Petition of FOTINI MANOLAKOS requesting a Special Permit under Section 3.3.5 Nonconforming
Single- and Two-Family Residential Structures of the Salem Zoning Ordinance to allow a change to
an existing non-conforming residential structure, in order to construct a 3-season room on a portion
of an existing deck, for the property located at 1 WINTER ISLAND ROAD (Rl Zoning District).
A public hearing on the above Petition was opened on April 16, 2014 pursuant to M.G.1, Ch. 40A, � 11. The
hearing was closed on that date with the following Salem Board of Appeals members present: Ms. Curran
(Chau), Mr. Dionne, Mr. Duffy,Mr. Watkins, and Mr. Copelas (Alternate).
The Petitioner seeks a Special Permit from Section 3.3.5 Nonconforming Single- and Tmo,Famill Re idential
Strictures of the Salem Zoning Ordinance.
Statements of fact:
1. In the petition date-stamped March 25, 2014, the Petitioner requested a Special Permit in order to
construct a 3-season room on a portion of an existing deck.
2. Ms. Fotini Manolakos presented the petition for the property at 1 Winter Island Road.
3. The proposed room would be 12-feet by 14-feet, and would lie entirely on a portion of the existing
exterior deck. The height of the proposed addition would not exceed the height of the existing floor
of the upper-level deck above.
4. The requested relief, if granted, would allow the Petitioner to change the existing non-conforming
structure, to allow the addition of a 3-season room on a portion of an existing deck.
5. At the public hearing, no members of the public expressed their support of or their opposition to the
petition.
The Salem Board of Appeals, after careful consideration of the evidence presented at the public hearing, and
after thorough review of the petitions, including the application narrative and plans, and the Petitioner's
presentation and public testimony, makes the following findings that the proposed project meets the
provisions of the City of Salem Zoning Ordinance:
Findings
1. The use of the building as a single family home does not change and therefore the impact of the
proposal on the community is no different than the existing condition
2. There will be no impact on traffic flow and safety
3. The utilities and public services to the building are adequate
4. The proposed addition is in keeping with the neighborhood
5. The proposed addition would result in additional tax revenue for the city, this would have a positive
economic and fiscal impact.

On the basis of the above statements of facts and findings, the Salem Board of Appeals voted five (5) in favor
(Mr. Watkins, Ms. Curran, Mr. Dionne, Mr. Duffy, and Mr. Copelas) and none (0) opposed, to grant the
requested Special Permit to allow a change to an existing non-conforming residential structure, in order to
construct a 3-season room on a portion of an existing deck, subject to the following terms, conditions, and
safeguards:
1. The Petitioner shall comply with all city and state statutes, ordinances, codes and regulations.
2. All construction shall be done as per the plans and dimensions submitted to and approved by the
Building Commissioner
3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly
adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. Exterior finishes of new construction shall be in harmony with the existing structure.
6. A Certificate of Occupancy is to be obtained.
7. A Certificate of Inspection is to be obtained.
8. Petitioner is to obtain approval from any City Board or Commission having jurisdiction including, but
not limited to, the Planning Board

We are proposing to build a 3 season room on property located on: 1 Winter Island Road.

This room is to be built on a section of an existing front deck that was added on 2012.
It will not increase the size of our home on the lot. %
The main purpose of this enclosure is so that we can enjoy times with our 3 beautiful
grandchildren for a longer period of time during our cold and very snowy winters
We already have parking spaces so that no additional spaces will be required.
The traffic flow will not be impacted by us in anyway. There are already numerous cars and
trolleys and making their way to Winter Island Park whether it is to put their boats in the
water or to accommodate the many thousands of tourists that visit our beautiful and historic
Salem each season.
The existing utilities are adequate and we will just hook up to our existing lines. No additional
drainage will be needed.
The proposed enclosure is in keeping with the style of our home and the exterior will fit in with
any of the other homes in our neighborhood.
These proposed changes will increase the value of our home and will also increase tax revenue
for the city of Salem.

Proposal For Exterior Deck
We will furnish all labor and materials for the following scope of work:
1. Construct 12' x 15' Pressure treated deck off of existing 4'x 16' attached to front of left side of
house as is. (2x10 Pressure treated joists) >4'/:"x 9'/<" Girder Beam at Center.
2. Construct 10' x 14' pressure treated deck to the right side of driveway and front left corner of
main house. (2x10 Pressure treated joists)
3. Construct 5'x 11' pressure treated platform across front of main house. (2x6 Pressure treated
joists).
4. Installation of 5/4" Pressure treated decking throughout;fastened with'galvanized ring nails
SBDR.
5. Installation of 6"x6"x 7'Support posts under Girder Beam and Outside Corners of 12'x15 Main
deck frame.
6. Installation of 12"xl2"x4'Sono Tube Piers under all support posts.
7. Installation of concrete footing piers in all sono tubes.
8. Installation of 3 1/2"turned Pressure treated-porch posts for all newel posts throughout.
9. Installation of 36" pressure treated ballasts to match as close as possible to existing porch as is.
10. Install all flashing as required along house perimeter.
11. Wrap exterior new deck joists with%z" Azek.
12. Installation of 2x4 handrails to match as close as possible to existing railings as is:
13. Install 1'-6"x 11' long concrete pad on house front of 5'x11' landing area.(brush finish)
14. All electrical supply furnished by owner for construction work as required.
15. All close parking access and egress for vehicles and equipment necessary to perform all work
supplied by Tina for Gil &Co.to perform all work efficiently.
16. All permits supplied by Tina for construction and addendums necessary for add=on deck work to
existing permit.
