reportable concentration limits for recreational sites according to the MCP. The area was backfilled with clean Lynn Pac. The soil removal generated one (55 gallon) drum of solids (non-hazardous, state regulated petroleum solids) that is still sealed and labeled on-site awaiting pick-up by General Chemical Corp., US EPA ID# MAD019371079. A7.1.2 Pipeline Oil Transfers The pipelines are supported by expansion loops which allow for the expansion and contraction of the pipe. During construction of the pipelines, they were coated to minimize corrosion. For transfers between tanks, inspections are completed prior to, during, and after transfer operations by Personnel equipped with two-way radios. Inspections are completed using the same criteria as routine inspections. The switches for the pump starter controls are located in the Oil Equipment Building(Annex l: Attachment B). The switches for the pump starter controls are in the closed position and the circuit breakers are open when not in service. There are emergency shut-off valves located both inside and outside of the containment structures for each tank. Should a release occur,notification and response procedures are followed as outlined ERAP. A7.1.3 Tank Truck Oil Tr Prior to transfer operations at the wheels of the tank truck are chocked. A temporary berm is placed around the tank truck and drains are covered in the area. The hose is attached using a quick connect coupling and a drip pan is placed beneath the connection. Once the transfer is complete, any OHM remaining in the line is suctioned back into the tank truck and controlled by a check valve. Only then may the line be disconnected between the truck and the tank. Valves and connections are inspected prior to vehicle departure. Should a release occur, contingencies as outlined in the ERAP would be implemented. Catch basins located within the vicinity of transfer areas are equipped with permanent removable caps. These caps are fitted with a pole allowing them to be tipped in the event of storm water accumulation within the vicinity. A7.L4 Aboveground Bulk Storage Tanks Existing containment structures in place as of February 1996 have been evaluated according to current regulations and iWorporate Guidelines. The current NEES guidelines require a secondary containment capacity of 110% of the voiume of the largest fluid containing tank or container. See N££.S Ha=ardour Waste. (c) As provided in section 313 (86 Stat. 875)departments, agencies, and instrumentalities of the Federal government are subject to these regulations to the same extent as any person, except for the provisions of§112.6. (d)This part does not apply to: , (1)Facilities, equipment or operations which are not subject to the jurisdiction of the Environmental Protection Agency, as follows: (i)Onshore and offshore facilities, which, due to their location, could not reasonably be expected to discharge oil into or upon the navigable waters of the United States or adjoining shorelines. This determination shall be based solely upon a consideration of the geographical, locational aspects of the facility(such as proximity to navigable waters or adjoining shorelines, land contour, drainage, etc.) and shall exclude consideration of manmade features such as dikes, equipment or other structures which may serve to restrain,hinder, contain, or otherwise prevent a discharge of oil from reaching navigable waters of the United States or adjoining shorelines;and'7 (9)Equipment or operations of vessels or transportation-related onshore and offshore facilities k. r which are subject to authority and control ofthe;Department of Transportationas defined in the Elvlemorandum of Understapding betwesn.die SOetary of Transportation;and thCAdministcator of[ the Environmentil Sotection-Agency;dated-November.24,-1971,736-FP,24000:7 (2)Those facilities which, although otherwise subject to the jurisdiction of the Environmental Protection Agency, meet both of the following requirements: (i) The underground buried storage capacity of the facility is 42,000 gallons or less of oil, and (u)The storage capacity,which is not buried, of the facility is 1,320 gallon-- or less of oil, provided no single container has a capacity in excess of 660 gallons. (e)This part provides for the preparation and implementation of Spill Prevention Control and Countermeasure Plans prepared in accordance with §112.7 , designed to complement existing laws, regulations, rules, standards, policies and procedures pertaining to safety standards, fire prevention and pollution prevention rules, so as to form a comprehensive balanced Federal/State spill prevention program to minimize the potential for oil discharges. GENERAL ' The City of Salem,in coordination with the Massachusetts Executive Office of Transportation and Construction,will be providing a demonstration ferry services project for the City over the months of June through October. A high-speed (25 to 35 ' knot) ferry approximately 90 linear feet,18 foot beam and 5 foot draft,will be operating at the site,picking up and delivering passengers between Boston,Salem, and other potential destinations. Facilities provided for the docking of vessels shall be temporary tand removed after the demonstration project. B. EXISTING CONDITIONS ' The project site is located just south of the 34 foot draft Federal and Private Entrance ' Channel. The site is abutted by Hawthorne Cove Marina and the New England Power Plant. It includes approximately 2 acres of backland area,and a shoreline comprised of dumped stone riprap revetment,and a vertical granite seawall. See Site Plan,Figure 2 1 and Typical Section 1,Figure 4. The site is relatively flat with slight scattered upland vegetation and is comprised of a '. filled pier structure built prior to 1911. The backland fill and shoreline areas are licensed under several Chapter 91 Licenses including recent DEP License No.4916 dated January N,1996. See Figure 5-License History Plan and Attachment G. ' According to the Coastal Zone Management(CZM) Phase 1,Dredge Material Management Program(DMMP) Summary Report,the immediate water area contains ' soft shell clams and oysters. No eel grass or other sub-aquatic vegetation are reported to be present in the area. ' The tidal range is 9 feet. The site is located in FEMA Zones V3,at a flood height of elevation 17.2,and Zone A4 at elevation 15.5. ' This site is zoned industrial. There is a current Order of Conditions for the project site (DEP No. 64-217). It is understood that this Order will be completed prior to issuance of a new Order for the project herein. PROPOSED WORK ' The proposed work herein will be temporary for this demonstration project,with all structures to be removed following operations. The anchoring of the floats by temporary "spud piles' is similar to the spud piles used to temporarily anchor barges. ' The Applicant will be applying for a Section 10 Harbormaster Permit for the facility. This float system and site work will include the following: 1 1. Site grading and placement of approximately 1,000 CY of gravel on upland areas to provide a uniform surface for parking and traffic. Existing piled stone on the ' site will be incorporated into the site grading,with all filling above the high tide level. 1 2. Placement of a concrete abutment to anchor a 5 foot by 50 foot aluminum gangway to the floats. ' 3. Four steel floats anchored by spud piles. 4. Installation of utilities including electricity,pole lighting,water and telephone; ' with work coordinated with utility companies. Approximately one hundred and ninety-six (196) parking spaces,including 6 handicap ' spaces,will be provided under this project. The site will accommodate automobiles and truck traffic,with the proposed layout illustrated by Figure 3. This layout has been developed in coordination with the City Zoning Department requirements. Access to ' the site will be from White Street and Barney Street. The site will contain an approximate 1,700 square foot paved area to provide shelter and ' services to passengers. The site will have a 14 foot by 50 foot trailer which will provide ticketing,food,and restroom services. Pole lighting and a security fence to the gangway will be provided. Partially embedded granite stone will be set along the shoreline to ' serve as barriers for traffic protection along the edge of the bank. There is a portion of seawall within the inner comer (See Figure 2 and 3) which has ' dislodged stone and is failing and which will be repaired. Repairs will include resetting of existing stone to restore stability. ' D. DRAINAGE ' The existing site is not paved and the proposed work will only include minimal paving (1,200 SF) at the end of the pier near the gangway abutment. The site presently is slightly mounded at the edge of slope and the majority of water either percolates into ' the subgrade or travels by gravity to the low area near the eastern edge of the site. Grading will be set to allow continued e e draina toward the resent low area. Th g p e proposed facility will only remain ' in operation from June through October and no permanent drainage structures are proposed. The proposed work will not measurably alter the current drainage patterns as further described in Attachment I,Stormwater Management. ' E. MITIGATION MEASURES ' The majority of the work will include grading and site preparation for backland services in upland areas outside of resource areas. The floats will be installed from a water- based barge and/or from a land-based crane. The existing surface drainage shall not be altered. Site work will coordinate the following measures: ' 1. Silt fences shall be placed adjacent to areas being graded. Existing piled stone on the site will be incorporated into the site grading above the high tide level. 2. No material shall be placed or stockpiled in tidal waters. 3. The Contractor shall remove all debris generated from site work to an approved ' disposal site. 4. Excavated material shall be stockpiled for site backfilling or properly disposed of ' offsite by the Contractor. Upon finishing work,the Contractor shall fill and regrade the areas of excavation to final grade conditions. The pier was active through the 1920's, utilized for some portion of that time for marine repair and salvage operations. The Russell Sim Tanning Company occupied the backland area, as illustrated by the placement of a bulkhead adjacent to one of their buildings, per the 1921 license drawing (License174A). Throughout the majority of this time,the pier was referred to as Webb's Wharf. ' The earliest DEP licenses for the site indicate some minor additions in 1909 and 1911; consisting of placement of a float and a small section of seawall adjacent to HCM,respectively. The 1909 license No. 3348 indicates the solid fill wharf(Webb's Wharf). The 1921 Licenses 174 and 174A provided for an extension to the then existing granite bulkhead which was to abut ' the then David M.Little solid wharf(current HCM filled wharf). In 1956, NEP constructed a dike adjacent to the Mackey property, and apparently later filled ' behind this dike to create the current NEP backland area. In 1962, the Owner of the Mackey site apparently filled adjacent to the NEP dikes, using material dredged from the basin between HCM and the Mackey site pier (License No.4548). The recent (1996) license provides approval for this past filling by the State. It also provided for filling the eastern low area of the site which is indicated by the license to be "replacement of eroded areas". Nothing in this condition shall be construed as preventing the Licensee from t excluding the public from portions of said property not intended for lateral passage . Acceptance of this Waterways License shall constitute an agreement by the Licensee to conform with all terms and conditions stated herein. 2. This License is granted upon the express condition that any and all other applicable authorizations necessitated due to the provisions hereof shall be secured by the Licensee prior to the commencement of any activity or use authorized pursuant to this License. 3. Any change in use or any substantial structural alteration of any structure or fill authorized herein shall require the issuance by the Department of a new Waterways License in accordance with the provisions and procedures established in Chapter 91 of the Massachusetts General Laws. Any unauthorized substantial change in use or unauthorized substantial structural alteration of any structure or fill authorized herein shall render this Waterways License void. 4. This Waterways License shall berevocableby the Department for noncompliance with ' the terms and conditions set forth herein. This license may be revoked after the Department has given written notice of the alleged noncompliance to the Licensee and those persons who have filed a written request for such notice with the Department and afforded them a reasonable opportunity to correct said noncompliance. Failure to correct said noncompliance after the issuance of a written notice by the Department shall render this Waterways License void and the Commonwealth may proceed to remove or cause removal of any structure or fill authorized herein at the expense of the Licensee, its successors and assigns as an unauthorized and unlawful structure and/or ' fS.ill. The structures and/or fill authorized herein shall be maintained in good repair and in accordance with the terms and conditions stated herein and the details ' indicated on the accompanying license plans. 6. Nothing in this Waterways License shall be construed as authorizing encroachment in, on or over property not owned or controlled by the Licensee, except with the ' written consent of the owner or owners thereof. 7. This Waterways License is granted subject to all applicable Federal, State, County, and Municipal laws, ordinances and regulations including but not limited to a valid final Order of Conditions issued pursuant to the Wetlands Protection Act, G.L. Details of ' the proposed erosion control measures are presented on the enclosed project plans. The following paragraphs present how the proposed work conforms to the DEP Stormwater Management Standards: ' Standard #1: Untreated stormwater The project includes the construction of a temporary parking area for the Salem Ferry ' Demonstration Project. There will be no alteration of existing drainage patterns and no new outfalls or discharges. ' Standard #2: Post-development peak discharge rates The proposed work will not alter drainage patterns or increase impervious areas, and therefore, the post-development peak discharge rates will not exceed pre-development ' peak discharge rates. Overall, the ferry project was a tremendous success in terms of ridership statistics. At the present time, the City is reviewing how best to proceed in this project going forward — both for the short term (the 1999 season) and long term. The City is engaged in substantial discussions with various state agencies involved in the overall redevelopment of Salem Harbor. ,The City has also had preliminary discussions with Goldeneye Corporation, the owners of the site, regarding future development of the site. During the entire project, indeed from the first day right through the final day, the relationship between the City of Salem and Goldeneye can be best described as strained. Goldeneye both failed to fulfill and abide by the terms of the License Agreement, and also failed to act in accordance with the Conservation Commission's Order of Conditions. For these reasons and at this time, the City it of Salem will neither support nor facilitate Goldeneye's further efforts to'develop this parcel for future use.
