VARIANCE AT 25 WASHINGTON SQ. NO. (R-2)

A hearing on this petition was held on May 13, 1987 with the o lowing Board
Members present; James Hacker, Chairman; Messers Fleming, Luzinski, Strout
and Labrecque. Notice of the hearing was sent to abutters and others and
notices of the hearing were properly published in the Salem Evening News in
accordance with .the provisions of Massachusetts General Laws, Chapter 40A.
The petitioner is requesting a Special Permit/Variance to allow property
to be used as a bed & breakfast four rooms, also a Variance from parking
requirements in this R-2 zone.
The Variance which has be requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings or structures in the .same district;
b. literal enforcement of the provisions of the Zoning Ordinance would in-
volve substantial hardship, financial or otherwise, to the petitioner; ,
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1. Major opposition including abutters and aggrieved parties.
2. Major, parking and traffic congestion in immediate'and general area.
3. No hardship was proved.
Therefore, the Zoning Board of Appeal voted unanimously voted 5-0 against the
granting of the requested Special Permit/Variance.

Dear Mr. Hacker:
The Board of Directors of the Salem Common Neighborhood Association opposes the granting of
any special permits or vwiances to allow a bed and breakfast or any commercial use of this beautiful
single family home at 25 Washington Square Horth. The following five point policy statement on
20rung and planning has been approved by a unanimous vote at our general meeting on IYIay 12, 1907.
Statement on Zoning and Planning
T w Salem Common Neighborhood Association believes the folio virg points and urges
their careful consideration and use by the City of Salem and its agents,especially the Board
of Appeals and the Planning Board,in the course of their deliberations:
1. That the residential character of our neighborhood be maintained with no additional
non-conforming commercial uses being permitted.
2. That the existing R-2{Residential,two-family}zoning and density requirements be
maintained and enforced.
3. That the parking congestion and traffic problems in our neighborhood be considered in
all future plaxuwve and development.
4. That landscaping such as lawns and awes and streetscapes including facades and fences
are important to the quality of life in our neighborhood and should be encouraged,
enhanced,respected and maintained.
5. Thai the historical nature of our neighborhood be encouraged,respected and maintained.
With reference to the above points, we specifically object to a special permit or variance being granted
on the grounds that this represents a cornrnencial venture in a R-2 residential neighborhood and that this
venture would increase parking congestion and traffic problems. Providing valet parking will not prevent
all parking and traffic problem that will occur. In fact,rhe mere presence of guests corning and going to a
lodging facility will exacerbate the severe parking and traffic woes that already exist in this heavily
congested neighborhood.
We trust that you will give your usual careful consideration to these concerns when making your
decision.
