RE: Deck encroachment
Dear Mr. Tremblay:
You have requested my opinion relative to a deck which does not meet current
zoning requirements but has been in existence for a substantial period of time. My opinion
follows:
Massachusetts General Laws Chapter 40A, Section 7 deals with enforcement of said
chapter and provisions to compel the removal, alteration or relocation of any structure.
If an individual constructs or alters a building and its appurtenant structures in
accordance with this section and in conformity with a building permit issued by the building
inspector, no action can be taken for abandonment, limitation or modification of the use or
removal, alteration or relocation of the structure after six years have expired from the
commencement of the alleged violation.
No action to compel a removal, alteration or relocation of any structure by reason
of violation of this Chapter shall be maintained if there is no building permit and the
structure or appurtenant buildings have existed for ten years from the date of the
commencement of the alleged violation.
Applying this section to the proposal that has been presented to me, it would appear
that although the encroachment is in violation of the zoning ordinance, no action can be
taken to remove the violation inasmuch as ten years from the date of the commencement
of the alleged violation has occurred without action by the City.

DECISION ON THE PETITION OF JOSEPH MARTEL FOR A
SPECIAL PERMIT AT 10 CLOUTMAN STREET (R-2)
A hearing on this petition was held June 15, 1994 with the following
Board Members present: Stephen Touchette, Chairman, Gary Barrett,
Stephen O'Grady, Albert Hill and Nina Cohen. Notice of the hearing
was sent to abutters and others and notices of the hearing were
properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
The Board of Appeal at the request of the petitioner voted
unanimously 5-0 to grant petitioners leave to withdraw this petition
for a Special Permit to allow existing deck that extends
nonconforming side setback and Variance to encroach of rear setback.
GRANTED LEAVE TO WITHDRAW WITHOUT PREJUDICE
