DECISION ON THE PETITION OF THE WINTER ISLAND COMMISSION m o
FOR A VARIANCE AT 50 WINTER ISLAND ROAD, SALEM (R-1 )
A hearing on this petition was held on January 16, 1985 and continued until
March 20, 1985. The following Board Members were present: James Hacker, Chairman;
Associate Member Richard A. Bencal, Acting Secretary; Messrs. , Gauthier, Luzinski
and Strout. Notice of the original hearing was sent to abutters and others and'
notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
The petitioner has requested a Variance to allow the hangar at 50 Winter Island
Road to be used for storage and work space for various tenants in this R-1 zone.
After hearing the petition and allowing the petitioner time to work out questions
and problems which aroused during the original hearing the Board voted 5 - 0 to
allow the petitioner to Withdraw Without Prejudice the aforementioned petition.

Dear Mr. Hacker,
Please accept this letter as an addendum to the Variance Appli-
cation of the Winter Island Commission submitted this date for your
review and consideration. For purposes of clarification, I wish to
expand on the term "adaptive use" of the hangar building. Two such
types of use are planned for the hangar for the winter of '84 - '85.
First: Salem State College has requested the use of the hangar
on an interim basis, to store wooden and fiberglass boats
of varying sizes, that have been donated to the Salem
State College Sailing Program, soon to be located in the
garage to the rear of the hangar. (letter of request attached)
Second: Mr. William Hanley, d.b.a. Magic Stage, Inc. , has requested
use of the hangar to store and modify trailors to serve as
portable stages. This activity shall cease no later than
April 30, 1985. (see letter attached)
The Winter Island Commission has voted its approval to allow for
such interim use of the hangar,as this positive use of the facility
will act to preserve and maintain the structure, allowing for more
permanent use options to be considered for the future that are in keeping
with the marine development theme of Winter Island.
I'll be happy to expand further regarding such use plans for the
hangar at any time.

As we work on the five bay garage behind the hanger , we
have a need to store boats. We also want to continue to use

Dear Mr. Hacker:
The Winter Island Commission has petitioned the Board of Appeal for
a Variance to allow the hangar at 50 Winter Island Road to be used for
storage and work space for various tenants.
At this time, the Commission would like to request that the
petition be withdrawn. This request is occurring because of a recent
opinion by the City Solicitor which states that the Salem Park and
Recreation Commission has jurisdiction over the island, its management,
and activities. As a result, a petition may soon be provided for a
Variance to the Board, but the petitioner will be the Park and
Recreation Commission.
The Park and Recreation Commission will be meeting during the month
of April to discuss the use of the hangar for storage and work space,
and may wish to come before the Board of Appeal in a future month.
