My opinion follows: Massachusetts General Laws Chapter 40A, Section 7 deals with enforcement of said chapter and provisions to compel the removal, alteration or relocation of any structure. If an individual constructs or alters a building and its appurtenant structures in accordance with this section and in conformity with a building permit issued by the building inspector, no action can be taken for abandonment, limitation or modification of the use or removal, alteration or relocation of the structure after six years have expired from the commencement of the alleged violation. No action to compel a removal, alteration or relocation of any structure by reason of violation of this Chapter shall be maintained if there is no building permit and the structure or appurtenant buildings have existed for ten years from the date of the commencement of the alleged violation. Applying this section to the proposal that has been presented to me, it would appear that although the encroachment is in violation of the zoning ordinance, no action can be taken to remove the violation inasmuch as ten years from the date of the commencement of the alleged violation has occurred without action by the City. Leo Tremblay, Building Inspector June 9, 1994 Page Two I hope this is sufficient for your purposes. Very truly yours, (x/// \ Wn ROBERT A.
