Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Law Chapter 40A. Petitioners request a Special Permit to convert an existing two family into a three family. The premises in this R-2 district is owned by petitioners. The provision of the Salem Zoning Ordiance which is applicable to this request for a Special Permit is Section V B 11 , which provides as follows: Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Section VIII F nad IX D, grant Special Permits for alterations and reconstruction of nonconforming structures, and for changes, enlargement, extension or expansion of nonconforming lots, land, structures, and uses, provided, however, that such change, extension, enlargement or expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood. In more general terms, this Board is, when reviewing Special Permit requests, guided by the rule that a Special Permit request may bepgrantedthe upopubliindinglth, by the Board that the grant of the Special Permit will safety, convenience and welfare of the City' s inhabitants. The Board of Appeal, after hearing the evidence presented at the hearing, makes the following finding .of fact: 1 . No opposition was presented to the plan; 2. The traffic and parking on Webb St. and the neighborhood will not be significally affected; 3. The premises will be owner occupied. On the basis of the above findings conclufact, des aand followthe evidence presented at the hearing, the Board of Appeal 1 . The proposed use of the property as a three unit building will not be substantially more detrimental to the public good or to the neighborhood than the existing two unit use$ 2. The proposed use as a three unit building is in harmony with the purpose and intent of the Ordinance. DECISION ON THE PETITION OF PAUL & MARGARET O'TOOLE FOR A. On site parking.be moved to two feet from the property-line bordering lot 227 on the plan filed with the Board; 2. A minimum of five parking spaces be maintained on site; 3. Although the proposal provides adequate off-street parking, the overall density of the neighborhood would be affected by this proposal. 2. Traffic on Webb Street, which is now heavy, would be further exacerbated. 3. It is further noted that any bituminous paving of a proposed parking Lot within 100' of Collins Cove would require Conservation Commission approval.
