unit at the time of inspection.
Per Mass State Building Code 780 C.M.R.Section R 104.1 and under the provisions of 780 CMR,
Section 104.6—Right of Entry, of the State Building Code, access to this property must be granted for
the purposes of this inspection. If this property has rental units,these tenants must be notified in
advance of this inspection,so that access to these spaces may also be accomplished.

Please be advised, the City Electrician was asked to
conduct an electrical safety inspection at the request of The
Assistant Building inspector Michael E. Lutrzykowski. Mr.
Lutrzykowski is concerned about electrical outlets and wiring that
is deemed unsafe at this time. Upon my investigation I found the
following violations.
1.) Unit # I a kitchen light and a hall light were missing glass
globes. Article 110.3 (b) Installation and use. Listed or
labeled equipment shall be installed in accordance with any
instructions included in the listing or labeling.
2.) A 4" round cover is missing on an electrical box by the
basement stairs. Article 314.17 (a.) all openings to boxes
shall be closed.
3.) Unit # 2 Non Metallic sheathed cable is stapled to dry wall
in the rear hall leading to the stairway and going to the
dining room.
4.) In the West bedroom there is improper use of extention
cords being used as a permanent wiring method. The cord is
stapled to the drywall going over a door frame. Article 590
extention cords shall not be utilized as a permanent wiring
method.
5.) In the middle bedroom the light fixture is unprotected and
hanging by one screw.
6.) In the basement there is a GFCI outlet that is only secured by
one screw on a device box and is open to a persons touch.
And a fluorescent light is attached to a steam pipe which
shall be removed for safety sake, the steam pipe could
accidently become a conductor and severely hurt someone if
they became the potential to ground.
7.) In the Garage area we had open junction boxes with outlet
and switch box covers unsecured and open to a persons
touch. Article 314.17 (a) all openings to boxes and conduits
shall be closed.
8.) Their was a 110 volt extention cord mounted to a fence
without GFCI protection. Article 590 improper wiring
method and Article 2 10.10 GFCI protection for 110 volt
outdoor outlets.
All violations shall be corrected within 21 days upon receipt of
this written notice. Failure to comply will result in further

The ensuing communication shall serve as our follow-up to our September 18,2012; Required Inspection
letter sent you under the provisions of 780 CMR, Section 104.6—Right ofEntry, of the State Building
Code. The inspection was conducted on Tuesday, September I9`",present were Chief Wiring Inspector
Mr. John Giardi, Mr. David Greenbaum of the Health Department, Officers Rocheville and King from the
Salem Police Department, you and myself. The purpose of the investigation was to identify any safety
concerns and code violations noted during the inspection as required in accordance with the
Massachusetts Building Code 780 CMR in both the main residential dwelling and rear detached garage.
I- Pursuant to our meeting at 7 Liberty Hill Avenue on the afternoon of September 18, 2012,you are hereby ordered to
immediately cease and desist any and all operations in the rear garage of the above mentioned property. You are hereby
ordered to vacate the garage unit immediately and to secure permits for its removal, and re-instatement back to an
accessory use. (Please refer to CEASE and DESIST letter sent on September 19, 2012.)
2- 7 Liberty Hill Avenue— Unit#1 - First floor unit front and rear door handset hardware is presently in need of repair and
or replacement.
3- 7Liberty Hill Avenue— Unit#1 -Exit passageways in unit is being used as storage limiting the required egress from the
unit. (780 CMR 1023.1 Exit Passageway. "Exit passageways serving as an exit in a means of egress system shall
comply with the requirements of this section. An exit passageway shall not be used for any other purpose other than
as a means of egress.')
4- 7 Liberty Hill Avenue— Unit #1 —Smoke detectors and Carbon monoxide detectors shall be installed and or replaced as
per requirements of Salem Fire Prevention and/or Massachusetts State Building Code.
5- 7 Liberty hill Avenue—Unit #1 —Bedroom door handset on kitchen side of unit needs to be replaced with `passage"
hardware, so door cannot be locked due to secondary egress requirements.

garage unit and its contents immediately and to secure permits for its removal ;failure to respond to this
notification will be construed as non- compliance,with issuance of Municipal tickets and including the
filing of criminal complaints at District Court.
Under the Authority of the Mass. State Building Code 780 CMR section 104.6, re-inspection of the
property is scheduled for Monday, October 1st at 10:00 A.M.

Pursuant to our meeting at 7 Liberty Hill Avenue on the afternoon of September 18, 2012,you are hereby

DECISION ON THE PETITION OF PAUL L. MICHAUD FOR A VARIANCE
AT15-7`LIBERTY HILL-AVENUE. (R-2)
A hearing on this petition was held April 19, 1995 with the following Board
Members present: Stephen Touchette, Chairman; Gary Barrett, Arthur
LaBrecque, Nina Cohen, and Albert Hill. Notice of the hearing was sent to
abutters and others and notices of the hearing were properly published in
the Salem Evening News in accordance with Massachusetts General Laws
Chapter 40A.
Petitioner, owner of the property, is requesting a Variance on minimum
distance between buildings on lot from 30' to 22.5.
The Variance which has been requested may be granted upon a finding by this
Board that:
1. Special conditions and circumstances exist which especially affect the
land, building or structure involved and which are not generally
affecting other lands, buildings and structures involved.
2. Literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship, financial or otherwise, to the
petitioners.
3. Desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district of the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented
at the hearing, and after viewing the plans, makes the following findings
of fact:
1. There was no opposition in this matter.
2. This will allow petitioner a fuller use of the property.
On the basis of the above findings of fact, and on the evidence presented
at the hearing, the Zoning Board of Appeal voted unanimously, 5-0 to grant
the variance requested, subject to the following conditions:
1. Petitioner shall comply with all city and state statues, ordinances,
codes and regulations.

The above referenced property has come to the attention of this department for the following reason(s):
A report has been made to this office that there is an illegal apartment units located in the garage. 3rd floor and
basement of this permitted two(2) -unit building in an R2 zoning district. For this reason an inspection must be
conducted by our office to assure compliance with the code and city ordinance.
Under the provisions of 780 CMR, Section 104.6—Right of Entry, of the State Building Code, access to this property
must be granted for the purposes of this inspection. Please call this office upon receipt of this letter, if this property has
rental units these tenants must be notified in advance of this inspection so that access to these spaces may also be
accomplished.
This Required Inspection shall be conducted by this office on Tuesday,September 18, 2012 at 3:00 p.m.; failure to
respond to this notification will be construed as non- compliance,with issuance of Municipal tickets and as such an
Administrative Search Warrant will be sought, so as to allow the lawful inspection of this property.
