Petition of PETER LUTTS seeking a Variance requesting relief from Sec. 5.1.5 Parking Design to
allow a 40' wide curb cut at the property located at 24 WINTER STREET (Map 35 Lot 83)(112
Zoning District).
A public hearing on the above Petition was opened on November 18, 2015 pursuant to M.G.L Ch. 40A, g 11
and continued to the next regularly scheduled meeting on December 16, 2015. The hearing was closed on that
date with the following Salem Board of Appeals members present: Ms. Curran (Chair), Mr. Duffy, Mr.
Copelas, Mr. Watkins,Mr. Viccica (alternate).
The Petitioner seeks a Variance per Sec. 5.1.5 Parking Design of the Salem Zoning Ordinance to allow a 40'
wide curb cut.
Statements of fact:
1. Attorney Johnathan White presented the petition on behalf of the applicant.
2. A public hearing for the petition was opened on November 18, 2015 and continued to the next
regularly scheduled meeting on December 16,2015 at the request of the applicant.
3. In the petition date-stamped October 21, 2015, the Petitioner requested a Variance seeking relief from
parking design requirements to allow a 40' wide curb cut along Oliver Street at the rear of 24 Winter
Street.
4. The property has an existing garage with a nineteen (19) foot curb cut and one (1) on-site parking
space. The petitioner proposes to create a second curb cut twenty-one (21) feet long to create a total
of three (3) on-site parking spaces,which complies with the Zoning Ordinance parking requirements.
5. The unique feature of the property is that the existing garage is located on the lot is such a way that
there is no existing driveway.
6. The property is an existing two-family home and is located within a local historic district.
7. The requested relief, if granted, would allow the Petitioner to have a 40' wide curb cut along Oliver
Street in accordance with the proposed plan titled, "Plot Plan 24 Winter Street, Salem,
Massachusetts",prepared by LeBlanc Survey Associates, Inc of Danvers,MA, dated October 13,2015
and accompanying landscape plan.
8. At the public hearings four (4) people spoke in favor and four (4) people spoke in opposition to the
proposal.
The Salem Board of Appeals, after careful consideration of the evidence presented at the public hearing,
and after thorough review of the petition, including the application narrative and plans, and the

Petitioner's presentation and public testimony, makes the following findings that the proposed project
meets the provisions of the City of Salem Zoning Ordinance:
Findings for Variance:
I. Special conditions and circumstances that especially affect the land, building, or structure involved,
generally not affecting other lands, buildings, and structures in the same district is that the existing
garage is a historically significant structure and to alter the structure to accommodate more on-site
parking would disturb the historic character and authenticity of the structure.
2. Literal enforcement of the provisions of the Ordinance would involve substantial hardship to the
applicant because the existing garage cannot simply be altered to accommodate due to its historic
character and utilizing the proposed curb cut to create additional on-site parking would result in some
public benefit.
3. Desirable relief may be granted without substantial detriment to the public good, and without
nullifying or substantially derogating from the intent of the district or the purpose of the ordinance.
On the basis of the above statements of facts and findings, the Salem Board of Appeals voted five (5) in favor
(Ms. Curran (Chair), Mr. Duffy, Mr. Copelas, Mr. Watkins, Mr. Viccica (alternate) and none (0) opposed, to
grant a Variance, to allow a 40'wide curb cut along Oliver Street at the rear of 24 Winter Street, subject to the
following terms, conditions, and safeguards:

In accordance with the City of Salem Zoning Board of Appeals please accept this
letter as a request to grant a 21.3 foot curb cut on Oliver St in Salem MA
I recently bought 24 Winter Street in Salem MA. Growing up in Salem my entire
life I feel in love with the home when I walked through it. I love old houses and
the history of 24 Winter Street as well as the historic preservation that I plan to
continue is extremely special to me. It is a large brick 2 family built in 1844 for
Joseph Bertram. I am only the 7th Owner.
The property presents one major challenge there is no off street parking. My
tenants and also the 2 people living in the main house (a total of 4 cars) are
forced to park on Winter Street. As you probably know Winter Street creates
parking challenges because a lot of the properties are limited in off street
parking. We have a hard time finding parking as well as during snow are forced to
park in the garage, which is usually full.
The curb cut I am requesting will not impact Winter Street or Oliver St The side of
the street I am requesting a Curb Cut is the side of Oliver Street that has no
parking 1 will not be impacting the neighborhood or taking away from any current
parking. Only adding off street parking which in downtown Salem is very much
needed. This curb cut will actually take 2-4 cars off of Winter Street and free up
the parking on Winter Street my direct abutter is a 6 Unit Condominium Complex
with no Off Street Parking.

I think this curb cut will be a win-win for the entire neighborhood. Over the last 5
month my tenant's car has been hit twice on Winter Street. We also are forced to
park in the garage and walk during snow, which is already over full. I have a
perfect back yard to create an elegant driveway with Parking. I have attached a
plot plan done by a surveyor to show the location of proposed Curb Cut. I also
will have a landscape architect design the site when construction starts. I have an
idea of planting a chestnut tree where the driveway ends as I feel it will be special
to the neighborhood.
I will take the boards consideration in how I construct the driveway as well as my
neighbors. I think either cobblestone or brick will fit vey well with the
neighborhood. My goal is the preserve the traditional and special characteristics
of 24 Winter Street while adding value to the neighborhood and my property.
Please accept this request to grant a 21-foot curb cut on Oliver Street, which will
create 2 —4 off street parking spaces for a property that currently has none. It will
be a benefit to my property fixing a hardship without impacting the street or
neighborhood.

Dear Madam Chairperson and the members of the Zoning Board of Appeals:
I represent Peter Lutts ofd Winter Street in his petition for a dimensional variance from
the City of Salem's Zoning Ordinance concerning curb cuts or the maximum width of
entrance and exit drives at the street lot line for residential districts. Mr. Lutts has
petition this Board to approve a new curb cut so that he can provide two more off-street
parking spaces for his two-family home.
Mass. Gen. L. ch. 40 A, section 10 requires a variance petitioner to demonstrate that a
literal enforcement of the provisions of the Zoning Ordinance or By-laws would involve
substantial hardship, financial or otherwise; and that the desired relief may be granted
without substantial detriment to the public good. The hardship must relate to the
premises for which the variance is sought.
Massachusetts case law that turn on the issue of hardship are notable for describing what
does not constitute a statutory showing of a hardship. For example, Massachusetts case
law is clear that personal hardship (i.e.,personal health, handicaps, or low income level)
and personal financial hardship (i.e., lost profits, prior expenditures, or resale value) do
not constitute a statutory showing of a hardship.
But several cases do provide examples of hardship caused by statutory hardships. In each
such case, the petitioner was successful in showing that conditions peculiar the lot caused
a hardship that was consistent with the showing required in Mass. Gen. L. ch. 40 A,
section 10.
Here, the entire lot is located within a historic district as shown on the City of Salem's
National Register of Historic Districts, Properties and Landmarks Map. The house on the
lot was once the home of shipping merchant and philanthropist, John Bertram, before the
Bertram family moved to 370 Essex Street. The existing garage on the lot is a former
stable so it is historically significant in its own right, and the prior owners have
maintained it in such a way as to preserve its historical significance and not disturb its
setting and authenticity. To alter this structure to accommodate more parking would not

only disturb its historic setting and disrupt its authenticity, but it would also require
permission from the Salem Historical Commission.
Therefore the Zoning Ordinance requirement of a maximum 20 foot width for entrance
and exit drives at the street lot line for residential districts causes a statutory hardship
peculiar to this lot because one cannot simply alter the existing garage to accommodate
more parking while utilizing the existing curb cut because of its historic designation and
importance. Instead, anyone attempting to make an otherwise reasonable and permitted
use of this lot would have to incur greater expense to go through an uncertain process
with the Historical Commission to seek its approval to disturb the historic setting and
authenticity of the existing garage that was once a stable on a lot that one of Salem's
greatest philanthropists developed in 1844.

Dear Erin,
Just a quick note to weigh in on the Variance request for 24 Winter Street 40' curb cut located on Oliver
Street.
I live at 41 Washington Square and can see this property from my yard and home. I enjoy seeing the green
space at 24 Winter Street which is somewhat limited in our historic neighborhood. I feel that cutting 40' of
curb to allow for parking would have a negative impact.
It is unclear to me why that parking 'relief' if needed for a single homeowner and two tenants. The condo
building where I live has Five Units and only two deeded parking spaces. Three units in my building have only
on street parking and do not deem it a hardship. Our association has discussed requesting curb cut for more
deeded parking however voted in favor or preserving our green space instead.
I am unable to attend tomorrow night's meeting but would like this letter to express a No vote for this
Variance request in my absence.

We are writing in regards to the variance requesting relief from Sec. 5.1.5 Parking Design to allow a 40' wide curb cut at the property
located at 24 Winter Street. As the immediate neighbor on 24 1/2 winter street we are opposed to the curb cut.
'file home had prior been owned by a single family with grown children and at one point owning three cars. The back apartment was
rented to a couple who owns two cars. Like most residents on Winter street, including ourselves, we park on the street.
On-street public parking is allowed on both sides of Winter Street. We have no garage ourselves and are always able to find parking
on the street. The current property has a garage. Apparently, it wasn't a hardship for the prior family for the twenty plus years that they
resided there.
In regards to the variance,substantial hardship is a reason to allow the variance. It is our understanding that Peter Lutts is a realtor and
developer. We have no desire for the grand single family residence with an apartment in the back to be turned into further residences.
Allowing parking there is a slope into having several cars and a future parking lot.Piggybacking of cars was a concern echoed by
neighboring residents. It will also present an obstructed view from Winter to Oliver street.
There is a large condo complex on 22 winter street directly next to Peter Lutts. Several people own these residences and park on the

property look more desirable from a business perspective there is the existing garage that can be offered.
Salem should continue to promote keeping our historical properties intact such as this consciously renovated gem. With this also
comes preservation of the green space.

Additionally the neighbors concern at the meeting was snow removal in my revised plan you will see a
place for snow designated.
Lastly the neighbors wanted to make sure I had a plan designed that appeals to the neighborhood as far
as landscaping is concerned
The plan submitted shows a nice landscape and still maintains the integrity of the property and
neighborhood while accomplishing my goal.
The City of Salem Zoning as you know requires 1.5 Parking Spaces per unit. Right now my building is a
grandfathered non-conforming building. It is a 2 family with only 1 parking spot.
This new proposal will allow my building to conform to zoning from a parking standpoint, as it will be a 2
family with 3 parking spaces.
Please consider this a slight modification amendment to my original application!
