Dear Mr.Jamison,
Our office received a complaint regarding your business's signage located at 92-96 Lafayette Street(`Bed Lulu").
The complaint was investigated on Wednesday,November 9,2011,and the Manager on duty was advised of the
reason for the site visit.Upon further investigation said property was found to be in violation of the City Ordinances,
see below.
Sea 4-35. Permit application and criteria for issuance.
(a) Application for a permit required under this article shall be submitted to the building inspector and mustprovide the name
and address of the sign owner;the proposed location;a scale drawing,a sketch, including an indication of colors to be used,
showing the design,dimensions andposidon of the sign;and such otherpertinent information as the building inspector may
require to ensure compliance with this article and any other applicable law.
(b) A permit shall be issued only if a sign conforms to this article and all other applicable laws and maybe issued as provided in
this article pursuant to a possible decision of the board of appeals.
(Code 1973,§3-25)
The signage in violation is the 27"x 120", aluminum and plexi-glass backlit signage over the Lafayette Street Entrance.
It shall be noted that the 36"x 60", "blade"signage is not in violation and is a legally permitted sign thus able to remain.
You are hereby ordered to begin to rectify these conditions within 5-7 days of receipt of this notice.Please contact Tom Daniel at the
Planning Department 978-745-9595 x5687 at your earliest convenience to start the process for the proper permitting for signage at
your location.Failure to do so may result in farther actions being brought against you,up to and including the filing of criminal
complaints at District Court.

Your attention is directed to the attached Statement of Understanding, dated July 21, 2003, signed by you.
The work referred to in this Statement is to be completed by September 30, 2003. It is my understanding
that the work has not been started nor have I received any communication from you that would indicate a
problem with getting the work completed. This Department has been discussing with you what is
required since February of this year. Further, I have expressed my concern that the work needs to be done
before the winter for obvious reasons. As you are aware,this Department prohibits work in the City
right-of-way beginning in October due to Haunted Happenings. Time is running out to get your work
completed.
As a result, I am putting you on notice that I fully intend to exercise my right under the Statement of
Understanding to do the work if it is not done by September 30".

Dear Bruce,
This letter is to request an extension until the Spring 2004, regarding the understanding for
the second manhole being required by the City of Salem.
To start a new business has been a challenge with many issues coming up at once.
Digging the streets within the given time frame has fallen short. I have had difficulty
scheduling a license digger to begin the work in September. Strega just finish paying for
the first manhole.
Dodge St. Ct. has many utilities underground and unclear of the exact locations. I need
help to find a company to have the project engineered properly. I have had several
conversations with Mackey& Sons about the project and agreement to do the work.
I have every intention of digging the second manhole as soon as I can find a contractor to
do the work. Your consideration for an extension would be greatly appreciated.

Dear Ms. Capuccio,
We have reviewed the plans submitted in support for your request for increased occupancy at the
above address. Your consultant has suggested that the space could support an occupancy of 324. I
would agree that the existing exits could support upwards of 230 but the existing plumbing
fixtures only support an occupancy of 180.
We have thus agreed to an increased occupancy from 98 to 180 persons subject to the following
conditions:
1. That the curtain obscuring the rear exit be removed or replaced with a wall and
door opening conforming to the 7`"edition of the State Building Code.
6. That a code conforming access corridor be created where the egress path to the rear
exit currently passes through a storage room in order to comply with the 7"edition of
the State Building Code.
7. That metal gates at the Lafayette Street sidewalk(refer to our letter of
October 10, 2008) be completely removed as a result of your multiple
violations of the agreement spelled out in the October 8 letter.
8. That a building permit be issued for the work described in items 1 and 2
above.
9. That the occupancy will remain at 98 until conditions# 1-4 noted are met.
If you wish to appeal this decision, your appeal is the Massachusetts Board of Buildings
Regulations and Standards(BBRS) only, and not to any other City of Salem agency.

your letter of November 16, 2009. 1 would like to confirm my conversation with yourself
and Tom St. Pierre relative to resolving the issues outlined in your letter of November 16,

We agree to the following conditions required to increase Strega's legal occupancy to
180 persons.

INTRODUCTION:
The purpose of this review is to determine the allowed occupant load for the Strega
Restaurant.
CHAPTER 10 MEANS OF EGRESS
780 CMR 1004.0 OCCUPANT LOAD
1004.1 Design Occupant Load. In determining means of egress requirements,the number of occupants
for whom means of egress facilities shall be provided shall be established by the largest number
computed in accordance with 780 CMR 1004.1.1 through 1004.1 .3.
1004.1.1 Actual Number. The actual number of occupants for whom each occupied space, floor or
building is designed.
1004.1.2 Number by Table 1004.1.2.The number of occupants computed at the rate of one occupant
Per unit of area as prescribed in Table 1004.1.2.
1004.2 Increased Occupant Load.The occupant toad permitted in any building or portion thereof is
permitted to be increased from that number established for the occupancies in Table 1004.1.2 provided
that all other requirements of the code are also met based on such modified number and the occupant load
shall not exceed one occupant per 5 square feet (0.47 m') of occupiable floor space.Where required by
the building official,an approved aisle,seating or fixed equipment diagram substantiating any increase in

1004.3 Posting of Occupant Load.Every room or space that is an assembly occupancy shall have the
occupant load of the room or space posted in a conspicuous place, near the main exit or exit access
doorway from the room or space.Posted signs shall be of an approved legible permanent design and shall
be maintained by the owner or authorized agent.

1004.7 Fixed Seating.For areas having fixed seats and aisles,the occupant load shall be determined by
the number of fixed seats installed therein.
For areas having fixed seating without dividing arms,the occupant load shall not be less than the number
of seats based on one person for each 18 inches (457 mm) of seating length.
The occupant load of seating booths shall be based on one person for each 24 inches (61.0 mm) of booth
seat length measured at the backrest of the seating booth.

1005.1 Minimum Required Egress Width.The means of egress width shall not be less than
required by 780 CMR 1005.0.The total width of means of egress in inches (mm) shall not be less
than the total occupant load served by the means of egress multiplied by the factors in Table 1005.1
and not less than specified elsewhere in 780 CMR. Multiple means of egress shall be sized such that
