Petitioner, owner of the property, is requesting Variances to divide the existing lot into two lots; Lot 1 containing the single family dwelling will contain approximately 6,112 sq.ft. ; Lot 2 will contain approximately 1,578 sq.ft. and is situated at the tip of the property. Lot 2 will be an unbuildable lot with the existing shade trees and vegetation remaining. The Variance which has been requested may be granted upon a finding by this Board that: 1. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures involved. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1. There was no opposition to the proposed request, an abutter spoke in favor. 2. The petitioner and her late husband purchased the property in 1969 and the petitioner still lives there. 3. Petitioner has paid taxes on entire property since it was purchased. 4. Petitioner lost the prospective 1989 sale as she was unable to transfer clear and marketable title to the entire lot. 6. Petitioner has incurred substantial financial hardship in trying to clear the title to this portion of the land shown as lot 16 on the plan submitted to the Board and as lot 2 on schedule A of petitioner's request. 7. Petitioner would be required to go through lengthy and costly land court procedure to clear the title of this portion of the property if this variance is not granted, causing her additional hardship. 8. The lot referred to as Lot 16 on the plans submitted will not be a buildable lot. On the basis of the above findings of fact, and on the evidence presented at the hearing, the Board of Appeal concludes as follows: 1. Special conditions exist which especially affect the subject property but not the district in general. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship to the petitioner. 3. Desirable relief can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. Therefore, the Zoning Board of Appeal voted unanimously, 4-0, to grant the variance requested, subject to the following conditions: 1. Petitioner shall comply with all city and state statutes, ordinances, codes and regulations. 2. The petitioner shall obtain approval from the City of Salem Planning Board. 3. The lot referred to as lot 16 on the plans submitted and as lot 2 in schedule A attached to the application, shall not be a buildable lot. No structure may be placed on said lot. 4. SCHEDULE A The Petitioner is the owner of the property located at + 4 Winter Island Road, consisting of a single family cape cod style home on approximately 7,700 square feet of land. The subject property is in an R-1 District. The Petitioner wishes to divide the existing lot into two lots as follows: Lot No. 1 with the existing house, containing approximately 6,500 square feet, and Lot No. 2, containing approximately 1,200 square feet and situated at the tip of the property of this triangular shaped lot. The proposed division of the lots is shown on the plan submitted with this application. The proposed Lot No. 1 .would be over 5, 000 square feet and exceed 50 feet of frontage. The proposed Lot 2 would be an unbuildable lot with the existing shade trees and vegetation remaining. It is submitted that the size of the proposed Lot No. 1 with dwelling will be in keeping with the existing buildings and lot sizes in the neighborhood. There is a compelling need by the Petitioner to divide this property. After the death of her husband, the Petitioner has become increasingly burdened by the care and upkeep of her single family home. In 1989, when a purchase and sale for the subject property was signed with a prospective buyer, it was discovered that there was a cloud on the record title to that portion of the property now designated as proposed Lot No. 2. As a result, the agreement to purchase was not consummated and the sale was lost. The Petitioner has been advised that unless she is able to clear this title problem, which would only affect proposed Lot 2, the subject property does not have clear and marketable title. Petitioner is again attempting to sell the property and the granting of this petition will serve to clarify issues which will be raised by the prospective Buyers. These issues arise from a unique series of events in the chain of title to the property as more particularly set forth below. The subject lot is comprised of five (5) parcels which are presently held in common ownership by the Petitioner. It is the parcel which is on the tip of the property, herein designated as proposed Lot 2, furthermost from the house, in which the petitioner apparently only has a two-thirds ownership interest. When this property was conveyed to the Petitioner in 1969, she believed she had a one hundred percent (100%) ownership interest. The Petitioner has paid real estate taxes for the entire property for the past twenty-four years. The title defect was finally discovered in 1989 by the prospective Buyer of the property when his lender performed a title examination. 1 It is submitted that the proposed creation of Lot No. 2 will not change the existing building or use of the property, nor will it substantially alter the existing character of the neighborhood. The Petitioner has landscaped that portion of the lot during the entire twenty-four years of ownership, and the Petitioner intends that the proposed Lot No. 2 will continue to be used as a side yard in conjunction with proposed Lot No. 1. Lot No. 2 is not intended to be used for any building, and the Petitioner agrees that Lot No. 2 in an unbuildable lot and that such a restriction be a condition of approval of this Petition. To not allow the Petitioner to divide her property, given the background of the situation and the size of the adjacent neighborhood lots, would seem to be unusually stringent, and would cause the Petitioner to suffer a substantial hardship, both financial and otherwise. The alternative correction to the title would be to go through the Land Court, a process which would be prohibitively costly to the Petitioner, who has already suffered a severe financial hardship by losing one sale and being unable to sell her. property prior to the economic downturn in the local real estate market.
